About this file
This document contains a justification and approval for other than full and open competition regarding a federal construction contract opportunity. The opportunity involves construction of a new 135,000 square foot hangar facility at Minot Air Force Base in North Dakota to consolidate helicopter squadron operations, a tactical response force alert crew facility, aircraft maintenance units, and associated site improvements including taxiways and airfield lighting. Proprietary brand name equipment is justified for direct digital controls, energy management systems, mass notification, and fire alarm equipment to integrate with existing base systems and minimize duplication of costs. The total estimated value of these proprietary systems is $170,000. The justification cites the critical nature of the facility's mission requirements and analyzes alternatives that would result in substantial unnecessary cost duplication. The contracting agency is the U.S. Army Corps of Engineers Omaha District.

JUSTIFICATION AND APPROVAL FOR
OTHER THAN FULL AND OPEN COMPETITION
03 Mar 2020
1. CONTRACTING AGENCY: The responsible contracting agency is the U.S. Army Corps of Engineers, Northwestern Division, Omaha District, Contracting Division (CENWO-CT), 1616 Capitol Avenue, NE 68102.
2. DESCRIPTION OF ACTION: Approval is being requested for name brand equipment in support of a future construction contract action relative systems and equipment for the Minot AFB Consolidated Helo/TRF/OPS/AMU & Alert Facility, using FY19 and FY20 MILCON funds, for which design is currently underway by Omaha District Engineering Division USACE (Construction via the Omaha District Contracting Division and Contracting Officers is anticipated for FY20).
This brand name justification is for systems and equipment integral to the function of the facility. All the systems and equipment below are included as part of CLIN0001 “Entire work complete for Construction of Helo/TRF/Maintenance Facility, complete to the five-foot line (up to 129,102 square feet), excluding items separately listed below. This facility will become the main control point for all unit flight and flying training tasks including planning, briefing, administration, alert response, life support system, maintenance, crew equipment storage and issue. Complex must provide collocation of the squadron operations facility and alert crew sleeping quarters with the aircraft to minimize crew response times and enhance rescue/security team effectiveness. Sustainability and energy enhancement measures are included. Associated site improvements shall include new taxiways, parking apron, and associated airfield lighting. The estimated period of performance for this contract is 1,000 calendar days from Notice to Proceed.
Estimated total of systems and equipment associated with this J&A: $170,000.
3. DESCRIPTION OF SUPPLIES/SERVICES OR NATURE OF CONSTRUCTION:
This project involves the construction of a new 135,000 square foot (sf) hangar at Minot AFB, ND to include Helicopter Squadron Operations, Tactical Response Force (TRF) Alert Crew Facility, Alert Aircraft Shelter, Aircraft Maintenance Unit (AMU), Aircraft Maintenance Shelter, Aircraft Simulator complex with a Construction Cost Limitation (CCL) of $55.9M utilizing conventional design and construction methods to accommodate Minuteman III Intercontinental Ballistic Missile (MMIII ICBM) weapons system mission requirements.
4. AUTHORITY CITED: 10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1, gives DoD the authority to set aside requirements when there is only one responsible source and no other supplies or services will satisfy agency requirements. FAR 6.302-1(a)(2)(iii) states:
“For DoD, services may be deemed to be available only from the original source in the case of follow-on contracts for the continued provision of highly specialized services when it is likely that award to any other source would result in—
(A) Substantial duplication of cost to the Government that is not expected to be recovered through competition.”
5. REASON FOR AUTHORITY CITED: AUTHORITY:
The J&A is based upon FAR 6.302-1 and is necessary for this requirement based on the following rationale:
a. BACKGROUND: See section b below for background on each system.
b. JUSTIFICATION:
i. Direct Digital Control (DDC), Energy Management Control System (EMCS) and Java Application Control Engine (JACE) systems: Johnson Controls name brand.
Estimated Cost: $90,000
All new Air Force facilities require that the HVAC control systems be tied into the existing EMCS. Minot AFB recently changed all of the base systems to a Johnson Controls system. In order to operate seamlessly with the existing EMCS, the new system will need access to proprietary Johnson Control information. Because the controls information, and system programming is proprietary to Johnson Control, no other system manufacturer would be able to seamlessly tie into the existing system.
Other systems, such as Siemens, could be used. However, this new system would require a new backbone and interface, duplicating an already existing system for the base. This duplication of costs to the Government are not expected to be recovered through competition. Thus, Johnson Controls is the only responsible entity able to provide the required equipment and systems for this project.
Parametric estimated duplication of costs: $80,000
ii. Mass Notification Equipment: Whelen name brand. Estimated Cost: $30,000
During the kickoff meeting (11-14 Dec 2017) by the Omaha District design team, Minot AFB affirmed that all mass notification panels are currently Whelen transmission, receivers, and distribution equipment.
A Mass Notification System (MNS) is required by design codes and Unified Facilities Criteria. Minot AFB currently has a Whelen brand MNS. Due to the proprietary nature of the protocol used in the Whelen system, there are no other systems that are able to seamlessly integrate, nor are there other systems that are compatible with the
Whelan central equipment. Since this system is a Life/Health/Safefty system, it is crucial that the whole system function seamlessly. This will ensure all mass notification systems continue to operate without technical issues in the future, will simplify on-site maintenance, and all systems installed be compatible with and connectible to the existing systems at Minot AFB.
A system other than Whelen will cause substantial duplication of cost to the Government that is not expected to be recovered through competition.
Parametric estimated duplication of costs: $250,000
iii. Fire Alarm Equipment: Monaco name brand. Estimated Cost: $50,000
During the kickoff meeting (11-14 Dec 2017) by the Omaha District design team, Minot AFB stated that all fire alarm panels are currently Monaco Systems. All systems added onto the existing system should be Monaco. This will ensure all fire alarm systems continue to operate without technical issues in the future, will simplify on-site maintenance, and all systems installed be compatible with and connectible to the existing systems at Minot AFB.
Fire alarm equipment are critical Life/Heath/Safety features of a facility. The Fire alarm equipment systems communicate from the facility back to the main Fire Dispatch Center. It is critical for this system to operate flawlessly to ensure prompt and proper response to any activation by the local Fire and Emergency Services.
The current system operated at Minot AFB is a Monaco system. Due to the proprietary nature of the programming and equipment, only Monaco equipment will integrate seamlessly with the current system. Thus, to furnish a compatible systems requires proprietary paragraphs in the specifications.
Other manufacturers are capable of providing Fire alarm equipment, such as Honeywell. However, installing a different system than Monaco will cause a significant duplication in equipment and effort, and complicate Fire Dispatch Operations by having to maintain and monitor two completely different systems.
This complication will lead to delayed response of Fire and Emergency Services, and will put life and property unnecessarily in danger.
Parametric estimated duplication of costs: $250,000
The project identified above is currently programmed projects at Minot AFB under design by in-house design staff. Proprietary systems addressed in this J&A match existing/current systems in use at Minot AFB, and are systems that will remain in place for the foreseeable future to maintain critical mission requirements at MAFB.
c. IMPACT IF NOT APPROVED: If this Justification and Authorization is not approved, the Government will incur substantial duplication of costs for existing systems, costs that are not expected to be recovered through competition. Duplication of costs are estimated at $580,000.
d. ALTERNATIVES: There are two other alternatives to implementing this J&A: 1) remove references to name brand requirements, or 2) do not build the facility.
Alternative 1 will incur substantial duplication of costs for existing systems, costs that are not expected to be recovered through competition. Alternative 2 is not acceptable as this project has already been approved and funded by Congress with the associated justification for the new facility to meet mission requirements and to house the newly procured airframe.
6. EFFORTS TO OBTAIN COMPETITION: Based on information in paragraph 5 above, and the sources sought information, competition for this action is best obtained through competition in sourcing the systems and equipment. Competition will be possible in the acquisition of the items. Each item is available from multiple suppliers.
7. ACTIONS TO INCREASE COMPETITION: Future acquisitions will continue to seek sources sought to identify other name brands which are compatible with the current systems.
8. MARKET RESEARCH: Request for approval has been submitted for name brand equipment in support of a future construction contract action relative systems and equipment for the Minot AFB Consolidated Helo/TRF/OPS/AMU & Alert Facility. The estimated total of systems and equipment associated with this J&A is $170,000.
Market research was conducted to provide brand name justification for systems and equipment integral to the function of the facility on the following items:
a) Item 1: Direct Digital Control (DDC), Energy Management Control System (EMCS) and Java Application Control Engine (JACE) systems: Johnson Controls name brand.
Estimated Cost: $90,000.
Findings: Due to the proprietary nature of the protocol used in the Whelen system, there are no other systems that are able to seamlessly integrate, nor are there other systems that are compatible with the Whelan central equipment.
Parametric estimated duplication of costs: $80,000
b) Item 2: Mass Notification Equipment: Whelen name brand.
Estimated Cost: $30,000.
Findings: A system other than Whelen will cause substantial duplication of cost to the Government that is not expected to be recovered through competition.
Parametric estimated duplication of costs: $250,000
c) Item 3: Fire Alarm Equipment: Monaco name brand.
Estimated Cost: $50,000 Findings: Other manufacturers are capable of providing Fire alarm equipment, such as Honeywell. However, installing a different system than Monaco will cause a significant duplication in equipment and effort, and complicate Fire Dispatch Operations by having to maintain and monitor two completely different systems.
Parametric estimated duplication of costs: $250,000
Market Research Summary: Proprietary systems addressed in this market research match existing/current systems in use at Minot AFB, and are systems that will remain in place for the foreseeable future to maintain critical mission requirements at Minot AFB North Dakota. Cost and other factors such as proprietary system, duplication of costs, protocols, integration, delayed response, critical Life/Heath/Safety, and risk of life and property stipulate the need to keep the current systems in place. The items listed above will satisfy agency requirements and it is the best interest and value for the government.
