B. BASIS FOR AWARD

The Government intends to award a single contract to the responsible Offeror whose proposal conforms to the solicitation, is fair and reasonable, and offers the best overall value to the Government, considering the evaluation factors described herein. The non-price technical factors when combined, are significantly more important than price. Offerors will be cautioned that the award may not necessarily be made to the lowest price offered. The Government reserves the right to accept other than the lowest priced Offeror or to reject all Offerors. To receive consideration for award, an Offeror must receive a rating of no less than “Acceptable” for each of the Technical factors.

If awarded the contract, the Offeror shall construct the project in accordance with the plans and specifications.

1.0 Contract Award

The evaluation will be conducted in accordance with the, Federal Acquisition Regulation (FAR) 15.3, Department of Defense Federal Acquisition Regulation Supplement (DFARS) 215.3, Army Federal Acquisition Regulation Supplement (AFARS) 5225.3, Department of Defense Source Selection Procedures, Army Source Selection Supplement (AS3) to the Department of Defense Source Selection Procedures, and this solicitation. Failure to comply with the terms and conditions of the solicitation may result in the Offeror being considered non awardable.

1.1. Award without Discussions

The Government intends to award without discussions IAW FAR 52.215-1; however, IAW FAR Subpart 15.306, should discussions become necessary, the Government reserves the right to conduct discussions. Therefore, Offerors are advised to submit proposals that are fully and clearly acceptable without additional information. If award will be made without conducting discussions, the Offeror may only be given the opportunity to clarify certain aspects of proposals (e.g., the relevance of an Offeror’s past performance information and adverse past performance information to which the Offeror has not previously had an opportunity to respond) or to resolve minor or clerical errors.

1.2 Competitive Range/Discussions

The Government reserves the right to eliminate from consideration for award any or all offers at any time prior to award of the contract; to negotiate with Offerors in the competitive range; and to award the contract to the Offeror

Section 00 22 16 – Page 5 whose proposal is determined to represent the best value to the Government, price and other factors considered.

If discussions are deemed necessary, they will be held only with those Offerors determined to be in the competitive range. The Contracting Officer may establish a competitive range comprised of the most highly rated proposals based on the rating of each evaluation factor against the evaluation criteria. The competitive range may be further reduced for purposes of efficiency pursuant to FAR 15.306(c)(2). If the Government elects to open discussions, it has sole discretion as to whether an Offeror is in the competitive range, and may include proposals rated “Unacceptable” under the Technical factors. Offerors whose proposals are not included in the competitive range will be notified as soon as practicable.

Discussions will include issuance of evaluation notices with its significant weaknesses, deficiencies, adverse past performance, and any other aspects of the Offeror’s proposal that could enhance materially the Offeror’s proposal for award. During discussions, the Government may ask the Offeror to further explain and / or to answer questions about its proposal. An Offeror initially included in the competitive range may be eliminated from consideration for award during discussions. At the conclusion of discussions, each Offeror still within the competitive range shall be given an opportunity to submit a Final Proposal Revision (FPR) for final evaluation and selection.

C. FACTORS TO BE EVALUATED

The following evaluation factors will be used to evaluate each proposal:

VOLUME 1 – TECHNICAL PROPOSAL

TAB A The Proposal Cover Sheet

Factor LOCATION DESCRIPTION RELATIVE IMPORTANCE

FACTOR 1 Vol 1 Tab B Airfield Paving Construction Experience

Most Important Technical Factor (Equally important to Factor 4)

FACTOR 2 Vol 1 Tab C Management Plan / Organization

FACTOR 3 Vol 1 Tab D Technical Approach Equally important to Factor 2, less important than Factor 1.

FACTOR 4 Vol 1 Tab E Past Performance More Less Important than Factors 2 and 3 (Equally important to Factor 1)

Factor 5, Price, is the least important factor. The resulting award will be a Firm Fixed Price contract. Price reasonableness will be utilized in the evaluation of the Firm-Fixed Price effort.

D. EVALUATION APPROACH

The Offeror’s Volume 1 and Volume 2 proposal will be evaluated as specified below:

1.0 VOLUME 1, TAB B – FACTOR 1 - AIRFIELD PAVING CONSTRUCTION EXPERIENCE

1.1 Submission Requirements:

1.2 Factor 1 Overview.

This factor evaluates the Offeror’s proposed Airfield Paving Construction Experience for the base contract and all options. The Offeror (or prime contractor) and its team shall demonstrate experience on contracts with similar features, magnitudes, and complexities to this RFP. The Offeror is expected to explain how its experience is similar to airfield paving construction as described in this RFP (including but not limited to Specification Section 32 13 14.13). The Offeror shall explain how its experience is similar to the management and coordination complexity (such as multiple contractors, stakeholders, joint occupancies and a Temporary Workforce Camp) expected for this RFP.

Section 00 22 16 – Page 6

1.2.1 The Offeror shall submit a maximum of five (5) contracts.

A “contract” is defined as a single contract or a single task order performed under a MATOC (Multiple Award Task Order Contract)/SATOC (Single Award Task Order Contract)/IDIQ (Indefinite Delivery Indefinite Quantity Contract).

Data presented shall include construction contracts relevant to this requirement as provided in the solicitation’s technical narrative which the Offeror’s team has completed, or which are currently under construction and are substantially complete. Relevant construction experience will be limited to performance of contracts similar in size, scope, and complexity to that outlined in the solicitation. The Offeror shall submit a maximum of five (5) contracts. If more than five (5) contracts are submitted, only the first five (5) contracts will be evaluated. The Offeror shall submit a completed Attachment A “Experience Information” form for each contract. All blocks must be filled in and all data should be accurate, current and complete. Each contract shall be described in two pages or less. Any pages that exceed this limitation will not be considered. The information in Attachment A includes, but is not limited to, the following contract information:

a. Contract title, contract number, and location.

b. Contract type (for example, Indefinite-Delivery, Indefinite-Quantity task order; Design/Build;

Design-Bid-Build; Firm Fixed-Price; Cost Plus, etc.)

c. Total dollar award amount, and the total dollar amount at completion of the contract.

d. Start and completion dates (month/year) or percentage until complete to include actual completion date

(month/year).

f. Brief description of contract and how it relates to this solicitation.

g. Customer primary Point of Contact (POC) and alternate POC (name, relationship to the contract [Administering Contracting Officer / Contracting Officer Representative, etc.], agency/firm affiliation, city, state, current phone number, and e-mail address)

h. Awards or recognition received, where applicable

Note: If the Offeror is a Joint Venture (JV) and the JV does not have experience working as a JV, the partners of the JV may submit experience on behalf of the Offeror. All references herein to “the Offeror” include all proposed joint venture partners. Submitted contracts by members of a joint-venture or from the joint-venture itself will be considered and evaluated as long as the member or joint-venture itself was the prime contractor. Sub-contractor experience may be submitted on behalf of the Offeror provided the Offeror provides a copy of a binding teaming agreement or binding letter of commitment from that sub-contractor to perform the work required in this RFP for the Offeror. Information provided from potential sub-contractors (not included in the joint venture) will not be considered or evaluated.

The JV shall submit no more than five (5) contracts, but each respective JV partner must submit at least one (1) contract under this Factor.

1.2.2 Evaluation Criteria:

The Government will evaluate the extent of relevant experience of the prime contractor. If an Offeror submits a proposal as a joint venture, the Government will evaluate the experience of its proposed JV team and the roles each member of the JV team will have in performing this contract. If an Offeror submits a binding agreement or letter from a sub-contractor as specified in Para 1.2.1, the Government will evaluate the experience of the proposed sub-contractor in relation to its proposed role in performing this contract. The extent of relevant experience will be determined based on the similarity of the submitted contracts to the size, scope, and complexity of the construction required by the solicitation. For the purposes of this solicitation, a recent contract is defined as at least 80% complete or turned over within the past seven (7) years preceding the issuance date of this RFP.

When assessing an Offeror’s relevant experience, the Government intends to give greater weight to each of the

Section 00 22 16 – Page 7 following:

a. Proposals that include a higher number of relevant contracts, up to a maximum of five.

b. Construction contracts for airfield paving with asphalt paving.

c. Construction contracts for airfield paving with Portland Cement concrete.

d. New / renovation construction contracts for airfield paving with an award amount of $50,000,000 or more.

e. Construction contracts for airfield paving where airfield operations continue within and/or adjacent to the project site.

f. New / renovation construction contracts demonstrating experience with underground electrical and plumbing.

g. New / renovation construction contracts with a temporary workforce camp.

See paragraph 6.2, Combined Technical / Risk Rating, Table 1, for the evaluation rating system for Factor 1, Airfield Paving Construction Experience.

2.0 VOLUME 1, TAB C – FACTOR 2 – MANAGEMENT PLAN / ORGANIZATION

2.1 Submission Requirements:

The Offeror shall describe its ability to maintain operability using reliable and proven methods in consideration of the following challenges:

Construction of an airfield, during ongoing flight operations.

Ongoing construction of an airfield and how the Offeror will provide access and protection to the aircraft, aircraft personnel, and aircraft passengers during construction.

Risk management framework interrelationship between ongoing flight operations.

Coordination with the Government, and other stakeholders.

Scheduling around adverse / seasonal weather conditions.

The Offeror shall relate the project scope features to the construction process considering the impact of environmental considerations, work sequencing, work by others, and resource management. The Offeror shall describe its understanding of construction in highly corrosive climates, construction in isolated areas, working with other prime contractors on the same work site and/or in the same facility during on-going construction, while achieving beneficial occupancy date milestone.

Section 00 22 16 – Page 8

The Offeror shall describe its understanding of airfield paving construction and explain how it will execute the construction of the project to include mobilization and demobilization of equipment, and the storage and management of supplies and materials.

Offeror shall describe reliable/proven methods for construction of an airfield at a confined area adjacent to on-going construction by another prime contractor.

3.1.2 Self-Performed Work. Generally describe the types of work the Offeror will self-perform to comply with the requirements in clause 52.236-1, Performance of Work by the Contactor, for self-performed work.

3.2 Evaluation Criteria:

3.2.1 Technical Approach. The Government will evaluate the strengths, weaknesses, and any deficiencies in the technical approach to which the Offeror is expected to be able to successfully complete the requirements within the required schedule based upon proven methods and techniques. The Government will evaluate the Offeror’s understanding of the requirements described in the technical specification of the solicitation. The Government will evaluate the Offeror’s proposal to determine if the proposed approach is workable and achievable. The Government intends to assess each Offeror’s plan to determine how well the Offeror understands the project. The Government will evaluate the Offeror’s understanding of construction in highly corrosive climates, construction in isolated areas, working with other prime contractors on the same work site and/or same facility under construction to achieve the beneficial occupancy date milestone. Additional consideration will be given to a detailed approach that identifies specific elements that present the greatest risk to project success and describe the approach to mitigate the risks.

See paragraph 6.4, Combined Technical / Risk Rating, Table 1, for the evaluation rating system for Factor 3.

3.2.2 Self-Performed Work. The Government will evaluate the Offeror’s proposal to ensure that self-performed work complies with the requirements of Clause 52.236-1 for self-performed work.

4.0 VOLUME 1, TAB E – FACTOR 4 – PAST PERFORMANCE

4.1 Submission Requirements:

4.1.1 Past performance refers to the quality of recent project experience from the owner's perspective. For each project submitted under Factor 1, the Offeror shall provide past performance information. For Federal projects, the Offeror may submit finalized CCASS or CPARS reports. If a finalized CCASS or CPARS report is not available, the Past Performance Questionnaire (PPQ) included in the RFP is provided for the Offeror or its team members to submit to the client for each project. The Offeror shall provide customer reference name(s), company affiliation and current contact information (phone number and email address) on the PPQ form, for each experience submitted for Factor 1. Previously completed PPQ’s may be submitted; however, ensure current phone numbers and email addresses are provided for the client point of contact. The completed Past Performance Questionnaires should be submitted with your proposal and may be duplicated for submission on future solicitations. If the Offeror is unable to obtain a completed PPQ from a client for a project(s) before the proposal closing date, the Offeror should complete and submit with the proposal the first 2 pages of the PPQ (Attachment 1), which will provide contract and client information for the respective project(s). Offerors should follow-up with clients/references to ensure timely submittal of questionnaires. If the client requests, questionnaires may be submitted directly to Government via e-mail to W9128A-19-R-0009@usace.army.mil prior to proposal closing date. Offerors shall not incorporate by reference into their proposal PPQs previously submitted for other RFPs. However, this does not preclude the Government from utilizing previously submitted PPQ information in the past performance evaluation.

4.1.2 Projects for which past performance information is submitted shall be well underway (fully designed and at least 80% construction progress completed) or completed and turned over no more than seven (7) years preceding the issuance date of this RFP. Also include performance recognition documents received within the last seven (7) years preceding the issuance date of this RFP, such as awards, award fee determinations, customer letters of commendation, and any other forms of performance recognition.

4.1.3 In addition to the above, the Government may review any other sources of information for evaluating past

Section 00 22 16 – Page 9 performance. Other sources may include past performance information retrieved through the Past Performance Information Retrieval System (PPIRS), including Contractor Performance Assessment Reporting System (CPARS), using all CAGE/DUNS numbers of team members (partnership, joint venture or teaming arrangement) identified in the Offeror’s proposal, inquiries of owner representative(s), Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), and any other known sources not provided by the Offeror. While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate and complete past performance information rests with the Offeror.

4.1.4 An Offeror will not receive credit for relevant past performance of a parent, affiliate or separate division.

An Offeror may receive credit for relevant past performance under a previous business arrangement (joint venture for example) if the Offeror demonstrates that its role on the submitted project is relevant to the role it proposes to perform on this project.

4.2 Evaluation Criteria:

4.2.1 The Government will first assess and rate the recency and relevancy of each recent project submitted by the Offeror. The projects will include those submitted under the Factor 1 as well as from other sources as described above. This rating is not a separate proposal rating but is only used in developing overall past performance confidence assessment rating assigned to Factor 4. The past performance relevancy ratings are described in Paragraph 6.3 below.

4.2.2 The Government will next consider how well the Offeror performed on the contracts. The Government will consider the currency and relevance of the information, source of the information, context of the data, and general trends in contractor performance. With respect to relevancy, past performance on projects with more relevance will typically be a stronger predictor of future success and have more influence on the past performance confidence assessment rating than past performance on projects of lesser relevance. Past performance of a parent, affiliate or separate division will not be considered relevant unless the Offeror demonstrates that the resources of the parent, affiliate or separate division will affect the performance of the Offeror on this project. Past performance under a previous business arrangement will not be considered relevant if the Offeror’s role on the project is not considered relevant. Owners/references may be asked to comment on items such as quality of construction, timeliness, management of the work, subcontractor management, including timely payment to subs or suppliers, safety, relations between owner and contractor, level of support for such things as as-built documentation, O&M manuals, correcting construction errors, warranty work, etc. The Government will target areas covered in the requirements of this proposal including records of conforming to quality, schedule, cost control, customer satisfaction, O&M manuals, problem resolution of construction errors, warranty work, and safety. The Government places a higher value on projects which provided particularly difficult or unique challenges and the innovative methods the contractor used to resolve problems successfully. The rating for this factor will be expressed as a degree of confidence in the Offeror’s ability to successfully accomplish the contract requirements. The rating system used for the performance confidence assessment is described in Paragraph 6.4 below.

4.2.3 The entity will be rated on its own performance or that of its predecessor, if relevant. Past performance under a previous business arrangement will not be considered relevant if the Offeror’s role on the project is not considered relevant. If the Government does not obtain past performance information for the project identified by the Offeror and cannot establish a past performance record for the Offeror through other sources, past performance will be rated neither favorably nor unfavorably. The performance confidence assessment will be considered “Unknown Confidence (Neutral)”.

5.0 VOLUME 2, TAB 3, FACTOR 5 – PRICE

5.1 Submission Requirements:

Submit the properly filled out and executed SF 1442, along with the Proposal Schedule, 00 10 00. See instructions in Section 00 21 00, “Instructions to Offerors.”

5.1.1 MARSHALLESE CONTRACTORS: This RFP includes Contract Clause 52.219-4 regarding a 10% price evaluation preference for Marshallese business concerns. Marshallese business concerns electing to waive the

Section 00 22 16 – Page 10 evaluation preference shall submit a copy of clause 52.219-4 indicating such.

5.2 Evaluation Criteria:

5.2.1 The Offeror’s proposed price will not be rated or scored, but will be evaluated to determine if it is fair and reasonable, using one or more of the price analysis techniques found at FAR 15.404-1(b). The Government may request supplemental price breakdown information to assist the Government in performing the price evaluation. The evaluation of all option CLINs will not obligate the Government to exercise any option.

5.2.1.1 Errors: The Offeror’s Cost/Price proposal will be reviewed for errors. The Offeror may be given an opportunity to clarify certain aspects of their proposal at the sole discretion of the Contracting Officer.

5.2.1.2 Award cannot be made at a price that exceeds that authorized by congress.

5.2.2 Supplemental Breakdown. If deemed necessary to evaluate elements of the price proposal The Government will request a breakdown of elements of the price in a sealed envelope marked “Price Breakdown Information,” in Excel format. The Government will provide details on where and how to send the breakdown. This information will not be needed sooner than three (3) working days after proposal submission due date. This information may be required for the initial proposal, and if requested, for any revised proposals. This information is not an opportunity for an Offeror to revise its non-price or price proposal.

The supplemental price breakdown information will be used to assist the Government in performing the price evaluations described above. Offerors are cautioned to distribute direct costs, such as material, labor, equipment, subcontracts, etc. and to evenly distribute indirect costs, such as job overhead, home office overhead, bond, etc., to the appropriate contract line items. The Government will presume that field overhead costs through the proposed contract duration are inclusive in the offered price for the contract.

5.2.3 The Government will evaluate the proposal to determine if the Offeror has submitted an original letter from a reputable surety indicating that the Offeror has the ability to obtain at the total contract value (base and options).

The Government considers any bonding company listed on the US treasury circular 570 a reputable surety. A proposal that fails to meet the bonding letter requirement as specified in this paragraph will be ineligible for award.

General Instructions. In accordance with Federal Acquisition Regulation (FAR) 15.402 and 15.403- 1, certified cost or pricing data are not required based on the fact that adequate competition is expected for this procurement. The Government may request for information other than certified cost or pricing data, if the Contracting Officer determines that there is insufficient information available to determine price reasonableness and none of the exceptions at FAR 15.403-1 apply. If requested, information submitted shall be prepared following the instruction in FAR 15.403-5. Additionally, in the event that adequate competition is not obtained, the Contracting Officer may incorporate FAR 52.215-20 entitled, “Requirements for Cost or Pricing Data or Information Other Than Cost or Pricing Data,” into the solicitation and request a Certificate of Current Cost or Pricing Data. There is no page limitations for this volume.
