d. All control measures will be maintained, inspected, and repaired throughout the construction period. All controls will remain in effective operating condition during permit coverage, and will be protected from activities that would reduce their effectiveness.

SWPPP Page 24 of 46

e. Inspections of receiving State waters and/or receiving drainage system, stormwater runoff and control measures, and best management practices will be performed on a weekly basis and within one day after a rainfall event of 0.25 inches or more over a 24-hour period. During prolonged rainfall, inspections will be done daily. When practicable, BMPs will be inspected prior to, during, and after a storm event.

i. Note: inspections are only required during the project’s normal working hours.

ii. Note: “within 24 hours of the occurrence of a storm event” means that the permittee is required to conduct an inspection within 24 hours once a storm event has produced 0.25 inches, even if the storm event is still continuing.

Thus, if there is a storm event at the site that continues for multiple days, and each day of the storm produces 0.25 inches or more of rain, the permittee is required to conduct an inspection within 24 hours of the first day of the storm and within 24 hours after the end of the storm.

f. Contractor shall inspect stormwater discharges and receiving State waters and/or receiving drainage system for turbidity, color, floating oil and grease, floating debris and scum, materials that will settle, substances that will produce taste in the water or detectable off-flavor in fish, and inspect for items that may be toxic or harmful to human or other life.

g. Inspections and maintenance activities will be logged by designated personnel.

h. Areas that need to be inspected are:

i. Silt fencing: Buildup of sediment along the silt fence is not to exceed 1/3 its height.

ii. Inlet protection: Inlet protection shall be cleaned, or removed and replaced as sediment accumulates, the filter becomes clogged, and/or performance is compromised. Where there is evidence of sediment accumulation adjacent to the inlet protection measure, the Contractor shall remove the deposited sediment by the end of the same work day in which it is found or by the end of the following work day if removal by the same work day is not feasible.

iii. Areas that have been excavated and that have not yet completed stabilization.

iv. Material, waste, and equipment storage areas: materials must be properly stored and labeled, and good housekeeping must be in place.

v. Concrete washout area: Washout area should be checked for evidence of spillage or leaks.

vi. Stabilized exit: Exit shall be checked to make sure sediment build-up is not causing tracking onto road.

vii. Stockpiles: Stockpile controls (plastic sheeting, berms, and/or perimeter controls) are adequate.

SWPPP Page 25 of 46

viii. All areas where stormwater typically flows within the site, including drainageways designed to divert, convey, and/or treat stormwater.

PART 1 GENERAL

1.1 REFERENCES

The publications listed below form a part of this specification to the extent referenced. The publications are referred to within the text by the basic designation only.

U.S. NATIONAL ARCHIVES AND RECORDS ADMINISTRATION (NARA)

40 CFR 247 Comprehensive Procurement Guideline for Products Containing Recovered Materials

1.2 OBJECTIVES

Government procurement policy is to acquire, in a cost effective manner, items containing the highest percentage of recycled and recovered materials practicable consistent with maintaining a satisfactory level of competition without adversely affecting performance requirements or exposing suppliers' employees to undue hazards from the recovered materials. The Environmental Protection Agency (EPA) has designated certain items which must contain a specified percent range of recovered or recycled materials. EPA designated products specified in this contract comply with the stated policy and with the EPA guidelines. Make all reasonable efforts to use recycled and recovered materials in providing the EPA designated products and in otherwise utilizing recycled and recovered materials in the execution of the work.

1.3 EPA DESIGNATED ITEMS INCORPORATED IN THE WORK

Various sections of the specifications contain requirements for materials that have been designated by EPA as being products which are or can be made with recovered or recycled materials. These items, when incorporated into the work under this contract, shall contain at least the specified percentage of recycled or recovered materials unless adequate justification (non-availability) for non-use is provided. When a designated item is specified as an option to a non-designated item, the designated item requirements apply only if the designated item is used in the work.

1.4 EPA PROPOSED ITEMS INCORPORATED IN THE WORK

Products other than those designated by EPA are still being researched and are being considered for future Comprehensive Procurement Guideline (CPG) designation. It is recommended that these items, when incorporated in the work under this contract, contain the highest practicable percentage of recycled or recovered materials, provided specified requirements are also met.

SECTION 01 62 35 Page 2

1.5 EPA LISTED ITEMS USED IN CONDUCT OF THE WORK BUT NOT INCORPORATED IN

THE WORK

There are many products listed in 40 CFR 247 which have been designated or proposed by EPA to include recycled or recovered materials that may be used by the Contractor in performing the work but will not be incorporated into the work. These products include office products, temporary traffic control products, and pallets. It is recommended that these non-construction products, when used in the conduct of the work, contain the highest practicable percentage of recycled or recovered materials and that these products be recycled when no longer needed.
