QUESTIONS & ANSWERS
1. Statement: The SCA has very specific requirements relating to items such as hazard pay and overtime
Question: How will the Government evaluate the proposals to ensure that these items are correctly priced?
Answer: Refer to solicitation section d, Volume IV Price (Cost), page 38 paragraph vii.
Proposed wages will be evaluated based on the Department of Labor (DoL) Wage Determinations for those positions.
2. Questions: Combined Synopsis/Solicitation Document page 36: Will the government evaluate past performance from a teaming subcontractor, or must all performance history be demonstrated fully by the prime offeror in either a prime or subcontract role?
Answer: Refer to solicitation section c, Volume III Past Performance, page 36 paragraph b) The Offeror SHALL provide a minimum of three (3) and no more than five (5) contracts/jobs performed within the last five (5) years prior to the date of issuance of this solicitation for the submitted data. The Offeror can use the past performance information where it was the prime or a subcontractor performing the same or similar services. The past performance data shall document a valid history of past contract performance.
3. Combined Synopsis/Solicitation Document page 1: How will questions and responses be distributed? Will this be done by email, or will they be posted?
Answer: All answers will be posted on SAM.gov via amendment of solicitation W9124M-22-R- 0023.
4. Issue:
This proposal is being prepared during a great deal of uncertainty associated with unprecedented inflation and high interest rates. There is no provision for economic price adjustments.
Question:
Will the Government incorporate FAR Clause 16.203-1 into the contract, or is the intent for the small businesses to solely bear all the risks associated with price volatility?
Answer: No, FAR clause 52.222-43 Fair Labor Standards Act and Service Contract Labor Standards - Price Adjustment (Multiple Year and Option Contracts) is in the solicitation.
Refer to FAR 16.203-1 Fixed-price contracts with economic price adjustment. There is not sufficient justification to include FAR 16.203-1 in this solicitation.
5. Issue:
RFP, Section M, Factor 3, Page 39. This proposal is being prepared during a great deal of uncertainty associated with unprecedented inflation and high interest rates.
Question:
Considering the high level of economic uncertainty associated with persistent inflation, how will the Government determine that prices are reasonable and realistic?
Answer: Market research and competition.
6. Issue:
PWS, Section C, 5.3.1, page 20. The Paragraph states that RCRA / Stormwater Inspections: It is anticipated that the Contractor shall conduct approximately 85 formal inspections of Installation (i.e., Fort Stewart and HAAF inclusive) military and civilian facilities per quarter. No specifics are provided for these inspections. In addition, there is no indication of the time it takes for these inspections, and only an incumbent would have such information.
Question:
So that all bidders have a common basis and can accurately estimate the level of effort, what is the average time it takes to conduct 1 inspection or a range average? Utilizing the TE+5.3.1- 001+RCRA+InspectionChecklist
Answer: These inspections typically take 1 – 1 ½ hours. We are expecting contractor to use commercial industry practices and meet the requirements of the PWS.
7. Issue:
PWS, Section C, 5.3.2, page 21. The paragraph states that Facility Assistance Visits (FAV's): It is anticipated that the Contractor shall conduct approximately 130 facility assistance visits (FAV's) per month of Installation (i.e., Fort Stewart and HAAF inclusive) military and civilian facilities. There is no indication of how long these visits are or any specifics. Only an incumbent would have such information.
Question:
So that bidders can accurately estimate the workload to support these FAV's, what is the average time for each visit?
Answer: Time spent on an FAV is dependent on the compliance status of the activity at the time of the visit. If the activity has several areas in need of improvement the assessor will spend more time coaching and mentoring the activity to regain compliance. A FAV could last 1-4 hours.
8. Issue:
PWS, Section C, 5.3.4, page 21. The paragraph states that the contractor shall facilitate, at a minimum, an environmental compliance officer/recycling compliance course once per quarter.
Question:
On average how much time is typically required to support the compliance course once a quarter? How many support personnel are typically required?
Answer: Refer to PWS paragraphs 5.3.4 and 5.3.5. The contractor shall facilitate these courses for Government personnel. The contractor needs to explain their method of fulfillment of this requirement.
9. Issue:
PWS, Section C, 5.4.2, page 23. The PWS requires contractors to conduct quarterly inspections of the hazardous materials storage facilities inspections at each of the approximately 40 activities that are serviced by the HAZMART section. No specifics are provided for the inspections, and only an incumbent will have access to this information.
Question:
To provide all bidders an equal opportunity to estimate the workload accurately, will the Government indicate how long each of these inspections takes utilizing TE+5.4.2- 001+HAZMART+Storage+Inspection+Checklist+(HW-HM)?
Answer: HAZMART inspections average approximately 1-2 hours.
10. Issue:
PWS, Section C Part 4, 4.1, page 17. The PWS stipulates that the contractor shall furnish all supplies, equipment, facilities, and services necessary to perform the required work.
Question:
Will the USG identify the equipment that has typically been supplied by the contractor?
Answer: TE 3.2-001 is included in this solicitation listing all Government Furnished Property/Equipment (GFP/GFE). TE 4.3-001 is included in this solicitation listing anticipated supplies.
11. Issue:
RFP, Instructions to offerors Volume IV, d, page 37. There are no demographic data provided for the existing staff, which impacts the paid time off calculations associated with fringe rates.
The Service Contract Act (SCA) has a stepped-up basis for vacation time relating to the years that an employee has been working on a specific contract and its successor(s). Greater levels of seniority will lead to more vacation hours. Absent this information, bidders will develop a basis of estimate that supports lower pricing, especially on Firm Fixed Price contracts where there is a greater incentive to provide the lowest price. This reduces accuracy.
Question:
To ensure price realism and prevent "inaccurate pricing from offerors with a resultant "lowballing" of pricing, what level of seniority should the bidders use in developing their pricing? For example, in other Government solicitations, there has been an instruction to assume that, on average, a specific number of years of experience. This approach ensures that the Government receives comparable proposals, and an incumbent does not have an advantage over other bidders.
Answer: This is a performance-based contract for services. It is the contractor’s business decision.
12. Issue:
PWS, Section C, 5.2.5, page 19. The paragraph states that the Contractor shall accept, store, and process for pick-up of all dry and wet batteries turned in on the installation.
Question:
Is the process for picking up batteries in preparation before the arrival of a vendor designated to collect the hazardous waste for treatment and disposal off the installation?
Answer: Lead acid batteries are received and processed at the hazardous waste facility in preparation for sale through the recycling program. Contractor needs to explain how they will process battery preparation for sale to meet this requirement.
13. Issue:
PWS, Section C, 5.3.4, page 21. The paragraph states that the Contractor shall train units via the "Recycling Compliance Person (RCP) / Hazardous Material - Hazardous Waste Handlers/Sustainability Management System (SMS)" class (i.e., the RCP/HM/HW/SMS course) and the "Stormwater Pollution Prevention" class, encompassing an anticipated attendance of 3,000 personnel annually.
Question:
How many occurrences are scheduled annually for this training requirement? On average, how long are each of the sessions? How many personnel are, on average, required to support the effort?
Answer: Refer to PWS paragraph 5.3.4. The contractor shall facilitate these courses for Government personnel. The contractor needs to explain their method of fulfillment of this requirement.
14. Issue:
PWS, Section C, 5.3.5, page 21. The paragraph states that the Contractor shall facilitate, at a minimum, the Environmental Compliance Officer/Recycling Compliance Person Course once per quarter; other aforementioned training listed in this paragraph are scheduled by the G-4
Command Maintenance Evaluation Team. No specifics are supplied relating to the number of courses and the specific duration of each. Without these specifics, the Government will receive widely divergent basis of estimates and associated costs. Only an incumbent will have accurate information upon which to develop pricing.
Question:
How long are these quarterly training sessions, and, on average, how many attendees are in each session?
Answer: Refer to PWS paragraph 5.3.5. The contractor shall facilitate these courses for Government personnel. The contractor needs to explain their method of fulfillment of this requirement.
15. Question: Is there an expectation in regard to the number of full-time staff members on site every day to support this work?
Answer: This is a performance-based contract for services. It is the contractor’s business decision.
16. Question: GFE cell phones, are these phones to be used for emergency, off hours, call in purposes or are they to remain on base at all times?
Answer: GFE cell phones are for daily operations in performance of the contract requirements and after-hours emergency responses. No personal or long-distance usage will be allowed.
17. Question: Is the contractor required to supply diesel fuel?
Answer: No.
18. Question: Are the drum grapples, hoists, diaphragm pumps, air compressor, etc. viewed during the site walk GFE?
Answer: Yes, they are GFE.
19. Question: Section 5.2.7 of the PWS references TE 4.2.2-01. As we do not see this attachment in SAM please provide if it is applicable to the PWS.
Answer: TE 4.2.2-01 is being provided in amendment 0001.
20. Question: Section 5.3.1 indicates that 85 formal installation inspections are to be conducted annually as shown on attachment TE 5.3.1-001. This attachment appears to have over 100 facilities listed for inspection. Please advise as to which is the most up to date.
Answer: Historically, there are 85 inspections performed throughout the year. The TE is the most accurate; however, the number will increase and decrease as the military changes mission and equipment.
21. Question: Will the government consider offering an extension to the proposal due date of 28 November to 02 December? The request is to allow for additional question response time, incorporation of responses into proposal, and client PPQ submittal responses. Based on the response to PWS questions additional past performance questionnaires may need to be submitted and the concern is that the evaluating personnel may be on leave in conjunction with the Thanksgiving Holiday.
Answer: The solicitation closing date is being changed in amendment 0001.
22. Question: Our team kindly requests an extension for the proposal submission date to December 5, 2022, 1200 EST.
Answer: The solicitation closing date is being changed in amendment 0001.

Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender's request and expense, unless they are destroyed during preaward testing.
(e) Multiple offers. Offerors are encouraged to submit multiple offers presenting alternative terms and conditions, including alternative line items (provided that the alternative line items are consistent with FAR subpart 4.10), or alternative commercial products or commercial services for satisfying the requirements of this solicitation. Each offer submitted will be evaluated separately.
(f) Late submissions, modifications, revisions, and withdrawals of offers:
(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.
(2)(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and--
(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or
(B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government's control prior to the time set for receipt of offers; or
(C) If this solicitation is a request for proposals, it was the only proposal received.
(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.
(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.
(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.
(5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers.
Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer.
(g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror's initial offer should contain the offeror's best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.
(h) Multiple awards. The Government may accept any item or group of items of an offer, unless the offeror qualifies the offer by specific limitations. Unless otherwise provided in the Schedule, offers may not be submitted for quantities less than those specified. The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit prices offered, unless the offeror specifies otherwise in the offer.
(i) Availability of requirements documents cited in the solicitation.

The Offeror shall enter, in the block with its name and address on the cover page of its offer, the annotation "Unique Entity Identifier" followed by the unique entity identifier that identifies the Offeror's name and address. The Offeror also shall enter its Electronic Funds Transfer (EFT) indicator, if applicable. The EFT indicator is a four-character suffix to the unique entity identifier. The suffix is assigned at the discretion of the Offeror to establish additional SAM records for identifying alternative EFT accounts (see FAR subpart 32.11) for the same entity. If the Offeror does not have a unique entity identifier, it should contact the entity designated at www.sam.gov for unique entity identifier establishment directly to obtain one. The Offeror should indicate that it is an offeror for a Government contract when contacting the entity designated at www.sam.gov for establishing the unique entity identifier.
