(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.

52.216-19 ORDER LIMITATIONS. (OCT 1995)

(a) Minimum order. When the Government requires supplies or services covered by this contract in an amount of less then $173,712.92, the Government is not obligated to purchase, nor is the Contractor obligated to furnish, those supplies or services under the contract.

(b) Maximum order. The Contractor is not obligated to honor:

(1) Any order for a single item in excess of 20% over any of the items listed in the schedule;

(2) Any order for a combination of items in excess of 20% over all of the items listed in the schedule; or

(3) A series of orders from the same ordering office within fourteen (14) days that together call for quantities exceeding the limitation in subparagraph (1) or (2) above.

(c) If this is a requirements contract (i.e., includes the Requirements clause at subsection 52.216-21 of the Federal Acquisition Regulation (FAR)), the Government is not required to order a part of any one requirement from the Contractor if that requirement exceeds the maximum-order limitations in paragraph (b) above.

(d) Notwithstanding paragraphs (b) and (c) above, the Contractor shall honor any order exceeding the maximum order limitations in paragraph (b), unless that order (or orders) is returned to the ordering office within fourteen (14) days days after issuance, with written notice stating the Contractor's intent not to ship the item (or items) called for and the reasons. Upon receiving this notice, the Government may acquire the supplies or services from another source.

52.216-22 INDEFINITE QUANTITY. (OCT 1995)

(a) This is an indefinite-quantity contract for the supplies or services specified, and effective for the period stated, in the Schedule. The quantities of supplies and services specified in the Schedule are estimates only and are not purchased by this contract.

(b) Delivery or performance shall be made only as authorized by orders issued in accordance with the Ordering clause. The Contractor shall furnish to the Government, when and if ordered, the supplies or services specified in the Schedule up to and including the quantity designated in the Schedule as the "maximum". The Government shall order at least the quantity of supplies or services designated in the Schedule as the "minimum".

(c) Except for any limitations on quantities in the Order Limitations clause or in the Schedule, there is no limit on the number of orders that may be issued. The Government may issue orders requiring delivery to multiple destinations or performance at multiple locations.

(d) Any order issued during the effective period of this contract and not completed within that period shall be completed by the Contractor within the time specified in the order. The contract shall govern the Contractor's and Government's rights and obligations with respect to that order to the same extent as if the order were completed during the contract's effective period; provided, that the Contractor shall not be required to make any deliveries under this contract after 31 Janurary 2021.

52.217-8 OPTION TO EXTEND SERVICES (NOV 1999)

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor at anytime prior to the expiration of the contract.

52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR 2000)

(a) The Government may extend the term of this contract by written notice to the Contractor prior to contract expiration; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 30 days before the contract expires. The preliminary notice does not commit the Government to an extension.

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.

(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 36 months.

Department of Defense Activity Address Code (DoDAAC) is a six position code that uniquely identifies a unit, activity, or organization.

Document type means the type of payment request or receiving report available for creation in Wide Area WorkFlow (WAWF).

Local processing office (LPO) is the office responsible for payment certification when payment certification is done external to the entitlement system.

PERFORMANCE WORK STATEMENT

Performance Work Statement (PWS) Fort Stewart Grounds Maintenance

1.0. INTRODUCTION. This is a non-personal services contract to provide Fort Stewart, GA (FSGA) and Hunter Army Air Field (HAAF) Grounds Maintenance Services. The Government shall not exercise any supervision or control over the contract service providers performing the services herein. Such contract service providers shall be accountable solely to the Contractor who, in turn is responsible to the Government. The Contractor shall provide all personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, and other items and non-personal services necessary to perform grounds maintenance at FSGA and HAAF as defined in this PWS.

1.1. Background. FSGA and HAAF are the home of the 3rd Infantry Division and combine to be the Army's Premier Power Projection Platform on the Atlantic Coast. FSGA is the largest, most effective and efficient armor training base east of the Mississippi, covering 280,000 acres including parts of Liberty, Long, Tattnall, Evans, and Bryan counties in Southeast Georgia. FSGA is physically located north of Hinesville GA accessible from either GA Highway 144 or GA Highway 84. FSGA consists of several improved areas totaling approximately 1508 acres, several semi improved areas totaling approximately 546 acres, several unimproved areas totaling approximately 757 acres, one airfield of approximately 225 acres and 51 small cemeteries scattered throughout the training areas of the Installation.

HAAF is home to the Army's longest runway on the east coast (11,375 feet) and the Truscott Air Deployment Terminal. Together these assets are capable of deploying units such as the heavy, armored forces of the 3rd Infantry Division or the elite light fighters of the 1st Battalion, 75th Ranger Regiment. FSGA and HAAF are located in the humid subtropics with long, hot summers and mild winters. HAAF is physically positioned in the southwest corner in the city limits of Savannah, GA. Savannah is approximately 35 miles from FSGA, accessible by either GA Highway 204 from the south or Interstate 516 from the north. HAAF’s mowing areas consists of two improved areas approximately 738 acres, several semi improved areas consisting of approximately 353 acres and an airfield of approximately 506 acres.

1.2. Objectives. The Contractor shall ensure all work accomplished maintains and presents a healthy, clean, neat, and professional appearance to all grounds included and covered by this contract in support of mission requirements for users, residents, and visitors to the installation.

2.0. REQUIREMENTS.

2.1. General Information.

2.1.1. Scope. The Contractor shall maintain Improved, Semi-Improved, Airfields, Cemeteries and Unimproved Grounds as identified under Technical Exhibit 3 – Acreage of Parcels, utilizing accepted industry standards and practices, where practical

2.1.1.1 Improved Areas. The work performed in these areas by the Contractor shall include mowing, edging and trimming grass, removing grass trimmings from paved areas, removing grass from cracks in sidewalks and pavements and litter control.

2.1.1.2 Semi-Improved Areas. These areas are used for operational and maintenance purposes. Erosion control shall be the predominant grounds maintenance work performed in this area by the Contractor. This will include mowing and trimming grassed and vegetated areas, litter removal and removing clippings from paved areas.

Specialized equipment may be required in some of these areas.

2.1.1.3 Unimproved Areas. Unimproved areas are acreage on which periodic recurring maintenance is performed.

Activities include mowing for life, health, safety, security, weed and brush control, erosion control, dust control, and drainage maintenance. These areas may include but are not limited to antenna fields, airfield shoulders, clear zones, drop zones and ranges.

2.1.1.4 Airfields: There are two airfields located on Fort Stewart and Hunter Army Airfield. One is located off the main cantonment area of Fort Stewart and it is called Wright Army Airfield. The other is located on Hunter Army Airfield. The work performed in these areas by the Contractor shall include mowing grass, trimming and litter removal.

2.1.1.5 Cemeteries: There are fifty-one (51) small historic cemeteries scattered throughout the outlying areas of Fort Stewart and located in at least five (5) different counties, Liberty, Tattnall, Bryan, Evans and Long (reference Technical Exhibit 3 – Acreage of Parcels and Technical Exhibit 4 – Area Maps for locations and lots sizes). The work performed in these areas by the Contractor shall include mowing grass, trimming and litter removal.

2.1.2. Description of Services

2.1.2.1. The Contractor shall provide grounds maintenance services to the identified improved areas, semi-improved areas, unimproved areas, airfields, and cemeteries on FSGA and HAAF.

2.1.3. General Information.

2.1.3.1. Period of Performance. The Period of Performance shall be for a one-month phase-in period, an eleven (11) month base period, and two (2) one-year option periods.

2.1.3.2 Place of Performance. The work to be performed under this contract will be performed at Fort Stewart, GA and Hunter Army Airfield, GA.

2.1.3.3 Hours of Operation. The Government's normal hours of operation are from 7:00AM to 4:00 PM, Monday through Friday, except Federal Holidays or when the Government facility is closed due to local or national emergencies, administrative closings, or similar Government directed facility closings. The Contractor is responsible for conducting business between these hours.

2.1.3.4 Recognized Federal Holidays. The Contractor’s performance shall not be required on the legal public holidays listed below. Holidays occurring on weekends will be observed as directed by the published Army calendar.

2.1.3.4.1. Contractor personnel shall not be scheduled for overtime work.

2.1.4. Travel / Temporary Duty. There is no Travel / Temporary Duty associated with this requirement.

2.1.5. Emergency Services.

2.1.5.1. The Contractor shall make available competent personnel trained and capable of dealing with minor injuries. The Contractor or their employees shall immediately notify their supervisor of any accident requiring emergency medical treatment. The Contractor will, in turn, notify the Contracting Officer (KO) or Contracting Officer’s Representative (COR) within two (2) hours of the incident.

2.1.5.2. Emergency medical treatment and services for Contractor personnel is the responsibility of the Contractor.

Civilian Contractors are not be allowed to use any of the government operated medical facilities on either Installation.

2.1.6. Contract Administration and Management.

2.1.6..1. Post Award Conference/Performance Evaluation Meetings. The Contractor shall attend the post award conference convened by the contracting activity or contract administration office in accordance with Federal Acquisition Regulation (FAR) Subpart 42.5. The KO and COR shall meet periodically with the Contractor to review the Contractor's performance. The post award conference will also be utilized to ensure the contractor understands all HSPD-12 requirements. Written minutes of such meetings will be recorded by the Government and signed by the PM and the KO, or COR and distributed within five (5) workdays after the meeting. The Contractor may request a meeting with the KO or COR when the Contractor believes such a meeting is necessary. In either case, if the Contractor does not concur with any portion of the minutes, recorded by the Government or the Contractor, such non-concurrence shall be provided in writing to the KO within two (2) calendar days following receipt of the minutes.

2.1.6.2. Contract Administration. Notwithstanding the Contractor’s responsibility for total management during the performance of this contract, the administration of the contract requires maximum coordination between the Government and the Contractor.

2.1.6.3. The following provides the roles and their respective authority during the performance of the contract:

2.1.6.3.1. Contracting Officer (KO). The KO is the only person authorized to direct changes in any of the requirements under this contract, and, notwithstanding any provisions contained elsewhere in this contract, said authority remains solely with the KO. In the event the Contractor effects any such change at the direction of any person other than the KO, the change will be considered to have been made without authority and solely at the risk of the Contractor. All contract administration will be effected by the KO. Communications pertaining to contractual administrative matters shall be addressed to the KO. No changes in or deviation from the terms and conditions shall be affected, without a written modification to the contract, executed by the KO authorizing such changes.

2.1.6.3.2. Contracting Officer’s Representative (COR). The KO shall designate contract level CORs during the term of this contract, under Defense Federal Acquisition Regulation Supplement (DFARS) clause 252.201-7000 “Contracting Officer’s Representative.” The COR will provide assistance in identification and resolution of problems, conflicts in priority, subtask requirement definitions, and other operations type problems.
