3. Proposal Content.

a. Volume I – RFP Documents. Offerors are required to submit a completed SF 1449 (including acknowledgment of Amendments) and FAR Provision 52.212-1. Failure to follow the below Contract Proposal preparation instructions may cause your proposal to be deemed unacceptable by the Government. Volume I will be organized as follows and contain the identified information.

i. TAB A, Executive Summary. Provide an executive summary that introduces the contractor team and proposal submission, to include a list of team members and subcontractors and the task areas they are designated to provide support. The executive summary shall also include a list of the proposal package contents.

ii. TAB B, Signed SF 1449 and Amendments. The SF 1449 will be submitted fully completed.

The offeror is cautioned that the SF 1449 must contain an original signature in block 30a of the form. The contractor will acknowledge all amendments to the RFP in accordance with the instructions on the SF 1449 and with Addendum to FAR 52.212-1, Instruction to Offerors Commercial Items.

iii. TAB C, Contact Information. The Offeror shall provide a contact list (with phone numbers, fax numbers, mailing addresses, email addresses, etc.) including the name and title of the company/division point of contact regarding decisions made with respect to your proposal and who can obligate your company contractually. Also, identify those individuals authorized to negotiate with the Government on behalf of your company.

iv. TAB D, Responsibility Statement. The Offeror shall submit a statement of their responsibility, in accordance with FAR 9.104-1 along with supporting documents, such as an Annual Profit and Loss Statement, or other such document to indicate that the Offeror possess adequate financial responsibility, or the ability to obtain such resources. This will be used in the Government’s determination of responsibility for the Offeror.

If offeror has completed Representations, Certifications, and Other Statements of Offerors via the System for Award Management (SAM) (www.sam.gov.), please indicate date registered and date of expiration.

vi. TAB F, Organizational Conflict of Interests (OCI) Mitigation Plan (If Applicable). Each offeror shall provide an OCI mitigation plan, if applicable, to its proposal.

b. Volume II – Technical Capability. The Technical Capability Volume II should be clear, concise, and include sufficient detail for effective evaluation and for substantiating the validity of stated claims in the Offeror’s proposal. Legibility, clarity and coherence are very important. Your responses will be evaluated against the Technical factors/elements defined in ADDEDUM FAR Clause 52.212-2, Evaluation – Commercial Items. The Offeror should address as specifically as possible the actual methodology used for accomplishing the PWS tasks. The proposal should not simply rephrase or restate the Government's requirements, but rather should provide convincing rationale to address how the Offeror intends to meet these requirements. Statements that the Offeror understands, can, or will comply with the PWS (including referenced publications, technical data, etc.); statements paraphrasing the PWS or parts thereof (including applicable publications, technical data, etc.); and phrases such as “standard procedures will be employed” or “well known techniques will be used,” etc., will raise questions regarding an Offeror’s technical ability to perform the services contained herein and may be grounds to eliminate the proposal from further consideration for contract award. Offerors should assume that the Government has no prior knowledge of their facilities and experience, and that it will base its evaluation on the information presented in the Offeror’s proposal. Elaborate brochures or documentation, binding, detailed art work, or other embellishments are unnecessary and are not desired. Submission of resumes is not required.

The Technical Capability Volume shall, at a minimum, be prepared in a form consistent with the PWS and the evaluation criteria for award set forth in this solicitation. The Technical Capability Volume shall be prepared in an orderly format and in sufficient detail to enable the Government to make a thorough evaluation of the Offeror’s technical competence and ability to comply with the contract task requirements specified in the PWS. The volume shall be organized according to the following general outline.

TAB A, Table of Contents

TAB B, Glossary of Abbreviations and Acronyms

TAB C, List of Table and Drawings and /or Cross Reference Matrix (if applicable)

TAB E, Factor I: Technical Capability.

TAB E1 – Element 1: Staffing Approach TAB E2 – Element 2: Management Approach

FACTOR 1, TECHNICAL CAPABILITY

Technical Capability Volume. The Technical Capability Volume shall include, at a minimum, the following information.

Element 1: Staffing Approach. The Offeror shall provide:

A staffing matrix which identifies each labor category, quantity of labor category proposed, and crosswalk to each task identified in the PWS 2.0 and 3.0 deemed necessary to perform the requirement.

Element 2: Management Approach. The Offeror shall provide:

a) An organizational chart identifying the management and communication structure of key personnel identified in PWS 2.1.10. of the proposed team to include subcontractors with a description of roles and responsibilities. The accompanying narrative also lists the qualifications of key personnel as listed in PWS 2.1.11.

b) The Offeror shall provide a plan on how it will manage personnel; and the process for how they will provide services IAW the PWS. The plan shall include a list of equipment, materials, and supplies deemed necessary to perform this requirement. As assurance to the process of equipment the Offeror shall identify whether these resources are owned, leased, or to be purchased by the offeror. If the offeror will use a subcontractor, the same list shall be provided and ownership or lease identified. The Offeror shall provide any agreements and/or subcontracts established which ensures access and availability of the equipment and supplies required to execute the requirements of the PWS.

c) A realistic phase-in plan that identifies how the offeror will transition its personnel, equipment, materials and supplies as required by PWS by the conclusion of the phase-in period/prior to start of full performance period.

FACTOR 2, PAST PERFORMACE

Past Performance Volume III: The Past Performance evaluation will be accomplished by reviewing aspects of an Offeror's recent and relevant Past Performance, focusing on and targeting performance which is relevant to the effort of Ground Maintenance Services. Recent and relevant past performance shall be discussed for the prime Contractor and any subcontractors proposed to support this contract. A list of no more than three (3) of the Offeror’s most recent and relevant past performance information on Grounds Maintenance Services in support of Army, Active, Reserve, and National Guard component military entities: similar in size, scope, and complexity to the services being procured under this solicitation), performed for Government agencies and/or commercial customers within the last three (3) years from the solicitation release date. Past performance can be for the prime, subcontractor, or a combination of the prime and subcontractor. No more than a total of three (3) contracts for past performance evaluation shall be submitted for this requirement. Offerors shall include a name, telephone number, and fax or email for each contract listed. The past performance volume shall include, at a minimum, the following information:

a) Provide information regarding any relevant experience acquired in providing similar Grounds Maintenance Services exceeding $100,000.00, in the last three (3) years that will enable successful execution of the proposed approach and satisfy the requirements of the contract.

b) Provide a description of the project(s) in which relevant experience was obtained. Relevant experience is defined as providing Grounds Maintenance for facilities over 1,000 acres. Offerors shall specify the date(s) of performance for this experience; a detailed description of the contract effort, whether it was performed as a prime or subcontractor, its relevancy to this acquisition, the size of the contract action, and what type of contract vehicle (Cost, Firm Fixed Price, etc.) was utilized. A table may be used to delineate experience.

c) The offeror shall submit, along with the information required in this paragraph, a consent letter, executed by each subcontractor, teaming partner, and/or joint venture partner, authorizing release of adverse past performance information to the offeror so the offeror can respond to such information. For each identified effort for a commercial customer, the offeror shall also submit a client authorization letter, authorizing release to the Government of requested information on the offeror's performance.

i. Recency Assessment. To be recent, the effort must be ongoing or must have been performed during the past three (3) years from the date of issuance of this RFP. Information that fails the recency assessment will not be evaluated.

ii. Relevancy Assessment. To be relevant, the effort must be similar to the nature of work, size, magnitude, complexity and scope to the work required by this RFP. The Government will conduct an in-depth evaluation of all recent performance information provided to determine if it is the same or similar in nature, size, and complexity to the services being procured under this RFP. In determining relevancy for individual contracts, consideration will be given to the effort, or portion of the effort, being proposed by the offeror, teaming partner, or subcontractor whose contract is being reviewed and evaluated. Relevant experience information that fails this condition will not be evaluated.

The Government reserves the right to obtain past performance data from other sources than those identified by the offeror in evaluating past performance. This includes, but not limited to, the Past Performance Information Retrieval System (PPIRS), Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), or other databases; interviews with Program Managers, Contracting Officers, and Fee Determining Officials; and the Defense Contract Management Agency. Offerors are reminded that both independent data and data provided by offerors in their proposals may be used by the Government to evaluate offeror past performance. However, the burden of providing thorough, complete, and current past performance information as requested in this paragraph remains with the offerors. Proposals that do not contain the information requested by this paragraph risk rejection or a less than acceptable performance rating by the Government. All past performance comments received will be taken into account and could affect the overall rating. The overall past performance evaluation is a subjective decision based on the whole of all data received.

In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a)(2)(iv)). Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.”

ADDENDUM TO 52.212-2

BASIS FOR AWARD AND EVALUATION CRITERIA

Basis for Award. This is a best value source selection conducted in accordance with Federal Acquisition Regulation (FAR) 15.3, Source Selection, as supplemented by the Defense Federal Acquisition Regulation Supplement (DFARS), and the Army Federal Acquisition Regulation Supplement (AFARS). Award will be made to a single Offeror who is deemed responsible in accordance with the Federal Acquisition Regulation (FAR), whose proposal conforms to the solicitation requirements, and whose proposal, judged by an overall assessment of the evaluation criteria and other considerations specified in this solicitation, represents the Lowest Priced Technically Acceptable offer.

A basis for trade-offs between cost/price and non-cost/price factors are not permitted.

Award will be made to the offeror whose proposal is deemed technically acceptable (technical capability and past performance) and offers the lowest price.

The Government will evaluate the offeror’s technical proposal to determine whether it satisfies the minimum for successful contract performance. In order to be considered for award, offerors proposal must receive “acceptable” rating in every non priced factor and element.

The Government will evaluate proposed prices for reasonableness. Proposed prices evaluated as unreasonable may be grounds for eliminating an offer from competition. Price analysis techniques in accordance with FAR 15.404-1 will be used to determine the total evaluated price to support the selection of the lowest price technically acceptable offeror.

The Government intends to evaluate proposals and award a maximum of one (1) contract without discussions with offerors. Therefore, the offeror’s initial proposal should contain its best terms from a technical and price standpoint.

However, in accordance with (IAW) FAR Part 15.306, should discussions become necessary, the Government reserves the right to hold them. If this occurs, a competitive range will be determined and offerors notified. The competitive range may be limited for purposes of efficiency IAW FAR Part 15.306 (c)(2).

The Contracting Officer will make a determination of responsibility in accordance with the standards of FAR 9.104.

In order to be determined responsible, a prospective contractor must meet all standards of FAR 9.104-1.

Evaluation Criteria.

The Evaluation Criteria consists of three (3) evaluation factors: Technical Capability, Past Performance, and Price.

Factor 1: Technical Capability Element 1 – Staffing Approach

Element 2 – Management Approach

Factor 2: Past Performance Factor 3: Price

The adjectival ratings to be utilized for proposal evaluations are consistent with the DoD Source Selection Procedures and Army Source Selection Supplement (AS3). A single rating system will be used to evaluate the Technical Capability factor, as indicated below; a separate rating system will be used to evaluate Past Performance.

Price will be evaluated for reasonableness and will not receive an adjectival rating.

Factor I - Technical Capability. The Technical Capability evaluation provides an assessment of the offeror’s capability to satisfy the Government’s requirements. The Technical Capability submission will receive one of the adjectival ratings at Table A-1. The compilation of the Element adjectival ratings will form the basis of the factor rating.

1) Element 1: Staffing Approach. To be deemed Technically Acceptable, the Offeror’s Staffing Approach must demonstrate:

The Offeror’s staffing matrix identifies labor categories and quantities of personnel sufficient to perform Grounds Maintenance Services in accordance with the PWS. The PWS crosswalk identifies adequate personnel to accomplish the tasks listed in PWS 2.0 and 3.0.

2) Element 2: Management Approach. To be deemed Technically Acceptable, the Offeror’s Management Approach must demonstrate all of the following:

a. The organizational chart must clearly identify the management structure of key personnel identified in PWS 2.1.10., lines of communication with proposed team to include subcontractors, and a description of roles and responsibilities for each key personnel, and the qualifications for all key personnel as listed in PWS 2.1.11.

b. The offeror’s plan adequately demonstrates how they will attain and sustain sufficient personnel, equipment, materials, and supplies to provide services IAW the the PWS throughout the duration of the contract period. The plan includes an adequate list of equipment, materials, and supplies deemed necessary to perform this requirement. The offeror identifies whether these resources are owned, leased, or to be purchased by the offeror to allow the evaluators to verify access and assurance to appropriate equipment.

Subcontractors have been identified.

c. A Phase-in plan that shows the Offeror will be fully staffed by the conclusion of the Phase-in period and to ensure all personnel, equipment, materials, and supplies are available for delivery and use at the conclusion of the Phase-in period/prior to start full performance period.

Table A-1. Technical Capability Ratings Acceptable/Unacceptable Ratings

Rating Description Acceptable Proposal clearly meets the minimum requirements of the solicitation.

Unacceptable Proposal does not clearly meet the minimum requirements of the solicitation.

Factor II - Past Performance. The Past Performance evaluation will assess the offeror’s probability of meeting the solicitation’s requirements as indicated by that offeror’s record of past performance. Past Performance is assessed at the factor level after evaluating aspects of the offeror’s recent past performance and focusing on performance that is relevant to the services being procured under this solicitation. Offerors are cautioned that in conducting the performance risk assessment, the Government may use data provided in the offeror’s proposal and data obtained from other sources, such as the Past Performance Information Retrieval System (PPIRS) or similar systems and State Department Watch Lists. Past performance areas of evaluation include:

- Business Relations

- Quality of Service

- Schedule

- Customer Satisfaction

1) Each offeror will receive a performance confidence assessment rating based on the Offeror’s recent past performance, focusing on performance that is relevant to the Contract requirements.

a. Recency Assessment. An assessment of the past performance information will be made to determine if it is recent. To be recent, the effort must be ongoing or must have been performed during the past 3years from the date of issuance of this solicitation. Past performance information that fails this condition will not be evaluated.

b. Relevancy Assessment. To be relevant, the effort must be similar in nature of work, size, and complexity. The Government will conduct an in-depth evaluation of all recent performance information obtained to determine if it is the same or similar in nature of work, size, and complexity to the services/products being procured under this solicitation. Recent past performance is defined as not more than 3 years from the RFP release date; relevant in terms of similar nature of work, size and complexity.

A relevancy determination of the offeror’s (including joint venture partner(s) and major and critical subcontractor(s)) past performance will be made. In determining relevancy for individual contracts, consideration will be given to the effort, or portion of the effort, being proposed by the offeror, teaming partner, or subcontractor whose contract is being reviewed and evaluated. In establishing what is relevant for the acquisition, consideration should be given to what aspects of an offeror’s contract history would give the most confidence that the offeror will satisfy the current procurement. The past performance information provided in the proposal and obtained from other sources will be used to establish the relevancy of past performance.

2) The Past Performance Evaluation Team will review this past performance information and determine the quality and usefulness as it applies to performance confidence assessment.

3) Assigning Ratings. The Past Performance Factor will be assigned one of the ratings defined below:

Table A-2 Past Performance Evaluation Ratings

Rating Description

Acceptable Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown.

Unacceptable Based on the offeror’s performance record, the Government has no reasonable expectation that the offeror will be able to successfully perform the required effort

4) Offerors without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance. Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.”

5) If the Contracting Officer determines that a small business’s past performance is not acceptable, this matter shall be referred to the Small Business Administration for a Certificate of Competency determination (see FAR 15.101-2 (b) (1)), in accordance with the procedures contained in Subpart

19.6 and 15 U.S.C. 637(b)(7).

Factor III: Price. Price will not be scored or rated. Evaluation of price will be performed using one or more of the price analysis techniques in FAR 15.404-1(b). Through these techniques the Government will determine whether an Acceptable Offeror’s price is reasonable IAW FAR 15.404-1(b) and balanced IAW FAR 15.404-1(g) (2).

Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). As part of price evaluation, the government will evaluate its option to extend services (see FAR Clause 52.217-8) by adding one-half of the offeror's final option period price to the offeror's total price. Thus, the offeror's total price for the purpose of evaluation will include the phase-in, base period, 1st option, 2nd option, and 1/2 of the 2nd option. Offerors are not required to enter a price for the six-month period.

Unbalanced Pricing may be evaluated in accordance with FAR 15.404-1(g), as applicable, to assess potential performance risk for unreasonably high prices.

Definitions.

Reasonableness. A price is reasonable if, in its nature and amount, it does not exceed that which would be incurred by a prudent person in the conduct of competitive business.

Completeness/Accuracy. The offeror’s proposal is in compliance with the Price Volume instructions in the solicitation.

A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
