Multiple Award Task Order Contract (MATOC) For Directorate of Public Works

(DPW)

SOLICITATION-W9124L-16-R-0001

Question 1. I do not see specified in the solicitation document how many projects we are to include as Specific Relevant Contracts and to send Past Performance Questionnaires on. What is the desired number of projects?

Government Response 1. Each offeror shall identify on the summary page no more than six (6) but not less than three (3) contracts, as a prime or major subcontractor, which is the same or similar in nature, magnitude, and complexity to the services being procured under this Solicitation. Offerors should use their own judgement to determine what shall be submitted to meet the evaluation factors established per Section M, Evaluation Factor for Award for Past Performance. The section was revised for clarification (see amendment 2).

Question 2. On the sample sheet drawing is there a sheet 4 of 77?

Government Response 2. Sheet 4/77 is AD110 Basement Floor Plan – Demolition.

Drawing sheet was inadvertently left out of the set. It is provided in amendment 1.

Question 3. I see “design” mentioned several times in the solicitation. Is this MATOC to be considered design-build? Should we be submitting with an A/E firm team member?

Government Response 3. No. This MATOC is not considered a design-build contract.

Some task orders may require some design effort that fully develops the governments design and provide some calculations and certified shop and/or fabrication drawings.

Question 4. Please confirm that minimum past performance projects requirement is $100,000.

Government Response 4. Yes, the minimum magnitude of past performance projects is $100,000.00.

Question 5. How many past performance contracts can be submitted for contractor.

Government Response 5. See #1.

Question 6. Is there a preference on the type of schedule submitted?

Government Response 6. A Gantt chart (Bar Chart). Section 01 32 00 has been revised (see amendment 2).

Question 7. Base specs 01 35 26 1.2 SUBMITTALS section indicates that plans for the following are required. Shall these submittal requirements only apply to jobs where those activities are required by SOW?

SD-01- 1. Crane Critical Lift Plan and 2. Proof of qualification for crane operators

SD-06-1. Crane reports

SD-07-1. Confined Space Entry Permit and 2. Hot work permit.

Government Response 7. Submittal requirement applies to jobs where the specific activity is required by the SOW. The specification section was revised for clarification (see amendment 2).

Question 8. Base specs 01 35 26 1.6.1.1.c states, Specific training in personal and respiratory protective equipment program implementation and confined space program oversight” required for SSHO. Shall this paragraph apply only to jobs where respirator protection plans and/or confined spaces are required by the SOW?

Government Response 8. This paragraph describes the qualifications for a SSHO that apply to all jobs.

Question 9. Base specs 01 35 26 3.2.1 states, “The contractor shall institute a fall protection training program.” Shall this paragraph apply only to jobs where fall protection plans are required by the SOW?

Government Response 9. The requirement for a fall training program is a contract requirement. How the fall protection training program is implemented is task order specific required by the SOW. The specification section was revised for clarification (see amendment 2).

Question 10. Base specs 01 36 29 1.15 and sub paragraphs describe required components of the SSHP. In the case of 1.15.4, 1.15.5, 1.15.8, 1.15.10, they do not apply to the seed project. Shall the requirement remain to include such components in a site specific SSHP, specifically, for the seed project?

Government Response 10. Specification applies to jobs where the specific activity is required by the SOW. For an activity performed for the seed project, the specification for that activity is applicable.

Question 11. The project documents describe the fixtures desired but do not provide the model number that should be used as the basis of design. I need the model numbers of the fixtures that are desired in order to ensure an accurate quote for this material.

Government Response 11. P-601 Plumbing Schedules have been revised to show basis of design (see amendment 2).

Question 12. Since it is the time of year that many contracting officers are non-responsive when we send out PPQs for completion, and since these go directly to the KO on this MATOC and we will have no way of knowing if they have been completed or not, what considerations will be taken for these PPQs? Will the government go directly to the CPARS for information on our performance on these projects?

Government Response 12. Refer to Section M- Evaluation Factors for Award for Factor 2- Past Performance, subparagraph f.

Question 13. On sheet E-101 note 1 tells us to remove the existing breaker that is in spaces 2-4-6 which is a 3 pole 20, then install a 225 amp. The way the panel is designed you can't interchange the two breakers because of the size. Please clarify.

Government Response 13. Remove the existing 20A/3P breaker from Panel HLD circuits 2,4,6 and replace it with a 100A/3P breaker as opposed to a 225A/3P breaker.

Provide the new Panel HLD1 as a 100A, 3 phase panel as opposed to a 225A, 3 phase panel. Panel HLD1 would still be large enough to power the new pump as well as the relocated breaker/load. Drawing E-101 will be revised. (see amendment 2).

Questions 14. Are we to submit the SPECIFIC RELEVANT CONTRACTS FORM for our subcontractors’ projects, or is this form for the prime offeror only? Am I correct in understanding that I am to submit for both the prime and our major subs Attachment 10 Company Specialized Experience and the PPQs (Attachment 14)? How many projects are desired for each?

Government Response 14. The Specific Relevant Contract form is for the Prime. The offeror shall provide documentation outlining the offeror’s past performance with contracts, as a prime or major subcontractor, which is the same or similar in nature, magnitude, and complexity to the services being procured under this Solicitation.

Attachment 10 is for Key Subcontractor (or Prime if work not to be subcontracted).

Question 15. Will the Government confirm that Volume II would be a total of 90 pages (60 IDIQ pages + 30 sample task order pages)?

Government Response 15. The total page count has been revised. (see amendment 2).

Question 16. Reference Page 65, Evaluation Criteria, Tab E-2, Elements 2, 3, and 4 Question: Can the Quality Control Plan, Safety Plan, and Warranty Plan be the same for both the IDIQ contract and sample task order?

Government Response 16. The decision as to whether one plan can meet the requirements for both the IDIQ contract and sample task order is the offeror’s decision to make. The Government will accept one plan for both the IDIQ contract and sample task order if the offeror submits only one plan for both actions. Reference Section H Special Contract Requirements, paragraph 42. The Evaluation Criteria was revised for clarification (see amendment 2).

Question 17. Reference Page 66, Section (c).3. Will the Government confirm that the bulleted items are not included in the Past Performance Volume III page Count identified in Table 2, Section C.2(c) on page 60? These items include the Table of Contents, Summary Page, Consent Letters, Client Authorization Letters, and Organization Structure Change History.

Government Response 17. Correct. The bulleted items are in addition to the three (3) page limit per past performance reference.

Question 18. Has all asbestos been removed from the latrines identified for renovation?

Government Response 18. An asbestos report and most recent inspection has been provided in amendment 2.

Question 19. Is there any lead pipe in the identified latrines that will require special hazmat disposal?

Government Response 19. Presence of lead pipes is not known, but unlikely. In the event lead pipes are encountered, they may be turned over to the government for disposal.

Soldered joints, which may contain lead, do not require hazmat disposal. Any soldered joints may be disposed in a landfill.

Question20. In second floor latrine, there is a lowered ceiling (multiple ceiling levels) that appears to house HVAC ducting. Will the Contractor be required to relocate this section of HVAC to accomplish one ceiling level for renovation?

Government Response 20. No. HVAC ducting will remain in place.

Question 21. Are all affected electrical panels up to code?

Government Response 21. No, the panel code violations (neutral and ground connected) is being address by a separate project by our maintenance contractor.

Question 22. Who will provide the color schemes and material specifications for the wall tiles, floor tiles and latrine entry thresholds?

Government Response 22. Refer to Drawing A-600 Door Schedule and Finish Schedules and Division 9 Specifications.

Question 23. Will the Contractor be allowed to use demo disposal chutes from the second and third floors?

Government Response 23. Yes. Demo disposal chutes may be used if areas are appropriately fenced for safety, and building access is not impaired.

Question 24. Is there an asbestos report available?

Government Response 24. See #18.

Question 25. There will be no design effort by a DOR on this project correct? The seed project is a bid build project.

Government Response 25. No design effort is required for the sample project.

Question 26. Will AS Builts be able to be turned in just as redlines to the government or will an architect need to take the redlines and incorporate them into CAAD?

Government Response 26. See Section 01 78 00 1.2B: As-Built drawings are required within 30 days of the beneficial occupancy by the government. The one hard copy (Architectural D Sized) and two electronic copies of the As-Built drawings shall be submitted to the Contracting Officer. The electronic copies shall be in PDF format and a format editable by Microstation V8i.

Question 27. Can past performance projects be projects awarded from Ft Sill Contracting? If so, will those projects be evaluated in the same manner as those awarded from agencies other than Ft Sill Contracting?

Government Response 27. Yes.

Question 28. Is the offer guarantee required for 20% of our price of seed project? If not, what amount does the offer guarantee need to be?

Government Response 28. Refer to Federal Acquisition Regulation (FAR) 52.228-1 Bid Guarantee. The amount of the bid guarantee shall be 20 percent of the bid price. This requirement has been clarified in amendment 2.

Question 29. Contract document SF1442 Box 11 requires 3 hard copies to be delivered to the government by due date. Solicitation also requires an electronic version to de sent via AMERDEC. Is this the government’s intent?

Government Response 29. Yes, this is the Governments intent.

Question 30. Is there a CAD version of the contract drawings that can be made available to the contractor prior to proposal due date?

Government Response 30. Yes. Micro station V8i (DGN) drawings may be provided.

Question 31. If the Contractor intends to submit as a newly formed JV under the SBA Mentor Protégé Program will the government accept PPQ’s from the individual firms in lieu of combined?

Government Response 31. Yes.

Question 32. Specification 01 45 00 paragraph 1.2 subparagraph c. Construction Project Manager- Project requirements direct the contractor to have a Construction Project Manager on site anytime work activities are being performed. Is it the intent of the government to add the additional cost to the task orders of a “Full Time Project Manager”?

Government Response 32. This requirement has been revised and is reflected in amendment 2.

Question 33. Drawing Sheet AD-400 Note 7 states “Remove one side (restroom side) of concrete masonry wall for access to piping. Detail 1 seems to have Note 7 Tag pointing to a vanity with no dashed wall section. Please clarify.

Government Response 33. The tag is correct and the wall behind the vanity should be removed for access to the piping.

Question 34. Sheet A-150 refers to Details 1 and 2 on sheet A-161. When you turn to drawing sheet A-161 there is no Details 1 or 2. Please advise.

Government Response 34. Details on A-161 mislabeled. Drawing has been revised and is included in an amendment 2.

Question 35. Sheet A-160 refers to Details 3 and 4 on sheet A-161. When you turn to drawing sheet A-161 there is no Detail 4. Please advise.

Government Response 35. Details on A-161 mislabeled. Drawing has been revised and is included in amendment 2.

Question 36. Has the government performed an independent cost estimate on the sample task order?

Government Response 36. Yes.

Question 37. Are subcontractors required to provide a breakdown as requested in Attachment 8 Contractor’s Price Schedule Worksheet since this is a competitive acquisition and not as required for negotiated acquisitions per the FAR? We have found subcontractors are reluctant to provide pricing information in this unusual fashion.

Government Response 37. Refer to FAR 52.236-28 Preparation of Proposals— Construction and 52.215-20 Requirements for Certified Cost or Pricing Data or information other than Certified Cost or Pricing Data.

A breakdown per each subcontractor is not required. However, division summary is needed for comparison to the government cost estimate. The worksheet has been revised and is provided in amendment 2. Although Certified Cost and Pricing Data is not required, the Government is requesting other than Certified Cost and Pricing Data to make a fair and reasonable price determination.

Question 38. Reference “Evaluation Criteria, TAB E – 1 – Sub-Factor 1, Organizational Structure, Element 2: Key Personnel and Key Subcontractors, pages 63 and 64 of 79”.

The requirement states, “Include, as a minimum, professional resumes for the key project personnel listed below…” The next four paragraphs in this section list Project Manager, Superintendent, QC Manager, and Key Subcontractors. The paragraph for “Key Subcontractors” requests Specialized Experience Forms and Letters of Commitment for the Key Subcontractors. Please confirm whether resumes are also required for Key Subcontractors. If so, for which positions?

Government Response 38. No. Resumes are not required for Subcontractors. The Evaluation Criteria was revised for clarification (see amendment 2).

Question 39. Evaluation Criteria, TAB E – 1 – Sub-Factor 1, Organizational Structure, Key Subcontractors, requires naming Key Subcontractors. Contractor feels this will limit competitive pricing for the seed project as well as task orders. Will the government consider removing this requirement?

Government Response 39. No. The Evaluation Criteria was revised for clarification (see amendment 2).

Question 40. Reference “Evaluation Criteria, TAB E – 1 – Sub-Factor 1, Organizational Structure, Key Subcontractors, page 64 of 79”. The requirement states, “Identify the Key Subcontractors chosen for mechanical and electrical installation, describing the extent of their involvement in the project.” Please verify if the requirement is limited to one (1) mechanical contractor and one (1) electrical contractor, or if more than one firm is to be provided for each discipline.

Government Response 40. The Evaluation Criteria was revised for clarification (see amendment 2).

Question 41. Reference “C. Proposal Preparation Instructions”, beginning on page 59 of

79. Please verify whether the following Attachments are included as part of the page count, or not:

Attachment 9 – Key Project Personnel Resume Attachment 10 – Specialized Experience Forms Attachment 11 – Letter of Commitment

Government Response 41. No. These are not included as part of the page count.

Question 42. Reference “TAB E-2 SUB-Factor 2, Project Execution; Element 2: Quality Control Plan; Element 3: Safety Plan; and Element 4: Warranty Plan,” page 65 of 79. The requirement for each section is for the Offeror to provide a plan for each (Quality Control, Safety and Warranty), for both the IDIQ contract and the sample project. These plans are normally fairly lengthy and would exceed the allowable page limit for the entire Technical Volume response. Can these plans be exempted from the page count?

Government Response 42. No, these plans will not be exempted from the page count.

However, the page count has been revised. (see amendment 2).

Question 43. Reference “Past Performance Questionnaire”, page 67 of 79. Please verify whether a copy of the Past Performance Questionnaire (Attachment 14) is to be returned to the KO only, or is it also to be returned to the Offeror and included in Volume III – Past Performance.

Government Response 43. Reference Solicitation page 67. The questionnaires shall be returned directly to the contracting officer. Any questionnaire not returned to the KO will not be reviewed and evaluated.

Question 44. Reference Sample Project requirements. Are lavatory faucets to have electric remote operated valves (infra-red sensors)? If so, are these to be “hard-wired” or battery-operated?

Government Response 44. Manually operated. P-601 Plumbing Schedules have been revised to show basis of design (see amendment 2).

Question 45. Reference Sample Project requirements. Are water closet and urinal flush valves to have electric remote operated valves (infra-red sensors)? If so, are these to be “hard-wired” or battery-operated?

Government Response 45. Manually operated. P-601 Plumbing Schedules have been revised to show basis of design (see amendment 2).

Question 46. Reference Sample Project requirements. Are new floor drains to be furnished with trap primers?

Government Response 46. No, see P-601 Note 1 Plumbing Fixture Connection Schedule:

Provide with Trap Guard.

Question 47. Reference Sample Project requirements. Will new panelboard “HLD-1” require arc flash labeling?

Government Response 47. No, the government is planning on conducting an arc flash study/analysis for the entire building.

Question 48. Reference Sample Project requirements. Will existing panelboard “HLD” require arc flash study and labeling? If so, will this be the responsibility of the Contractor or the DOR?

Government Response 48. No, the government is planning on conducting an arc flash study/analysis for the entire building.

Question 49. Base Specification 01 35 26 1.6.1.1.c says, “Specific training in personal and respiratory protective equipment program implementation and confined space program oversight.” Is it the intention of the government to require these certifications regardless of task order scope of work, or may this requirement be waived for the MATOC APP and applied to each individual task order Safety Plan as required?

Government Response 49. This paragraph describes the qualifications for a SSHO that apply to all jobs.

Question 50. Base specifications 01 35 26 1.7.1.b requires a crane critical lift plan.

This is an activity specific plan that likely be excluded from the MATOC Safety Plan.

Could this requirement be excluded from the proposal requirement?

Government Response 50. This activity may not apply to the sample task order; however, the contractor shall have an overall safety plan and a crane critical lift plan in the overall plan should describe how the contractor would develop and implement at site/activity specific plan.

Question 51. Base specifications include a section 01 35 43. There is no section 01 35 43 in the UFGS current version. Additionally there is no section titled “Environmental Procedures. Please provide the referenced section.

Government Response 51. The specs provided are for Fort Sill and while partially adapted from the UFGS, the provided spec is the contract requirement and not the UFGS.

Question 52. Base Specifications 01 70 00 para 1.2 AND para 1.3.1 reference a separate section titled “SPECIAL CONTRACT REQUIREMENTS.” This section is not included in any other specification section. Please provide the referenced section.

Government Response 52. Specification Section 01 70 00 has been revised and included in amendment 2.

Question 53. Base Specification 01 33 00 1.1 A.1.a.ix mentions an Energy Conservation Plan as a preconstruction submittal, insinuating that this plan is task specific. Base specification 01 00 00 para 1.37.E requires an Energy and Water Conservation Plan, apparently as a MATOC specific plan. SubPara 1 says, “The plan shall outline all expected activities that will consume water, electricity, and natural gas along with estimates of consumption.” Since this plan is typically task and job and project specific, and is not typically required for the base contract, in this case a MATOC, as consumption and conservation cannot be specifically predicted for unknown activities. We request that paragraph 1.37.E in it’s entirely be removed from the BASE Specifications and be added as desired to the Task Order Specifications.

Government Response 53. No. This is a base requirement that will apply to all task orders.

The base specifications apply to all task orders and will not be provided for each request for task order proposal. While certain portions of the base specifications will not apply to each and every task order, the contractor is required to comply with those provisions that do apply. This is similar to other state and city published specifications.

Question 54. In section 01 78 00 Closeout submittals, section 1.3 warranty management, there is no 1.3.1, but there is a 1.3.2, and is preceded by “B”. It appears some formatting issues are present. This could create some confusion.

Government Response 54. The specification has been revised and included in amendment 2.

Question 55. In section 01 78 00, section labeled B. 1.3.2 sub para e should not be a sub paragraph of the Performance Bond Section. The Pre-Warranty Conference is its own section.

Government Response 55. The specification has been revised and included in amendment 2.

Question 56. In section 01 78 00, section labeled B. 1.3.2 sub para f should not be a sub paragraph of the Performance Bond Section. The Contractor’s Response to Construction Warranty Service Requirements is its own section.

Government Response 56. The specification has been revised and included in amendment 2.

Question 57. Base Specification 01 33 00 1.1.A.1.a Preconstruction Submittals does not specify a Waste Management Plan as a required submittal. 01 74 19 1.3.A requires a Waste Management Plan. Since this plan is typically task and job and project specific, and is not typically required for the base contract, in this case a MATOC, as consumption and conservation cannot be specifically predicted for unknown activities, could section 01 74 19 1.3.A be removed from the BASE specifications and be added as desired to each individual Task Order Specifications?

Government Response 57. No. This is a base requirement that will apply to all task orders. Section 01 33 00 has been revised and included in amendment 2.

The base specifications apply to all task orders and will not be provided for each request for task order proposal. While certain portions of the base specifications will not apply to each and every task order, the contractor is required to comply with those provisions that do apply. This is similar to other state and city published specifications.

Question 58. 01 33 00 paragraph 1.4.D.1 states “submit two samples, or two sets of samples showing range of variation, of each required item.” 1.14.D.1 states “submit one set of identified samples.” Which is desired? Please clarify.

Government Response 58. Section 01 33 00 has been revised and included in amendment 2.

Question 59. Will KTR have secure storage available inside Bldg. 475 for smaller more frequently used items?

Government Response 59. No.

Question 60. What is the location of Panel A2 referenced on Sheet E-121?

Government Response 60. The panel call-out is mislabeled. It should be H2 and is located in the hallway near the 2nd floor mechanical room. The drawings has been revised and included in amendment 2.

Question 61. What is the location of Panel A3 referenced on Sheet E-131?

Government Response 61. The panel call-out is mislabeled. It should be H3 and is located in the hallway near the 3rd floor mechanical room. The drawings has been revised and included in amendment 2.

Question 62. Sheet E-101 tells us to remove 3 phase breaker from panel HLD circuits 2,4,6 and install new 225amp breaker. Panel HLD appears to be an ITE panel board.

The electrician does not believe we can install a 225amp breaker in place of what is in spaces 2, 4,and 6. Does the government agree with our assessment and is there an alternative installation solution to this requirement?

Government Response 62. Remove the existing 20A/3P breaker from Panel HLD circuits 2,4,6 and replace it with a 100A/3P breaker as opposed to a 225A/3P breaker.

Provide the new Panel HLD1 as a 100A, 3 phase panel as opposed to a 225A, 3 phase panel. Panel HLD1 would still be large enough to power the new pump as well as the relocated breaker/load. Drawing E-101 has been revised and included in amendment 2.

Question 63. We request further clarification on the nature of key subcontractors for this contract. In Sub-Factor 1, the section titled Key Subcontractors requires primes to "identify the Key Subcontractors chosen for mechanical and electrical installation, describing the extent of their involvement in the project."

a) Is the understanding that these subcontractors are to be utilized for the seed project only?

Government Response 63a. The use of subcontractors is at the discretion of the Prime Contractor. The decision regarding their use on the sample project or any other task order is the contractors’ decision. The only requirement of the Government is the contractor shall provide personnel (including subcontractors) who meet the required qualifications and are approved by the KO as prescribed by this contract. The Evaluation Criteria was revised for clarification (see amendment 2).

b) Are contractors required to commit exclusively to the named subcontractors for the entirety of the MATOC contract if awarded?

Government Response 63b. No, but any future subcontractor must have the minimum qualifications and be approved by the KO prior to use. See Section H Special Contract Requirements H40. Prime contractor shall submit a completed Standard Form (SF) 1413 on all subcontractors prior to their start of work at the work site. The SF1413 shall be submitted only as an electronic pdf document. See Exhibit 4.

Question 64. Is the Price Schedule worksheet a basic worksheet that will be used for each task order? Is this specific for the seed project? Does each line item need to have a breakdown?

Government Response 64. See #37. The Government, at their discretion, may request and the Contractor shall provide a cost breakdown on individual task orders to establish price reasonableness.

Question 66. Do ALL subcontractors need to fill out past performance? Page 64 states electrical and mechanical. Page 66 requirements state each subcontractor. Please confirm it is only needed for electrical and mechanical.

Government Response 66. The Evaluation Criteria was revised for clarification (see amendment 2).

Question 67. Is only one resume for each key personnel required (1 Project Manager, 1 Superintendent, 1 QC Manager). Can multiple be submitted?

Government Response 67. Multiple may be submitted; however, the rating will be based on the least experienced person for each key position. Additionally, any future person appoint to a key position must be approved by the KO prior to use.
