If inspection of the landfill caps identifies ponding/settling on the surface or erosion of the cap and drainage, will these repairs to the cap or drainage around the landfills be considered under the Emergency Repairs CLIN as opposed to “maintenance”? If these tasks are required as “maintenance” under the Firm Fixed Price CLIN, then this forces bidders to build in risk in order to provide a cost for the import and placement (difficulty of access to the site, site characteristics including whether fill is placed on flat ground or sloped surface, unknown number and type of equipment required for placement such as dozers, rollers, skid steers…including mobilization, etc…) of unknown quantities of material. The cost of this task is also highly dependent on weather and the existing quality of construction of the landfill caps.
What does the government consider “maintenance” of landfills?

Procurement Plan, PWS 1.6.19
Small Business Subcontracting Plan/Management Plan, PWS 1.6.20
Section 7.2 DELIVERABLES SCHEDULE - ATTACHMENT 2/TECHNICAL EXHIBIT 2, 1st and 3rd item on the Schedule, identified that a Procurement Plan and a Small Business Subcontracting Plan/Management Plan are due with the proposal, referencing Sections 1.6.19 and 1.6.20 of the PWS, respectively. However, Sections 1.6.19 and
1.6.20 are not in the PWS dated 3/8/2023. It appears that the procurement plan requirement is discussed in Section 1.6.12. There is no discussion as to the requirements of the Subcontractor Plan due with the proposal. In addition, these documents are not called out in the requirement in the Instruction to Bidders Section L.
Are these documents required as part of the proposal submission? If so, where should they be in the submission?

The Compliance plans in the two RCRA permits for the site requires that the various landfills and closed units be inspected for erosion and ponding, and that the landfills/closed units be maintained in such a manner that there is positive drainage off the cap. Due to the unpredictability of landfill subsidence (both area and depth), we recommend repairs to the OBR Landfill, ODA, WISL, and G-Pond caps be considered under the Emergency CLIN.
Can the scope of work for cap repairs to the OBR Landfill, ODA, WISL, and G-Ponds be moved to the Emergency CLIN?
Government Answer:
Paragraph 5.5.3 of the PWS was updated to state, “Emergency repairs to the landfills’ caps shall be reported to the COR and, if approved, executed under the Emergency
