1.
Section L& M
Can you clarify a possible discrepancy in Sections L and M of the Fort Polk Job Order Contract RFP?

Section L states: “Key personnel at a minimum consist of the Program Manager, Superintendent, and Quality Control Manager.

”Section M (Evaluation Criteria) lists the qualification requirements and states: “The key personnel positions and acceptable qualifications/certifications and experience shall include: … Project Manager (PM), … (Superintendent, … Quality Control Manager…” It’s very important to know the exact intent of this staffing requirement. Could you please clarify whether the terms should actually be the same, and if so – which exact position is required?

See Amendment 0002 which revises Sections L & M.

2.
Sections F and I
Section F Deliveries of Performance

CLAUSES INCORPORATED BY FULL TEXT

52-211-12 LIQUIDATED DAMAGES-CONSTRUCTION (SEP 2000) (a) reads “If the Contractor fails to complete the work within the time specified in the Applicable Job Order, the contractor shall pay liquidated damages to the Government in the amount determined at the individual Job Order Level for each calendar day of delay until the work is completed or accepted.”

Section I – Contract Clauses

CLAUSES INCORPORATED BY REFERENCE

52-211-12 LIQUIDATED DAMAGES-CONSTRUCTION (SEP 2000) (a) reads “If the Contractor fails to complete the work within the time specified in the Contract, the Contractor shall pay liquidated damages to the Government in the amount of $558.00 for each calendar day of delay until the work is completed or accepted.”

Can you please clarify, which clause will be applicable for this Contract?

See Amendment 0002 which deleted FAR 52-211-12 LIQUIDATED DAMAGES-CONSTRUCTION (SEP 2000) (a) reads “If the Contractor fails to complete the work within the time specified in the Contract, the Contractor shall pay liquidated damages to the Government in the amount of $558.00 for each calendar day of delay until the work is completed or accepted.”

3.
Section L and M
In review of the Solicitation we could find no reference to Past Performance Questionnaires. Will Past Performance Questionnaires be required?

No Past Performance questionaries’ are required.

4.
Tab D: Responsibility Statement
1) Can you please clarify the “Latest Financial Statement”. What are the things that are required at a minimum?(for example: balance sheet, profit & loss, taxes)

2) Are financial statements required to be complied/reviewed/audited by a certified public accountant?

3) Would bank statements and/or letter from bank to verify the financial resources suffice this requirement?

1) See FAR 9.104-1, The Contract must have adequate financial resources to perform the contract or ability to obtain the required resources. Balance sheet, income statement, cash flow statement are some examples.

2) No, financial statements are not required to be complied/reviewed/audited by a certified public accountant.

3) See response to question one above

5.

Please advise if W9124E-16-R-0002 is a new requirement or if there is an incumbent. If existing, who is the incumbent and what is the current contract value and contract number?

This is not a new requirement. Incumbent is Keiland Construction, LLC, Contract W91247-15-D-0005, $14,997,945.00

6.

Can please help us to know if there are available electronic copies of plans and specifications, and to whom we need to contact to send a request for these documents.

All plans will be provided at the issuance of each task order

7.
L.3.2. Proposal Preparation Instructions.

Section L.3.2 of the RFP states that the format for Volumes I and II are “MS Word 2010 or earlier” and the Number of Copies is “1 Electronic Copy

Most of Volume I contains forms such as the signed SF1442, completed Reps & Certs, submittal letter, etc. It seems this file would have to be provided as a PDF. Can you advise whether we should indeed provide that volume as a PDF?

See Amendment 0002 which clarifies, Section L Proposal Preparation Instructions.

8.
L.3.2. Proposal Preparation Instructions.
It appears you do not want a printed submittal at all since there is no mention of “Original plus X number of copies.” Can you please confirm our understanding that you want to receive each volume on its own separate CD only; that is, no printed material?
See Amendment 0002 which clarifies Section L Proposal Preparation Instructions.
9.
L.3.2. Proposal Preparation Instructions.
For security purposes, most electronic documents are submitted as a PDF. Will you consider allowing this proposal to be submitted in PDF format?
See Amendment 0002 which clarifies Section L Proposal Preparation Instructions.
10.
L.3.2. Proposal Preparation Instructions.
Has a contractor performed similar work to this for the government in the past?

If available, please provide the incumbent contract number.

If you are unable to provide a contract number, is it safe to assume this is a new requirement for the government?
