L.3.3. Proposal Content.

a. Volume I – RFP Documents. Part I must be clearly marked “VOLUME I - RFP DOCUMENTS, RFP W9124E-16-R-0002.” Offerors are required to submit a completed SF 1442 (including acknowledgment of Amendments), Section K, Transmittal Summary Letter, Exceptions/Assumptions, Financial Statements, and Offer Bond. Failure to follow the below RFP Document Proposal preparation instructions may cause your proposal to be determined unacceptable by the Government. The RFP Documents Volume shall be organized as follows and contain the identified information.

(1) TAB A - SF 1442. The SF 1442 shall be submitted fully completed. The offeror is cautioned that the

SF 1442 shall contain an original signature in block 30B of the form. Acknowledgment of amendments can be made on the face of the SF 1442 in block 19 or signed copies of the amendments can be included in this Section.

(2) TAB B - Section K (Representation, Certifications, and Other Statements of Offerors). The offeror shall ensure that Section K is submitted with all blocks in each certification/representation completed truthfully and completely.

(3) TAB C - Transmittal Summary Letter. A summary cover letter to the proposal shall provide the following: (1) the name, title and telephone number of the company/division point of contact, who is authorized to make decisions with respect to the proposal and obligate the company contractually, (2) Identify those individuals authorized to negotiate with the Government, (3) A list of the proposal package contents, and (4) A listing of subcontractors and/or teaming partners that the offeror historically uses when involved in contracts of this type or magnitude.

(4) TAB D – Responsibility Statement. The Offeror shall submit a statement of their responsibility and its latest financial statements, in accordance with FAR 9.104-1. This will be used in the Government’s determination of responsibility for the Offeror.

(5) TAB E - Proper Offer Guarantee (offer bond). The offeror shall submit a bid guarantee in accordance with FAR 52.228-1. The bid guarantee amount shall be at least 20% of the bid price but not exceed $3 million.

(6) TAB F – Organizational Conflict of Interest (OCI) Mitigation Plan (if applicable). Offerors shall submit a Mitigation Plan, if required, to satisfy the requirements of FAR 9.5 “Organizational and Consultant Conflicts of Interest”. Potential OCI conflicts that may exist include Unequal Access to Information, Biased Ground Rules, and Impaired Objectivity. The OCI Mitigation Plan shall include a description of the actual or potential OCI, a description of the action that the responder has taken or proposes to take to avoid, mitigate, or neutralize the conflict, and any other relevant information that would assist the Contracting Officer in determining whether the Mitigation Plan is in fact acceptable or unacceptable.

The Contracting Officer will review any mitigation plans submitted in response to this Request for

Proposal before the proposal is evaluated or considered for award. The Contracting Officer will determine whether there is an OCI issue based on the information submitted and if the mitigation plan resolved any OCI concerns. If the Contracting Officer determines that there is an OCI issue and that it cannot be mitigated, the Contracting Officer will inform the Offeror that the proposal will not be evaluated or considered for award. The Contracting Officer and Offeror must resolve any OCI issues prior to the evaluation and consideration for award.

Legibility, clarity and coherence are very important. Responses will be evaluated against the factors defined in Section M, Evaluation Factors for Award.

The proposal should not simply rephrase or restate the Government's requirements, but rather shall provide convincing rationale to address how the offeror intends to meet these requirements. Statements that the offeror understands, can, or will comply with the SOW (including referenced publications, technical data, etc.); statements paraphrasing the SOW or parts thereof (including applicable publications, technical data, etc.); and phrases such as “standard procedures will be employed” or “well known techniques will be used,” etc., will be considered

W91247-15-R-0004 unacceptable. Offerors shall assume that the Government has no prior knowledge of their facilities and experience.

The Government will base its evaluation on the information presented in the offeror's proposal. Elaborate brochures or documentation, binding, detailed art work, or other embellishments are unnecessary and are not desired.

(2) The Mission Capability Volume shall, at a minimum, be prepared in a form consistent with the SOW and the evaluation criteria for award set forth in Section M of this solicitation. The section shall be prepared in an orderly format and in sufficient detail to enable the Government to make a thorough evaluation of the contractor’s technical competence, and ability to comply with the contract job requirements specified in the SOW. The offeror shall address as specifically as possible the actual methodology to be used for accomplishing the SOW requirements. The volume shall include a table of contents, a list of table(s) and drawings (if applicable), and cross reference matrix (if applicable).

(3) The offeror shall provide the following:

(a) TAB A, Table of Contents

(b) TAB B, Glossary of Abbreviations and Acronyms

(c) TAB C, List of Tables and Drawings and/or cross reference matrix (if applicable)

(d) TAB D, Element 1: Bonding Capacity. Information showing minimum available bonding capacity of

$15M aggregate ($5M per year) with verification from the Securities or Bonding Company. The information shall include how long the Surety Company has provided bonding for the Contractor and the bonding limit for a single project, aggregate amount, and current available bonding.

(e) TAB E, Element 2: JOC Program Management Plan: For this element the offeror shall submit a

Management Plan for successful execution of the contract. The management plan shall include, at a minimum, the following:

(f) TAB E, Element 2: JOC Program Management Plan: For this element the offeror shall submit a

Management Plan for successful execution of the contract. The management plan shall include, at a minimum, the following:

(i) The Management Plan will detail how the Offeror will manage and maintain a comprehensive subcontractor base. The plan must also address the offeror’s capability to recruit and retain qualified, licensed, certified, and trained subcontractors throughout the duration of the contract.

(ii) The Management Plan will detail how the Offeror will manage and maintain an “in-house” workforce, to perform the required percentage of in-house work in accordance with SOW 2.4.3. The plan must also address the Offeror’s capability to recruit and retain a qualified, licensed, certified and trained workforce throughout the duration of the contract.

(iii) The offeror shall demonstrate their understanding of and ability to manage multiple and concurrent task orders, and their ability to ramp-up for typical end of fiscal year workload and deadlines.

(g) TAB F, Element 3: Quality Control Plan. The Offeror shall provide their quality control which meets the requirements stated in SOW 2.6.3. Quality Control Plan.

2.4.1. – 2.4.1.3.

c. Volume III – Price Proposal (Coefficients). Part III must be clearly marked “VOLUME III – PRICE

PROPOSAL, RFP W9124E-16-R-0002.”

(1) TAB A, ID/IQ Price Proposal: Price proposal shall consist of Schedule B plus all costs included in development of the coefficients. Schedule B shall be submitted fully completed and error free. It shall contain the offeror’s prices (coefficients) for the established format in Schedule B. Coefficient means a numerical factor that represents costs (generally indirect costs) not considered to be included in the UPB prices. The coefficients are proposed as a percentage (in decimal format) increase or decrease to the UPB prices. For example, a coefficient of

1.2 would result in an additional 20 percent to the listed unit price; 0.9 would result in a 10 percent decrease of the listed prices, and 1.00 would leave the unit price as the proposed unit price. The offeror shall limit the Coefficients to two decimal places. The offeror shall propose Base Year and Option Year Coefficients. All components of price shall be included in the offeror’s coefficient, and shall be fully supported as no allowance for omitted cost will be made later. The offeror’s Coefficients shall be all inclusive and shall include, but not be limited to, the following costs:

General and Administrative and other Overhead Profit and risk Bond premiums Social security contributions Insurance Costs Employee Payroll Taxes Insurance and Fringe Benefits Subcontractors’ Overhead and Profit Business Taxes, contributions, and memberships Mobilization and demobilization costs Site cleanup Labor adjustments between the Gordian Unit Price Book given labor rates and the current Davis/Bacon

SECTION M - EVALUATION FACTORS FOR AWARD

EVALUATION FACTORS FOR AWARD

EVALUATION FACTORS FOR AWARD

M.1. Basis for Contract Award.

a. The source selection shall be conducted via a Lowest Price Technically Acceptable (LPTA) approach in accordance with Federal Acquisition Regulation (FAR) 15.3, Source Selection, as supplemented by the Defense Federal Acquisition Regulation Supplement (DFARS), and the Army Federal Acquisition Regulation Supplement (AFARS). The government will award the contract to the LPTA offeror who is deemed responsible. For a proposal to be determined “Technically Acceptable” and receive consideration for award based upon low price submitted, the proposal must receive a rating of “Acceptable” for the mission capability factor. Failure to meet the criteria will render the proposal to be technically unacceptable and will not be considered for award.

b. Preliminary Screening. The contracting officer, or designated individual(s) will conduct a preliminary screening to determine if the proposal(s) have complied with the data submission prerequisites of Sections A, B, K and L. Failure to submit the required information may result in elimination of the proposal for award consideration.

c. The Government will evaluate responses strictly in accordance with this solicitation and will not assume that performance will include areas not specified in the Contractor's submission.

M.2. Award. The Government intends to award a single contract as a result of this solicitation. Offers received for less than the stated number of coefficients listed in the Schedule B will be considered ineligible for award. As set forth in FAR 52.215-1 (f)(4), the Government intends to evaluate proposals and award a contract without discussions with offerors (except clarifications as described in FAR 15.306(a), Clarifications and award without discussions). Therefore, the offeror’s initial proposal shall contain the offeror’s best terms from a price and technical standpoint. The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary. In the event that discussions are held, a competitive range determination will be made.

M.2.1. Evaluation Criteria. The Government will use the criteria set forth below in the evaluation and selection of offers for award. Each offeror must submit a proposal that completely addresses all of the requirements listed in Section L of the RFP and must demonstrate how each requirement will be satisfied. Cursory responses or responses which merely reiterate or reformulate Section L, the SOW or technical specifications, or the solicitation will not be considered “Acceptable” as satisfying the requirements of the RFP or as demonstrating the ability to perform the jobs outlined in the solicitation.

a. Factor 1 – Mission Capability. The Government technical evaluation team will evaluate the technical proposals on an acceptable/unacceptable basis, assigning ratings of Acceptable or Unacceptable (defined below).

The Government will evaluate offeror’s methods and approach to meeting the (1) Bonding Capacity, (2) JOC Program Management Approach, (3) Quality Control Procedures and (4) Staffing Approach, to determine Technical Acceptability. The offeror’s technical proposal will receive one (1) of the adjectival ratings defined below.

ADJECTIVAL

RATING

DEFINITION

Acceptable Proposal clearly meets the minimum requirements of the solicitation.

Unacceptable Proposal does not clearly meet the minimum requirements of the solicitation.

To be considered technically acceptable, offerors must demonstrate the capability to provide the elements set forth below as required by the solicitation. Technical Acceptability will be based on the following:

(1) Element 1: Bonding Capacity. To be considered technically acceptable, the offeror’s bonding capacity shall show that the offeror has the capability to obtain from a Securities or Bonding Company a minimum available bonding capacity of $15M aggregate ($5M per year).

(2) Element 2: JOC Program Management Approach. To be considered technically acceptable, the JOC Program Management Approach must meet the following:

(a) The Management Plan demonstrates that the Offeror can successfully manage and maintain a comprehensive subcontractor base. The plan illustrated that the offeror is capable of recruiting and retaining qualified, licensed, certified, and trained subcontractors throughout the duration of the contract.

(b) The Management Plan demonstrates the offeror can successfully manage and maintain an “in-house” workforce, to perform the required percentage of in-house work as defined in the SOW 2.4.3. The plan illustrated that the offeror is capable of recruiting and retaining a qualified, licensed, certified, and trained workforce throughout the duration of the contract.

(c) The offeror’s Management Plan demonstrates the offeror’s understanding of and ability to manage multiple and concurrent task orders, and their ability to ramp up for typical end of fiscal year workload and deadlines.

(3) Element 3: Quality Control Plan – The offeror’s quality control plan meets the requirements stated in SOW 2.6.3. Quality Control Plan.

(4) Element 4: Staffing Approach. The Offeror provided an organization chart which listed key personnel and adequate in-house staff as defined in the SOW 2.4.3 Attachment 3. The narrative provided illustrated that the key personnel meet the required knowledge, skills, and experience listed at SOW 2.4.1 – 2.4.1.3.

b. Factor 2 – Price (Coefficients). Price will not be scored or rated. The price analysis techniques and procedures described under FAR Part 15.404-1(b) will be the primary means of assessing whether the price submission is reasonable, complete and balanced. The Government will evaluate all offers for award purposes by multiplying the offered coefficients by $5M for each year (three year total) to determine the offered price of each offeror.

Additionally, as part of price evaluation, the Government will evaluate its option to extend services (see FAR Clause 52.217-8) by adding one-half of the Offeror's final option period price to the Offeror's total price. Thus, the Offeror's total price for the purpose of evaluation will include the base period, 1st option, 2nd option, and 1/2 of the 2nd option. Offerors are not required to enter a price for the six-month period. Evaluation of options shall not obligate the Government to exercise the option(s).

Also, the Government may determine that an offer is unacceptable if the prices are significantly unbalanced, as defined under FAR 15.404-1 (g).

Definitions:

Completeness/Accuracy: The Offeror’s proposal is in compliance with the Price Volume instructions is mathematically accurate.”

Reasonableness: A price is reasonable if, in its nature and amount, it does not exceed that which would be incurred by a prudent person in the conduct of competitive business.

Unbalanced: Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one or more contract line items is significantly over or understated as indicated by the application of price analysis techniques.
