3. In accordance with the requirements in Specification Section 01310, “CPM”, furnish a Submittal Schedule fixing the respective dates for the delivery of all submittals, the beginning of manufacture, testing and installation of materials, suppliers and equipment. This schedule will indicated those that are critical to the progress schedule.
4. Do not begin any of the Work covered by a submittal that has been returned for correction until a revision or correction thereof has been reviewed and approved.
5. Deliver all submittals sufficiently in advance of construction requirements to provide no less than twenty (20) working days for checking and appropriate action.
6. Be responsible for, and bear all cost of damages, which may result from the ordering of any material, or from proceeding with any part of Work, before the review of the necessary submittals.
7. All submittals produced by subcontractors will be sent to Contractor for preliminary checking. Contractor will verify measurements, size of members, materials and details to verify conformance with the intent of the Contract
Documents. Submittals found to be inaccurate or otherwise in error, will be returned to subcontractors for correction before submission to the MICC.
Contractor will be responsible for their submission at the proper time to prevent delays in delivery of materials.
3 Section 01300- Submittals
8. Prepare and transmit each submittal sufficiently in advance of performing the related Work, or within the time specified in the individual Work Sections of the Specifications. Submittals will be delivered so that the Work will not be delayed by processing times including disapproval and resubmittal (if required), coordination with other submittals, testing, purchasing, fabrication, delivery and similar sequenced activities. No extension of time will be authorized due to failure to transmit submittals sufficiently in advance of the Work.
D. Review of Submittals:
1. The review of submittals will cover only general conformity to the Contract
Documents. Contractor remains responsible for details and accuracy, for coordinating the Work with other associated work and trades, for selecting fabrication processes, for techniques of assembly and for performing work in a safe manner.
2. Review of submittals will be general, and will not be construed to:
a. Permit any departure from the Contract Documents.
b. Relieve Contractor of responsibility for any errors, including details, dimensions, quantities, and details of the material, equipment, device, or item shown.
3. If submittals describe variations and show a departure from the Contract
Requirements, which are determined to be in the interest of the Government and to be so minor as not to involve a modification in the Contract Price or
Contract Time, the Submittals may be returned to Contractor without noting an exception.
4. Submittals will be annotated by ESD Project Manager in one of the following ways:
APP Approved No exceptions are taken
AAN Approved as Noted Minor corrections are noted and will be made

4 Section 01300- Submittals
5. Resubmittals will be handled in the same manner as the first submittals. On resubmittals, Contractor will direct specific attention, in writing, or on resubmitted Shop Drawings, to revisions other than the corrections requested on previous submissions. Any such revisions, not clearly identified, will be made at the risk of Contractor. Contractor will make any corrections required.
6. If the Contractor considers ant correction indicated on the submittal to constitute a change to the Drawings, Specifications, or Scope of Work, Contractor will give written notice.
7. A submittal/resubmittal/confirmation will be reviewed a maximum of three
(3) times, after which the cost of review will be borne by the Contractor. The cost of review will be equal to the costs to the Government, which is $217/day or $27.13/hr. This cost will be related in a deductive modification to the
Contractor.
8. Contractor will carry out the construction in accordance with approved submittals.
9. No partial submittals will be reviewed. ESD Project Manager will return all incomplete submittals to MICC, who will return the submittals to Contractor, and they will not be reviewed until resubmitted.
PART 3 – EXECUTION (Not applicable)
End of Section- 01300
1 Section 01310- CPM Schedules
SECTION 01310- CPM SCHEDULES
A. Work Included:
1. This Section specifies requirements and procedures in preparing and updating construction schedules and reports for planning, coordinating, executing, and monitoring the progress of the Work. The construction work will be scheduled using the Critical Path Method (CPM) of network analysis.
B. Form of Schedules:
1. Prepare schedules in the form of critical path method (CPM), as described herein:
a. Provide separate CPM networks (Sub-networks) of activities for each process or facility.
b. Each sub-network will be assigned a code and separate activity numbering series.
c. Interrelationships between sub-networks and any individual activities will be identified.
C. Scheduling Responsibility:
1. The Critical Path Method type construction schedule will be used to monitor job progress and as a means to make monthly payments to Contractor.
Contractor will be responsible for providing all information concerning the sequencing, logic and durations of all activities as well as providing the initial logic network diagram. Once the schedule is accepted, Contractor will be responsible for providing monthly update information on logic, percent complete, actual start and finish dates and duration changes. Contractor will be required to produce the computerized printout of the schedule updates. Copies of the updated schedule will be distributed at the progress meetings.
2. From Contractor’s initial schedule and from information received at the monthly schedule update meetings, computerized and dated tabular schedule reports, or updated network diagrams, or bar charts will be produced by Contractor which will be reviewed by Contractor and ESD Project Manager for accuracy and integrity. It will at all times remain Contractor’s responsibility to schedule and direct his forces in a manner that will allow for the completion of the Work within the contractual period.
3. It should be clearly understood that the initial schedule and all update information must be provided by Contractor and that this information is a representation of the best efforts of Contractor and his subcontractors as to how they envision the work to be accomplished. Similarly, all progress information to be provided by and through Contractor must be an accurate representation of his subcontractors or suppliers actual performance. The schedule will at all times remain an accurate reflection of Contractor’s actual or projected sequencing of Work.
2 Section 01310- CPM Schedules
Section 01310- CPM Cont.
Once accepted, adherence to the established CPM schedule will be obligatory upon Contractor and his subcontractors for the Work under this Contract. ESD Inspector may require Contractor to revise the schedule if, in his judgement, the schedule does not accurately reflect that actual execution of the Work, or is in violation of any provision of the CPM scheduling specification. Contractor will revise the schedule as often as is necessary during the course of performance of the Work without additional cost to the Government.
D. Progress of the work:
1. The Work will be started on the date indicated in the Notice to Proceed and will be executed with such progress as may be required to prevent delay to other Contractors or to the general completion of the Project. The work will be executed at such times and in or on such parts of the Project, and with such forces, material and equipment, as to assure completion of the Work in the time established by the Contract. Additionally, Contractor will, at times, schedule and direct his Work so that it provides an orderly progression of the Work to completion within the specified Contract Time.
2. Contractor agrees that whenever it becomes apparent from the current monthly CPM Schedule update that delays to the critical path have occurred, and these delays are through no fault of the Government, or Government’s representatives, and hence, that the Contract completion date will not be met, or when so directed by Government, he will take some or all of the following actions at no cost to Government:
a. Increase construction manpower in such quantities and crafts as will substantially eliminate the backlog of Work.
b. Increase the number of working hours per shift; shifts per working day, or days per week; the amount of construction equipment; etc., or any combination of the foregoing to substantially eliminate the backlog of Work.
c. Schedule activities to achieve maximum practical concurrence of accomplishment of activities, and comply with the revised schedule.
d. Contractor will submit for review a written statement of the steps ne intends to take, to remove or arrest the delay to the schedule.
PART 2 – CPM CONSTRUCTION SCHEDULE
A. Network Requirements:
1. The network diagram will show the order and interdependence of activities and the sequence in which the Work is to be accomplished as planned by Contractor.
The basic concept of the network analysis diagram is to show how the start of a given activity is dependent on the completion of preceding activities and its completion restricts the start of succeeding activities. A time scaled precedence format will be followed. The detailed network diagram will be time scaled showing a continuous flow from left to right.
3 Section 01310- CPM Schedules
2. The Schedule Activities will be developed into four major groups:
a. Procurement Activities (as applicable).
1. Permits
2. Easements
3. Submittal Items
4. Approval of Submittal Items
5. Fabrication and Delivery (F&D) of Submittal Items
b. Each of the following procurement activities should be tied logically to the correct construction activity in the overall CPM construction schedule.
1. Permit Activities
2. Easement Activities
3. F&D Activities
c. Construction Activities: Construction activities will be physical work activities that describe how the job will be constructed.
d. Testing, Startup, Training, and Closeout: CPM activities for this group will include all work required to satisfy appropriate specification sections and meet the requirements of Substantial and Final Completion.
3. Contractor will break the work into activity duration of one to twenty (1to20) working days each, except for non-construction activities (such as procurement of materials and delivery of equipment) and other activities that may require longer durations. To the extent feasible, activities related to a specific physical area of the Project should be grouped on the network for ease of understanding and simplification. The selection and number of activities will be subject to the review and agreement of Contractor and ESD.
4. Each activity on the network indicated will have the following:
a. A single duration, no longer than 20 days (i.e., the single best estimate of the expected elapsed time, considering the scope of work involved in the activity) expressed in working days. Normal holidays and weather delays will be included. One critical path will be shown for the schedule.
b. An activity identification number will be assigned to each activity. The identification number will be in a format acceptable to ESD.
c. A brief description of the activity will be included. If this description is not definitive, a separate listing of each activity and a descriptive narrative may be required.
d. Each activity will be loaded to include the total estimated budget of the activity.
e. Each activity (except for procurement activities) will be man-hour loaded with the estimated man-hors to be expended on each day.
5. The CPM schedule will include a weather calendar that contains non-working days in addition to weekend and holidays to account for anticipated inclement weather days. The number of anticipated inclement weather days per month will be based on average weather fir the immediate area. The weather calendar will be applied to all activities, which may be affected by inclement weather.
4 Section 01310- CPM Schedules
6. Failure to include in the CPM schedule any element of the Work required under the performance of this Contract will not excuse Contractor from completing all the Work required within the applicable completion time, notwithstanding Government’s network review.
7. A CPM schedule with shows a completion of any portion of the Work prior to the Contractual completion date may be accepted but in no event will be acceptable as a basis for a claim for delay against Government by Contractor.
The period time between the Contractor’s baselines accepted CPM schedule’s projected completion dates and the contractual stipulated completion, of any, will be treated as Project Float.
B. Schedule of Values:
1. Each activity on the construction schedule will be assigned a dollar value. Each activity’s assigned cost will consist of labor, equipment, and materials costs, and a pro rata contribution of overhead and profit. The sum of activities costs will be equal to the Total Contract Price. In submitting cost data, each activity represents Contractor’s estimate of the actual costs of performing that activity.
2. The accepted schedule of values will represent a fair, reasonable and equitable dollar cost allocated for each activity on Contractor’s construction schedule.
3. If it is determined that the cost data does not meet the requirements for a balanced bid breakdown in the opinion of ESD, Contractor will present documentation substantiating the cost allocation. Cost allocations will be considered unbalanced if activity on the construction schedule has been assigned a disproportionate allocation of direct costs, overhead and profit.
PART 3 – SCHEDULE SUBMITTALS
A. CPM Schedule Implementation:
1. Within ten (10) calendar days after the Notice to Proceed, Contractor will submit six (6) prints of his proposed CPM network diagram and tabular reports for the first ninety (90) calendar days of the Work. This initial logic diagram will be drawn as described herein and submitted on sheets 24 inches by 36 inches and will include both procurement and construction activities. The schedule will be the subject of the schedule review meeting with the Contractor, Government, Government’s representatives, within two (2) weeks of its submission. Contractor will revise and resubmit the ninety (90) day schedule until it is acceptable.
2. Within thirty (30) days after Notice to Proceed, Contractor will submit six (6) prints of his proposed CPM network diagram and tabular reports for the entire Contract duration and will include both procurement and construction activities.
These tabular reports will be sorted by total float and activity number. They will also contain a predecessor/successor resource loading report, and project calendar. This logic diagram will be drawn as described herein and will be the subject of a schedule review meeting with Contractor, Government, and Government’s representatives with two (2) weeks of its submission.
5 Section 01310- CPM Schedules
3. In lieu of submitting network diagrams and report, Contractor may submit
Primavera schedules on discs.
4. If a review of the submitting network diagrams a work plan which will not complete the Work within the time requirements stated in the Contract, it will be the responsibility of Contractor to revise the CPM schedule as required and resubmit it until it is acceptable.
5. Acceptance of the schedule will not constitute a representation by Government that the Work can be completed as shown on the schedule.
B. Submittals:
1. In addition to the above scheduling requirements, Contractor will be required to submit a complete and detailed listing of anticipated submittals during the course of the Contract. Contractor will coordinate his submittals with those of his subcontractors and suppliers and will identify each submittal as specified.
The anticipated submission due date for each submittal must be indicated along with the data on which its return is anticipated. For planning purposes, shop drawings submittals will usually be returned twenty (20) working days after receipt. However, longer durations for review will not be considered a basis for a claim unless the Project critical path is delayed thereby. Durations shown for review will be understood to share available float.
