ORDERING PROCESS FOR TASK ORDERS:
Authority to Place Task Orders: The US Army Corps of Engineers-Sacramento District, Contracting Divsion will administer the awarded Job Order Contract, to the extent delegated to the Administrative Contracting Officer.
As indicated in the Army Supplement to the Federal Acquisition Regulation (AFARS), each task order under a Job Order Contract becomes its own stand-alone negotiated task order contract. Work ordered under this contract will follow the process articulated below:
1. The Contracting Officer, or authorized representative, will notify the contractor of a requirement. Such notification can be issued in writing, and will be accompanied by a requirements package (general scope of work or outcome objective, the estimated performance period, and all relevant documentation to support the project (e.g., drawings as-built, special provisions above and beyond the basic technical specifications)). A date/time for a joint site visit will be established as far in advance as possible for the Contractor to review the requirements package and be prepared to ask questions and contribute to the final scoping requirements.
2. The Contractor will review the requirements package, determine what special skills or construction trades will be needed for the project, and bring potential subcontractors to the site visit. Subsequent access to the job site will be granted, as needed, for measurements and verification of existing site conditions prior to final preparation of the task order proposal.
3. Generally, the Contractor will be given 10 calendar days to submit a fully detailed line item proposal derived from RSMeans (the Unit Price Book). The Contracting Officer may require more immediate response in emergency situations affecting life, health, or safety of Soldiers, and/or Government property, and generally shorter response times will be enforced during the fourth quarter of the fiscal year.
4. Upon submission, the Contractor shall provide a cover sheet on company letterhead containing the contract number, the Government Project Number, a total task order price, any assumptions or exceptions the Contractor makes in preparing the lump sum price, and a signed statement that “The attached proposal considers all information provided in the preliminary requirements package provided by the Contracting Officer. The attached line item proposal has been prepared in accordance with the terms and conditions of subject contract, and pricing provided has been reviewed for accuracy and currency to the best of my knowledge”. The designated Contract Manager, or other individual delegated authority to commit the Contractor, shall sign the statement.
5. Attached to the Cover Sheet is the detailed price proposal derived from line items in the Unit Price Book. Each priced line item will be identified by Division of Work and Line Item Number from RSMeans, quantity of each line item, unit price and extended price. Each line item shall have a note regarding how it will be used in the execution of the task order. Unit prices will include the installing contractor’s overhead and profit. The appropriate coefficient will be applied to the total line item cost, resulting in a single lump sum price for the task order.
6. Included in each task order proposal will be a list of all proposed subcontractors, and a preliminary progress schedule supporting the time needed to complete the work.
7. Task order proposals will be delivered to the Contracting Officer via encrypted email, or by hand delivery to the Contracting Officer.
8. Upon delivery, task order proposals will be reviewed by the Contracting Officer, and provided to the technical evaluation team for comment. The Government will notify the Contractor of a date/time when negotiations will be conducted. During negotiations, the Contractor shall record minutes of the proceedings and supply a copy of the minutes to the Contracting Officer with its final revised proposal.
9. The issuance of the final negotiated task order will constitute the Government’s Official Notice to Proceed with the work as negotiated, and the Contractor’s final revised proposal will be incorporated into the task order by reference. At the point of issuance of the task order, the price is the final negotiated firm fixed-price. No adjustments in price will be made based on mistakes made during proposal development. Price adjustments to task orders are generally limited to Government ordered suspensions, differing site conditions, and authorized changes in scope, and conditions occurring that delay progress that are not within the Contractor’s ability to control (FAR 52.249-10).
10. The Government will deliver the task order to the Contractor within three business days of final approval. The task order package will include a disk containing final revised construction plans and drawings, incorporating all recorded changes resulting from Requests for Information, clarification and negotiations.
11. Upon arrival, the Contractor shall immediately review the task order and disk for accuracy and concurrence of negotiated prices, terms and conditions, and special requirements. If, after three calendar days, the Contractor does not identify any anomalies in the task order, it will be assumed that the task order is accurate and complete for execution.
The process outlined above is not all inclusive. The Contractor shall be held responsible for considering all terms and conditions in the contract, as well as Division 1, General Requirements, when preparing task order proposals.
Unauthorized Work: The Contracting Officer is the sole authority for changes to the contract, and any task order awarded under the contract. While authorized individuals may be named to represent the Contracting Officer at site visits or negotiations, no individual other than the Contracting Officer can sign contractual documents, task orders, or modifications changing the scope, price, or performance period of the task order. The Contractor, performing work under this contract at the direction of anyone other than the Contracting Officer, does so at its own risk, with no obligation on the part of the Government to reimburse for that work.
AWARD OF CONTRACT AND NOTICE TO PROCEED (NTP):
Generally, a 30-day mobilization period will be authorized at the beginning of the period of performance to allow for pre-construction responsibilities such as the submission of Quality Control Plan, Health/Safety Plan and other required forms and reports as specified in the Technical Exhibit B, Division 1 General Requirements.

Standard Forms 25 and 25A are available at https://www.gsa.gov/portal/forms/type/SF. No billable work shall commence under any issued task order until after the contractor receives the NTP.

DOCUMENTATION TO SUPPORT SUBCONTRACT AWARDS:
Within 10 business days after the award of any subcontract, the contractor shall deliver a completed SF Form 1413 (Statement and Acknowledgment) to the Contracting Officer. Each subcontract shall contain, as a minimum, the Contract Number, Task Order Number (if applicable), and Title. The subcontract must clearly identify what the subcontractor will be performing in relation to other trades on the job. All subcontracts shall contain the anticipated period of performance that correlates with the approved Progress Schedule for that Division of work. A sample format shall be submitted for Contracting Officer approval prior to commencement of work under this contract.
PUBLIC RELEASE OF INFORMATION:
Contractor and subcontractor personnel shall not publicly (or privately) discuss or release information, photographs, or other documents concerning any aspects of the materials or services relating to this contract or its task orders without the express written approval of the Contracting Officer.
RELATIONSHIP BETWEEN GOVERNMENT, CONTRACTOR, AND CONTRACTOR PERSONNEL:

Further, the contractor is not the Government's agent.
The Government will not exercise any supervision or control over contractor personnel performing services under this contract. Contractor personnel shall not become an integrated part of the Government organization in connection with performance under this contract.
