1.5 PARTNERING

To most effectively accomplish this Contract, the Government requires the formation of a cohesive partnership within the Project Team whose members are from the Government Construction Team, the Contractor and their Subcontractors. Key personnel from the Government Construction team, Construction Subject Matter Experts, the Contractor and Subcontractors, will be invited to participate in the Partnering process. The Partnership will draw on the strength of each organization in an effort to achieve a project that is without any safety mishaps, conforms to the Contract, and stays within budget and on schedule. Small projects should have an Issue Resolution Matrix at a minimum. As project increase in size/complexity, the partnering processes will expand accordingly.

1.5.1 Informal Partnering

The Contracting Officer will organize the Partnering Sessions with key personnel of the project team, including Contractor personnel and Government personnel. The Initial Partnering session will be a part of the Pre-Construction Meeting. Partnering sessions will be held at a location agreed to by the Contracting Officer and the Contractor. The Initial Informal Partnering Session will be conducted and facilitated using electronic media (a video and accompanying forms) provided by the Contracting Officer. The Partners will determine the frequency of the follow-on sessions, at no more than three to six month intervals.

Informal Partnering is led by Resident Engineer personnel at the Pre-Construction Conference.

1.6 UTILITIES

It is anticipated that pole lines, signs, pipelines and private improvements that would interfere with or are to be replaced by new construction will be removed to new locations by the owners (or by the State of California or its agents) in advance of construction operations.

Notify the Contracting Officer at least 30 calendar days in advance of the date on which work will be started requiring the removal of such utilities or private improvements. Care must be taken to preserve and protect any such improvements from injury or damage during construction operations.

SECTION 01 00 00 Page 3

Assume full responsibility for reimbursing the owners for any damage to their properties, utilities, or improvements, or interference with their services caused through construction operations. Should such damage be found to have been caused without the Contractor's fault or negligence an equitable adjustment in the amount due under the Contract will be made under the applicable CONTRACT CLAUSES. If unplanned utilities are discovered during construction the Contractor must notify the Contracting Officer.

The Contractor shall coordinate with utility owners and the Contracting Officer for utilities identified to be protected in place on the Plans.

Contact information for utility owners are shown on the Plans.

1.7 PLANNED UTILITY OUTAGES AND STREET CLOSURES

Power outages must be restricted to off-duty hours and weekends. Other utilities may be connected and streets closed during normal working hours with the outage duration and street closure as short as possible. All outages and street closures must be scheduled as far in advance as possible with the Contracting Officer and in no case less than 7 days before the outage or closure.

1.8 TIME EXTENSIONS FOR UNUSUALLY SEVERE WEATHER

This provision specifies the procedure for the determination of time extensions for unusually severe weather. In order for the Contracting Officer to award a time extension under this clause, the following conditions must be satisfied:

a. The weather experienced at the project site during the Contract period must be found to be unusually severe, that is, more severe than the adverse weather anticipated for the project location during any given month.

b. The unusually severe weather must actually cause a delay to the completion of the project. The delay must be beyond the control and without the fault or negligence of the Contractor.

The following schedule of monthly anticipated adverse weather delays is based on National Oceanic and Atmospheric Administration (NOAA) or similar data for the project location and will constitute the base line for monthly weather time evaluations. The Contractor's progress schedule must reflect these anticipated adverse weather delays in all weather-dependent activities.

MONTHLY ANTICIPATED ADVERSE WEATHER DELAY

WORK DAYS BASED ON (5) DAY WORK WEEK

JAN FEB MAR APR MAY JUN JUL AUG SEP OCT NOV DEC

8 7 7 3 2 0 0 0 1 2 5 8

Upon execution of the Notice to Proceed (NTP) and continuing throughout the Contract, the Contractor will record on the daily CQC report, the occurrence of adverse weather and resultant impact to normally scheduled work. Actual adverse weather delay days must prevent work on critical activities for 50 percent or more of the Contractor's scheduled work day.

SECTION 01 00 00 Page 4

Refer to ER 415-1-15 .

1.9 BID ITEM OVERRUN

Throughout the Contract (at a minimum, every two weeks), monitor placement or installation of unit price items (if any) with respect to the original estimated quantities shown in the Contract. If placement or installation indicates a possible overrun with respect to the original estimated quantities shown in the Contract, immediately provide written notification to the Contracting Officer with revised total estimated quantities.

1.10 WARRANTY OF CONSTRUCTION

a. Performance Bond.

(1) It is understood that the Contractor's Performance Bond will remain effective throughout the life of all warranties and warranty extensions.

(2) In the event the Contractor or his designated representative fails to commence and diligently pursue any work required under the Warranty of Construction Section of the Technical Provisions within a reasonable time after receipt of written notification pursuant to the requirements thereof, the Contracting Officer must have a right to demand that said work be performed under the Performance Bond by making written notice on the surety. If the surety fails or refuses to perform the obligation it assumed under the Performance Bond, the Contracting Officer must have the work performed by others, and after completion of the work, must make demand for reimbursement of any or all expenses incurred by the Government while performing the work, including, but not limited to administrative expenses.

(3) Warranty repair work which arises to threaten the health or safety of personnel, the physical safety of property or equipment, or which impairs operations, habitability of living spaces, etc., will be handled by the Contractor on an immediate basis as directed verbally by the Contracting Officer or his authorized representative. Written verification will follow verbal instructions. Failure of the Contractor to respond as verbally directed will be cause for the Contracting Officer or his authorized representative to have the warranty repair work performed by others and to proceed against the Contractor as outlined in the paragraph b. above.

1.11 NON CONTRACT WORK

Do not perform any work or erect any structure for third parties, landowners or otherwise, within the limits of construction shown on the Plans without prior approval of the Contracting Officer.

1.12 DAMAGE TO ROADS

Preserve and protect all existing private or private project access or right-of-way roads. At the completion of work and prior to the Contractor leaving the project, he must restore to pre-project conditions all such roads. Repairs must include replacement of base rock and/or surface treatment as required. Refer also to paragraph PROTECTION OF TRAFFIC in Section 01 50 00 TEMPORARY CONSTRUCTION FACILITIES AND CONTROLS.

Haul roads and ramps which cross any creek or drainage channel shall be constructed and maintained by the Contractor so as to not flood either upstream areas by restricting stream flows or flood downstream areas by the release of any stored water in the event that the crossing fails for any cause. Haul roads, working surfaces, and ramps constructed during the contract duration shall be removed after work is completed and the impacted area restored to its preconstruction conditions. All costs associated with these haul roads and ramps shall be considered as a subsidiary obligation of the Contractor. The Contractor shall have access to the landside levee toe for hauling of materials and equipment provided all work is coordinated with the Contracting Officer.

SECTION 31 00 00 Page 7

1.5.5 Excavations

The Contractor shall submit a written Excavation Plan a minimum of 20 days prior to the beginning of any excavation work. This plan shall be reviewed and approved by the Contracting Officer prior to starting any excavation work. The plan shall be modified as required to meet field, river stage, and flood/weather season conditions, and the modifications shall be reviewed prior to use. As a minimum, the plan shall include the following:

a. Proposed methods for preventing interference with, or damage to, existing underground and overhead utility lines, trees designated to remain, and other existing improvements or natural features designated to remain within or adjacent to the construction right-of-way.

b. The proposed methods for controlling surface water and groundwater in the excavations.

c. Stockpiling and blending plan for embankment material showing locations, stockpile heights, slopes, limits, and drainage around the stockpile areas.

d. Methods and equipment to be used in the removal of existing concrete lining in drainage channel within footprint of setback levee embankment.

f. The Contractor's proposed sequence of work for excavating with plan and cross- sectional views showing starting and final work locations and clearing, grubbing and stripping limits.

g. The Contractor's proposed road pattern and plan for implementing dust control measures.

1.5.6 Slides and Foundation Failures

The Contractor shall repair any sliding that occurs in any part of the existing embankment and backfills prescribed in this section prior to final acceptance of the work. When the slide is caused through the fault of the Contractor, the repair shall be made at no cost to the Government.

The Contracting Officer shall be the sole judge of whether a slide or foundation failure is caused through a fault of the Contractor. The Contractor shall submit a plan detailing how the repair will be completed.

The plan shall be reviewed and approved by the Contracting Officer prior to the start of repair work. When the slide is not the fault of the Contractor, an extension of the unit prices for excavation and embankment shall be made to cover the cost of the repairs.

1.5.7 Drainage Requirements

The Contractor shall not block or restrict the flow in a natural drain, existing culvert, ditch or channel at any time without obtaining prior written approval. This approval shall not relieve the Contractor from responsibility for any damage caused by his operation. The Contractor shall monitor the channel flow and provide sufficient free discharge areas so that conditions are not worsened upstream or downstream by possible floods during construction. Surface water shall be directed away from excavations and construction sites so as to prevent erosion and

SECTION 31 00 00 Page 8 undermining of foundations. Diversion ditches, dikes, and grading shall be provided and maintained as necessary during construction. Excavated slopes and backfill surfaces shall be protected to prevent erosion and sloughing.

Excavation shall be performed so that the site and the area immediately surrounding the site and affecting operations at the site shall be continually and effectively drained. If private property is to be used for drainage, the Contractor shall submit written evidence that the right has been obtained from the property owner for drainage on his property. After construction, natural drains, existing culverts, ditches and channels affected by construction shall be restored to their preconstruction condition.

1.5.8 Stockpile of Excavated Soils

Excavated soils not used for construction of the setback levee and berm shall be stockpiled within the locations shown on the Plans. Stockpile Area 1S shall be filled to the dimensions shown on the Plans prior to the use of the stockpile within Staging Area 2. The dimensions for the stockpiles shown on the Plans are approximate and final dimensions will depend on the amount of excavated material that does not meet and cannot be blended to meet the requirements for Levee Fill below.

No ground disturbance shall be allowed within Stockpile Area 1S. The stipulation of no ground disturbance is herein defined as no alteration to the existing ground surface through clearing and grubbing or leveling.

Removal of vegetation through mowing would be allowed. The Contractor shall place a layer of geotextile as shown on the Plans and in accordance with Section 31 05 19 GEOTEXTILE before the placement of fill. The Contractor shall submit a Material Stockpile Plan a minimum of 20 days prior to excavation of the existing levee. The Plan shall outline the equipment to be used for placement of stockpiled soils and the methods to be used to provide stability of the stockpile slopes. The removal of the stockpiled material shall also adhere to no ground disturbance. The material can be mechanically removed to within 4 to 6 inches of the fabric, then removal of material must be by hand to ensure that no ground disturbance occurs.

1.5.9 Utilities

Movement of construction machinery and equipment over or near utilities (including underground and overhead utilities) during construction shall be at the Contractor's risk and shall adhere to the requirements of EM 385-1-1 and any other applicable utility agency requirements. Utility lines damaged during construction shall be immediately reported to the Contracting Officer and repaired at the Contractor's expense. Contractor shall obtain a current USA clearance for excavation area of project.

1.5.10 Protection of Existing Man-Made Facilities and Natural Features

Embankment excavation and fill/backfilling shall be conducted in such a manner as to avoid damage to trees outside the excavation areas, existing buildings, man-made facilities and natural features, with due regard to the safety of employees and others.

PART 2 PRODUCTS

2.1 MATERIALS

A least 30 days prior to delivery of any offsite borrow material to the

SECTION 31 00 00 Page 9 site, submit soil test results for embankment and backfill materials for review and approval by the Contracting Officer. Contractor shall provide sufficient testing to show that proposed borrow areas have an adequate quantity of satisfactory soils to meet the requirements for the materials purpose.

Project fills shall be constructed of suitable earth materials as defined in paragraph 1.2 DEFINITIONS and as required below in paragraph 2.2 TYPES OF FILL MATERIALS and obtained from project excavations or the borrow site(s). The Contractor shall prioritize the reuse of project excavations to construct the setback levee and berm. Materials shall be screened of oversize material and blended as needed to obtain a blended material suitable for construction meeting the fill requirements outlined in these Specifications. Materials shall be screened, blended and tested for suitability at the borrow site, at staging/stockpile areas, or at other designated areas approved by the Contracting Officer. The test results and suitability of fill material shall be reviewed and approved by the Contracting Officer prior to placement. Soil classification tests shall be completed for all blended material in accordance with ASTM D2487.

If a disagreement between the Contractor and Contracting Officer occurs over the suitability of fill materials, the Contractor shall perform laboratory testing as directed by the Contracting Officer to demonstrate compliance with the Specifications at no additional cost to the Government. This testing shall comply with paragraph 3.8 FIELD QUALITY CONTROL. The failure of the Contractor to perform this testing shall not relieve the Contractor from the obligation to provide suitable materials.

2.2 TYPES OF FILL MATERIALS

2.2.1 Levee Fill

Levee Fill material shall be obtained from project excavations and from Contractor-provided borrow site(s) and shall meet the following requirements:

GRADATION ASTM TEST PROCEDURE

Si eve Si ze Per cent Passi ng

2-inch 100 ASTM D6913

No. 200 >= 35 <= 75

ASTM D1140

Liquid Limit <= 45 ASTM D4318 (wet preparation method)

Plasticity >= 10 and <= 30 ASTM D4318(wet preparation method)

2.2.2 Top Soil

Materials for top soil shall be free of stones, lumps, and roots larger than 1 inch and shall not contain debris, herbicides, insecticides or other pesticides, salts, or other chemical compounds toxic to plant growth, aquatic flora and fauna or humans. Materials generated from

SECTION 31 00 00 Page 10 stripping operations shall be reused as Top Soil.

2.3 IMPORTED FILL

Imported Fill must meet the requirements of Paragraph 2.3.1 CHEMICAL TESTING REQUIREMENTS FOR OFFSITE SOILS. All testing data for imported fill must be submitted no later than 30 calendar days after execution of the

NTP.

2.3.1 General Chemical Testing Requirements

Offsite soils must be chemically tested prior to being considered as fill material onsite. Submit a work plan to the Contracting Officer for approval in accordance with Paragraph 2.3.2 BORROW SITE SOIL SAMPLING WORK PLAN. Conduct the sampling activities according to the approved plan. The sample results must then be compared against the "Imported Fill Chemical Screening Limits" values attached to this specification.

The Contractor is responsible for ensuring that the testing is performed and the results are submitted as part of the Borrow Area Chemical Suitability Report. The Borrow Area Chemical Suitability Report must meet the requirements outlined in paragraph titled Borrow Area Chemical Suitability Certification Report. Material from a borrow area can be brought onsite only after the Contracting Officer has provided approval confirming that the material meets the soil screening criteria.

2.3.2 Borrow Site Soil Sampling Work Plan

Within 14 days after the NTP and at least 30 days prior to the sampling activities at any borrow site, a plan including, but not limited to, the number of samples, sample methods and analysis, sample procedures, laboratory who is performing the analysis, and quality control and quality assurances, is to be provided to the Contracting Officer for approval. The Contractor must not collect any samples at the borrow site before the Government's approval. The work plan must be certified by California-licensed professional engineer or geologist.

2.3.3 Sample Collection

The soil samples must be collected from evenly distributed locations across the borrow site so that the analytical results are as close as possible to being representative of each overall site. Samples must be preserved, transported and analyzed in accordance with EPA SW-846.3-3. The discrete soil samples from the borrow site must normally be composited into one sample by the analytical laboratory for analyses; individual site conditions, however, may also dictate that the discrete samples be analyzed separately. Sample collection locations should be noted in the field and recorded in latitude-longitude and/or California State Plane coordinate formats.

2.3.4 Chemical Testing

All borrow site soil must undergo a solids analysis for undesirable constituents. The soil constituent concentrations must then be compared against the values in the attached "Imported Fill Chemical Screening Limits". In the event any of those limits are exceeded, perform testing to determine the potential soluble concentration of the constituent(s). All analysis must be performed at a facility that is ELAP/NELAP certified for the methods used.

SECTION 31 00 00 Page 11

2.3.5 Soluable Constituent Testing

Soluble constituent testing must only be required in the event that the constituent concentration was above the Maximum Concentration for Solids Analysis value provided in the "Imported Fill Chemical Screening Limits".

The soluble analyses must be conducted using the Waste Extraction Test procedure (WET) to generate an extractant that can be tested. Analysis on the extractant must include ONLY the constituents listed as having a Soluble Threshold Limit Concentration (STLC) in the attached "Imported Fill Chemical Screening Limits".

2.3.6 Potential Contaminants of Concern and Screening Criteria

Due to the growing concern over the suitability of borrow material, increased testing requirements have been initiated. The soil must be tested for total concentrations of screening constituents. Attached to this specification is a list of constituents, "Imported Fill Chemical Screening Limits" that are to be included in the analysis. The tested borrow site soil is to be compared against the Maximum Concentration for Solids Analysis in mg/kg. In the event that the concentration of a constituent is above the 'Maximum Concentration for Solids Analysis as indicated hereafter, then the soluble extractible levels of that constituent must be analyzed. To perform the soluble testing, the soil must undergo a Waste Extraction Test (WET) and the extractant must be tested and compared against the Soluble Threshold Limit Concentration (STLC) value(s). In the event that the screening limits are exceeded (or there is no STLC value to compare against), the Contractor can choose to determine natural background concentrations of the constituent(s) in the region of the project site. This background level can be determined through composite testing of the new placement site. If the background value is found higher than limits provided, the Contractor can use the information as justification of potentially exceeding the limit(s). This justification must be submitted to the Contracting Officer for review and final determination of acceptability will be provided to the Contractor.

2.3.7 Sampling Cost

All costs associated with the chemical sampling shall be coordinated and paid for by the Contractor.

2.3.8 Borrow Area Chemical Suitability Certification Report

A report detailing the chemical testing performed and confirming the chemical suitability of the borrow site is to be provided to the Contracting Officer within 45 calendar days after sample collection and at least 30 days prior to the first scheduled date for importing borrow material. The report must include, but is not limited to the following:

all chemical testing results with a section describing how the results compare to the screening limits, a map of sample locations with GPS coordinates, a brief summary of sampling activities, sample composite details, and any other pertinent information. This report must be certified by a California-licensed professional engineer or geologist.

The report must include all laboratory chemical results and outlined in this specification. The results must be compared against the values provided in the attached, "Imported Fill Chemical Screening Limits".

In addition to the chemical result comparison, additional location

SECTION 31 00 00 Page 12 information (e.g. soil history, date of sampling, etc.) and commercial contact information (e.g. company name, laboratory used for testing, etc.)

must be provided in the report. Material from a borrow area can be brought onsite only after the Contracting Officer has provided approval to the report. It is the Contractor's responsibility to allow ample time for the Contracting Officer to review and approve the report and avoid any project delays.

PART 3 EXECUTION

3.1 TOLERANCES

All embankments (prior to placement of aggregate surfacing or topsoil) and backfills shall be constructed to the grades, lines, and cross-sections shown on the Plans. Levee adn berm final lines and grades shall be within plus or minus 0.1 ft of the required design lines and grades shown on the Plans before spreading the topsoil layer and prior to placing aggregate base. This tolerance will be allowed provided that any excess material is so distributed that the crown and slopes of the levee drain and that there are no abrupt humps or depressions in any surfaces.

A tolerance of 0.2 feet above or below the prescribed grade will be allowed for finished surfaces outside the levee embankment provided that the surface drains away from the levee and berm in the direction indicated on the Plans with no abrupt humps or depressions.

3.2 PREPARATION OF FOUNDATION, PARTIAL FILL SURFACES AND EMBANKMENTS

3.2.1 Foundation Preparation

After excavation, grubbing and stripping (as described in Section 31 11 00 CLEARING, GRUBBING, AND STRIPPING) of the embankment and foundation area to the extent indicated on the Plans or otherwise required, the sides of stump holes, test pits, and other similar cavities or depressions shall be broken down so as to flatten out the slopes to no steeper than 1H:1V, and the sides of the cut or hole shall be scarified to provide bond between the foundation material and the fill. Unless otherwise directed, each depression shall be filled with the same material type that is to be placed immediately above the foundation. The fill shall be benched or keyed, placed in layers, moisture conditioned, and compacted in accordance with the applicable provisions of these Specifications for the specific material type. Materials which cannot be compacted by roller equipment because of inadequate clearances shall be compacted with hand operated compactors in accordance with Paragraph 3.6 COMPACTION for the specific material type.

Prior to placement of levee fill in any section of the embankment, the foundation of such section shall be observed by the Contracting Officer's Representative and approved by the Contracting Officer before the surface is loosened thoroughly by discing or harrowing to a minimum depth of 6 inches, and moisture conditioned to the amount specified in Paragraph 3.5 MOISTURE…
