SUPPLEMENTARY INSTRUCTIONS
Supplementary Instructions - Please submit the following as part of your proposal:
A. Technical Proposal – consisting of Experience, Schedule and Past Performance.
B. Price Proposal – consisting of the items identified in Paragraph 3 of this section.
1. Technical Proposal
i) Experience – Each offeror shall submit at least three (3),but no more than five (5) written descriptions of example projects performed within the last six (6) years by the offeror, i.e. by the prime contractor and/or key subcontractor(s). Any joint venture or team of prime and key subcontractor(s) must include at least one project with the organizations working together as a team. Offeror shall demonstrate experience in the key elements listed below.
Offeror’s descriptions of example projects collectively shall demonstrate:
Experience and capability performing work of similar scope, magnitude and complexity as that which is the subject of this solicitation;
• Experience and capability to place at least fifty (50) tons of rip rap, or rock (cobbles or larger), in water or on a water resource project feature(s), such as levee, dam, channel, bank of water body, or habitat area;
• Experience and capability managing and performing water resource related work on a job of at least $1,000,000 in value.
Each written project example shall include a narrative with the following information:
• Project title and location
• Detailed description of the project and work performed
• Original contract award amount and final construction cost
• Original contract finish date and actual finish date
Formatting Limitations:
Each example project description shall not exceed three (3) pages (8.5 x 11 inches page size) including any images, graphics, charts and tables. If offeror submits more than three (3) pages for any example project description, the additional pages will not be evaluated. Start each example project on a new page.
An introduction overview, and/or summary of the offeror’s capabilities may also be included, of no more than two (2) additional pages beyond the example project descriptions. If offeror submits more than two (2) pages for the capabilities overview, the additional pages will not be evaluated.
Key Subcontractor Letters of Commitment and Authorization Letters.
Submit a letter of commitment and authorization from each proposed key subcontractor that provides authorization for the Government to discuss the key subcontractor’s past performance record with the offeror in conjunction with the Government’s evaluation of the offeror’s technical proposal. Each letter should be furnished on the business concern’s letterhead and signed by an authorized representative of the concern. There is not a page limitation for this submission.
Failure of a key subcontractor to provide authorization for the Government to discuss their past performance record with the offeror will not be considered a proposal deficiency. However, the Government will not be able to discuss in detail any key subcontractor past performance problems with the offeror, which could affect the Government’s rating of the proposal’s acceptability.
Any post award change to key subcontractor(s) and/or design from your technical proposal will require contracting officer approval.
ii) Schedule - Offeror’s technical proposal shall include a schedule for completing the required work to be contracted. The schedule shall show the contractor’s major pre-construction preparatory activities, physical construction activities, and post-construction activities. It should illustrate the offeror’s understanding of the required work and how the work will be accomplished in a logical progression.
The schedule shall be consistent with the Period of Performance statement (Attachment 2) and the following constraints:
• Use a NTP date of 30 July 2019 for evaluation purposes only
• In-water work under the contract shall not begin prior to August 1, 2019.
• In-water work must be completed by October 31, 2019
• Construction of bank protection must be completed by November 30, 2019; and
• The period of performance for the entire contract.
The presentation of the schedule shall include a network diagram that shows the order, duration, and interdependence of activities and clearly indicates the critical path. It shall also include a succinct narrative that explains the approach and logic of the proposed schedule. The narrative should identify important assumptions and explain any unusual or counter-intuitive aspects of the schedule, especially those related to task sequencing or critical path activity durations.
The schedule is limited to a Gantt chart of no more than two (2) pages in length (page size 11 x 17 inches).
The narrative is limited to at most two (2) pages (page size 8.5 x 11 inches).

The Past Performance Questionnaire (PPQ) is included in the solicitation as an Attachment and is provided for the offeror or its team members to submit to the client for each project the offeror includes in its proposal for Experience. Ensure correct phone numbers and email addresses are provided for the client point of contact. Completed PPQs should be submitted with your proposal. If the offeror is unable to obtain a completed PPQ from a client for a project (s) before proposal closing date, the offeror should complete and submit with the proposal the first page of the PPQ, which will provide contract and client information for the respective project(s).

Additionally, the offeror must also complete and return the “Representations, Certifications, and Other Statements of Offerors” included in Section 00 45 00 of the solicitation. If the offeror is a Joint Venture, all participants must separately complete annual representations and certifications and Section 00 45 00.
Tab 6 of the Price Proposal: Offer Guarantee.
All offerors must submit an Offer guarantee (e.g., Standard Form 24, Bid Bond) which complies with the requirements of FAR 28.101 Bid Guarantees, and any Defense and Army supplements thereto.
Tab 7 of the Price Proposal: Pre-Award Survey Information
a. The Contracting Officer is required to make an affirmative pre-award determination of the prospective contractor’s responsibility in accordance with the mandatory requirements of Part 9 of the Federal Acquisition Regulation (FAR) and its supplements. The Contracting Officer must have sufficient information available to determine that a prospective contractor meets these minimum standards. Therefore, the offeror is requested to provide the pre-award survey information described below with its price proposal:
(1) The completed Construction Contractor Data Form with Supplemental Schedules A-C (see Pre- Award Survey as an Attachment). If the offeror is a large multi-segmented business concerns, the data provided on the supplemental schedules may be limited to information that directly pertains to the specific segment of the business concern (e.g., the division, group, unit, etc.) proposed to perform work under the prospective contract with its own work force. If the offer is being submitted by a Joint Venture, submit a separate form for each Joint Venture participant. The offeror may submit pre-award survey information in another format, provided that the information furnished is substantially the same as that which would be furnished on the Construction Contractor Data Form and its supplemental schedules.
(2) Current financial statements. If the financial statement is more than 60 days old, submit a certificate stating that the firm's financial condition is substantially the same, or, if not the same, state the changes that have taken place. If a Joint Venture, provide this information for each participant in the Joint Venture.
(3) Banking information. Provide letters from banks or other financial institutions with which the contractor conducts business. The letters should contain information about your firm's accounts, loans, lines of credit, etc. The Government is interested in financial stability, timely payments, the length and nature of the relationship between the firm and the financial institution, and the firm's financial ability to perform the contract. The letters should also provide the name and telephone number of the bank representative the Government may contact. If a Joint Venture, provide this information for each Joint Venture participant.
b. The Government will treat the pre-award survey information submitted by the offeror as proprietary.
The pre-award survey will be provided in the solicitation as an Attachment.
SECTION 00 22 16 - SUPPLEMENTARY INSTRUCTIONS TO PROPOSERS
The following have been modified:
EVALUATION CRITERIA
TECHNICAL EVALUATION FACTORS
1. This is a “Best Value” Lowest Priced Technically Acceptable Request for Proposal acquisition for the Feather River (FHR) 1.0L Bank Protection Project, Sacramento, California. The Contracting Officer will award a firm fixed-price contract to the responsive and responsible offeror which the Source Selection Authority determines to have the lowest priced technically acceptable (LPTA) proposal that conforms to the solicitation, and is fair and reasonable. The Lowest Price Technically Acceptable (LPTA) source selection process is appropriate when best value is expected to result from selection of the technically acceptable proposal with the lowest evaluated price. Proposals are evaluated for technical acceptability but are not ranked using the non-cost/price factors as described in FAR 15.101-2. The Government intends to make award to the lowest priced technically acceptable proposal without conducting discussions , but reserves the right to conduct discussions if determined by the Source Selection Authority to be necessary [see FAR Part 15.306(a)].
The Government will first evaluate the technical proposal of the offeror whose price proposal is found to provide the lowest price. If the technical proposal of the lowest-priced offeror is determined to be technically acceptable, the Government will not evaluate any other proposals. But if the lowest priced proposal is determined not to be technically acceptable, then the next lowest priced offer will be evaluated for technical acceptability. This process will continue until the Government establishes the lowest-priced technically acceptable offer. The Government intends to enter into a contract with that contractor.
2. The Government evaluation board will review each of the three components of an offeror’s technical proposal and reach a consensus determination of “Acceptable” or “Unacceptable” for each component. The factors that will be evaluated for award are:
Factor Name 1 Experience
2 Schedule
3 Past Performance
Factors 1 – 2 are non-priced technical Factors and will be rated as technically acceptable or technically unacceptable. Past Performance will be rated in accordance with the evaluation criteria listed below in section 3.
Technical Acceptable/Unacceptable Ratings Adjectival Rating Description
Acceptable Proposal meets the requirements of the solicitation Unacceptable Proposal does not meet the requirements of the solicitation
Evaluation Criteria for Factor 1 – Experience:
Offeror has experience placing at least fifty (50) tons of rip rap, or rock (cobbles or larger), in water or on a water resource project feature(s), such as levee, dam, channel, bank of water body, or habitat area.
Offeror has experience managing and performing resource related work on a job of at least $1,000,000 in value.
Evaluation Criteria for Factor 2 – Schedule:
The Offeror’s schedule shows the major pre-construction preparatory activities, physical construction activities, and post-construction activities.
The schedule includes a network diagram that shows the order, duration, and interdependence of activities and clearly indicates the critical path.
Offeror’s schedule is consistent with the Period of Performance statement (Attachment 2) and the following constraints:
• A NTP date of 30 July 2019 for evaluation purposes only
• In-water work under the contract shall not begin prior to August 1, 2019.
• In-water work must be completed by October 31, 2019.
• Construction of bank protection must be completed by November 30, 2019; and
• Completion of all work within the period of performance for the entire contract.
Evaluation Criteria for Factor 3 - Past Performance:
The Government will review and evaluate past performance information included in the offeror(s) technical proposal using three criteria: recency, relevance, and quality (including general trends in contractor performance and source of information). These criteria are defined as follows:
Recency. The “Recency” criterion measures the number of months or years that have elapsed since substantial completion (no more than punch list items to be undertaken before project acceptance by the sponsor) of a past performance project submitted by the offeror. The more recent a past performance project, the greater weight government evaluators will assign to it.
Relevance. The “Relevance” criterion measures the degree to which a past performance project submitted by the offeror is similar in its nature and scope of work to the work sought under this solicitation. Projects that do not primarily involve one or more of the central elements of work set forth in this solicitation will be discarded as not relevant.
Quality. The quality criterion measures the overall success of the offeror’s performance of each past performance project submitted. Government evaluators will consider the degree of satisfaction expressed by project sponsors regarding the offeror’s performance of prior work and will consider sponsors’ comments about any construction problems that may have arisen, timeliness of project completions, and overall adequacy of the final result. Projects for which the sponsor expressed material dissatisfaction with the offeror’s quality of work will be found unsatisfactory.
Offerors are required to submit past performance questionnaires (see the PPQ attachment) and/or Contract Performance Assessment Reports (CPARs) to demonstrate the quality of performance for the recent and relevant example projects submitted in response to Factor 1 above. CPARs is preferable however if a CPARS is not available, a questionnaire must be submitted.
The past performance component of an offeror’s technical proposal will be rated either “Acceptable” or “Unacceptable” on the following basis:
Past Performance Acceptable/Unacceptable Rating Method Adjectival Rating Description Acceptable Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown.
Unacceptable Based on the offeror’s performance record, the Government does not have a reasonable expectation that the offeror will be able to successfully perform the required effort.
Overall Technical Evaluation:
If the technical proposal of the lowest-priced offeror receives an “acceptable” rating for each of the three components (Experience, Schedule, and Past Performance) the offer will be found technically acceptable and the government will indicate its intention to enter into a contract with that offeror.
If, on the other hand, the lowest-priced offeror receives a “Unacceptable” rating for one or more of the three components of its technical proposal, its offer will be set aside and the government will evaluate the next-lowest-priced offer. This process will continue until the Government identifies the lowest-priced technically acceptable offer.
For each factor the evaluators will provide a group consensus rating and text supporting that rating. The text supporting the rating will make reference to specific portions of the offeror's proposal (or mention that information is lacking from the proposal) and will flow from the evaluation criteria.
Although adequate price competition is anticipated, price analysis will be performed separately by the contract specialist/contracting officer. As necessary, realism, reasonableness and appropriateness of costs will be reviewed.
