1.8 UNITED STATES NOT A PARTY
a. No appropriated funds exist for the construction which is the subject
SECTION 01 00 00 Page 3 of this IFB. Article 1, Section 9, Clause 7, of the U.S. Constitution states: "No money shall be drawn from the Treasury, but in Consequence of Appropriations made by Law". 41 USC 11 states: No Contract on behalf of the United States shall be made, unless the same is authorized by law or under an appropriation adequate to its fulfillment-". 41 USC 12 states: "No contract shall be entered into for the erection, repair, or furnishing of any public building -- which shall bind the Government to pay a larger sum of money than the amount in the Treasury appropriated for the specific purpose."
b. Since no funds have been appropriated for the construction, it would be illegal for the United States of America to enter into a Contract for the construction.
c. In the event funds are insufficient to complete the project, the Contractor will have no obligation to continue work on the project.
This is the only exception to the last sentence of the disputes clause.
1.9 WARRANTY OF CONSTRUCTION
a. Performance Bond.
(1) It is understood that the Contractor's Performance Bond must remain effective throughout the life of all warranties and warranty extensions.
(2) In the event the Contractor or his designated representative fails to commence and diligently pursue any work required under the Warranty of Construction Section of the Technical Provisions within a reasonable time after receipt of written notification pursuant to the requirements thereof, the Contracting Officer must have a right to demand that said work be performed under the Performance Bond by making written notice on the surety. If the surety fails or refuses to perform the obligation it assumed under the Performance Bond, the Contracting Officer must have the work performed by others, and after completion of the work, must make demand for reimbursement of any or all expenses incurred by the Government while performing the work, including, but not limited to administrative expenses.
(3) Warranty repair work which arises to threaten the health or safety of personnel, the physical safety of property or equipment, or which impairs operations, habitability of living spaces, etc., must be handled by the Contractor on an immediate basis as directed verbally by the Contracting Officer or his authorized representative. Written verification must follow verbal instructions. Failure of the Contractor to respond as verbally directed will be cause for the Contracting Officer or his authorized representative to have the warranty repair work performed by others and to proceed against the Contractor as outlined in the paragraph b. above.
b. Pre-Warranty Conference. Prior to Contract completion and at a time designated by the Contracting Officer or his authorized representative, meet with the Contracting Officer to develop a mutual understanding with respect to the requirements of Paragraph titled WARRANTY OF CONSTRUCTION, of this specification. Communication procedures for Contractor notification of warranty defects, priorities with respect to the type of defect, reasonable time required for Contractor response, SECTION 01 00 00 Page 4 and other details deemed necessary by the Contracting Officer or his authorized representative for the execution of the construction warranty must be established/reviewed at this meeting.
In connection with these requirements and at the time of the Contractor's quality control completion inspection, the Contractor must furnish the name, telephone number and address of a licensed and bonded company which is authorized to initiate and pursue warranty work action on behalf of the Contractor. This single point of contact must be located within the local service area of the warranted construction, must be continuously available, and be responsive to Government inquiry on warranty work action and status. This requirement does not relieve the Contractor of any of his responsibilities in connection with Paragraph titled WARRANTY OF CONSTRUCTION.
c. Equipment Warranty Identification Tags. Provide warranty identification tags on all equipment installed under this Contract.
d. Contractor's Response to Warranty Service Requirements. The following warranty service requirements are applicable to this Contract.
Following notification by the Contracting Officer or the Contracting Officer's Representative, respond to a warranty service requirement identified by the Contracting Officer's Representative in accordance with the "Warranty Service Priority List" of this program. This list prioritizes warranty work into the categories:
First Priority 1A. Perform on site inspection to evaluate situation, determine course of action, initiate work within 24 hours and work continuously to completion or relief.
Second Priority 1B. Perform on site inspection to evaluate situation, determine course of action, initiate work within 48 hours and work continuously to completion of relief.
Third Priority. All other work to be initiated within 5 work days and work continuously to completion or relief.
The "Warranty Service Priority List" must be compiled by the Contractor and approved by the Contracting Officer.
Should parts be required to complete the work and the parts are not immediately available provide the Contracting Officer's Representative with firm written proposals for emergency alternatives and temporary repairs for Government participation within 12 hours after arrival at the job site, and provide emergency relief until the required parts are available on site for the Contractor to perform permanent warranty repair. Include a firm date and time that the required parts must be available on site to complete the permanent warranty repair. The Contracting Officer's Representative will evaluate the proposed alternatives and negotiate the alternative considered to be in the best interest of the Government to reduce the impact of the emergency condition. Alternatives considered by the Contracting Officer's Representative will include the alternative for the Contractor to "Do Nothing" while waiting until the required parts are available to perform permanent warranty repair. Negotiating a proposal which will require Government participation and the expenditure of Government funds must constitute a separate procurement action by the using service.
SECTION 01 00 00 Page 5
1.10 AFTER AWARD DOCUMENTS
Provide five hard copy sets of the Contract drawings and specifications to the Government. The hard copy drawings must be 1 set of ANSI D (22" x 34"), 4 sets of half size (11 x 17) and the specifications must be standard 8-1/2" x 11", 3-hole punched with posts. Provide these documents within 5 work days of the execution of the NTP from the Government.
The Government will provide an optical disc, without charge, containing the electronic CADD files and Portable Document Format (PDF) files of the plans and specifications to prepare stated five hard copy sets of awarded plans and specs, any Contract amendment submittals, as-built/as-constructed drawings and a submittal register data file in comma separated value (CSV) format.
1.11 AVAILABILITY OF CADD DRAWING FILES
After award, the electronic "Computer-Aided Drafting and Design (CADD)" drawing files will be made available to the Contractor for use in preparation of construction data related to the referenced Contract subject to the following terms and conditions.

Any other use or reuse must be at the sole risk of the Contractor and without liability or legal exposure to the Government. Make no claim and waives to the fullest extent permitted by law, any claim or cause of action of any nature against the Government, its agents or sub consultants that may arise out of or in connection with the use of these electronic files. To the fullest extent permitted by law, indemnify and hold the Government harmless against all damages, liabilities or costs, including reasonable attorney's fees and defense costs, arising out of or resulting from the use of these electronic files.
These electronic CADD drawing files are not construction documents.
Differences may exist between the CADD files and the corresponding construction documents. The Government makes no representation regarding the accuracy or completeness of the electronic CADD files, nor does it make representation to the compatibility of these files with the Contractors hardware or software. In the event that a conflict arises between the signed and sealed construction documents prepared by the Government and the furnished CADD files, the signed and sealed construction documents must govern. The Contractor is responsible for determining if any conflict exists. Use of these CADD files does not relieve the Contractor of duty to fully comply with the Contract documents, including and without limitation, the need to check, confirm and coordinate the work of all Contractors for the project.
If the Contractor uses, duplicates and/or modifies these electronic CADD files for use in producing construction drawings and data related to this Contract, all previous indicia of ownership (seals, logos, signatures, initials and dates) must be removed.

PART 3 EXECUTION
3.1 GENERAL REQUIREMENTS
Prepare for approval a Project Schedule,(PS) as specified herein, pursuant to the Contract Clause, SCHEDULE FOR CONSTRUCTION CONTRACTS. Show in the schedule the sequence in which the Contractor proposes to perform the work and dates on which the Contractor contemplates starting and completing all schedule activities. The scheduling of the entire project, including the
SECTION 01 32 01 Page 4 construction sequences, is required. The scheduling of construction is the responsibility of the Contractor. Contractor management personnel will actively participate in its development. Subcontractors and suppliers working on the project must also contribute in developing and maintaining an accurate Project Schedule. The schedule must be a forward planning as well as a project monitoring tool.
3.1.1 Approved Project Schedule
Use the approved Project Schedule to measure the progress of the work and to aid in evaluating time extensions. Make the schedule cost loaded and activity coded. The schedule will provide the basis for all progress payments. If the Contractor fails to submit any schedule within the time prescribed, the Contracting Officer may withhold approval of progress payments until the Contractor submits the required schedule.
3.1.2 Schedule Update Status Reports
Provide an updated schedule at the Weekly Progress Meeting as defined in this specification. The Government will use the NAS Project Schedule to evaluate the Contractor's progress for timely completion, plan for Quality Assurance verification of the work and evaluate the effects of a proposed modification on the Contract duration (critical path activities). If, in the opinion of the Contracting Officer, the Contractor falls behind the approved schedule, the Contractor must take steps necessary to improve its progress including those that may be required by the Contracting Officer, without additional cost to the Government. In this circumstance, the Contracting Officer may require the Contractor to increase the number of shifts, overtime operations, days of work, and to submit for approval any supplementary schedule or schedules as the Contracting Officer deems necessary to demonstrate how the approved rate of progress will be regained.
3.1.3 Default Terms
Failure of the Contractor to comply with the requirements of the Contracting Officer must be grounds for a determination by the Contracting Officer that the Contractor is not prosecuting the work with sufficient diligence to ensure completion within the time specified in the Contract.
Upon making this determination, the Contracting Officer may terminate the Contractor's right to proceed with the work, or any separable part of it, in accordance with the default terms of the Contract.
3.2 BASIS FOR PAYMENT AND COST LOADING
Use the schedule as the basis for determining Contract earnings during each update period and therefore the amount of each progress payment. Lack of an approved schedule update or qualified scheduling personnel will result in an inability of the Contracting Officer to evaluate Contract earned value for the purposes of payment. Failure of the Contractor to provide all required information will result in the disapproval of the preliminary, initial and subsequent schedule updates. In the event schedule revisions are directed by the Contracting Officer and those revisions have not been included in subsequent revisions or updates, the Contracting Officer may hold retainage up to the maximum allowed by Contract, each payment period, until such revisions to the Project Schedule have been made. Activity cost loading must be reasonable, as determined by the Contracting Officer. The aggregate value of all activities coded to a Contract CLINPricing Schedule Item must equal the value of the ItemCLIN on the Schedule.
SECTION 01 32 01 Page 5
3.3 PROJECT SCHEDULE DETAILED REQUIREMENTS
The computer software system utilized to produce and update the NAS Project Schedule must be capable of meeting all requirements of this specification. Failure of the Contractor to meet the requirements of this specification will result in the disapproval of the schedule. Scheduling software that meets the activity coding structure defined in the Standard Data Exchange Format (SDEF) in ER 1-1-11 are Primavera Project Planner (P6) by Primavera, and Open Plan by Deltek. The Contractor must provide to the Government a complete input listing for the selected software. Manual methods used to produce any required information must require prior approval by the Contracting Officer. The Contracting Officer intends to use P6.
3.3.1 Critical Path Method
Use the Critical Path Method (CPM) of network calculation to generate the Project Schedule. Prepare the Project Schedule using the Precedence Diagram Method (PDM). Present task durations in workdays.
3.3.2 Level of Detail Required
Develop the Project Schedule to an appropriate level of detail. Failure to develop the Project Schedule to an appropriate level of detail, as determined by the Contracting Officer, will result in its disapproval. The Contracting Officer will consider, but is not limited to, the following characteristics and requirements to determine appropriate level of detail:
3.3.2.1 Activity Durations
Reasonable activity durations are those that allow the progress of ongoing activities to be accurately determined between update periods. Less than 2 percent of all non-procurement activities must have Original Durations (OD) greater than 20 work days or 30 calendar days. Durations must be in workdays. Procurement activities are defined herein.
3.3.2.2 Procurement Activities
The PS must include activities associated with the submittal, approval, procurement, delivery of long lead materials, and equipment. Long lead procurement activities are those with an anticipated procurement sequence of over 30 calendar days. A typical procurement sequence includes the string of activities: submit, approve, procure, and deliver.
3.3.2.3 Mandatory Tasks
Include and properly schedule the following mandatory tasks:
a. Submission and approval of Accident Prevention Plan (APP)to include the appendix Injury and Illness Prevention Program (IIPP).

3.3.2.4 Government Activities
Show Government and other agency activities that could impact progress.
These activities include, but are not limited to: approvals, inspections, utility tie-in,and Notice to Proceed (NTP) for phasing requirements.
Government approval of shop drawings activities should be shown with the duration at least the minimum allowed by the Contract. The Contractor's failure to provide reasonable durations in its schedule for Government activities does not establish or change the Government's review or approval path periods and the durations established for Government's activities are subject to approval by the Contracting Officer.
Allow 10 calendar days total duration prior to current contract completion date for the following activities. Refer to specification Section 01 45 00 QUALITY CONTROL. Include and properly schedule the following critical tasks:

3.3.2.5 Activity Responsibility Coding (RESP)
Assign responsibility Code for all activities to the Prime Contractor, Subcontractor or Government agency responsible for performing the activity. Activities coded with a Government Responsibility code include, SECTION 01 32 01 Page 7 but are not limited to: Government approvals, Government design reviews, environmental permit approvals by State regulators, Government Furnished Equipment (GFE) and Notice to Proceed (NTP) for phasing requirements. Code all activities not coded with a Government Responsibility Code to the Prime Contractor or Subcontractor responsible to perform the work. Activities must not have more than one Responsibility Code. Examples of acceptable activity code values are: DOR (for the designer of record); ELEC (for the electrical subcontractor); MECH (for the mechanical subcontractor); and GOVT (for USACE). Unacceptable code values are abbreviations of the names of subcontractors.
3.3.2.6 Activity Work Area Coding
Assign Work Area code to activities based upon the work area in which the activity occurs. Define work areas based on resource constraints or space constraints that would preclude a resource, such as a particular trade or craft work crew, from working in more than one work area at a time due to restraints on resources or space.
