SCOPE OF WORK
SUBJECT: FY15 Pier 3 Repairs, Military Ocean Terminal Concord (MOTCO); Concord, California
1.0 INTRODUCTION:
Military Ocean Terminal Concord (formerly Concord Naval Weapons Station) is an active military installation located on the southern bank of the Sacramento River (Suisun Bay) and the north edge of the City of Concord, in Contra Costa County, California. The installation is divided (separated by Port Chicago Highway) into two primary areas; 1) the Inland Area (5,170 acres) and 2) the Tidal Area (7,630 acres). As part of the Base Alignment and Closure Act (1 October 2008) the southern portion of the Inland Area was transferred to the City of Concord while the Tidal Area was transferred from the Department of the Navy to the Department of the Army. The Tidal Area comprises the northern portion of the facility, which supports the receipt of munitions by either truck and/or rail; and then loaded (from two piers along the south bank of the Sacramento River) onto deep draft vessels for onward shipment. The land on the southern portion of the Tidal Area contains multiple transfer and storage pads, which are used for the transfer and/or short term storage of containerized munitions prior to their shipment. A significant portion of the Tidal Area is made up of wetlands while hills provide a natural backdrop to the south.
As a result of the Base Realignment and Closure Commission's decision to close Oakland Army Base in 1995, the 834th Transportation Battalion moved its operation to this facility in October 1997. As such, this facility became the Department of Army’s major ammunition transshipment port for the West Coast. The 834th is the sole operational tenant and caretaker of this California terminal. In addition to military munitions, the 834th is also responsible for coordinating the movement of Defense Transportation System surface cargo through Concord and four other strategic expansion ports along the West Coast.

After exercise of Option CLIN 1002 the Government shall provide the Contractor written notice to commence Move-Out Demobilization for each Move-Out Demobilization event, specifying the date on which Move-Out Demobilization must be completed. The Government shall give said notice as early as possible to accommodate the Contractor’s planning and orderly withdrawal, but in any case not less than forty five (45) calendar days prior to the date Move-Out Demobilization must be completed. The Contractor shall demobilize with reasonable promptness, removing all of its personnel and equipment from the Pier 3 work area and from any MOTCO storage yards and shall fully vacate the MOTCO facility on the specified date.
The Contractor shall remain off base until an “all clear” notice is given in writing by the Government directing the Contractor to return to work. For each demobilization the period of work suspension during which the Contractor must remain off base shall not exceed 25 calendar days after the date the Contractor fully vacates MOTCO, including the time required for the Contractor to remobilize to the job site. Upon receipt of the Government’s “all clear” notice to return to work the Contractor shall expeditiously remobilize personnel and equipment to the Pier 3 work areas and to any MOTCO storage areas previously utilized and shall promptly resume work.
The Contractor’s cost for each day of work suspension between move-out demobilization and remobilization shall be paid per Option CLIN 1003.
The Contractor shall consult the specifications contained in the Division 01 Specifications at Section 1.2.3, “Work Suspension – Move-out,” and related specifications.
2.2.3 CLIN 1003 - Work Suspension Period - Move out (other Costs) Out Suspension Costs
It is recognized that the Contractor will have other costs besides Demobilization and Remobilization for such things as labor, bonds, insurance, etc. For this CLIN, the estimate is 25 days.
While project work remains in suspension after the Contractor’s move-out demobilization from the MOTCO installation pursuant to the Government’s exercise of Option CLIN 1002, the Contractor will incur daily costs for labor, equipment, insurance, overhead, etc. applicable to the Pier 3 project. These work suspension costs will persist until the Government provides an “all clear” notice and directs the Contractor to remobilize and return to work. The allowable suspension of work period per Move-Out Demobilization and Remobilization sequence under Option CLIN 1002 shall not exceed 25 calendar days. Since the Government may require up to two Move-Out Demobilization and Remobilization sequences under CLIN 1002, the maximum number of work suspense days payable under CLIN 1003 is 50 calendar days.
The Government shall calculate the Contractor’s work suspension costs hereunder by multiplying the firm fixed price for each day of work suspension specified in Option CLIN 1003 by the number of days the Contractor is withheld by the Government from the MOTCO installation.
2.2.4 CLIN 1004 – Stand-by Demobilization and Remobilization (No Notification no advance notice)
The Contractor is advised that the Army’s on-going mission at MOTCO includes activities which could pose safety risks to third parties present at the installation or security risks to the Government when third parties are present. Accordingly, the Government may have to limit the Contractor’s access to the
Page 11 of 14 Amendment 0010 installation and limit or suspend construction work temporarily when performance of a particular MOTCO mission so requires Accordingly a Stand-By Demobilization and Remobilization could be required at any time during the period of contract performance to comply with safety protocols related to unforeseeable military or national security activity at MOTCO.

The Contractor shall also consult the specifications at paragraph 1.2.3, “Work Suspension – Standby.” And related specifications immediately thereafter, contained in the Division 01 Specifications of this contract.
Therefore the Contractor is hereby advised that the Government may have to exercise CLIN 1004, temporarily suspending project work at MOTCO and directing the Contractor’s personnel and equipment to vacate the Pier 3 work area one or two separate times during the period of contract performance. The Contractor would not be required to vacate the Lot E Staging Area and could stage equipment in Lot E during the stand-by work suspension period and would retain unrestricted access to Lot E.
Upon its exercise of Option CLIN 1004 the Government shall notify the Contractor in writing of the need to vacate the Pier 3 work area with as much lead time as the Government is able to provide under the circumstances, but the Contractor is hereby advised that the Government may itself have no advance warning of MOTCO operations requiring the exercise of this option.
On receipt of a written notice from the Government that the Pier 3 work area must be vacated under Option CLIN 1004 the Contractor shall promptly commence demobilization and withdrawal of its personnel and equipment from the Pier 3 work area. The Contractor shall be restricted from access to Pier 3 until an “all clear” notice is given in writing by the Government directing the Contractor to return to work. However the Contractor shall retain use of MOTCO Lot E for staging of equipment and shall have unrestricted access to Lot E during the temporary closure of Pier 3.
Once the Government issues the Contractor a written “all clear” notice to return to work the Contractor shall expeditiously remobilize personnel and equipment to the Pier 3 work areas and shall promptly resume work.
The Contractor shall consult the specifications contained in the Division 01 Specifications at Section 1.2.4, “Work Suspension – Stand-by,” and related specifications immediately thereafter.
The Contractor’s daily costs for each day or partial day of work suspension between stand-by demobilization and remobilization shall be paid under CLIN 1005; see below.
2.2.5 CLIN 1005 - Work Suspension Period - Stand-By Suspension Costs- Standby (Other Costs)
It is recognized that the Contractor will have other costs besides Demobilization and Remobilization
Page 12 of 14 Amendment 0010 for such things as labor, bonds, insurance, etc. For this CLIN, the estimate is 15 days While project work remains in suspension after the Contractor’s stand-by demobilization from the MOTCO installation pursuant to the Government’s exercise of Option CLIN 1004, the Contractor will incur daily costs for labor, equipment, insurance, overhead, etc. applicable to the Pier 3 repair project. These work suspension costs will persist until the Government provides an “all clear” notice and directs the Contractor to remobilize and return to work..
The allowable suspension of work period under Option CLIN 1004 may not exceed 15 calendar days between each demobilization and remobilization. Since the Government may require up to two Stand-By Demobilization and Remobilization sequences under CLIN 1004, the maximum number of work suspense days payable under CLIN 1005 is 30 calendar days.
The Government shall calculate the Contractor’s work suspension costs hereunder by multiplying the firm fixed price for each day of work suspension specified in Option CLIN 1005 by the number of days the Contractor is withheld by the Government from the Pier 3 work area.
2.2.6 CLIN 1006 - MEC Removal Blow-in-Place Action
