The right is reserved, as the interest of the Government may require, to revise or amend the specifications or drawings or both prior to and/or after the date set for receipt of proposals as necessary. Such amendments, if any, will be announced by an amendment or amendments to this Request for Proposal. All information relating to this RFP, including pertinent changes/amendments and information prior to the date set for receipt of proposals will be posted on the following website: http://www.fbo.gov

4.2. Offerors are strongly cautioned to check this site frequently and to “refresh” their web page to ensure they have the most current information.

5. HAND CARRIED PROPOSALS/INVITATIONS

5.1. A bid repository is provided for hand carried proposals and is located at Contracting Branch, USACE Detroit District, 7th Floor , 477 Michigan Avenue, Detroit, MI 48226. Hand carried proposals must be deposited in the repository prior to the time established for receipt of proposals. Fax proposal will not be accepted.

5.2. Offerors are cautioned that there is a security checkpoint and screening station at the entrance to the McNamara Federal Building. Delays are probable at the entry point and should be accommodated in the timing of any proposal delivery. Late receipt of proposals due to facility entry delays may not be deemed excusable and the Contracting Officer may declare the proposal late and remove it from consideration.

6. WAGE DETERMINATION

6.1. In accordance with FAR 22.407, minimum federal construction wage rate requirements are applicable to this project. See FAR Clause 52.222-6.

6.2. Applicable wage rates can be found at http://www.wdol.gov/wdol/scafiles/davisbacon/mi.html

7. SAFETY REQUIREMENTS

7.1. The successful contractor to this Request for Proposals will be required to comply with all pertinent provisions of the latest version of the U.S. Army Corps of Engineers Safety and Health Requirements Manual, EM 385-1-1, in effect on the date of the solicitation. EM 385-1-1 and its changes are available at http://www.usace.army.mil by selecting “Safety and Occupational Health” followed by “EM 385-1-1”. The Contractor must also comply with Occupational Safety and Health Act (OSHA) standards. OSHA standards are subject to change. It is the Contractor's responsibility to maintain familiarity with current OSHA standards.

8. PROPOSAL EXPENSES AND PRE-CONTRACT COSTS

9. REMOVAL OF SECTIONS AT TIME OF AWARD

9.1. Provisions and all exhibits will be physically removed from the contract document at the time of contract award, but will be deemed to be incorporated by reference in that award.

10. DISPOSITION OF UNSUCCESSFUL PROPOSALS

11. RESERVED.

12. EXCEPTIONS

12.1. If the offeror takes exception to any of the requirements specified in this solicitation, the offeror shall clearly identify each such exception and include a complete explanation of why the exception was taken and what benefit accrues to the Government. All exceptions to the solicitation requirements (Sections 00010 through 00800) and supporting rationale shall be included in an addendum to the proposal and clearly labeled "Exceptions". An addendum is only required if the offeror takes exception to any requirement in the solicitation.

(The Addendum does not have a page limitation, but shall only include information relevant to exceptions taken to the solicitation requirements.) The Government will assume an offeror takes no exceptions to any solicitation requirement if the offeror does not submit an Addendum identifying exceptions. Offerors are advised that solicitation requirements are not necessarily negotiable and such exceptions may render an Offeror’s proposal unacceptable and ineligible for award.

13. CLAUSES

13.1. Clauses and provisions from the Federal Acquisition Regulation (FAR) and supplements thereto are incorporated in this document by reference and in full text. Those incorporated by reference have the same force and effect as if they were given in full text.

13.2. Clauses and provisions in this document may not appear in consecutive order.

EVALUATION FACTORS

1. INSTRUCTIONS, CONDITIONS AND NOTICES TO OFFEROR

Project Description: The DLA Standby Generator Replacement project will improve the existing standby power system that supports DLA operations at the Hart-Dole-Inouye (HDI) Federal Center in Battle Creek, Michigan. The scope of work includes removing three existing generators, removing the existing paralleling switchgear, and removing and replacing feeders to various portions of the Federal Center. The project will provide two new generators, new paralleling switchgear, new feeders, new control infrastructure, and new remote monitoring points for the generator plant. New unit substations, switchboards, and electrical infrastructure will be provided in multiple locations within the Federal Center to provide separated distribution of Emergency power and Standby System power, in accordance with the National Electrical Code. New electrical distribution points will be provided in new fire-rated rooms with supporting infrastructure as necessary. The work of this project will extend standby power to locations identified by DLA, where standby power is necessary and does not currently exist.

Basis for Award: Award will be made to the responsible offeror, whose proposal is determined to be technically acceptable and offers the lowest aggregate amount for the project, including all options. A technically acceptable offer is one in which the offeror satisfies all evaluation factors and complies with the instructions contained in the Solicitation document and does not take exception, nor object, to any terms therein. To reiterate, in order for a proposal to be considered awardable, there must be an “acceptable” rating in every non-price factor/subfactor.

2.6 All pages should be numbered.

2.7 All page margins must be at least 1 inch wide, but may include headers and footers.

2.8 Number pages consecutively. There shall be no consideration of information incorporated by reference.

Proposal presentation shall be in a manner which allows it to “STAND ALONE” without need for evaluators to reference other documents.

The Contracting officer may remove any Offeror from further consideration during any phase of the procurement if the Offeror fails to meet the submittal requirements of the RFP. Proposals must contain sufficient detail to allow review and evaluation. Proposal clarity, organization, and cross-referencing are mandatory. Failure to submit an organized proposal may adversely affect an Offeror’s evaluation. Penalty for making false statements in proposals is prescribed in 18 U.S.C. 1001.

3. SELECTION PROCEDURES

Technical Evaluation: There will be an evaluation of technical proposals for conformance with the minimum RFP criteria to determine if the proposal is technically acceptable. While there is intent to keep the Offeror’s pre-award proposal effort to a minimum, proposals must provide adequate detail for evaluators to determine if the proposal is technically acceptable.

The SSEB’s duty is the assignment of a fair, unbiased technical rating for each proposal based solely on the merits of the proposal. Proposals that do not conform to requirements of the RFP or those that include stipulations or qualifying conditions unacceptable to the Government may be removed from further consideration. There will be no consideration of pricing data during the technical evaluation.

Offerors whose proposals are rated as “technically acceptable” will have their price proposals evaluated for fairness and reasonableness using price analysis.

4. DEBRIEFINGS

Post-award: In accordance with FAR 15.506, Unsuccessful Offerors may request a post-award debriefing within three (3) days after the date on which the Offeror received notification of contract award. There will be no point-by-point comparisons with other Offerors’ proposals and debriefings will not reveal any information that is not releasable under the Freedom of Information Act (FOIA).

5. TECHNICAL EVALUATION RATINGS

5.1 Factor 1 will be evaluated using the Ratings shown below. Technical proposals will be evaluated against the requirements of the RFP. Offeror’s must receive all “acceptable” ratings in order to be considered for award.

Technical Evaluation Ratings

Acceptable Proposal clearly meets the minimum requirements of the solicitation.

Unacceptable Proposal does not clearly meet the minimum requirements of the solicitation.

5.2 Factor 2 will be evaluated using the performance confidence assessments shown below. Offeror’s must receive all “acceptable” ratings in order to be considered for award.

Past Performance Evaluation Ratings

Acceptable Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown. (See note below.)

Unacceptable Based on the offeror’s performance record, the Government has no reasonable expectation that the offeror will be able to successfully perform the required effort.

Note: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a)(2)(iv)). Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.

6. TECHNICAL PROPOSAL CONTENTS AND FACTORS/SUBFACTORS

If necessary, a section entitled “Deviations.” This section is to include all deviations from the minimum

RFP requirements, and, in the event of the submittal of a Final Proposal Revision, all changes made to their original proposal. Such deviations must include specific explanations concerning their nature, as well as why the Offeror thinks that they are necessary or appropriate. Deviations are not necessarily substitutions and must not result in an Offeror’s proposal that does not meet minimum RFP criteria;

If necessary, a section entitled “Identification of Items Exceeding RFP Requirements.” This section must include a list including all items in excess of the minimum RFP requirements, and, if required to submit a Final Proposal Revision, all changes made to their original proposal that exceed RFP minimum requirements.
