QUESTIONS AND ANSWERS 2
RFI Response – W911SD-21-R-0054 Cadet Mess Attendant and Waiter Services
24 August 2021
RFI: W911SD-21-R-0054
1. I have read through the SOW and understand the size of the building as well as the amount of patrons to be served each day etc, but I am unclear what the expected number of Mess Hall Attendants would be for this proposal. My company has staffed this specialty before and seen requests for anywhere from 20-45 Mess Hall Attendants for this size serving line. Have I missed this in the RFP, or could you please provide me with a clearer understanding of the expectations?
Contractor shall supply all necessary personnel to meet the terms of contract.

QUESTIONS AND ANSWERS 2
RFI Response – W911SD-21-R-0054 Cadet Mess Attendant and Waiter Services
24 August 2021
RFI: W911SD-21-R-0054
Questions:
1. Is there an incumbent on this project?
Three Cities, LLC
2. If so, what is the contract number?
W911SD-19-C-00012
3. Can the government please confirm that it is does want the proposal sent via snail mail as well as copies of the proposal as digital copies in the forms of CDs?
Submit your proposal in accordance with 52.212-1(b) Instructions to Offerors – Commercial Items Addendum
4. Reference the Price Volume for Solicitation Number
W911SD21R0054:
We’re requesting the governments explain how they plan to calculate the cost of the phase-in in the overall contract price.
Will the price for Phase-In be excluded from the overall contract price?
Since the incumbent will not incur “transition costs”; including the phase-in cost will give them a price advantage over a new contractor.
Phase – In will be included into the overall contract. Please reference Item No 0001 of the SF1449 solicitation.
5. In the previous solicitation for the subject services, W911SD-19-R-
0004, the Service Contract Act FAR 52.222.41, was included. Is the Agency claiming an exception to the Service Contract Act in the current solicitation? If the Agency is claiming an exception, please state the exception. If no exception is being claimed, please state for the record that the Service Contract applies to this procurement.
There is no exception to the Service Contract act. Reference Clause 52.222-42.
6. Please allow a reasonable extension of the offer due date so that answers to questions can be incorporated in proposals.
At this time there will be no extension of the proposal due date.
7. We noted a conflict in the instructions to offerors and to Past Performance Questionnaire responses.
The Past Performance Questionnaire requests responders to provide contractor performance information for the past 3 years.
This is not consistent with proposal instructions which request offorer’s to provide relevant past performance within the past 5 years.
We request the government post an amendment to correct the Past Performance Questionnaire reference be updated to request for performance information during the past 5 years.
The past performance questionnaire does not request the responders to provide contractor performance information for the past 3 years.
The standard questionnaire provides an example of how to conduct “Telephone Interviews” for the performance assessment if applicable.
See the following excerpt from Attachment 4 of the Past Performance Questionnaire.
If conducting a telephone interview:
“Hello, I am _________________. I am calling in reference to Contract with a company called _____________ . My questions will pertain to the contractor’s record of past, which is defined as within the past three years, and current performance. The information that you provide will be used in the awarding of a federal contract. Therefore, it is important that our information be as factual and accurate as possible. A summary of this discussion may be sent to you for your records.
This is simply an example of how to conduct an interview.
8. Electronic Proposal. Can offerors submit all three proposal volumes on one CD-ROM disc, to include Volume I, Volume II, and Volume III?
(Ref: RFP Page 57)
In addition to submitting a hard copy of the proposal, digital copies shall be provided on CD-ROM disks in Microsoft Word, PowerPoint and/or Excel.
You may submit digital all digital volumes on one CD-ROM.
9. Proposal Cross-References. Can the Government provide an example of “cross reference” in the format they want to submit in their proposals? (Ref: RFP Page 57)
The government does not have an example of cross –references utilized to preclude unnecessary duplication of data between sections.
10. On-Site Work Space. Will the Government provide the contractor with an on-site work office and/or storage space? If so, how much space?
Reference the Performance Work Statement paragraph “3.1.1.1 Office/Storage Areas”. The Government will provide the Contractor with office and custodial/storage areas.
11. Personal Protective Equipment (PPE). Will the Government provide PPE e.g., face masks, gloves, etc. to contractor employees?
Reference Performance Work Statement paragraph 4.2.9 “Uniforms and Personal Protective Equipment. Employee uniforms and Personal Protective Equipment (PPE) shall be furnished by the contractor.”
12. Price Assumptions. Can offerors list any price assumption in their Volume III proposals and not have the Government determine this as qualifying their offer with a resulting determination of the offer is non-responsive? (Ref: Volume III Instructions).
The Offeror shall submit complete pricing in accordance with Volume III – General and Factor 3 – Price.
13. Offsite Management Plan. What specific “offsite” locations is the RFP mentioning for the “Supervision and Management Organization
Plan”? (Ref: RFP Page 59 - TAB (A). Propose on-site and offsite supervision and management organizational plan)
Offsite refers to the supervision and management not located at the performance work site location.
14. Representations and Certifications (Section K). On page 77, does what action is required in response to “52.204-8 ANNUAL REPRESENTATIONS AND CERTIFICATIONS (MAR 2020)”, on page
80, “52.204-19 INCORPORATION BY REFERENCE OF
REPRESENTATIONS AND CERTIFICATIONS (DEC 2014)”, on page
83, “52.204-24 REPRESENTATION REGARDING CERTAIN
TELECOMMUNICATIONS AND VIDEO SURVEILLANCE SERVICES
OR EQUIPMENT (OCT 2020)” and page 84 “52.204-26 COVERED
TELECOMMUNICATIONS EQUIPMENT OR SERVICES--
REPRESENTATION (OCT 2020)”, and on page 92 “52.212-3
OFFEROR REPRESENTATIONS AND CERTIFICATIONS--
COMMERCIAL ITEMS (JAN 2021) ALTERNATE I (OCT 2014)”? Must completed responses to the above Section K items be submitted in full text in the Volume III Price Proposal?
Yes.
15. Can you please clarify the quantity for CLIN 0002, the Schedule of Supplies/Services states 11 months and Attachment A reflects 12 months.
Attachment A has been revised to reflect the CLIN structure on the SF 1449 solicitation document.
16. PWS 1.3.5 Management Plan – At the end of this paragraph it calls for submission of a Property Management Plan IAW FAR 45.201 (c) (4) with the proposal. This submission requirement is further identified in 3 (a). Proposal Content (2) Management Plan (TAB E). In 3.3.1 Accountability, a Property Management System (PMS) is due to the Contract Administrator NLT 30 days after award of the contract. All other deliverables (i.e., plans, schedules, etc.) are due for submission to the CO/COR at some point after contract award. Can this Property Management Plan be rescheduled for submission after contract award?
The Property Management Plan is required with submission of proposal and in accordance with the evaluation criteria listed in solicitation W911SD-21-R-0054.
17. Factor 1 Evaluation and Volume I Tab (c) Management Positions
a) We understand resumes are not required for key management positions, i.e., Project Manager, Assistant Project Manager.
However, are offerors permitted to include resumes or names/credentials for proposed key management positions if the offeror chooses to do so?
The proposals will be evaluated in accordance with 52.212-2 and only those documents required to be submitted in 52.212-1. No additional documents will be considered during evaluation.
b) Page 88, Section 2.3, states that “[t]he Government will also consider proposed personnel qualifications by position and labor category . . . .” If an offeror includes resumes or otherwise identifies the names/credentials of its key management personnel, could the offeror be rated more favorably in the Factor 1 evaluation based on its proposed key management personnel?
The proposals will be evaluated in accordance with 52.212-2 and utilize the documents required in accordance with 52.212-1. No additional documents will be considered.
c) The government’s removal of the resume requirement and evaluation of key personnel requirements introduces risk that an offeror will propose a management plan it cannot reasonably expect to deliver because it lacks the necessary management personnel. The government has added a technical risk rating, but it is unclear if/how the technical risk evaluation will consider this risk when there is no requirement to submit resumes or names/credentials of proposed key management personnel, or a hiring plan to do so. Will the government consider adding the submission of resumes and evaluation of key personnel back into the solicitation like it was in prior versions of the solicitation?
This requirement and solicitation stands on its own merit and shall not be compared to previous solicitations. Only documents required to be submitted will be used in the evaluation of this proposal.
There will be no change to the solicitation submission requirements.
18. CLIN 0003 and subsequent Paper Goods CLINS.
a) The Solicitation appears to have an error when it states that 2.2.80 is to be included in CLIN 0003, which covers PANTRIES. We believe the government should amend CLIN 0003 to read 2.2.81, which covers PAPER GOODS.
CLIN 0003 has been revised.
b) Paper goods identified in PWS 2.2.81 and PWS 5.20.7.5.2 are to be included in this CLIN. PWS 4.2.15 and PWS 5.8.1 (Disposable Tableware Items and Condiment Boxes) are also paper goods referenced in the PWS. Are PWS 4.2.15 and PWS 5.8.1 to be included in the calculation for CLIN 0003?
Yes
c) The Solicitation states that CLIN 0003 will be funded in the amount of $30,000.00. However, the pricing spreadsheet at Attachment A is blank for CLIN 0003, suggesting offerors have discretion on the price they propose for paper goods. Does the government want offerors to propose $30,000 for each year for paper goods, or is it up to the offeror to decide the fixed price for CLIN 0003?
The Fixed price for CLIN 0003 is Not to Exceed (NTE) $30,000.00.
d) May an offeror propose greater than $30,000 per year for CLIN
0003?
No. The Fixed price for CLIN 0003 is Not to Exceed (NTE) $30,000.00.
19. FAR Part 16.203 Fixed-Price Contracts with Economic Price Adjustments – We could not find this referenced in the Solicitation starting on page 74 of incorporated FAR Clauses. Will this FAR part be included?
No. This is not applicable and therefore not included in the solicitation.
20. Factor 2 – Past Performance
a) The proposal submission requirements on page 61 state that offerors should submit past performance information that was performed “within the past five (5) years from the date of issuance of this solicitation.” The evaluation criteria on page 90 state that the agency will evaluate past performance information “performed during the five (5) years prior to date for receipt of offers.” The evaluation criteria also state that “experience prior to the last five
(5) years . . . will not be considered.” Please confirm that the government will evaluate the full period of performance for any contract reference that was performed during the past five years, even if some of the period of performance for the contract was performed more than five years ago (i.e., a contract that began in 2013 and ended in 2018).
In accordance with the solicitation, experience prior to the last five years will not be considered.
b) The prior solicitations stated that references performed within the past six years would be considered recent. However, this solicitation narrowed the recency period to five years. Please explain why the agency believed it would best promote competition and meet the agency’s needs to narrow the past performance period by one year, from six to five.
Each solicitation and action stand on their own merit.
c) Once the agency has clarified the past performance submission and evaluation requirements in response to offerors’ questions, please confirm the agency will give offerors an opportunity to revise any aspect of its initial past performance submission and the deadline for doing so.
21. Price
a) This contract has historically been cost reimbursable, but the agency is changing it in the Solicitation to be firm fixed price (“FFP”). FFP contracts should be used when the risk involved is minimal or can be predicted with an acceptable degree of certainty.
Cost-reimbursement contracts, by contrast, are to be used when uncertainties involved in contract performance do not permit costs to be estimated with sufficient accuracy. Here, there is significant uncertainty still from the ongoing COVID-19 pandemic and Technical Exhibit 4 contains meal recaps for Fiscal Year 2019.
Please explain why the agency determined that the change from cost reimbursable to FFP was appropriate here, particularly given the ongoing uncertainties caused by the COVID-19 pandemic.
A determination has been made that this action does not meet the application requirements of FAR 16.301-2.
b) Will the agency agree to change the contract type from FFP to cost reimbursable given the significant uncertainties caused by COVID- 19 and lack of more recent data in Technical Exhibit 4?
There will be no change to the contract type.
c) It is unclear if the government intends to perform a price realism evaluation. The price evaluation section does not mention price realism, but the government has added a technical risk evaluation, which will evaluate (among other things) the extent to which the offeror’s proposal may lead to increased cost or degradation of performance. Please confirm the technical risk rating will involve an assessment of the realism in the offeror’s proposed price.
The technical risk rating will not involve assessment of price realism. Only those items required to be submitted will be evaluated under technical, in accordance with the solicitation and evaluation criteria.
d) If the government maintains the FFP nature of the contract, and given the significant uncertainties based on COVID-19 and the most recent performance data from FY19, there is risk that an offeror could significantly under bid and would not be capable of performing at such a low price upon award. Therefore, the government should revise the Solicitation to confirm that it will evaluate price realism.
The solicitation will be evaluated in accordance with the solicitation and evaluation criteria.
e) How will the government ensure that an offeror does not buy into the contract, which is an improper business practice per FAR 3.501?
f) What pricing information will the government require with proposals, and what evaluation will the government perform, to ensure offerors price the work consistent with the SCA/CBA requirements in the Solicitation?
g) For Volume III General and Factor 3 – Price, the only requirement is to provide pricing for CLINs on Attachment A and the Schedule B CLIN’s starting on page 63. Is this correct?
That is Correct.
h) Factor 3 – Price states that during review of the pricing and determining price reasonableness, the Government reserves the rights to request other than cost and pricing data in support of the Offerors line item pricing. However, Factor 3 is not clear as to what type of other than cost and pricing data information may be requested by the Government. Please clarify what other than cost or pricing data the government may request as part of the price evaluation.
That determination would be made at the time, if deemed necessary. In the event the government requires submission of data other than certified cost or pricing data, it will be requested in accordance with FAR Part 15.403-3.
22. FAR Part 12
a) Please explain why the government determined to procure the services sought under the solicitation as commercial services pursuant to FAR Part 12.
This requirement meets the definition of Commercial Item in accordance with FAR Part 2.1
b) What type of market research was performed by the Government to determine the services sought under this solicitation meet the definition of commercial services?
c) How did the government determine that a monthly fixed price is a customary commercial pricing practice for the services sought under the solicitation?
d) Please describe the established catalogue or market prices in the commercial market place that were used to substantiate the decision to issue the solicitation under FAR Part 12.
23. In Schedule B (page 64) Item No. 0002 CLIN states that the quantity is 11 months. In Attachment A, the comparable entry 2. states 12 months. Please clarify and provide a correction.
Attachment A has been revised.
24. Though the solicitation has incorporated the Service Contract Act, it does not include FAR 52.222-43 (Fair Labor Standards Act and Service Contract Labor Standards - Price Adjustment (Multiple Year and Option Contracts)). Pursuant to FAR 22.1006(c)(1), please confirm the government will revise the solicitation to include FAR 52.222-43.
The solicitation has been amended to include FAR clause 52.222-43.
25. The current proposal deadline is September 2, 2021 at 4:00 p.m. This will not provide offerors sufficient time to consider the government’s answers to offerors’ questions in preparing their proposal. We request that the government extend the proposal due date to be at least three weeks after the date on which the government answers offerors’ questions. Additionally, the government should provide offerors an opportunity to revise their initial past performance submission.
26. Is the offeror to provide staffing matrices for each of the following meal types: family style service, cafeteria style service, special event meals, grab n go, housekeeping, etc?
Provide Staffing matrixes in accordance with 52.212-1(b) Instructions to Offerors –Commercial items Addendum
27. Will offeror require to provide a separate staffing matrix for VIP Individual Plates?
Provide Staffing matrixes in accordance with 52.212-1(b) Instructions to Offerors –Commercial items Addendum
