SECTION 00100 - BIDDING SCHEDULE/INSTRUCTIONS TO BIDDERS

The following have been modified:

INSTRUCTIONS TO OFFERORS

PART I – INSTRUCTIONS, CONDITIONS AND NOTICES TO OFFERORS

1. NOTICES TO OFFERORS:

a. MAGNITUDE OF PROJECT: IAW DFARS paragraph 236.204, the estimated cost of this project for the entire contract period (base period and four option periods) is between $25,000,000.00 and $100,000,000.00.

b. COMPETITION: This acquisition is 100% set-aside for HUBZone small business concerns, pursuant to the requirements of FAR Subpart 19.1305, HUBZone set-aside procedures.

c. NORTH AMERICAN INDUSTRY CLASSIFICATION SYSTEM (NAICS) CODE for this acquisition is 236220. It is the Offeror’s responsibility to ensure that its System for Award Management (SAM) registration includes this NAICS. If it does not, contract award may be delayed.

d. BID GUARANTEE: REQUIRED and shall be provided with the offer, see FAR Clause 52.228-1.

e. OFFER ACCEPTANCE PERIOD: See Standard Form 1442, SOLICITATION, OFFER, AND AWARD, BLOCK 13 D. AND BLOCK 17. Offerors providing less than 270 calendar days for Government acceptance after the date offers are due will not be considered for award and will be rejected. If the offeror would like to provide more than 270 calendar days to be considered, the number of days must be inserted in BLOCK 17. Failure to insert a number into BLOCK 17 shall mean the offeror accepts the minimum in Item 13D.

f. PERFORMANCE AND PAYMENT BONDS: Offerors are reminded of the requirement for performance and payment bonds (SEE BLOCK 12A. of the STANDARD FORM 1442 – SOLICITATION, OFFER, AND AWARD and FAR Clause 52.228-15 -- Performance and Payment Bonds -- Construction).

1. In accordance with AFARS 5117.9004-2(g) “"Bonding must be sufficient to cover the stated estimated annual maximum contract value.... The estimated annual maximum value will be a reasonable figure based on historical experience and known workload for the coming year. This approach should avoid the prior difficulties associated with adjusting bonding coverage every time a new task order is awarded.

Because contractors can now plan their liability for premiums, and because they get unliquidated/unneeded premiums reimbursed by the bonding agent, payment incrementally through the use of the coefficient becomes both logical and reasonable." Offerors shall provide 100% Payment and Performance bond for the estimated annual maximum contract value of $19.8 Million based on the figures noted in the Bid Schedule and estimated figures provided by the customer.

g. SYSTEM FOR AWARD MANAGEMENT (SAM): To be eligible for award of a Department of Defense (DoD) contract, Contractor registration in the SAM data base is required (see FAR Clause 52.204-7 and DFARS Clause 252.204-7004 Alternate A). Failure to register with SAM shall make the Contractor ineligible for award. New registration in SAM can take a few weeks. Therefore, it is critical that Offerors interested in this solicitation complete their SAM registration in sufficient time to meet solicitation representation and certification requirements.

h. AMENDMENTS: No bidder’s mailing list will be maintained. It is the responsibility of all interested parties wishing to offer on this requirement to monitor FedBizOpps (FBO) for any/all amendments to this solicitation. The offeror is required to acknowledge amendments in block 19 of the SF 1442. Failure to respond to an amendment may render the offer ineligible for award and thereby rejected.

i. SOLICITATION PROVISIONS/REPRESENTATIONS & CERTIFICATIONS: The Offeror must have completed the Representations and Certifications section within their SAM record or FAR 52.204-8 is required to be completed.

j. REPRESENTATIONS AND CERTIFICATIONS: Representations and certifications shall be updated within the SAM system as necessary, but as a minimum, an annual update is required.

k. VETS-4212: Federal Contractors and subcontractors who receive Federal contracts of $150,000 or more are required to annually file, no later than September 30th of each year, Form No. VETS-4212 entitled "Federal Contractor Veterans' Employment Report" with the Department of Labor. In addition, all Federal Contracting Officers are prohibited from awarding contracts or disbursing funds to Federal contractors or subcontractors that have not submitted a current VETS-4212 Report. For more information on this requirement, see the following website: http://www.dol.gov/vets/vets4212.htm.

l. SOLICITATION QUESTIONS: Questions shall be in writing and e-mailed to nennie.y.gargard.mil@mail.mil, and marisa.m.mustizer.civ@mail.mil. Questions concerning this solicitation will be accepted up to 20 Nov, 2016, 4:00 PM. Fort Drum does not commit to providing responses to questions submitted after THIS DATE; however attempts to answer all relevant questions will be made.

m. OFFER SUBMISSION: All offers must be RECEIVED on COMPACT DISK (CD) prior to the offer due date in box 10 of this solicitation (first page). PAPER COPY OFFERS WILL NOT BE ACCEPTED.

HOWEVER, required in hard copy are: the first page of the SF 1442 signed and dated, first page of any and all amendments to the solicitation signed and dated (if applicable), and original signed and Bid Guarantee. All hard copies shall be executed with the original signature of the Offeror. Required hard copy documents shall be included with the digital proposal submission. The Request for Proposal (RFP) contains provisions and other items required to be completed by the Offeror and returned with its proposal. Failure to provide this information with the proposal may render the proposal non-responsive and not eligible for award. Offers on a Compact Disk and all other hard copy documents, are due 23 December 2016 at 2:00 PM EST. The hard copy documents shall be clearly marked containing the procurement and solicitation number: Fort Drum Job Order Contract, Solicitation# W911S2-16-R-8001 and be mailed or delivered to:

Mission & Installation Contracting Command – Fort Drum P31 Quartermaster Road Fort Drum, NY 13602

n. CONTRACTOR MANPOWER REPORTING APPLICATION (CMRA): The Contractor shall provide data on Contractor labor hours (including subcontractor labor hours) for performance of this contract IAW the Statement of Work (SOW). The Contractor must provide all of the information requested and in required format, using the following web address http://www.ecmra.mil for the purpose of capturing Contractor and subcontractor manpower hours utilized during the performance of this Contract.

Instructions, including the Contractor and Subcontractor User Guides, are available at http://www.ecmra.mil. Contractors filing their Contractor Manpower Reports will receive immediate e-mail confirmation that their reports have been received in the system. Proof of CMR completion shall be uploaded into Wide Area Work Flow with the last invoice submitted of each option period to facilitate contract payment.

o. PROPOSALS: The Offeror shall submit a proposal that addresses all evaluation areas, specifically identifying how the proposed contractual requirements will be satisfied. A Government team will evaluate each proposal strictly in accordance with its content and will not assume that performance will include areas not specified. Proposals that are unrealistic in terms of capability to perform the requirement will be deemed reflective of an inherent lack of competence or indicative of failure to comprehend the complexity of the proposed contractual requirements and may be deemed unacceptable.

p. FACTORS: The proposals will be evaluated on three factors: Technical Capability, Past Performance, and Price.

q. On Site. On-site means the entire Fort Drum, NY military installation and the Contractor managed office which facilitates the response time specified in Part 1 paragraph 1of the Statement of Work (SOW). Fort Drum will not provide any office or Government space on the installation.

2. HUBZone JOINT VENTURES. There are specific requirements that a Joint Venture (JV) must satisfy to submit an offer on a HUBZone contract (CFR Title 13--PART 126). Therefore, Offerors submitting proposals as a Joint Venture shall provide the following information with its proposal:

a. The Joint Venture Agreement

b. A description of

(1) Who will have control over the JV and the percentage of control,

(2) The management structure of the Joint Venture,

(3) Who will manage the contract,

(4) The relative amount of work to be performed by each party, and

(5) Who will perform each contract task

c. The names, signatures and titles of each participant in the joint venture shall be set forth in the proposal.

3. PROPOSAL FORMAT: Written proposals shall be submitted in four Sections. Each section shall be in the format as follows:

Proposals shall be clearly and concisely written, indexed (cross-indexed, as appropriate) and logically assembled.

All pages of each proposal shall be appropriately numbered and identified with the solicitation number. Price information shall only be included in Section IV.

Offerors shall include a cover page on each document, which clearly identifies the Section Name (e.g., Section II, Management), Request for Proposal (RFP) Number, and Date of Submission.

The Offeror’s written proposal shall be prepared in PDF using standard 8.5 x 11 inch layout in portrait orientation.

Print must be spaced at six lines per inch. Text font shall be Times New Roman and no smaller than 11 point, but text included on figures and/or matrices may be reduced to 8 point. An Offeror’s proposal must meet the Government’s readability requirement and smaller type shall not be used to circumvent the proposal page limitations.

Proposals, with the exception of Section I, Executed Request for Proposal shall be prepared using PDF, in portrait orientation. The price spreadsheets shall be prepared in PDF.

Section I, Executed Request for Proposal, shall be submitted both on a compact Disk (CD) and hard copy. Required in hard copy are: the first page of the SF 1442 signed and dated, first page of any and all amendments to the solicitation signed and dated (if applicable), and the original corporate sealed and signed bonds. All hard copies shall be executed with the original signature of the Offeror. Digital copies shall be included with the digital proposal submission. All completed Representations and Certifications required by the solicitation shall be as set forth in Section 00100 Paragraph (1) (k). All required documentation, whether digital or hard copy, must be received prior to solicitation close. Documentation received after solicitation close may be considered ineligible for award.

Section II, Technical Proposal; Section III, Past Performance Proposal, and Section IV, Price Proposal. The proposal should be specific, detailed, and complete in order to demonstrate that the Offeror has a thorough understanding of the solicitation requirements. Statements such as “the Offeror understands, assumes, can, or will comply with the Statement of Work”, statements that paraphrase the Statement of Work (SOW), or contain ambiguous phrases such as “standard procedures will be employed” or “well known techniques will be used” will be considered unacceptable.

As stated in FAR Clause 52.215-1, the Government intends to award without discussions (except clarifications as described in FAR 15.306(a), Clarifications and award without discussions). Therefore, the offerors’ initial proposals should contain their best offer from a price, technical and past performance standpoint. The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary. In the event that discussions are held, discussions will be held only with the offerors in the competitive range. If negotiations are deemed necessary, and proposal revisions are requested, they shall be submitted as an edited version of the original PDF document(s) with revised text readily identifiable using bolded font, red in color.

4. FACTOR 1: TECHNICAL CAPABILITY: The Technical portion of the proposal encompasses the recognition of the full scope of services and their interrelationships in order to optimize responsiveness, timeliness, efficiency, and effectiveness of services rendered. The Technical proposal shall consist of a narrative and supporting data (e.g., matrix, charts, or other graphics) addressing the technical requirements necessary to support contract performance.

a. ELEMENT 1 - MANAGEMENT: The Offeror shall address the management areas defined below.

(1) On-Site Staff: Describe your proposed on-site personnel structure and staff, authority, and responsibilities required for each position (see Section 00800 - Special Contract Requirements, STATEMENT OF WORK (SOW) paragraph 1.3. POSITION REQUIREMENTS/CONTRACTOR STAFF). Provide an organizational chart which includes job category/title with qualifications/skills or resumes for all key personnel listed in the section above. .

(2) Response Time: Describe your local office location plan in order to meet the minimum response time to Fort Drum (see Section 00800 - Special Contract Requirements, STATEMENT OF WORK (SOW) paragraph 1.2.).

b. ELEMENT 2 – CONTRACTOR QUALITY CONTROL PLAN:

Provide a Quality Control Plan that meets all requirements of SECTION 00800 – ADDITIONAL CONTRACT REQUIREMENTS Paragraph 13 Contractor Quality Control Subparagraph a-k.

c. ELEMENT 3 - SUBCONTRACTING: The Offeror shall address the subcontracting areas defined below.

Subcontracting Support. Describe in detail to what extent subcontracting may be used to satisfy the requirements of the solicitation. Specifically identify all major areas where subcontracting support may be used as part of the overall work effort. Include the extent and rationale for in-house and/or subcontract work distribution. Clearly describe the plan and percentage of work to be completed through self-performance. Describe the technical capabilities of the proposed subcontractors. Provide your rationale for selecting and utilizing subcontractors. Provide any written prime-subcontractor agreements. Specifically identify how you are going to meet the requirements of FAR clause 52.219-3.

d. ELEMENT 4 - BONDING CAPACITY: The Offeror shall address their bonding capability defined below.

(1) Proof of acceptable bonding coverage for the full contract. Performance and Payment Bonding capability will be evaluated to determine if the Offeror has the bonding capability to fulfill the requirements of the contract. The bonding will be considered acceptable when the Offeror provides documentation at the time of proposal, with verification from the Securities or Bonding Company, to demonstrate their per task order ($5 Million) and annual aggregate maximum capability ($19.8 Million) for construction bonding in support of the estimated amounts for this contract. The corporate bonding surety must appear on the Department of Treasury Listing of Approved Sureties (Department Circular 570) and will be evaluated using such ratings as, but not limited to, A.M. Best, to assess the financial strength of the insuring organization and credit quality of their obligations. In accordance with SECTION 00010 – BID SCHEDULE, Paragraph 3. BONDS; the potential exists that through contract modification the maximum annual quantity may exceed $19,800,000. Therefore, after contract award the Contractor may be required to increase their bonding capability within that year.

The contract will not exceed the total maximum of $99,000,000.

5. FACTOR 2: PAST PERFORMANCE:

a. The Past Performance Proposal shall provide recent and relevant information on contracts and subcontracts on which the Offeror has performed, or is performing work. Identify if the work was performed as a Contractor or subcontractor, and company name if different than current. The Offeror shall provide information on relevant contracts and subcontracts for similar/relevant projects such as JOC, Simplified Acquisition of Base Engineering Requirements (SABER) and IDIQ type contracts for pre-priced maintenance, repair, and minor construction of facilities. Relevant is defined as contracts of the same or similar size, scope, magnitude, complexity, nature of work and contract type. The information provided shall also be recent. Recent is defined as an effort that is ongoing or has been performed during the five years prior to the date of issuance of this solicitation. The Offeror shall state the years in which the described work was/is being performed. Offerors shall clearly distinguish between corporate experience and personnel experience. Past performance that is not determined recent and relevant as defined above will not be evaluated.

b. In addition to the above, Offerors shall identify and submit a separate reference for five of the most similar/relevant federal, state, local government, and private sector contracts and subcontracts the firm has performed within the last five years. To comply with this requirement, the Offeror shall use the format at Enclosure 1 of the RFP. Based upon the information provided in Enclosure 1, Offerors shall send the Past Performance Risk Assessment Questionnaire Letter at Enclosure 2 of the RFP to their references (individuals and organizations), and request them to e-mail the completed questionnaires at Enclosure 3 to nennie.y.gargard.mil@mail.mil, on or before the due date for Receipt of Proposals. The Government will consider this information, as well as information obtained from any other source, when evaluating the Offeror’s past performance. To be considered acceptable in this area, all reference questionnaires submitted on behalf of the offeror shall contain ratings of at least Acceptable.

c. IAW FAR 15.305 – Proposal Evaluation, paragraph (a)(2)(iv). In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available, the offeror may not be evaluated favorably or unfavorably on past performance.

d. The Offeror shall address the past performance elements defined below within their proposal.

(1) Quality of Service: Demonstrate that your company has been successful in this area, and your experience and successes.

(2) Timeliness of Performance: Demonstrate that your company has been successful in this area, and your experience and successes.

(3) Customer Satisfaction: Demonstrate that your company has been successful in this area, and your experience and successes.

(4) Contractor Submitted References: As discussed in paragraph 5.b. above.

e. The Government reserves the right to obtain past performance data from other sources than those identified by the Offeror in evaluating past performance. This includes, but is not limited to, the Past Performance Information Retrieval System (PPIRS), Federal Awardee Performance and Integrity

Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), or other databases;

interviews with Program Managers, Contracting Officers, and Fee Determining Officials; and the Defense Contract Management Agency. Offerors are reminded that both independent data and data provided by Offerors in their proposals may be used by the Government to evaluate the Offerors past performance. The KO may also evaluated Past Performance based on direct knowledge of the Contractor’s performance on current or recent contracts. All past performance received will be taken into account and could affect the overall rating. The overall past performance evaluation is a subjective decision based on the whole of all data received. In the case of an Offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the Offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a)(2)(iv)). Therefore, the Offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.”

6. FACTOR 3: PRICE: JOC IDIQ price proposal shall consist of the Bid Schedule. Section 00010 Bid Schedule, Paragraph 6 Table shall be submitted fully completed and error free. It shall contain the offeror’s prices (coefficients) in the established format specified in the Bid Schedule. Coefficient means a numerical factor that represents costs (generally indirect costs) not considered to be included in the UPB prices. The coefficients are proposed as a percentage (in decimal format) increase or decrease to the UPB prices. For example, a coefficient of 1.2 would result in an additional 20 percent to the listed unit price; 0.9 would result in a 10 percent decrease of the listed prices, and 1.00 would leave the unit price as the proposed unit price. The offeror shall limit the Coefficients to two decimal places. The offeror shall propose Base Year coefficients for each SubCLIN. The price proposal is required for the Base Year only, since coefficients for the Option years shall be based on the BCI and will be determined prior to the exercise of any Option Period (see AFARS Clause 5152.237-9000 Economic Price Adjustment (Job Order Contracts) [AFARS Revision #15, February 17, 2005]. The Bid Schedule Table is also shown below in Part II (PART II – EVALUATION FACTORS FOR AWARD), 4 C-2.

The offeror shall fill out this table by inserting their respective coefficients for each of the associated working hours categories in column (1), then multiplying each coefficient by the respective proportion in column (2), and summing each of these weighted coefficient factors to produce the single weighted coefficient in the “Sum of (1) x (2)” row that will be used to develop the evaluated price. As a basis for award, trade-offs between price and non-price factors are not permitted. Incomplete offers may be considered ineligible for award. As set forth in FAR 52.215-1(f)(4), the Government intends to evaluate proposals and award a single award JOC IDIQ contract without discussions with offerors (except clarifications as described in FAR 15.306(a), Clarifications and award without discussions). The proposals will be evaluated on three factors: Technical Capability, Past Performance, and Price.

b. The Government will evaluate each proposal under source selection procedures to determine the extent to which each proposal demonstrates both the capability to perform and a clear understanding of the JOC IDIQ requirements.

c. Proposals shall conform to or exceed solicitation requirements, and will be evaluated to determine which proposal is the lowest price technically acceptable based on technical capability, past performance, and price. Award will be made to the lowest price technically acceptable responsible Offeror on the basis of the lowest evaluated price of proposals meeting the capability standards for non-cost factors in accordance with the terms and conditions of the solicitation and evaluation procedures set forth in Section 00100 of the solicitation.

An Offeror receiving an unacceptable rating for any element within the Technical Capability factor will receive an unacceptable overall rating for the factor and will not be considered for award.

RATING DEFINITION

Acceptable Proposal meets the requirements of the solicitation.

Unacceptable Proposal does not meet the requirements of the solicitation.

b. FACTOR 2: PAST PERFORMANCE: The Past Performance evaluation will assess the relative risks associated with an Offeror’s the relative risks and likelihood of success in performing the solicitation’s requirements as indicated by that Offeror’s record of past performance. In this context, “Offeror” refers to the proposed prime Contractor, major subcontractors, or joint ventures. Performance risk is assessed at the factor level after evaluating aspects of the Offeror’s recent past performance and focusing on performance that is relevant to the services being procured under this solicitation. Offerors are cautioned that in conducting the performance risk assessment, the Government may use data provided in the Offeror’s proposal and data obtained from other sources, such as the Past Performance Information Retrieval System (PPIRS), Contractor Performance Assessment Reporting System (CPARS), similar systems and State Department Watch Lists, or applicable references. An unsatisfactory rating documented within any of the above mentioned systems may deem the proposal unacceptable.

(1) The evaluation elements specific to the Past Performance factor are:

a. ELEMENT 1 - Quality of Service:

b. ELEMENT 2 - Timeliness of Performance:

c. ELEMENT 3 - Customer Satisfaction:

d. ELEMENT 4 - Contractor Submitted References:

To be relevant, the Offeror’s work experience must be similar in nature of work, size, magnitude, complexity and scope to that required under the solicitation. The Government will conduct an in-depth evaluation of all recent performance information obtained to determine if it is the same/similar in nature, size, and complexity to the services/products being procured under this solicitation. When determining the relevancy for individual contracts, consideration will be given to the effort, or portion of the effort, being proposed by the Offeror, joint venture, or subcontractor whose contract is being reviewed and evaluated.

(4) The past performance information provided in the proposal and information obtained from other sources will be used to establish the degree of relevancy of past performance information. Offerors without a record of relevant past performance or for whom information on past performance is not available will not be evaluated favorably or unfavorably on past performance and, as a result, shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.”

Assigning Ratings. The Past Performance Factor will be assigned one of the ratings defined below. An offeror whose proposal demonstrates no past performance will be rated “Unknown.”

In the event that the a different coefficient is proposed for Emergency or Accelerated Working Hours, an annual coefficient will be calculated based on a weighted average as follows:

* Estimated Distribution of Normal, Emergency and Accelerated Working Hours

(1) (2) (3) = (1) X (2)

Offeror Coefficient *Proportion

Weighted Coefficient

Normal Working Hours 80% Emergency Working Hours 1% Accelerated Working Hours 19%

Sum of (1) x (2)

(3) The Government, for evaluation purposes only, will multiply the weighted coefficient above by $17,000,000 representing estimated bare costs, to arrive at the evaluated price for purposes of determining the low price.

(4) Completeness/Accuracy: The Offeror’s proposal is in compliance with the Price Volume instructions in the RFP.”
