ETSSLS Solicitation W911QY19R0008 Questions & Answers

1. Can the drawing tree in the first 13 pages of the TDP be provided in Excel?

Answer: An Excel version of the drawing tree is provided with this amendment.

2. Can all the drawings in the TDP be provided in CAD format during the solicitation period? If not, will they be provided after award?

Answer: The TDP drawings are in Solidworks 2018 format. They will be available upon contract award.

3. Clause 52.209-3, "First Article Approval--Contractor Testing (Sep 1989) included on RFP page 31 specifies that "The Contractor shall submit the first article test report within thirty (30) calendar days from the date of this contract…". This is in direct conflict with the delivery schedule provided on page 56 in Paragraph L.10.3.5 and with CDRL A002, which specifies that a draft of the first article test report must be provided within thirty (30) days after the first article test, and a final copy must be delivered within forty-five (45) days after the first article test.

Please advise to the correct timeline for submitting the first article test report.

Answer: Clause 52.209-3 has been revised to agree with Para. L.10.3.5.

4. Paragraph C.2.2 states, "The ETSSLS shall be built in accordance with the Government’s specifications, supplied Technical Drawing Package and supporting documentation. The ETSSLS shall be packed for shipment per the supplied ETSSLS Equipment packing plan (Attachment 0002). Pack-out equipment is defined in the ETSSLS Equipment pack-out list (9-2- 4832). The ETSSLS has been developed, tested, and certified based on this supplied information." Has a prototype been previously built, or are the certifications referenced based on engineering design analysis only?

Answer: Three (3) prototypes of the ETSSLS were built.

5. If a prototype has been previously built, please provide the name of the Contractor who built the prototype.

Answer: Prototypes were built by the Government and Berg Manufacturing, Inc. of Spokane, WA (CAGE: 4JKJ9).

6. If a prototype has been previously developed, built, tested, and certified by an entity other than the Government (i.e. a Contractor under a previous contract), will the Government consider adding a reference to FAR Part 9.5 in order to prevent unfair competitive advantage in this solicitation?

Answer: The ETSSLS is a Government design, initially developed by the Government. One (1) prototype was built by the Government. Due to limited Government production capacity and drawing workload, the Government contracted to have two (2) additional prototypes built by

Berg Manufacturing, Inc. (Berg) to support Government testing and prepare the final Technical Data Package (TDP) based on the initial Government design. The systems underwent Government-evaluated testing under the oversight of the Army Test and Evaluation Command at Aberdeen Test Center/Aberdeen Proving Ground, during which design modifications based on test findings were incorporated into the final TDP.

Accordingly, although Berg provided the final TDP, it did not develop the underlying specification, and is not conflicted. FAR 9.505-2(a) & (b) make clear that TDP development is a basis for exclusion based on OCI only when the entity is solely responsible for development and may therefore skew the design to favor its product, which is not the case in this acquisition. To the extent that Berg has a competitive advantage, it is related to its participation in the developmental program, specifically identified by FAR 9.505-2(a)(3) as not implicating OCI.

7. Please provide the name of the Contractor(s) who built the TRICON units that will be supplied as Government Furnished Equipment (GFE) under the contract resulting from this solicitation.

Answer: Initially the GFE TRICONs will be provided via a Defense Logistics Agency contract with Atlantic Diving Supply, Inc. (ADS, Inc.), CAGE 1CAY9.

8. Does the Government intend to order all production units under CLINs 0006 and 0007 per year at one time, under one task order, or will the Government issue multiple task orders per year?

Answer: Orders will be dependent on unit deployment rotations, unit requirements, and funding.

As a result, multiple task orders may be issued per year.

9. In the event the Government will issue multiple task orders per year, does the Government intend that stepladder pricing will be cumulative across all task orders, or will each task order incur separate cost corresponding with only the stepladder pricing for the quantity of units ordered?

Answer: Stepladder pricing will be applied on the individual order level, as well as orders issued within sixty (60) days of one another. The solicitation has been revised to include Section H.

Paragraph H.1.1. discusses the application of stepladder pricing.

10. Please clarify the Key Personnel requirement listed in Paragraph L.10.3.5. Specifically, which labor categories should be used when proposing key personnel?

Answer: The identification of Key Personnel is left to the offeror’s discretion.

11. Section C.3.1 of the solicitation states that the GFE TRICON will be provided IAW drawing 9-1-1410 (Attachment 0006). Section C.3.2 states the ETSSLS DEI is to be manufactured IAW drawing 9-2-0356. However, both drawings require PN 9-2-4843 (Container I/O Pan Installation). Is PN 9-2-4843 installed as part of 9-1-1410 and provided as GFE or is it installed as part of the vendors scope IAW 9-2-0356?

Answer: 9-2-4843 will be installed as part of the contractor’s scope of work in accordance with 9-2-0356.

12. Likewise, drawing 9-1-1410 also lists PN’s 9-2-4714 & 9-2-4715 as sub-tier assemblies.

Please confirm that the GFE TRICON provided as 9-1-1410 will have 9-2-4714 & 9-2-4715 installed prior to vendor receipt.

Answer: 9-2-4714 and 9-2-4715 will be installed as part of GFE 9-1-1410.

13. Is it expected that the GFE TRICON containers (IAW 9-1-1410) will be provided new, used, refurbished, or as some combination of the three?

Answer: GFE TRICON containers may be provided new as well as refurbished.

14. Will container connecting couplers be provided in instances where three TRICON containers are assembled into a single Twenty Foot Equivalent Unit (TEU) for delivery?

Answer: Container couplers are provided as part of GFE.

15. Is contractor logistics supply support required for the first year of the contract as stated in section C.12.3 of the solicitation or for the duration of the contract as stated in section C.11.6?
