4.0 VOLUME 1, TAB A – FACTOR 1 - SPECIALIZED EXPERIENCE

4.1 SUBMISSION REQUIREMENTS

The prime contractor and team shall demonstrate recent, relevant experience on projects with similar features, magnitudes, and complexities. Offerors are instructed to utilize the Construction – Specialized Experience form, Attachment 2 to this document (no more than 2 pages per project). A team is defined as the prime contractor and their respective key subcontractors and subject matter experts with a formal letter of commitment. Key subcontractors performing in the following areas/disciplines: HEMP Shielding, Seismic Non-Structural Protection Construction, Fuel Offloading System, Electrical Power Generating Units, AM#7... Power System Integrator ...AM#7 and Risk Management Framework. Key subcontractors submitted to satisfy specialized experience requirements will be incorporated into the contract and may only be changed with the approval of the Contracting Officer by contract modification after award. Offerors may identify government (local, state, federal) and/or private experiences that are similar to the requirements for this solicitation. If the offeror is a joint venture, each firm of the joint venture shall provide information, demonstrating experience relevant to their role on this project. Submit projects that are currently well underway (designed and at least 50% construction progress completed) or completed and turned over no longer than ten (10) years preceding the date of this Solicitation. For projects that are longer than 6 years, submit a point of contact or owners representative. The Government will only evaluate the experiences of the firm and their team submitting the offer. The requirements of this factor cannot be met through the experience of the offeror’s parent, affiliate, or separate division. If any firm has multiple functions, divisions or previous business relationships with other firms (previous joint ventures), limit the project examples to those projects performed by the firm submitting an offer.

Submit no more than five (5) projects for the prime contractor and no more than AM#9...six (6)...AM#9 projects for key subcontractors, for a total of ten (10) projects for the below facility types similar in scope features, complexity, and magnitude as the solicitation.

Joint Occupancy Dates (JOD’s) and interfaces as contained in technical specification 01 19 30.03 29 SPECIAL ITEMS, section 1.7 Work Activities.

Constraints: Offeror must demonstrate the capability and flexibility to plan and schedule the complete project to meet the proposed contract completion period. Clearly identify any constraints on the schedules presented (e.g., labor or material availability, coordination with other contractors working inside the project boundary, approval for work in secure areas, utility outages, permits, weather, joint occupancy constraints). Identify the anticipated overall critical path on the schedule.

Temporary Workforce Camp: Provide your projected Temporary Workforce Camp staffing curve with a narrative comparing your projected Temporary Workforce Camp staffing curve to the baseline allocated Temporary Workforce Camp rooms provided in technical specification 01 19 30.03 29 SPECIAL ITEMS.

6.2 Evaluation Criteria:

6.2.1. Execution Concept Narrative and Proposed Contract Duration: The offeror’s proposed contract duration will become the contractually binding completion period and will replace the duration stated in FAR 52.211-10 upon contract award. The Government will evaluate the contract duration, as proposed by the Offeror. The proposed contract duration shall not exceed the maximum allowed duration stated in FAR 52.211-10. In assessing the reasonableness of the proposed contract duration, the Government may take into account how well the summary schedule and other technical submittals supports the proposed duration, as well as use other information, such as independent judgment concerning logic, constraints and typical construction durations. Inconsistencies between the concept narrative and proposed contract duration will be considered a weakness. A proposed contract duration matching the maximum allowed contract duration is “acceptable”. Proposed contract duration shorter than the maximum allowed duration will receive additional rating consideration, provided it is realistic and deemed to be achievable. The Government will consider an unreasonably condensed contract duration, which places additional cost or schedule risk on the Government or which may create a risk of contract or performance failure, as a significant weakness. Proposal’s which incorporate innovative and realistic methods to mitigate schedule risk will be given additional consideration.

6.2.2. Summary Schedule: The duration of the schedule must match the Offeror’s proposed contract duration. If it is shorter than the proposed contract duration, it offers no advantage to the Government because it is non-binding, only representing a preliminary planned schedule. The Government will evaluate the schedule to assess the strength of understanding of the project scope, restrictions which must be considered in the schedule e.g., interfaces, constraints, Joint Occupancy (Reference Specification Sections 01 11 00.03 00 Summary of Work and 01 19 30.03 29 Special Items, 1.7 Work Activities), permitting, long lead items, etc. The Government will evaluate the Offeror's capability to schedule the complete project within the proposed contract duration, the reasonableness of the schedule, and one that does not increase the risk to the Government. A schedule that offers advantage(s) to the Government (over one that merely indicates an adequate understanding of the scope, restrictions, major milestones and general understanding of the various events that can affect start and completion of construction) will receive additional consideration.

The Government will evaluate the contractor's performance and prepare a performance report using the Contractor Performance Assessment Reporting System (CPARS), a web-based system (https://www.cpars.gov/). After an evaluation (interim or final) is generated by the Government, the contractor will have the ability to access, review and comment on the evaluation for a period of 30 days. If the Contractor fails to review, and or comment on the evaluation within the 30-day period, the Contracting Officer will take the appropriate steps to finalize the evaluation without the contractor's comments. It is the sole responsibility of the Contractor to purchase any necessary software to access the electronic system, including a Public Key Infrastructure (PKI) certificate. Contractors are encouraged to obtain and use the Public Key Infrastructure (PKI) certificate. Details and information to access the system are listed below. The contractor shall provide the Contacting Officer the primary contact name and email address in order to receive the initial email and to access the system. Additional information and training material is available at https://www.cpars.gov/. This web site will give the contractor an understanding of the system and levels of access, the policies and regulations governing CPARS and the electronic workflow with particular attention to the Contractor comment function. Contractor users are required to obtain a PKI certificate in order to log into CPARS. PKI certificates can be purchased from DoD's industries partners under External Certificate Authorities (ECAs). A list of ECAs vendors is available at http https://www.cpars.gov/main/pki_info.htm.

DOCUMENT 00 73 00.03 29 Page 3 the Government, and storing weekly payrolls and other data required for the contractor to comply with Davis-Bacon and related Act regulations. When the contractor uses an electronic Davis-Bacon payroll system, the electronic payroll service shall be used by the contractor to prepare, process, and maintain the relevant payrolls and basic records during all work under this construction contract and the electronic payroll service shall be capable of preserving these payrolls and related basic records for the required 3 years after contract completion. If the contractor chooses to use an electronic Davis-Bacon payroll system, then the contractor shall obtain and provide electronic system access to the Government, as required to comply with the Davis-Bacon and related Act regulations over the duration of this construction contract. The access shall include electronic review access by the Government contract administration office to the electronic payroll processing system used by the contractor.

The contractor's provision and use of an electronic payroll processing system shall meet the following basic functional criteria: commercially available; compliant with appropriate Davis Bacon Act payroll provisions in the FAR; able to accommodate the required numbers of employees and subcontractors planned to be employed under the contract; capable of producing an Excel spreadsheet-compatible electronic output of weekly payroll records (format at http://www.rmssupport.com/guides.aspx) for export in an Excel spreadsheet to be imported into the contractor's Quality Control System (QCS) version of Resident Management System (RMS), that in turn shall export payroll data to the Government's Resident Management System (RMS); demonstrated security of data and data entry rights; ability to produce contractor-certified electronic versions of weekly payroll data;

ability to identify erroneous entries and track the data/time of all versions of the certified Davis Bacon payrolls submitted to the government over the life of the contract; capable of generating a durable record copy, that is, a CD or DVD and PDF file record of data from the system database at end of the contract closeout. This durable record copy of data from the electronic Davis-Bacon payroll processing system shall be provided to the Government during contract closeout.

All contractor-incurred costs related to the contractor's provision and use of an electronic payroll processing service shall be included in the contractor's price for the overall work under the contract. The costs for Davis-Bacon Act compliance using electronic payroll processing services shall not be a separately bid/proposed or reimbursed item under this contract.

1.2.10 SCR-GE112 Equipment Ownership and Operating Expense Schedule (MAR 1995)

(a) This clause does not apply to terminations. See 52.249-9000, Basis for Settlement of Proposals, and FAR Part 49.

(b) Allowable cost for construction and marine plant and equipment in sound workable condition owned or controlled and furnished by a contractor or subcontractor at any tier shall be based on actual cost data for each piece of equipment or groups of similar serial and series for which the Government can determine both ownership and operating costs from the contractor's accounting records. When both ownership and operating costs cannot be determined for any piece of equipment or groups of similar serial or series equipment from the contractor's accounting records, costs for that equipment shall be based upon the applicable provisions of EP 1110-1-8, Construction Equipment Ownership and Operating Expense Schedule, Region IX. Working conditions shall be considered to be average for determining equipment rates using the schedule unless specified otherwise by the contracting officer. For equipment not included in the schedule, rates for comparable pieces of equipment may be used or a rate may be developed using the formula provided in the schedule. For forward pricing, the schedule in effect at the time of negotiations shall apply. For retroactive pricing, the schedule in effect at the time the work was performed shall apply.

(c) Equipment rental costs are allowable, subject to the provisions of FAR 31.105(d)(ii) and FAR 31.205-36, Rental Costs. Rates for equipment rented from an organization under common control, lease-purchase arrangements, and sale-leaseback arrangements, will be determined using the schedule, except that actual rates will be used for equipment leased from an organization under common control that has an established practice of leasing the same or similar equipment to unaffiliated lessees.

(d) When actual equipment costs are proposed and the total amount of the pricing action exceeds the SAT, the contracting officer shall request the contractor to submit either certified cost or pricing data, or partial/limited data, as appropriate. The data shall be submitted on Standard Form 1411, Contract Pricing Proposal Cover Sheet.

1.2.11 SCR-GE113 Payment for Materials Delivered Off-Site

(a) Pursuant to FAR 52.232-5, Payments Under Fixed Price Construction Contracts, materials delivered to the contractor at locations other than the site of the work may be taken into consideration in making payments if included in payment estimates and if all the conditions of the General Provisions are fulfilled. Payment for items delivered to locations other than the work site shall be limited to:

(1) Materials required by the technical provisions; or

DOCUMENT 00 73 00.03 29 Page 5

(2) Materials that have been fabricated to the point where they are identifiable to an item of work required under this contract; or

(3) Items specifically listed as in the contract documents.

Payment for materials delivered off-site shall be made only after receipt of paid invoices listing the value of material and labor incorporated in the items along with a canceled check showing the prime contractor's title to the items delivered off site. Payment for materials delivered off-site shall be limited to the following items: Items approved for payment by the Contracting Officer, or their representative.

1.2.12 SCR-GE114 Plant And Material Removal After Contract Termination

Should this contract be terminated as provided in clause 52.232-5001 because of the failure of Congress to provide additional funds for its completion, the contractor may be permitted to remove plant and material on which payments for preparatory work have been made, subject to an equitable deduction from the amounts due the contractor to reimburse the United States for the unabsorbed value of such plant and material.

1.2.13 SCR-GE115 Basis For Settlement Of Proposals

Actual costs will be used to determine equipment costs for a settlement proposal submitted on the total cost basis under FAR 49.206-2(b). In evaluating a terminations settlement proposal using the total cost basis, the following principles will be applied to determine allowable equipment costs:

(1) Actual costs for each piece of equipment, or groups of similar serial or series equipment, need not be available in the contractor's accounting records to determine total actual equipment costs.

(2) If equipment costs have been allocated to a contract using predetermined rates, those charges will be adjusted to actual costs.

(3) Recorded job costs adjusted for unallowable expenses will be used to determine equipment operating expenses.

(4) Ownership costs (depreciation) will be determined using the contractor's depreciation schedule (subject to the provisions of FAR 31.205-11).

(5) License, taxes, storage and insurance costs are normally recovered as an indirect expense and unless the contractor charges these costs directly to contracts, they will be recovered through the indirect expense rate.

1.2.14 SCR-GE117 Variations In Estimated Quantities, Subdivided Items

This variation in estimated quantities clause is applicable only to Items No.

0009.

(a) Variation from the estimated quantity in the actual work performed under any second or subsequent sub-item or elimination of all work under such a second or subsequent sub-item will not be the basis for an adjustment in contract unit price.

DOCUMENT 00 73 00.03 29 Page 6

(b) Where the actual quantity of work performed for Items No. 0009 is less than 85% of the quantity of the first sub-item listed under such item, the contractor will be paid at the contract unit price for that sub-item for the actual quantity of work performed and, in addition, an equitable adjustment shall be made in accordance with the clause FAR 52.211-18, Variation in Estimated Quantities.

(c) If the actual quantity of work performed under Items No 0009 exceeds 115% or is less than 85% of the total estimated quantity of the sub-item under that item and/or if the quantity of the work performed under the second sub-item or any subsequent sub-item under Items No.

0009 exceeds 115% or is less than 85% of the estimated quantity of any such sub-item, and if such variation causes an increase or a decrease in the time required for performance of this contract the contract completion time will be adjusted in accordance with the clause FAR 52.211-18, Variation in Estimated Quantities. ...AM#9

The Contractor shall be responsible for complying with the current edition and all changes posted on the web (see web address above) as of the effective date of this solicitation and shall comply with the version in effect on the contract award date. This EM 385-1-1 shall remain in effect throughout the life of the contract.

1.3.2 SCR-SS030 Communication Security:

All communications with DOD organizations are subject to COMSEC review.

Contractor personnel shall be aware that telecommunications networks are continually subject to intercept by unfriendly intelligence organizations.

The DOD has authorized the military departments to conduct COMSEC monitoring and recording of telephone calls originating from or terminating at DOD organizations. Therefore, civilian Contractor personnel are advised that any time they place a call to or receive a call from Alaska District offices or Resident Engineer offices located on military installations, they are subject to COMSEC procedures. The Contractor will assume the responsibility for ensuring wide and frequent dissemination of the above information to all employees dealing with official DOD information.

1.3.3 SCR-SS040 Haul Roads:

Whenever practical, one-way haul roads shall be used on this contract.

Haul roads built and maintained for this work shall comply with the following:

1. One-way haul roads for off-the-road equipment; e.g., belly dumps, scrapers, and off-the-road trucks shall have a minimum usable width of 25 feet. One-way haul roads for over-the-road haulage equipment only (e.g., dump trucks, etc.) may be reduced to a usable width of 15 feet.

When the Contracting Officer determines that it is impractical to

DOCUMENT 00 73 00.03 29 Page 7 obtain the required width for one-way haul roads (e.g., a road on top of a levee), a usable width of not less than 10 feet may be approved by the Contracting Officer, provided a positive means of traffic control is implemented. Such positive means shall be signs, signals, and/or signalman and effective means of speed control.

2. Two-way haul roads for off-the-road haulage equipment shall have a usable width of 60 feet. Two-way haul-roads for over-the-road haulage equipment only may be reduced to a usable width of 30 feet.

3. Haul roads shall be graded and otherwise maintained to keep the surface free from potholes, ruts, and similar conditions that could result in unsafe operation.

4. Grades and curves shall allow a minimum sight distance of 200 feet for one-way roads and 300 feet for two-way roads. Sight distance is defined as the centerline distance an equipment operator (4.5 feet above the road surface) can see an object 4.5 feet above the road surface. When conditions make it impractical to obtain the required sight distance (e.g., ramp over levees), a positive means of traffic control shall be implemented.

5. Dust abatement shall permit observation of objects on the roadway at a minimum distance of 300 feet.

6. Haul roads shall have the edges of the usable portion marked with posts at intervals of 50 feet on curves and 200 feet maximum elsewhere. Such markers shall extend 6 feet above the road surface and, for nighttime haulage, be provided with reflectors in both directions.

1.3.4 SCR-SS060 Preservation Of Historical, Archaeological & Cultural Resources:

A. Known historical, archeological and cultural resources within the Contractor's work area are designated on the contract drawings. The Contractor shall install protection for these resources as shown on the drawings and shall be responsible for their preservation during the contract.

B. If, during construction activities, the Contractor observes items that might have historical or archeological value, such observations shall be reported immediately to the Contracting Officer so that the appropriate authorities may be notified and a determination can be made as to their significance and what, if any, special disposition of the finds should be made. The Contractor shall cease all activities that may result in the destruction of these resources and shall prevent its employees from trespassing on, removing, or otherwise damaging such resources.

1.3.5 SCR-SS070 Time Extensions For Unusually Severe Weather (ER 415-1-15, 31 OCT 89):

A. This provision specifies the procedure for determination of time extensions for unusually severe weather in accordance with the Contract Clause entitled "DEFAULT (FIXED PRICE CONSTRUCTION)". In order for the Contracting Officer to award a time extension under this clause, the following conditions must be satisfied:

DOCUMENT 00 73 00.03 29 Page 8

1. The weather experienced at the project site during the contract period must be found to be unusually severe; that is, more severe than the adverse weather anticipated for the project location during any given month.

2. The unusually severe weather must actually cause a delay to the completion of the project. The delay must be beyond the control and without the fault or negligence of the Contractor.

B. The following schedule of monthly anticipated adverse weather delays is based on National Oceanic and Atmospheric Administration (NOAA) or similar data for the project location and will constitute the base line for monthly weather time evaluations. The Contractor's progress schedule must reflect these anticipated adverse weather delays in all weather dependent activities.

Monthly Anticipated Adverse Weather Delay Work Days Based on a 5-Day Work Week

JAN FEB MAR APR MAY JUN JUL AUG SEP OCT NOV DEC

22 20 21 21 0 4 4 6 0 14 21 22

C. Upon acknowledgement of the Notice to Proceed and continuing throughout the contract, the Contractor shall record on the daily CQC report, the occurrence of adverse weather and the resultant impact to normally scheduled work. Actual adverse weather delays days must prevent work on critical activities for 50 percent or more of the Contractor's scheduled workday. The number of actual adverse weather days shall include days impacted by actual adverse weather (even if adverse weather occurred in previous month), be calculated chronologically from the first to the last day in each month, and be recorded as full days. If the number of actual adverse weather days exceeds the number of days anticipated in Paragraph B, above, the Contracting Officer will convert any qualifying delays to calendar days, giving full consideration for equivalent fair weather workdays, and issue a modification in accordance with the Contract Clause entitled "DEFAULT (FIXED-PRICE CONSTRUCTION)".

1.3.6 SCR-SS080 Electrical Conformance Inspection

Provisions shall be made by the contractor for Government inspection of those parts to be energized of all service equipment, transformers, switchboards, panel boards, non-power limited industrial control panels, and motor control centers. Inspections shall be performed after electrical construction is complete, before equipment is energized, and prior to final inspection. However, if special circumstances require parts to be inspected while energized, the contractor shall provide exposure of, and safe and controlled access to, the live parts.

The Government shall be notified not less than five (5) work days in advance of the scheduled inspection date. The Government inspector will be an electrician or electrical engineer qualified (as defined in NFPA 70E) to perform this type of work. Deficiencies found during the inspection shall be documented and corrected, and, at the Government's discretion, re-inspected under the provisions of this paragraph.
