SECTION SF 30 BLOCK 14 CONTINUATION PAGE

SUMMARY OF CHANGES

QUESTIONS AND RESPONSES:

1. Question: Is the contractor allowed to dewater the excavation? Note 4 W-2 of the plans states- All drainage from within the construction limits shall be drained into the excavation. Drainage or dewatering to marine waters or nearby freshwater creeks is prohibited. Section 31 23 00.00 20 excavation and fill 3.1.1.1 drainage states- So that construction operations progress successfully, completely drain construction site during periods of construction to keep soil materials sufficiently dry.

Given the conflict of the above notes is the contractor allowed to dewater the basin?

Please explain .

Response: The government does not have permits to discharge water from the site into any nearby stream, wetland, or marine water. All dewatering of the excavated material must occur within the construction boundary and water will be collected in the excavated harbor basin area. The excavated harbor basin material may be placed in the disposal area and be allowed to drain back into the harbor basin to allow the soil to become sufficiently dry for working. It is anticipated that the harbor basin will fill with water and that the excavation will be wet.

2. Question: This job requires evidence of bidders qualifications, including financial statements less than 6 months old. The standalone financial statement for GCCO is produced annually, and was last produced in March 2009. We do have current 10Q (9/30/09) for GCI. Will the 2008 GCCO standalone financial statement, in conjunction with the GCI 10Q 9/30/09 will satisfy the financial statement requirement?

Response: Yes it will.

3. Question: Section 01 22 00.00 10 part 1.2.2.1 Measurement of Access Road Fill states “ Measurement shall be made to the original surface before performance of work and to the finished surface at the lines and lines and elevations shown on the drawings after completion of work.” I interpret this to mean that the original surface is the top of the grubbing layer. If this is correct then the volume of access road fill placed to replace the grubbing is incidental. The plan quantity is based on the actual volume of fill placed. Please clarify or revise the plan quantity.

Response: As part of this amendment the referenced paragraph has been deleted, due to the deletion of the requirements to construct access roads.

4. Question: Page 14 of 92 of the bid documents- Note to Offerors #3 reads “ The following options (if needed) will be exercised concurrently. “

i. 0011, 0012

ii. 0013, 0014, 0015, 0016 Items 0011-0013 are base bid items. Please clarify the intent of this note.

Response: This note has been corrected in the revised Proposal Schedule issued as part of this amendment.

EVALUTIONS OF OFFERS.

1. AWARD: Award will be made in accordance with Section 00 22 11, PROPOSAL SUBMISSION

REQUIREMENTS, EVALUATION CRITERIA AND BASIS FOR AWARD.

Award will be made to the low, responsive, responsible offeror on the total of all items (Base and

Options).

2. INCOMPLETE OFFERS: Failure to submit an offer on all items in the schedule constitutes an incomplete offer. Incomplete offers may be rejected. Lump sum or unit prices must be shown for each item within the schedule.

3. EXTENSIONS: All extensions of the unit prices shown will be subject to verification by the Government.

In case of variation between the unit price and the extension, the unit price will be considered to be the offer.

4. SPECIAL CONDITION: If a modification to an offer based on unit prices is submitted which provides for a lump sum adjustment to the total estimated cost, the application of the lump sum adjustment to each unit price in the proposal schedule must be stated. If it is not stated, the offeror agrees that the lump sum adjustment shall be applied on a pro rata basis to every unit price in the proposal schedule.

NOTE TO OFFERORS:

1. The Federal portion of this project is being funded under the American Recovery and Reinvestment Act of

2009 (ARRA). Due to this the Line Items in the Proposal Schedule are required to be separated based on the Cost Share percentage in order to separate the Federal ARRA funding from the Local funding. These percentages are reflected in the quantities for the unit price line items and as a percentage for the lump sum line items.

2. In accordance with FAR 52.215-1 Instructions To Offerors - Competitive Acquisition (Jan 2004) para.

(f)(8), “The Government may determine that a proposal is unacceptable if the prices proposed are materially unbalanced between line items or subline items. Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one or more contract line items is significantly overstated or understated as indicated by the application of cost or price analysis techniques. A proposal may be rejected if the Contracting Officer determines that the lack of balance poses an unacceptable risk to the Government.”

3. The following Option Items (if needed) will be exercised concurrently.

- 0018, 0019, 0020

- 0021, 0022, 0023, 0024, 0025, 0026, 0027, 0028, 0029, 0030

4. A permit to divert a stream was being processed by the State of Alaska at the time this solicitation was released. The permit is expected to be issued well before the proposal due date and coordination with regulators has allowed the design and anticipated permit-related conditions and stipulations to be incorporated into the solicitation. However, no award will be made until all required permits are obtained.

The Government reserves the right to cancel this solicitation prior to award with no obligation to the offeror or the Government if unanticipated and insurmountable permitting issues are encountered.
