The purpose of the meeting was to ask for contractor input and comments on the draft solicitation, specifications, and drawings that were issued on www.fbo.gov on November 24, 2009. A Transcript of the pre-solicitation meeting is attached (Attachment 1).
Based on the discussions in the meeting as recorded in the transcript, the follow clarifications are provided.
1. Lowest Price Technically Acceptable. Discussions in the meeting seem to imply that the Lowest price technically acceptable (LPTA) was a different procurement method than Best Value. LPTA is not a separate procurement method from Best Value. It is a form of Best Value. As shown in FAR Subpart 15.1 -- Source Selection Processes and Techniques, LPTA source selection process is appropriate when best value is expected to result from selection of the technically acceptable proposal with the lowest evaluated price.
When using the lowest price technically acceptable process, the following apply:
(1) The evaluation factors and significant subfactors that establish the requirements of acceptability shall be set forth in the solicitation.
(2) Tradeoffs are not permitted. The government will not consider award to other than the lowest priced technically acceptable offeror.
(3) Proposals are evaluated for acceptability but not ranked using the non-cost/price factors.
(4) Exchanges may occur (see FAR 15.306). If these exchanges involve discussions as described in FAR 15.306, then final proposal revisions as described in FAR 15.307 will be requested from all offerors within the competitive range.
15.307 -- Proposal Revisions
Offerors are reminded that in accordance with FAR 52.215-1 Instructions To Offerors - Competitive Acquisition (Jan 2004) para. (f)(8), “The Government may determine that a proposal is unacceptable if the prices proposed are materially unbalanced between line items or subline items. Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one or more contract line items is significantly overstated or understated as indicated by the application of cost or price analysis techniques. A proposal may be rejected if the Contracting Officer determines that the lack of balance poses an unacceptable risk to the Government.”
2. Accommodations for Government Personnel. As part of the solicitation offerors will be provided with Points of Contact for the City of Akutan. In addition, contractors may want to contact Trident Seafood processors as potential sources for room and board for the project. Accommodations at Trident Seafoods may be a potential for government personnel as long as the requirements in the specifications are met.
Local Points of Contact in Akutan for the Project
City of Akutan, Joe Bereskin, Mayor, 907-907-698-2241 Trident Seafood Processors, Steve Francis, 907-698-2211
3. Environmental Requirements for Barges. Barges can only be beached no more than 13 consecutive days.
4. Quality Control Requirements for Personnel. The draft specification Section 01 45
04.00 29, para 3.4.1 contained a requirement for a Design Quality Manager. This requirement has been removed from the final specifications that are to be issued as part of the solicitation.
5. Silt Curtain. Based on the discussions and further review of the specifications, the specifications for Silt Curtains have changed. In the final specifications that are to be issued as part of the solicitation the following changes are being made to the environmental requirements for a silt curtain:
Specification Section 01 57 20.00 10, para. 1.9.2 Beach Berm Excavation and Breakwater/Slope Protection Construction, para. 3. During all excavation in marine waters, the work shall be isolated from adjacent marine waters by the use of a silt curtain.
The silt curtain shall extend from the surface to a depth of at least 10 feet or to full depth, which ever is less, where depths are 20 feet below MLLW or less and shall extend from the surface to at least half way through the water column where depths exceed 20 feet MLLW. With the silt curtain in place, and with the Contracting Officer's written approval, the harbor will be breached by excavating the remaining material for the entrance channel and breakwaters. Silt curtains are not required for placing rock for breakwater construction.
6. Rock Quarry Testing, Prequalifying Quarries. During the pre-solicitation conference, several questions were asked about the Corps of Engineers prequalifying quarries. After review, the specifications for rock testing remain unchanged. As stated in Specification Section 35 31 19, Part 2 Products, para. 2.1 Rock Source. There is no Government furnished or designated rock source for this project. The Contractor shall obtain rock which meets all requirements specified herein.
