Industry Questions and Answers #1

Question 1: DOT Number

The agency has already awarded solicitation W9115125Q0023 to a vendor, which was previously issued under Contract W9115125P0011. However, the vendor performing these hauling services did not possess a Department of Transportation (DOT) number— either for hauling operations or for brokering. Although we have raised this concern before, it appears your office believes current practices comply with the law. We respectfully disagree, as the legal counsel’s position seems to reflect a misunderstanding of the relevant DOT requirements.

Answer 1: DOT Number

There is no awarded contract for solicitation W91151-25-Q-0023. All vendors are required to abide by all state and federal transportation and licensing requirements. In accordance with the amended solicitation, the winning vendor shall provide proof of all licenses and certifications within five business days of the first task order award. These documents are also required for entry to the federal installation and all work will be performed on Fort Cavazos.

The agency does not deem it appropriate to include this requirement as an evaluation criterion for solicitations, as interested companies are authorized to subcontract portions of work and due to the uncertain performance date, the selection of a specific subcontractor may not be formalized at the time of their quote. Any subcontractors used must meet all of the same state and federal licensure and certification requirements.

Question 2: Oversize / Overweight Cargo

We also request clarification on whether the cargo involves oversized or overweight loads under DOT and Texas Department of Transportation (TXDOT) regulations. If so, please specify:

1. The number of trucks needed for oversized cargo

2. The estimated number of load runs

3. The Texas counties where these loads will be transported

Answer 2: Oversize / Overweight Cargo

1. In accordance with the PWS, linehaul vehicles should meet the outlined requirements. There is no requirement to move overweight or oversize equipment.

2. The number of transport runs is approximately four 15–20-mile roundtrips per flatbed, Monday through Friday, accomplished during standard rail yard operations hours of 8AM to 4PM local time.

3. Not applicable as all transportation will be done within Fort Cavazos Cantonment.

Question 3: Cargo and Quantities Specifications

The primary objective of this solicitation is to secure local freight services within the Fort Cavazos garrison and surrounding areas. However, as a freight services requirement, the solicitation does not provide the specific quantities or descriptions of cargo. This information is critical to:

• Determine Appropriate Equipment: We need to ensure that adequate rigging equipment is allocated for each type of hauled cargo.

• Develop Accurate Pricing: Potential offerors must anticipate the number of trucks “runs” and thereby assess fuel consumption and other operational costs.

We note that density lists for equipment deployed by the 1ACBT and similar brigades have often been published as part of standard Army procedures. We request that you provide a density list or any comparable documentation, so all offerors have a clear and consistent basis for evaluating scope and pricing.

Answer 3: Cargo and Quantity Specifications

1. The number of transport runs is approximately four 15–20-mile roundtrips per flatbed, Monday through Friday, accomplished during standard rail yard operations hours of 8AM to 4PM local time.

2. General descriptions of the equipment and density list will be provided as an attachment in the solicitation.

General examples of equipment:

• QUADCON, TRICON, CONEX, MILVAN and 20 Foot Containers

• Mine plows, rollers, small generators

• Various small or medium sized vehicles in accordance with the UDL.

Question 4: Movement Plan

The solicitation does not specify distances or locations for loading and unloading, further complicating pricing. More clarity is necessary since fuel consumption and transit time are critical cost drivers.

We respectfully request the following information:

1. Loading and Unloading Points (Coordinates)

2. Any Traffic Constraints (roads restricted for use or special travel conditions)

3. Item-by-Item Breakdown of loading and unloading points correlating with the density list

Answer 4: Movement Plan

1. Distance between the gate and rail operations center is approximately 7 miles and distance between the rail and line haul and equipment disposition locations is approximately 15-20 miles round-trip. Exact locations and coordinates will be provided to the awardee and upon arrival, equipment operators.

2. There are currently no specific traffic constraints, the best routes will be provided to the drivers from the unit coordinator based on day-to-day conditions.

3. The density list will be provided as an attachment with the solicitation.

Question 5: Weekend Work

The current solicitation treats all optional service dates—including weekends—as part of the same category. However, weekends typically incur overtime and different rates.

Therefore, we respectfully request that your office clearly distinguish between weekends and standard business days in the solicitation, reflecting the distinct tariffs or rates associated with each.

Answer 5: Weekend Work

The Rail Operations Center (ROC) does not authorize weekend work or overtime, as such, there is no expectation for weekend work nor operations outside of standard business hours as outlined in the solicitation.

Question 6: Contradiction in Solicitation: Fixed Price vs. 30-Day IDIQ

The solicitation requests a firm fixed-price quote yet stipulates a 30-day IDIQ arrangement, stating that “the contractor will only invoice for days used.” This requirement contradicts the fundamental premise of a fixed-price contract. We respectfully ask the agency to clarify or reconcile these inconsistencies to ensure both fairness and compliance with the Federal Acquisition Regulation (FAR).

Answer 6: Contradiction in Solicitation: Fixed Price vs. 30-Calender Day IDIQ

The solicitation is amended to approximately a 30 Calendar Days Indefinite Delivery Indefinite Quantity (IDIQ) Contract with a ceiling and Task Orders will be awarded as Firm Fixed-Priced.

Question 7: WAWF Information

Additionally, no WAWF (Wide Area Workflow) information has been applied to Solicitation No. W91151-25-Q-0023. We would appreciate clarification on whether this solicitation will indeed proceed to award, along with any details on how vendors are expected to submit invoices or track performance if awarded under this solicitation number. Additionally, we would like to know if any WAWF information has already been applied, since W91151-25-Q-0023 has already been awarded

Answer 7: WAWF Information

W91151-25-Q-0023 is the solicitation and it has not been awarded yet. Once the contract has been awarded, the WAWF clause 252.232-7006 will be updated to include all details on how the vendor will be required to submit invoices on the actual contract. This information is not included in the solicitations.
