Government Responses to Contractors Questions
Question 1: Solicitations We have identified two additional solicitations published by your office that also require material handling equipment: W9115125R0003 and W9115125Q0005. These solicitations remain active, as neither has been awarded nor canceled, and they appear to include similar requirements.
Request for corrective action:
· Please clarify whether Solicitation W9115125Q0008 competes with W9115125R0003 and W9115125Q0005.
· If overlap exists, we request clarification on how the agency manages these overlapping solicitations to avoid redundancy or confusion.
Gov’t Response 1:
The solicitations identified as W9115125Q0008, W9115125R0003, and W9115125Q0005 are distinct and independent requirements. There is no overlap or competition among these solicitations, as each one pertains to a different category of equipment necessary for fulfilling separate operational needs. Each solicitation specifies unique equipment types required to meet the particular specifications and objectives outlined in their respective requirements. W9115125R0003 has been awarded and updated on SAM to reflect this award.
Question 2: Fixed Price with adjustments Page 1 of the solicitation states, "Firm-Fixed-Price Contract for MHE Redeployment Service," yet on Page 31, Section 5.1.4, it states:
"The Government shall not be charged for decreasing quantities or periods of performance due to changes in operational requirements. Any changes shall be prorated at the calculated daily amount to adjust for increasing or decreasing requirements."
This language appears contradictory. A firm-fixed-price contract, as defined under FAR 16.202, does not allow for price adjustments due to changes in performance or quantity. We seek clarification to ensure full alignment with FAR 16.202 and the fixed-price contract structure.
Request for corrective action:
· Please clarify and resolve this inconsistency.
· If price adjustments are indeed required, we ask the agency to rectify any potential violation of FAR 16.202 and provide an updated pricing structure.
Gov’t Response 2:
The government will update and post an amended solicitation to ensure full alignment with a Firm-Fixed Price contract structure in accordance with all applicable statutes and regulations.
Question 3: Sites, Locations and distances Page 31, Section 5.1.1, states: "Locations will be specified by the COR, but include unit motor pools, a deployment readiness facility, and a rail operations center."
However, the solicitation lacks sufficient detail regarding all actual sites' specific pickup and drop-off locations. Distance is a critical factor in determining pricing in the transportation industry, and the ambiguity around these locations presents challenges in developing accurate quotes.
To solve these unknown locations, we request the contracting office to provide the following corrective actions:
· Please provide detailed information about all pickup/drop-off locations, including specific motor pools and line haul sites.
· Include any route constraints, such as required paths or restricted roads.
· Please provide an aerial image or Google Maps snapshot showing these locations and routes to improve understanding.
Gov’t Response 3:
The U.S. Army's operational security (OPSEC) regulations are primarily governed by Army Regulation (AR) 530-1 titled "Operations Security". In compliance with OPSEC regulations, detailed information regarding locations—such as restricted roads, logistics, operational plans, capabilities and aerial images will not be published on a public site. If such information is publicly disclosed or shared inappropriately, it could potentially compromise operational security. This critical information will be provided during the post-award meeting with the awarded vendor and the Contracting Officer’s Representative (COR). Recognizing that distance plays a key role in pricing, contractors can apply a 25-mile radius for the requirement once on Fort Cavazos. Additionally, the approximate distance between the gate and rail operations center is approximately 7 miles, while the approximate distance between the rail and line haul and unit motor pool is approximately 8 miles. OPSEC Requirements also outline the need for Contractor to have training to enter Fort Cavazos.
Question 4: Line haul quantities / Transported Equipment Transportation industry standards rely on precise quantities and equipment details to calculate distances and accurately quote. While the solicitation implies a line haul service, it does not specify the amounts of each type of equipment to be transported or the location of pickup/drop off per piece of equipment.
To solve these unknown quantities, we request the contracting office to provide the following corrective actions:
· Please provide a detailed list of equipment requiring line haul services.
· Include pickup and drop-off logistics, including quantities and weights for each item.
· Please provide a projected logistic plan to help offerors develop realistic quotes.
Gov’t Response 4:
It is not possible to accurately determine which equipment will be Non-Mission Capable (NMC) requiring line haul until it has been physically inspected and removed from the transport vessel and/or the rail line. This uncertainty is inherent to the nature of the operation, as the condition and configuration of the equipment will only be fully understood once it reaches the designated arrival point and undergoes inspection. As a result, the solicitation is structured around the required MHE (Material Handling Equipment) needed to support the unit’s mission of moving all assets. By submitting a technical approach, the vendor enables a thorough evaluation of all offers, ensuring that the submitted quotes can be assessed for technical acceptability. Part 1 Section 1 General Information of the PWS provides information on the type of equipment with weight range being moved as well as locations.
Question 5: Legal Compliance The solicitation requires a commercial hauling service under Department of Transportation (DOT) regulations. Contractors providing such services must hold a valid DOT number as a transporter, hauler, or broker. However, this solicitation does not specify this as a requirement.
Concern:
We identified past instances where similar contracts were awarded to companies without valid DOT numbers, potentially violating FAR 1.602-1(b), which requires the contracting officer to ensure compliance with all legal and regulatory requirements.
Request for corrective action:
To ensure compliance with DOT regulations and FAR 1.602-1(b), we recommend adding a pass/fail evaluation criterion requiring offerors to hold a valid DOT number.
This will create a fair and compliant competitive environment and prevent non-regulated entities from gaining an unfair advantage by offering lower, non-compliant quotes.
Gov’t Response 5:
To legally operate a semi-truck or any commercial vehicle for transportation services, contractors must be registered with the Department of Transportation (DOT) as a transporter, hauler, or broker. This registration ensures compliance with federal regulations, including those related to vehicle safety, driver qualifications, and other operational standards. While the solicitation requires “contractors to provide all applicable safety equipment and comply with relevant safety laws and regulations (including federal, state, local, and DoD regulations)”, it underscores the necessity of a valid DOT number for compliance with these requirements. In addition to the legal requirement for contractors to be registered with the Department of Transportation (DOT) to operate commercial vehicles, a valid DOT number is also essential for gaining access to Army installations through the commercial gate. Army regulations mandate that contractors operating commercial vehicles on military posts must have a valid DOT number to be granted entry. This requirement ensures that only properly registered and compliant vehicles are allowed onto the installation, in accordance with security and safety protocols.
