Combined Synopsis/Solicitation W91151-25-Q-0008
MHE REDEPLOYMENT SERVICE
This is a combined synopsis/solicitation for commercial services prepared in accordance with the format in FAR Subpart 12.6 and 13.5, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. The solicitation number is W91151-25-Q-0008. This combined synopsis/solicitation document incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2025-01, effective 12 November 2024 and DFARS Defense Publication Notice Current to DPN: 15 November 2024.
MICC Fort Cavazos intends to award a Firm-Fixed-Price Contract for MHE Redeployment service. The North American Industrial Classification System (NAICS) code for this procurement is 532490 – Other Commercial and Industrial Machinery and Equipment Rental and Leasing, Business Size Standard $40M. This requirement is a 100% Total Small Business Set-Aside acquisition. See the attached Performance Work Statement (PWS) for full requirement details.

This solicitation will close at 11:00 AM Central Time on November 25, 2024. Quotations received after this date and time will be considered late in accordance with FAR 52.212-1(f) and will not be evaluated. The Contracting Officer intends to make an award without discussions; however, that does not prevent the Contracting Officer from holding discussions if it is in the best interests of the government. All quotes must reference and acknowledge all amendments posted to this solicitation, if applicable.
All questions must be submitted no later than 2:00 PM Central Time on November 21, 2024, to both the Contract Specialist and the Contracting Officer at the above email addresses. E-mail is the preferred method for questions.

Period of Performance: 09 December 2024 to 20 December 2024
Place of Performance: Fort Cavazos, TX 76544
The contractor shall provide one (1) 15K Forklift w/ operator, two (2) 35K Forklift w/ operators, two
(2) 50Ton Detachable Gooseneck w/ operators, three (3) 53’ Flatbed Trucks w/ operators, and one
(1) 50 Ton Crane w/ operator and spotter, on Mondays through Fridays during the hours of 0730 to 1700.
The Contractor shall submit all and any other pertinent information for the following Contract Line-Item Numbers (CLINs). Include sufficient detail to evaluate compliance with the requirements in the solicitation.

PoP is a total of 10 days, the usage of two (2) 35K forklift for 10 days equal 20 days. Invoice for the days of usage of each 35K forklift.

Contractor shall provide all applicable safety equipment, and shall meet all applicable safety laws, and regulations (Federal, State, local, and DoD regulations where services are being provided). The forklift shall be suitable for its intended use and shall be operated with due care and within all operating safety limits.
PoP is a total of 10 days, the usage of two (2) 50 Ton detachable gooseneck (semi with trailer) for 10 days equal 20 days. Invoice for the days of usage of each 50 Ton detachable gooseneck.

Contractor shall provide 53’ Flatbed Truck (Semi with Trailer) with Operator. Capability shall be capable of transporting standard shipping container and 30K lbs.
Fuel shall be included to support operations throughout the duration of the period of performance. The 53’ Flatbed Truck (Semi with Trailer) provided shall be in sound mechanical condition. Contractor shall provide all applicable safety equipment, and shall meet all applicable safety laws, and regulations (Federal, State, local, and DoD regulations where services are being provided). The Flatbed Truck (Semi with Trailer) shall be suitable for its intended use and shall be operated with due care and within all operating safety limits.

0005 MHE - 50 Ton Crane with Operator and Spotter
Contractor shall provide a 50 Ton Crane with Operator and Spotter.
Capability shall be capable of lifting and pivoting/rotating and placing equipment weighing up to 50T on rail cars and flatbed trailers. Fuel shall be included to support operations throughout the duration of the period of performance. The 50T Crane provided shall be in sound mechanical condition.
Contractor shall provide all applicable safety equipment, and shall meet all applicable safety laws, and regulations (Federal, State, local, and DoD regulations where services are being provided).
The 250T Crane shall be suitable for its intended use and shall be operated with due care and within all operating safety limits.

Factor 1 - Technical capability of the item offered to meet the Governments requirement
i. Quote shall provide the Technical Equipment Specifications to allow the Government to review the Technical Capability.
Factor 2 – Delivery
i. Include the delivery date in the Quote. The delivery of equipment and Operators/Spotters shall be NLT 09 December 2024.
Factor 3 – Price
i. Ensure each CLIN is priced and the total price is mathematically correct.

52.212-2 EVALUATION--COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
(i) Technical capability of the item offered to meet the Government requirement
(ii) Delivery Schedule
(iii) Price
Past performance is N/A.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

ADDENDUM TO 52.217-7
Addendum to Clause 52.217-7 Option for Increased Quantity-Separately Priced Line Item (Services)
(a) Definition. "Increased Quantity," as used in this clause, means additional services beyond the base quantity specified in the contract, which the Government may order at its discretion.
(b) Option. The Government may increase the quantity of services specified in the contract by giving written notice to the Contractor within 5 days after the date of this contract. The increased quantity shall be separately priced line items in the contract.
(c) Limitations. The total quantity of services ordered under this contract, including any increases, shall not exceed 204 days for each separately priced line item.
(d) Price Adjustment. The price for the increased quantity of services shall be the price specified in the contract for the separately priced line item.
(e) Other Terms and Conditions. Except as otherwise provided in this clause, all other terms and conditions of the contract shall remain unchanged.
(f) Acceptance. The Contractor's acceptance of the increased quantity order shall be indicated by the Contractor's acknowledgment of the Government's order or by the Contractor's performance of the increased services.
(g) Delivery Schedule. The delivery schedule for the increased quantity of services shall be as agreed upon by the Government and the Contractor.

52.217-8 OPTION TO EXTEND SERVICES (NOV 1999)
The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within THREE (3) calendar days of the end of the performance period.
52.219-14 LIMITATIONS ON SUBCONTRACTING (DEVIATION 2021-O0008) (FEB 2023)
(a) This clause does not apply to the unrestricted portion of a partial set-aside.
(b) Definition. “Similarly situated entity,” as used in this clause, means a first-tier subcontractor, including an independent contractor, that—
(1) Has the same small business program status as that which qualified the prime contractor for the award (e.g., for a small business set-aside contract, any small business concern, without regard to its socioeconomic status); and
(2) Is considered small for the size standard under the North American Industry Classification System (NAICS) code the prime contractor assigned to the subcontract.
(c) Applicability. This clause applies only to—
(1) Contracts that have been set aside for any of the small business concerns identified in 19.000(a)(3);
(2) Part or parts of a multiple-award contract that have been set aside for any of the small business concerns identified in 19.000(a)(3);

(e) Limitations on subcontracting. By submission of an offer and execution of a contract, the Contractor agrees that in performance of a contract assigned a North American Industry Classification System (NAICS) code for—
(1) Services (except construction), it will not pay more than 50 percent of the amount paid by the Government for contract performance, excluding certain other direct costs and certain work performed outside the United States (see paragraph (e)(1)(i)), to subcontractors that are not similarly situated entities. Any work that a similarly situated entity further subcontracts will count towards the prime contractor’s 50 percent subcontract amount that cannot be exceeded. When a contract includes both services and supplies, the 50 percent limitation shall apply only to the service portion of the contract. The following services may be excluded from the 50 percent limitation:
(i) Other direct costs, to the extent they are not the principal purpose of the acquisition and small business concerns do not provide the service. Examples include airline travel, work performed by a transportation or disposal entity under a contract assigned the environmental remediation NAICS code 562910), cloud computing services, or mass media purchases.
(ii) Work performed outside the United States on awards made pursuant to the Foreign Assistance Act of 1961, or work performed outside the United States required to be performed by a local contractor.

(4) Construction by special trade contractors, it will not pay more than 75 percent of the amount paid by the Government for contract performance, excluding the cost of materials, to subcontractors that are not similarly situated entities. Any work that a similarly situated entity further subcontracts will count towards the prime contractor’s 75 percent subcontract amount that cannot be exceeded.
(f) The Contractor shall comply with the limitations on subcontracting as follows:

(a) Definitions. As used in this clause—
“Department of Defense Activity Address Code (DoDAAC)” is a six position code that uniquely identifies a unit, activity, or organization.
“Document type” means the type of payment request or receiving report available for creation in Wide Area WorkFlow (WAWF).

PART 1
GENERAL INFORMATION
1. GENERAL INFORMATION: This is a service contract with equipment and personnel to provide MHE capable of loading containerized and non-containerized equipment weighing less than 12,000 lbs and no more than 50 Tons. Containerized equipment will be configured in containers ranging from quadcon to twenty-foot equivalent unit (TEU) and possible forty-foot containers. Non-containerized equipment could be any range of armored or unarmored military vehicle. The contractor shall provide capability to simultaneously upload and download containerized equipment across several battalion footprints located in Fort Cavazos and West Fort Cavazos. Locations also include the wash rack, line haul site, Deployment Ready Reaction Field (DRRF) and the Rail Operations Center (ROC) to support, 1st Cavalry Division Sustainment Brigade deployment and redeployment operations.
1.1. Description of Services/Introduction: The contractor shall provide all personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, and other items and non-personal services necessary to perform services and capabilities as defined in this Performance Work Statement. The contractor shall perform to the standards in this contract.
1.2. Background: 1st Cavalry Division requires a MHE contract to support 553DSSB deployment and redeployment operations.
1.3. Objectives: To fulfill the U.S. Governments, need for material handling equipment (MHE) in Fort Cavazos. Obtain efficient, cost-effective services by providing MHE capable of supporting 1CD SB operations.
1.4. Scope: The contractor shall provide one (1) 15K Forklift w/ operator, two (2) 35K Forklift w/ operators, two (2) 50Ton Detachable Gooseneck w/ operator, three (3) 53’ Flatbed Trucks w/ operators, and one (1) 50 Ton Crane w/ operator and spotter, on Mondays through Fridays during the hours of 0730 to 1700. If work on weekends is required, prior coordination will be accomplished with the Contracting Officer Representative (COR) and contractor to be approved by the Contracting Officer (KO).
1.4.1 The contractor shall ensure that all assets are following all safety and environmental regulations and all 15k and 35k forklifts should be equipped with an operational internal weight scale. The scales shall be accurately calibrated for use.
1.4.2 The Contractor shall be responsible for all maintenance the equipment might need that is not considered damage due to negligence, and in the event of an emergency maintenance requirement lasting more than eight
(8) hours to repair shall be prepared to swap out the vehicle. The government will NOT provide fuel for the vehicles at any point throughout the period of performance.
1.4.3 The contractor shall have a company representative on call to respond to equipment operability issues with full telephone coverage and authority to make decisions on behalf of the company. The time starts for a required maintenance call when the Government calls or texts the company representative.
The contractor shall have a functioning voicemail. Lack of telephonic capabilities by the contractor does not relieve the contractor of liability for required time frame to make equipment operational.
1.5. Period of Performance: The period of performance shall be for both deployment and redeployment operations from 9 December to 20 December 2024. As identified in paragraph 1.4, Scope, while the intent is to support operations Monday – Friday excluding holidays, as per paragraph 1.6.4 of this PWS. Not all equipment will be required during the full duration of the period of performance. The crane is expected to be required for one day between 16-20 December. The remainder of the equipment is expected to be required between 09-20 December. Specific daily requirements will be communicated to the contractor as equipment arrives to Fort Cavazos.
1.6. 1.6.1 Quality Control Plan (QCP): The Contractor shall develop, implement, and maintain a QCP and program to ensure all work described in this contract is performed at or above the standard defined in the Performance Requirements Summary (PRS). The QCP is developed by the contractor for its internal use to ensure that it performs and delivers high-quality service. The contractor’s QCP is the means by which the contractor ensures all work complies with the requirements of the contract. The QCP identifies and corrects potential and actual problem areas throughout the entire scope of the contract.
1.6.1.1. The contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. The QCP shall be submitted within thirty (30) days of contract award. After acceptance of the QCP, the contractor shall receive the contracting officer’s (KO) acceptance in writing of proposed changes to the QC procedures. The contractor shall submit QCP changes within five (5) days to the KO and Contracting Officer’s Representative (COR) for review and approval prior to implementation.
1.6.1.2. The Quality Control Plan shall address as a minimum:
1.6.1.2.1 Inspection Program. Included shall be a quality control inspection program covering all general and specific tasks included in the contract scope of work. It shall specify tasks or areas to be inspected on a scheduled or unscheduled basis, the manner in which inspections are to be conducted, the titles of the individuals who will perform the inspections, and the percentage of the work that will be inspected on a recurring basis. In developing this inspection program, the Contractor shall identify the key activities and associated characteristics in each process that have a significant influence on specific services and provide for methods for evaluation of the selected characteristics.
1.6.1.2.2 Deficiency Identification.
