Introduction. This is a non-personal services contract to provide Solid Waste Management in support of the Directorate of Public Works (DPW). The Government will not exercise any supervision or control over the contract service providers. The Contractor shall perform to the standards specified in this Performance Work Statement (PWS). Contract service providers shall be accountable solely to the Contractor who, in turn is responsible to the Government.

Background. The Contractor shall perform Solid Waste Management of the Fort Hood Installation. Fort Hood is located near Killeen, Texas and consists of approximately 218,823 acres and 5,838 buildings. The on post population consists of approximately 65,000 military, Government civilians, Contactor personnel, and resident family members. Fort Hood supports an overall population of nearly 500,000, to include retirees, off post family members, and survivors.

Contract work shall be performed at Fort Hood, Texas which consists of the Main Cantonment, West Fort Hood, North Fort Hood, Belton Lake Outdoor Recreation Area (BLORA), Doppler radar site located at Granger Lake, all range training areas, and all areas under the control of the Fort Hood Installation, or considered Installation Real Property. Fort Hood is located approximately sixty (60) miles north of Austin and fifty (50) miles south of Waco, Texas. The main cantonment area is approximately twenty (20) miles west of Interstate Highway 35 at Belton, Texas, and adjacent to Killeen, Texas. West Fort Hood is immediately adjacent to the main cantonment. North Fort Hood is approximately twenty-five (25) miles north of the Main Cantonment. Belton Lake Outdoor Recreational Area, approximately twelve (12) miles from Fort Hood, and the Doppler radar site located at Granger Lake, approximately fifty-seven (57) miles from Fort Hood.

Objectives . The Contractor shall ensure all work accomplished in the performance of this PWS meets all applicable Federal, State, local laws, regulations and directives. The Contractor shall provide all management, supervision, personnel, supplies, materiel, and operational equipment necessary to perform Solid Waste Management.

The Contractor shall compile historical data, prepare required reports TE-J, and submit all information as specified by the Deliverables presented in the contract. The Contractor shall ensure all work in support of mission requirements tendered to the Government for acceptance conform to the measurable performance standards of quality, timeliness, and quantity specified in the PWS of this contract.

The intent is to establish work requirements that are performance-based and results-oriented. The Contractor shall determine the best and most cost effective ways to fulfill Solid Waste Management and their component needs, emphasizing innovation and commercial best practices. The Contractor shall ensure all work accomplished maintains and presents a healthy, clean, neat, and professional appearance to all Solid Waste Management included and covered by this contract in support of mission requirements for users, residents, and visitors.

Climatic Conditions . The average annual rainfall is 34 inches; with the wettest months being April, May, and June. The average annual snowfall is zero inches, with rare accumulation or no snowfall expected during the winter months. The average frost-free period (growing season) during the year is about 236 days. The first killing frost may be expected about November, and the last killing frost generally occurs in March. The average annual maximum and minimum temperatures are approximately 77.7 and 53.8 degrees Fahrenheit, respectively. Monthly normal temperatures ranged from a low of 34 degrees in the month of January to a high of 96 degrees in the month of August. Summer temperatures often reach 102 degrees Fahrenheit, while sub-freezing weather is common during the winter months.

1.4 Facility Access. The Contractor shall ensure access to all fire detection and suppression systems in case of emergencies or for other Fire Department purposes. The Contractor shall inform the Fire Department point-of-contact (POC) OMD Outages Office, and the COR, prior to outages that will impact the function of the system, special problems or circumstances, which require Fire Department inspection. The Fire Department will reset alarm systems to operational status.

1.5 Traffic Flow. The Contractor shall maintain the free flow of traffic during grounds maintenance. The Contractor shall notify the Contracting Officer (KO), in writing, a minimum of fourteen (14) calendar days in advance of any scheduled closure of roads. Emergency road closures shall be coordinated with the Contracting Officer Representative (COR) or Alternate Contracting Officer Representative (ACOR).

1.6 Drainage. Maintenance work performed under this contract shall not impede drainage. Fort Hood is permitted to discharge storm water to surface waters of the state under the Texas Pollutant Discharge Elimination System (TPDES), general permit Number XR040000. Fort Hood has developed and implemented a Storm Water Management Program (SWMP). The intent of the Fort Hood SWMP is to reduce the discharge of pollutants to the “maximum extent practicable,” to protect water quality, and to satisfy the water quality requirements of the CWA of 1972. The SWMP must be adhered to by all Soldiers, civilians, and contractors on Fort Hood. All Soldiers, civilians, and contractors are prohibited from willingly discharging pollutants into the MS4 system, including, but not limited to:

1. Oil, grease and other vehicle fluids from roadways, driveways, and parking lots.

2. Pesticides, fertilizers, and grass clippings.

3. Sediment from construction sites or sediment from military vehicles at motor pools.

4. Trash and debris, such as cigarette butts, paper wrappers, and plastic bottles.

5. Contaminated wash water containing detergents from activities such as Industrial or commercial washing of floors, vehicles, and buildings.

6. Chlorinated water or backwash water from swimming pools.

7. Hyper chlorinated water from line flushing and/or testing.

1.7 Restoration of Landscape Damage. Trees or other landscape features damaged by the Contractor’s operations shall be restored at no additional cost to the Government. The COR/ACOR will decide the method of restoration for trees or whether damaged trees will be removed.

1.8 Dust Suppression. The Contractor shall perform dust suppression as directed by the COR/ACOR.

2.0 Requirements.

2.1 Description of Services.

2.1.1 Non-Personal Services. The personnel rendering the services are not subject; either by the contract’s terms or by the manner of its administration, to the supervision and control usually prevailing in relationships between the Government and its employees. Non-personal service contracts are authorized by the Government in accordance with (IAW) Federal Acquisition Regulation (FAR) Subpart 37.104, under general contracting authority, and do not require specific statutory authorization.

2.1.2 General Information.

2.1.2.1 Period of Performance (PoP). The PoP consists of 5 years and is as follows:

2.1.3 Place of Performance and Hours of Operation.

2.1.3.1 Place of Performance. The work to be performed under this contract will be performed at the locations listed in Technical Exhibit (TE-R) Fort Hood Main Cantonment Map, (TE-S) West Fort Hood Cantonment Map, (TE-T) North Fort Hood Cantonment Map and (TE-U) BLORA Map

2.1.3.2 Hours of Operation. Contractor’s Landfill and Refuse collection hours of operation shall be 0730 – 1700 hours Monday through Friday and Saturday 0730-1400 hours to include Federal Holidays. The Contractor shall conduct business during regular hours, except for Sunday refuse collection operation shall be conducted between the hours of 0800-1400hrs. The landfill gates shall be open to all authorized customers during the Landfill hours of operation (0730 – 1700 hours Monday through Friday and Saturday 0730-1400 hours to include Federal Holidays.

2.1.3.2.1 Other Than Standard Hours of Operations. The Contractor shall NOT work outside the standard hours of operation unless written authorization from the Contracting officer is provided in advance. Deviation from these standard hours of operation may potentially be allowable for service under this contract, especially if doing so is in the Government's best interest or weather has impacted the Contractor's ability to execute work during standard hours of operation. All deviations from standard hours of operation should be documented and a record maintained by the Contractor, which shall be provided to the Contracting Officer within twenty-four (24) hours of request. No overtime is permitted under this contract. The Contractor shall manage/schedule personnel resources appropriately to preclude the need for overtime while still fulfilling all contractual requirements. Working outside the standard hours of operation shall be at no additional cost to the Government.

2.1.4 Federal Holidays

. The Contractor’s performance shall be required on the Federal public holidays listed below. Holidays occurring on weekends will be observed as directed by the Federal calendar (5 U.S.C. 6103).

2.1.4.1 The Contractor shall provide personnel support within twenty-four 24 hours of notification outside the normal hours of operation as required, including holidays, to support the Directorate of Public Works (DPW) mission. Prior to performance of services outside the locally established hours of operation, the Contractor shall request and obtain, in writing, approval from the KO. The Program Manager shall be available after normal hours to serve as the central point of contact (POC) for Contractor operations. Contractor personnel shall not be scheduled for overtime work.

2.1.4.2 Installation Closures. When an unforeseen installation closure occurs on a regularly scheduled day of work, the Contractor shall:

a. Reschedule the work to be performed the following day unless the following day is a Saturday, Sunday, a legal public holiday, and when routine work is not scheduled for that day; or

b. Reschedule the work on any day mutually satisfactory.

2.1.4.3 Inclement Weather Delay. If the Contractor determines unsafe weather conditions for continued operations, then the Contractor shall notify the KO if inclement weather suspends operations within 2 hours. The Contractor shall resume operations with KO approval.

2.1.5 Travel/Temporary Duty. N/A

2.1.6 Emergency Services. The Government may provide, on an emergency basis, medical services for job related injuries while an employee is performing under this contract. Emergency medical care is available to the Contractor employees at Carl R. Darnell Army Medical Center. Such emergency medical care will be limited to those services necessary to prevent undue suffering or loss of life and will be provided only during the period of emergency. In such circumstances, action shall be taken to transfer employees of the Contractor to a civilian health care provider as soon as the emergency period ends.

The Fort Hood Medical Emergency call number is 254-288-8114 or 911 if present on the Fort Hood Installation.

2.1.6.1 The Contractor or their employees shall immediately notify their supervisor of any accident requiring emergency medical treatment. The Contractor shall notify the COR/ACOR immediately telephonically and in written form not later than (NLT) two (2) hours of the incident.

2.1.6.2 The Contractor shall be responsible for the emergency medical treatment services for Contractor personnel.

2.1.7 Contract Administration and Management.

2.1.7.1 Post Award Conference/Performance Evaluation Meetings. The Contractor shall attend the post award conference convened by the contracting activity or contract administration office IAW FAR Subpart 42.5. The KO and COR/ACOR will meet quarterly with the Contractor to review the Contractor's performance. Written minutes of meetings will be recorded by the Government and signed by both the Contractor’s Program Manager and the KO. The written minutes will be distributed within five (5) workdays after the meeting. If the Contractor does not concur with any portion of the minutes, recorded by the Government, the non-concurrence shall be provided in writing to the KO within two (2) calendar days following receipt of the minutes.

2.1.7.2 Notwithstanding the Contractor’s responsibility for total management during the performance of the contract, the administration of the contract requires maximum coordination and cooperation between the Government and the Contractor.

2.1.7.3 The following provides the roles and their respective authority during the performance of the contract:

2.1.7.3.1 Contracting Officer (KO). The KO is the only person authorized to direct changes in any of the requirements under this contract, and, notwithstanding any provisions contained elsewhere in the contract, said authority remains solely with the KO. In the event the Contractor makes any change at the direction of any person other than the KO, the change shall be considered to have been made without authority and solely at the risk of the Contractor. All contract administration will be effected by the KO. Communications pertaining to contractual administrative matters shall be addressed to the KO. No changes in or deviation from the terms and conditions shall be affected, without a written modification to the contract, executed by the KO authorizing such changes. The KO will approve all submittals and plans required in this PWS.

2.1.7.3.2 Contracting Officer’s Representative (COR). The KO will appoint a COR during the performance of the contract. Additional Government personnel may be assigned to assist in contract oversight IAW AR 70-13, Management and Oversight of Service Acquisitions. Other surveillance personnel may be designated as COR or ACOR, and shall be trained and appointed IAW DoDI 5000.72, DoD Standard for Contracting Officer’s Representative (COR) Certification and DFARS 201.602-2. The ACOR will serve as on-site representatives of the COR in performance of actual contract surveillance, if they meet all COR training, experience requirements, and are appointed by the KO as an ACOR. The COR/ACOR will provide assistance in identification and resolution of problems, conflicts in priority, subtask requirement definitions, and other operations type problems. The COR/ACOR will perform IAW the responsibilities and duties identified in the appointment letter.

2.1.7.3.2.1COR Authority. A letter of designation will be issued to the COR/ACOR by the KO. A copy of the letter will be sent to the Contractor. The letter of designation states the responsibilities and limitations of the COR/ACOR, especially with regard to changes in cost, price estimates, or changes in delivery dates. The COR/ACOR is not authorized to change any of the terms and conditions with regard to cost TE-D, quantity, or schedule of the resulting order.
2.1.7.3.3.The Contractor shall not in any way represent the United States (U.S.) Government, or that it has the authority to contract or procure supplies for the account of the United States of America (USA).
2.1.8COR/ACOR Functions. The COR/ACOR monitors all technical aspects of the contract and assists in contract administration. The COR/ACOR is authorized to perform the following functions: assure the Contractor performs the technical requirements of the contract; perform inspections necessary in connection with contract performance; maintain written and oral communications with the Contractor concerning technical aspects of the contract; issue written interpretations of technical requirements; monitor, document, and report Contractor's performance and notify both the KO and Contractor of any deficiencies; coordinate availability of Government-Furnished Property, and coordinate site entry of Contractor personnel.
2.1.9Quality Control (QC). Quality Control is the responsibility of the Contractor. The Contractor shall provide a final Quality Control Plan (QCP) five (5) calendar days before contract start. The Contractor shall provide and maintain a QCP that is acceptable to the KO. Changes to the Contractor’s QCP shall be submitted to the KO for review and approval within five (5) business days prior to implementation.

2.1.10 Subcontract Management. The Contractor shall be responsible for any subcontract management necessary to integrate work performed on this requirement and shall be responsible and accountable for subcontractor performance on this requirement. The Contractor will manage work distribution to ensure there are no Organizational Conflict of Interest (OCI) considerations.

2.1.11 Contractor Employees. TE-K and TE-N

2.1.11.1 Contractor Key Personnel.

2.1.11.1.1 The Contractor shall provide a Program Manager who is responsible for the performance of the work. The Program Manager shall have full authority to act for the Contractor on all contract matters relating to daily operation of the contract. The name of the Program Manager shall be provided by the Contractor to the KO. The Program Manager or Landfill Manager shall be available 24 hours telephonically in case of an emergency.

The Contractor shall provide a Program Manager on-site at the Fort Hood Landfill who shall be available to the Contracting Officer during the Landfill Operating Hours. The Program Manager shall be the central point of contact with the Contracting Officer for performance of all work under the contract. The Program Manager shall be responsible for the overall management and coordination on all matters pertaining to this contract and have the authority to act or make decisions for the Contractor. The Program Manager shall be available 0730 - 1630 Monday through Friday except Federal holidays or when the Government facility is closed.

The Contractor shall provide the Contracting Officer and COR, in writing, a location (address) and local or toll-free telephone number where the Project Manager may be contacted.

The Project Manager shall have a current Texas Class A MSW (Municipal Solid Waste) License with a minimum of three (3) years’ experience operating a landfill and managing personnel that perform work under solid waste requirement. The Project Manager shall comply with requirements of The State of Texas - Texas Engineering and Land Surveying Practice Acts and Rules Concerning Practice and Licensure when submitting professional documents (i.e - historically and currently a Professional Engineer (PE) shall ensure all plans are prepared, stamped and submitted to TCEQ and the Fort Hood Landfill Permit 1866 permit is updated. The Project Manger shall maintain a Texas Class A MSW License for duration of contract and provide current license to COR upon renewal.

The Landfill Manager shall have a current Texas Class A MSW License with a minimum of three (3) years of experience in managing personnel that perform work under solid waste requirement.

The Quality Control Manager shall have a minimum of three (3) years of experience in Quality Control Inspection and Planning under solid waste requirement.

The Contractor shall provide the name of the individual who is designated as the Project Manager and Landfill Manager at time of proposal submission. The Contractor shall provide a current legible photocopy of the individual’s license to the COR/KO not later than (NLT) the contract award date. Contractor personnel performing work under this contract shall have and maintain the minimum Fort Hood Installation access background or security clearance at time of the contract start date and for the life of the contract. The Program Manager and any individuals designated as key personnel shall be able to understand, speak, read, and write the English language.

2.1.11.1.2 Personnel List. The Contractor shall provide in writing to the Contracting Officer, a list of all Contractor employees no later than five (5) calendar days after the contract award. The list shall include each employee's name, job title, telephone numbers, and employment date with the Contractor, and a legible photocopy of each employee's certifications and licenses. The Contractor shall revise and resubmit it to the Contracting Officer within one (1) calendar day of any changes of personnel.

2.1.11.1.3 N/A

2.1.11.1.4 All Contractor employees shall be legal U.S. residents. The Contractor shall immediately remove any employee that is not a legal U.S. resident. The Contractor personnel shall be able to communicate clearly in the English language.

2.1.11.1.4.1 Language Proficiency. All other Contractor employees shall meet US Department of State Language Proficiency Level 3 - Minimum Professional Proficiency standards (able to speak the language with sufficient structural accuracy and vocabulary to participate effectively in most formal and informal conversations on practical, social, and professional topics and be able to read standard newspaper items addressed to the general reader, routine correspondence, reports, and technical materials in the individual's special field).

2.1.11.1.5 Qualification Standards. The Contractor shall inspect, repair, and maintain systems and components associated with facilities listed in real property records as required throughout this contract utilizing properly trained, skilled, and qualified employees or subcontractor personnel. The Contractor shall provide objective evidence of key personnel qualifications to perform landfill operations to the KO/COR for review and acceptance.

The Project Manager shall have a current Texas Class A MSW (Municipal Solid Waste) License with a minimum of three (3) years’ experience operating a landfill and managing personnel that perform work under solid waste requirement.

The Landfill Manager shall have a current Texas Class A MSW License with a minimum of three (3) years of experience in managing personnel that perform work under solid waste requirement.

The Contractor shall provide the name of the individual who is designated as the Project Manager and Landfill Manager at time of proposal submission. The Contractor shall provide a current legible photocopy of the individual’s license to the COR/KO not later than (NLT) the contract award date.

The Quality Control Manager shall have a minimum of three (3) years of experience in Quality Control Inspection and Planning under solid waste requirement.

2.1.11.1.6 Contractor Identification. The Contractor shall ensure all personnel be identified as a Contractor to distinguish themselves (e.g., badge, company logo, or uniform) from Government employees. The Contractor shall ensure all correspondence and reports TE-J produced are marked as Contractor products or that Contractor participation is disclosed. All Contract personnel attending meetings, using Government email and network, answering Government telephones, and working in other situations where their Contractor status is not obvious to third parties, are required to identify themselves as Contractor employees to avoid creating an impression in the minds of members of the public that they are Government officials.

2.1.11.1.6.1 Identification Badges. Contractor personnel on duty shall wear Contractor provided identification badges displaying at a minimum: company name, employee name, employee photo, contract title, contract number, and contract expiration date. Identification badges shall be worn on the front upper outer garment and visible at all times. Contractor shall turn in employee identification badges to the COR upon termination of employment or completion of the contract.

2.1.11.1.7 Standards of Conduct. Contractor personnel’s conduct shall not reflect discredit upon the Government. The Contractor shall ensure all personnel present a professional appearance while working on the Government installation. The Contractor’s employees shall observe and comply with all local policies and procedures concerning fire, safety, environmental protection, sanitation, security, and possession of firearms or other lethal or illegal weapons or substance. The Contractor shall ensure all Contractor employees, providing services under the contract, conduct themselves and perform services in a professional, safe, and responsible manner. The Contractor shall remove, from the job site, any employee for reasons of misconduct or security. The Contractor shall ensure employee conduct complies with 41 USC §423, Procurement Integrity. The Contractor shall also ensure that no Contractor employees conduct political related activities or events on the installation.

2.1.11.1.8 Contractor Hiring Restrictions. The Contractor shall not hire or sub-contract with off duty or former Government employees whose employment would result in a conflict with AR 600-50, Standards of Conduct.

2.1.11.1.9 Organizational Conflict of Interest (OCI). The Contractor shall not employ any person who is a current employee of the United States Government or the Department of Defense, either military or civilian, if such employment would create a conflict of interest or be contrary to the policies contained in Joint Ethics Regulation (JER), DOD 5500.7-R. The Contractor shall not take any action which will result in an organizational conflict of interest.

2.1.12 Business Relations. The Contractor shall successfully integrate and coordinate all activity needed to execute the requirement of this PWS. The Contractor shall manage the timeliness, completeness, and quality of problem identification to a degree acceptable to the Government. The Contractor shall provide to the COR/ACOR corrective action plans, timely identification of issues, and effective management of subcontractors within one (1) day or at a mutually agreed upon date. The Contractor shall ensure customer satisfaction and professional and ethical behavior of all Contractor personnel.

2.2 Work Management. N/A

2.3 As-Builts and Geospatial Information System (GIS).

2.3.1. Maintain As-Builts. The Contractor shall maintain as-built drawings. The Contractor shall copies of all maps for maintaining landfill requirements.

2.3.1.1. Support. Hard copy markups and electronic redlines shall be delivered to the COR/ACOR at the completion of each major project as identified by the COR/ACOR or, at a minimum, at the end of each contract-year quarterly cycle. The Contractor shall validate all maps for accuracy and content.

2.3.1.2. Training. N/A

2.3.2. Real Property Records Updates. N/A

2.3.3 GIS. N/A

2.3.4 GIS Support Services. N/A

2.3.5 GIS Files. N/A

2.3.6 Other Documents. The Contractor shall update and maintain other documents TE-J, which include the following: Route Report, Weekly Schedule, Monthly Summary Report, Monthly Customer Transaction Report, Refuse Container Data Collection Report, Customer Call Report, Non-Collected/Skip Container Report, Container Cleaning Report, Container Evaluation Report, Other Reports to or from TCEQ, Grease Trap Waste Transporters Log, All Landfill Documents, Landfill Operation Records and Reports, Landfill Tickets, Landfill Cover Log, Waste Analysis Report, Special Waste Disposal Report, Ground Water Monitoring Report, Landfill Gas Monitoring Report, Waste Elevation Report, Final Closure Certification, Records Required by the TCEQ, TCEQ Annual Report, Landfill Construction Records and Reports, Landfill Scale Calibration Report, Soil Liner Evaluation Report (SLER) and Liner Evaluation Report. See 9.0 deliverable schedule for actual submission dates.

2.4 Historic Property or Archaeological Site. Historic properties and archaeological sites are subject to the provisions of the National Historic Preservation Act (NHPA). The Contractor shall maintain the historic properties on the installation IAW the NHPA, 54 United States Code (U.S.C) § 300101, National Preservation Programs Policy; 36 Code of Federal Regulations (CFR) Part 800, Protection of Historic Properties; and United Facilities Guide Specifications (UFGS). The Contractor shall comply with all applicable Federal historical structure and archeological laws.

2.4.1 Repair and Replacement. The Contractor shall report damages to the COR/ACOR within two (2) hours. The Contractor shall repair or replace parts with products similar in appearance to the original. Repairs, renovation, or replacement to historic buildings must be approved by the KO. The Contractor shall coordinate work through the Cultural Resources Manager, DPW Environmental Division. The Contractor shall comply with the appropriate provisions and stipulations of the Secretary of Interior's "Standards for Rehabilitation and Guidelines for Rehabilitating Historic Buildings" (Revised 1983) and the Integrated Cultural Resources Management Plan. Location maps are available at the DPW.

2.5 Special Requirements

2.5.1 Security.

2.5.1.1 Access and General Protection/Security Policy and Procedures. All contractor and all associated sub-contractors employees shall comply with applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative). The Contractor shall also provide all information required for background checks to meet installation/facility access requirements to be accomplished by installation Provost Marshal Office, Director of Emergency Services or Security Office. Contractor workforce must comply with all personal identity verification requirements (FAR clause 52.204-9, Personal Identity Verification of Contractor Personnel) as directed by DOD, HQDA and/or local policy. In addition to the changes otherwise authorized by the changes clause of this contract, should the Force Protection Condition (FPCON) at any Installation or facility change, the Government may require changes in contractor security matters or processes.

2.5.1.1.1 Pre-screen candidates using E-Verify Program. The Contractor must pre-screen Candidates using the E-verify Program (http://www.uscis.gov/e-verify) website to meet the established employment eligibility requirements. The Vendor must ensure that the Candidate has two valid forms of Government issued identification prior to enrollment to ensure the correct information is entered into the E-verify system. An initial list of verified/eligible Candidates must be provided to the COR no later than (NLT) three (3) business days after the initial contract award." *When contracts are with individuals, the individuals will be required to complete a Form I-9, Employment Eligibility Verification, with the designated Government representative. This Form will be provided to the Contracting Officer and shall become part of the official contract file.

2.5.1.2 Contractors who do not require CAC, but require access to a DoD Facility or Installation. Contractor and all associated sub-contractors employees shall comply with adjudication standards and procedures using the National Crime Information Center Interstate Identification Index (NCIC-III) and Terrorist Screening Database (TSDB) (Army Directive 2014-05/AR 190-13), applicable Installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative, as NCIC and TSDB are available), or, at OCONUS locations, in accordance with status of forces agreements and other theater regulations.

2.5.1.3 Motor Vehicle Operators. Contractor’s personnel, whose tasks involve operation of any vehicles, shall possess a valid driver’s license, certificates, and permits applicable for the type and class of vehicle being operated.

2.5.1.4 Contractor Vehicle Registration. The Contractor shall register all Contractor-owned or operated vehicles and trailers operating on the installation within five (5) working days of contract start date. The Contractor shall complete all applications with the Visitor Welcome Center located in Building 69012. Evidence of vehicle ownership and vehicle liability insurance must be presented upon application of vehicle registration.

2.5.1.4.1 Waste Collection Vehicles and Equipment. The Contractor shall furnish and use equipment that is two years old or newer (at contract start date), waste collection (and associated) vehicles and equipment specially-designed for the type of waste they will be used to collect and fully compatible with the Contractor-furnished waste containers and the Contractor's waste collection system. All vehicles used for collecting and transporting solid waste shall meet all applicable state and federal standards for solid waste. These standards include, but are not limited to, 49 CFR 390-396 Federal Motor Carrier Safety Standards and 40 CFR 202 Noise Emission Standards for Motor Carriers Engaged in Interstate Commerce. TE-O shall be used to provide a general estimate of necessary vehicles and equipment to perform the Solid Waste Management requirement.

The Contractor's waste collection vehicles and equipment shall be capable of functioning properly in confined or congested areas with limited maneuvering space. All waste collection and transportation vehicles and equipment shall be designed, constructed, operated, and maintained to prevent loss of liquid, fluids or solid waste and to minimize health and safety hazards to solid waste management personnel, the public, and the environment.

All waste collection vehicles and equipment shall be maintained in a clean and sanitary condition to preclude odors and breeding of flies; properly serviced to maintain proper operation; and safety inspected daily. All safety defects shall be repaired or corrected prior to using the vehicle or equipment. All Cantonment Area Refuse Collection Vehicles, Special Pickup Collection Vehicles and Roll-Off Collection Vehicles shall be the same color and of similar design for the types of containers they are servicing.

2.5.1.4.2 Contractor Vehicle and Equipment Identification. Contractor provided vehicles and equipment used in the performance of services under the contract on the Fort Hood Installation shall be clearly and legibly marked with the Contractors company name in three (3) inch block letters, or with a company logo of a color that contrasts with its background, on both sides of the vehicle.

2.5.1.4.3 The Contractor shall provide all information required for background checks to meet Installation access requirements, to be accomplished by the installation Provost Marshall Office, Director of Emergency Services, or Security Office.

2.5.1.4.4 Installation Access. The Contractor shall be responsible for assuring all Contractor personnel authorized to perform work under the contract; obtain Installation access as required by DoD Directive 4630.5, Interoperability and Supportability of Information Technology (IT) and National Security Systems (NSS). Government furnished identification shall be returned to the Government when the employee no longer performs work for the Contractor under this contract, or upon termination of the contract.

2.5.1.4.5 Access to Secure Areas. Contractor employees will be allowed access to facilities when properly having obtained access, wearing identification badges, and complying with local security procedures. All contract employees, including subcontractor employees who are not in possession of the appropriate security clearance or access privileges, will be escorted in areas where they may be exposed to classified and/or sensitive materials and/or sensitive or restricted areas.

2.5.1.4.6 Hot Work. The Contractor shall obtain approval from the Contracting Officer and Fort Hood Fire Department (254-288-5820), prior to performing any hot work or work that will require the use of an open flame. All Contractor work performance shall be IAW Fort Hood Regulation (FHR) 420-1, Fire and Emergency Services, dated 1 September 2007 or later.

2.5.1.4.7 Fire Protection. The Contractor shall comply with AR 420-1, ARMY Facilities Management Chapter 25 Fire and Emergency Services 24 August 2012, and FH 420-1, Fire and Emergency Services 1 September 2007, for fire protection and fire prevention

The Fort Hood Fire Department Emergency call number is 254-288-5820 or 911 if on the installation.

2.5.1.5 Physical Security. The Contractor shall safeguard all Government equipment, information, and property provided for Contractor use. The Contractor shall maintain a physical security checklist or log (e.g., Standard Form (SF) 701, Activity Security Checklist), which will be forwarded to the COR/ACOR, NLT the tenth (10th) of each month, following the month of surveillance. The Contractor shall secure Government facilities, equipment, and materials at the close of each work period.

2.5.1.5.1 Physical Security Plan. The Contractor shall develop and administer a Physical Security Plan (PSP) and maintain an effective physical security program to ensure the security of the physical infrastructure at Fort Hood is secure before, during and after maintenance is performed. The finalized PSP will be due to the Contracting Officer within ten (10) calendar days after contract award. The Contracting Officer may notify the Contractor of required modifications to the plan during the period of performance. The Contractor shall make the required modifications within five (5) working days after notification, and submit the modified PSP to the Contracting Officer for approval. The Contractor may recommend modifications to the PSP. Such recommendations shall be submitted to the Contracting Officer for approval NLT five (5) working days prior to requested effective date of the change. The Contracting Officer may find the PSP to be “unacceptable" and notify the Contractor; whenever the Contractor's procedures do not comply with the requirements of the contract. The Contractor shall revise the PSP within five (5) working days from receipt of notice that it is found to be "unacceptable”, and submit it to the Contracting Officer for approval.

2.5.1.5.2 Key Control/Key Control Plan. The Contractor shall establish and implement a plan IAW FHR 210-2 and FHR 190-3, which ensures that all keys/key cards issued to the Contractor by the Government are safeguarded, not lost or misplaced, and are not used by or to unauthorized persons. (NOTE: All references to keys include key cards.) The plan shall be provided to the Contracting Officer for approval within five (5) working days after contract award. In the event keys, to include master keys, are lost or duplicated, the Contractor shall be responsible for the total cost of the re-keying or the replacement of the lock(s). Also, if a master key is lost or duplicated, all locks and keys for that system shall be replaced by the Government at the contractors expense.

2.5.1.5.3 Key Access. The Contractor shall prohibit the use of Government issued keys/key cards by any persons other than the Contractor employees. The Contractor shall prohibit the opening of locked areas by Contractor employees to permit entrance of persons other than Contractor employees engaged in the performance of assigned work in those areas, or personnel authorized entrance by the Contracting Officer. The Contractor shall submit a written report of any occurrence of duplicated, lost, or misplaced keys to the Contracting Officer within one (1) working day after the discovery of the incident. The report shall contain the following information:

1. Facility and door/item containing lock;

2. Number of key;

3. Person to whom key was assigned;

4. When key was discovered missing.

The Contractor will be provided a Government furnished on-site staging area for necessary equipment and materials. The Contractor shall secure the area at the close of each work period. The Contractor shall be solely responsible for any loss or damage of equipment and material. The Contractor shall ensure debris of any type will be disposed of according to local policies and directives.

2.5.2 Security Training.

2.5.2.1 iWATCH Training. The Contractor shall brief the local iWATCH program (training standards provided by the RA’s Anti-Terrorism Officer (ATO)) to all of the Contractor’s employees and associated subcontractors. This training is used to inform employees of the types of behavior to watch for and instruct employees to report suspicious activity to the COR/ACOR. The Contractor shall complete the training within thirty (30) calendar days of contract award and within five (5) calendar days of new employees commencing performance with the results reported to the COR/ACOR NLT thirty (30) calendar days after contract award.

2.5.2.2 OPSEC Training. All new Contractor employees will complete Level I OPSEC Training within thirty (30) calendar days of their reporting for duty. Additionally, all Contractor employees must complete annual OPSEC awareness training. The Contractor shall submit certificates of completion for each affected Contractor and subcontractor employee, to the COR or to the contracting officer (if a COR is not assigned), within five (5) calendar days after completion of training. OPSEC awareness training is available at the following websites: https://www.iad.gov/ioss/ or http://www.cdse.edu/catalog/operations-security.html; or it can be provided by the RA OPSEC Officer in presentation form which will be documented via memorandum

2.5.2.3 Antiterrorism Training. All Contractor employees, to include subcontractor employees, requiring access Army Installations, facilities and controlled access areas shall complete AT Level I awareness training within thirty (30) calendar days after contract start date or effective date of incorporation of this requirement into the contract, whichever is applicable (and annually thereafter). The Contractor shall submit certificates of completion for each affected Contractor employee and subcontractor employee, to the COR or to the Contracting officer or designated representative, within thirty (30) calendar days after completion of training by all employees and Subcontractor personnel. 2.5.3Safety. The Contractor shall safeguard and maintain all Government and Contractor property, as well as provide for the safety and well-being of personnel employed under this contract. The Contractor shall comply with AR 385-10, The Army Safety Program.
2.5.3.1Safety Plan. The Contractor shall develop and implement a safety program for its employees. The Contractor shall submit the Safety Plan to the KO for review and acceptance within ten (10) calendar days of commencement of work. Revisions shall be submitted five (5) calendar days prior to the effective date of change.
2.5.3.2Occupational Safety and Health. The Contractor shall comply with the Occupational Safety and Health Administration (OSHA) standards. The Contractor shall comply with all applicable Federal, State, and local laws, regulations, and directives.

2.5.3.2.1 Safety Measures and Protective Equipment. The Contractor shall provide all personal protective equipment IAW Federal Law and the aforementioned paragraphs of section 2.5.3. Safety. Workers shall be trained in appropriate safety measures and shall not place materials, machines, or other equipment in traffic lanes or other locations that could create safety hazards. The Contractor shall maintain a safe job site, clean and free of all foreign debris during and upon completion of work. The Contractor shall remove unserviceable parts and components from Government property, unless otherwise directed by the Contracting Officer. The Contractor shall be responsible for the enforcement of all safety requirements for any work performed under the contract. If the Contractor fails or refuses to comply with safety or environmental requirements, the Contracting Officer may issue an order stopping all or part of the work IAW the Stop work Clause of the contract.

2.5.4 Training, Physical Requirements, or other Expertise Required.

2.5.4.1The Contractor shall ensure all Contractor’s employees and associated subcontractors are certified or licensed in the specific areas required by the State of Texas. The Contractor shall ensure employees are certified or licensed in the appropriate Environmental Protection Agency (EPA) areas required. The Contractor shall ensure all required documentation of certification or licensure for Contractor personnel are provided and filed with the COR/ACOR not later than (NLT) contract award date prior to employees commencing performance.
2.5.5Environmental Requirements.

2.5.5.1 Green Procurement. Section 6002 of the Resource Conservation and Recovery Act of 1976 (RCRA) requires the use of recycled and recovered products identified in the EPA’s Comprehensive Procurement Guidelines.

2.5.5.2 The Contractor shall use these recycled or recovered products unless they cannot be procured within a reasonable period of time not to exceed seven (7) calendar days; at prices not to exceed five (5) percent of prevailing rates; or the product(s) does not meet technical or performance standards. EPA Guidelines are the minimum requirement. The Contractor shall use materials and products commonly used in industry. The Contractor shall maintain records and submit an annual report to the COR/ACOR, along with the annual certification required by FAR 52.223-9 Estimate of Percentage of Recovered Material Content for EPA Designated Items, upon completion of the base year and each option year.

2.5.5.3 Environmental Compliance. The Contractor shall comply with all Federal, State, local, and installation environmental laws, rules, plans, and policies. The Contractor shall use and store all materials, chemicals, and equipment used in the performance of services on the installation IAW with industry standards, local, State and Federal laws, and according to manufactures' recommendations. The Contractor shall be financially responsible for all fines and associated costs for hazardous waste management, transportation, and disposal of waste due to the Contractor's non-compliance. The Contractor shall submit Safety Data Sheets (SDS) for approval on all materials, five (5) calendar days before delivery of the material, to the COR/ACOR. The Contractor shall provide upon request from the COR/ACOR all required data to meet environmental-mandated reporting requirements (e.g., air emission data, hazardous material storage/usage, herbicide/pesticide usage, solid/hazardous waste generation). The Contractor shall provide data to meet reporting deadlines and during compliance inspections upon request from the COR/ACOR.

2.5.5.4 Spill Plan. The Contractor shall notify the COR/ACOR within one (1) hour, if the Contractor spills or releases any hazardous substances, i.e., substances listed in 40 CFR 302, Designation, Reportable Quantities, and Notification. The Contractor shall submit a Spill Plan to the KO for approval within thirty (30) days of contract award IAW Spill Prevention Control and Countermeasure Plan.

2.5.6 Contingency Plans.

2.5.6.1 General. The Contractor shall establish, maintain, and implement a contingency plan for mobilization, disaster, and labor dispute contingencies. The plan shall assume no Government support to the Contractor workforce.
