Question #1: PWS 2.1.11.1 Can the program manager be located offsite? Can this be a corporate position?

Response: No, see revised PWS 2.1.11.1 the Program Manager is required to be on site. The Government doesn’t determine industry corporate positions.

Question #2: PWS 2.1.11.1.1 Can the government provide historical data for construction activity for landfill that requires a personnel with the Professional Engineer in State of Texas license to be present?

Response: The Professional Engineer does not have to be present during construction. The PE shall ensure all plans are prepared, stamped and submitted to TCEQ and the Fort Hood Landfill Permit 1866 permit is updated.

Question #3: Solicitation Page 37 Can the government provide a minimum number of Past Performance that is required to be submitted with the Proposal?

Response: No requirement for minimum is stated

Question #4: Solicitation Page 52 Can key personnel experience be used as Past Performance?

Response: Past performance is designed for companies past performance and not individuals past performance.

Question #5: Solicitation Page 52 Will the government consider changing the Recency Assessment of Past Performance from the past 3 years from the date of issuance of this solicitation to the past 5 years?

Response: Yes, we have revised the Solicitation via this amendment to indicate: past performance has been changed to 5 years vs. 3 years.

Question #6: PWS 2.5.1.4.1 Waste Collection Vehicles and Equipment Is the requirement for 2-year-old equipment required for all refuse containers?

Response: This PWS requirement is for Vehicles and Equipment is for waste collection. Front load trucks, Stinger truck and Roll off trucks. Refuse containers have be new or like new or acceptable to the Government as stated in 7.2.1.1.

Question #7: With the landfill being such a major part of this contract would the government allow a representative from our company to come on post and look at the landfill? If not will the government please take video of all around the landfill, ponds excreta to show what we will be dealing with.

Response: Yes. This was an in person site visit on 23 Feb 2021 at 1300 HRS.

Question #8: Will the government be able to tell us when the current cell is expected to be filled and when they expect construction of the next cell to begin? Would the government be able to provide video of the remaining area and the area that the construction will begin in?

Response: Current cell is expected to be filled in 2 years. Construction plans are to start as soon as contract is awarded. Site visit would work better than video.

Question #9: A personnel meeting the minimum requirements as outlined in the PWS is difficult to find- most personnel that have a Professional Engineer License in the state of Texas rarely has solid waste experience and vice versa. Would the government consider letting a subcontractor and/or a consulting company that has a personnel with a valid PE license in Texas be onsite during construction activities at the landfill with the supervision of a qualified PM (who meets the minimum three years of solid waste experience)? We have exhausted every avenue looking for a candidate that meets this requirement and we are not finding any that align with the qualifications outlined. Please keep in mind companies offer first right of employment to the personal already working the contract granted that they meet the minimum requirements as outlined in the PWS.

Response: The contractor will be able to utilize a subcontractor or company that has a PE license.

Question #10: Performance Work Statement, Page 52, Section 8.2 Container Inventory – The Contractor shall conduct an inventory of all Government-owned refuse dumpsters, roll-offs, and compactors as identified in TE-B & TE-C. This statement conflicts with W9115121R009, Page 47, Item (d), and TE-B, Paragraph 1, Sentence 3. Does the government intend to provide containers or is it the Contractor’s responsibility?

Response: Per PWS 7.2.1 it is the contractors responsibility to provide containers.

Question #11: Performance Work Statement, Page 98, Section 10.5.3 The Contractor shall secure the necessary office space and other facilities required for the performance of this contract, off the military installation. Is it the government’s intent that the Contractor shall no longer have an office for its management team at the Fort Hood Landfill on Turkey Run Road?

Response: See revised PWS 10.5.3 the government will provide the following facilities: Main Office BLDG 56134, Scale House BLDG 56133 and Maintenance Facility BLDG 56135 for use under this contract.

Question #12: Performance Work Statement, Page 98, Section 10.5.2.1.2 The Contractor shall remove all vehicles, trailers and equipment from the installation at the end of each workday, unless otherwise directed by the KO. Is it the government’s intent that the Contractor shall no longer operate route trucks from the Fort Hood Landfill on Turkey Run Road?

Response: PWS 7.9.1 allows all vehicle that are performing work under this contract can be kept inside the landfill boundary. No other vehicles or equipment on other contracts can be kept or maintained at the landfill or its facilities.

Question #13: W9115121R009, Page 43, Paragraph 2 Each volume shall be uploaded / submitted as a separate Microsoft Word Document file (or as a single file of each volume clearly marked).

Given that the solicitation files are provided in various formats that would require conversion and manipulation to submit in Microsoft Word format, would it be acceptable to submit in a PDF format?

Response: Yes, it is acceptable to submit documents in PDF Format

Question #14: has the government performed any cost estimates or have specific details on this requirement so that we might budget in our proposal? Currently the landfill is under the Garrison's Storm Water Permit which means any needed storm water controls need to be paid for by the Government. Paragraph 7.3.12 Contaminated Water Management of the PWS states “Contractor shall develop and submit Industrial Storm Water Permit under Contractor’s name to TCEQ within 90 days after start of contract award.” We can estimate a cost for preparing the permit but the unknown cost issue is the unknown costs with having to build retention ponds and other storm water controls which now is the responsibility Government.

Background: This issue came up in the past by the Government, but when it was found that the cost of the storm water control improvements was the Governments, the problem mysteriously "went away". I suggest we qualify our proposal that all storm water control improvements found needed as part of the Industrial Storm Water Permit development be a future additional cost to the Government and not part of our proposal. I'm fairly sure the environmental division folks know what improvements will required, but do not have the funds to pay for the improvements so they "innocently" slipped it into this PWS.

Response: IAW PWS 7.3.12 Please bid accordingly. Government environmental office will provide current Storm Water Pollution Prevention Plan (SWPPP) to assist the contract awardee in Best Management Practices (BMP).

Question 15: Since there was not a physical site visit, will the government provide the make, model, and size of the landfill equipment.

Response: This was an in person site visit on 23 Feb 2021 at 1300 HRS. IAW TE-O this provides the minimum equipment necessary to perform landfill operations.

Question 16: How many of the 750 8yds have two sliding doors?

Response: PWS 7.2.1 states “The Contractor shall provide and maintain twenty (20) eight (8) CY two (2) sliding door containers out of the 750 total containers and placed in designated locations TE-B by the COR.”

Question 17: Is the government responsible for the dirt/mulch and liners for the landfill?

Response: Earth material is currently on site for use of cover. Liners are the responsibility of the contractor to provide for the landfill.

Question 18: 2.5.1.4.1 Waste Collection Vehicles and Equipment: Do the back up trucks fall under the two years or newer for the contract?

Response: No, the government does not plan for back up vehicles on contract. If vehicle is performing work under 2.5.1.4.1 then vehicle shall be two years old or newer (at contract start date).

Question 19: Please confirm the government owns the scales.

Response: Yes the scales are government owned as stated in PWS 7.3.2

Question 20: Will the government provide a current landfill ticket?

Response: See example of a customer copy of a landfill ticket (Attachment 2)

Question 21: 8.7 Fuel Depot: Please confirm that the contractor can fuel up at the Fuel Depot.

Response: The fuel depot is strictly for the landfill contractor use

Question 22: 10.1.1.94 Mow: The equipment list provided by the government did not have landscaping equipment for the landfill. Will the government provide a list of landscaping equipment? What is the height requirement on the vegetation?

Response: 10.1.1.94 falls under definitions. 7.3.18 Post Closure Care must be maintained IAW TCEQ requirements. The height requirement for vegetation must comply with TCEQ. No the government will not provide a list of landscaping equipment.

Question 23: Will the government provide pictures and voltage of the compactors? Also provide measures for any modifications to the hoppers.

Response: See picture of the voltage (Attachment 1) of the self-contained compactors. There are currently no hoppers as that would be building equipment.

Question 24: Please confirm 7 of the FEL containers are required to have lock mechanisms.

Response: On this follow-on contract, this is no longer a requirement.

Question 25: Will the government provide an arial image and photos of the government furnished facility where equipment can be park.

Response: IAW TE-H the contractor can see the area to park vehicles on the contract, and it also shows where containers and roll offs are stared when not being utilized.

Question 26: Volume I, Page 45 item 4 Offeror Awareness of Contractor Responsibility Determination lists 8 items (items a-h) that the Government will assess to determine responsibility.

a. Please confirm that in accordance with item a, Offerors are to provide a letter or other items verifying a bank line of credit.

b. Does the Government want Offerors to provide any other specific items to verify responsibility matters for items b-h?

c. Does the Government want Offerors to provide CPARS to verify responsibility matters for items b-h?

Responses: a.Yes please provide some form of verification for bank line of credit.

b. No specific items are necessary.

c. No

Question 27: Volume II, Page 46, Subfactor 1, a states “Offeror’s TE O Equipment Listing shall be used to evaluate and ensure it includes a list of proposed equipment that provides adequate support…” However TE-O states “The purpose of TE-O, Vehicles and Equipment, is to provide a general estimate of the necessary vehicles and equipment to perform the Solid Waste Management requirement.” Can the Government please clarify:

d. Is TE-O a reference document intended to provide Offeror’s with an estimate of equipment needed? Yes

e. Are Offerors required to adjust the quantities and equipment within TE-O as appropriate for their proposal and submit it as part of Volume II? Yes with a detailed explanation of vehicles and equipment usage under proposal to determine validity that vary from the minimum recommendation.

Response: See answers above

Question 28: Volume II, Page 47, Subfactor 1, b states “Offeror’s shall provide their TE N – Recommended Baseline Staffing sheet to ensure it includes a labor and manpower mix that provides adequate staffing to support…” However TE-O states “he purpose of TE-N, Baseline Staffing, is to provide a general estimate of the necessary personnel to perform the Solid Waste Management requirement. Can the Government please clarify:

f. Is TE-N a reference document intended to provide Offeror’s with an estimate of personnel needed? Yes

g. Are Offerors required to adjust the personnel and labor categories within TE-N as appropriate for their proposal and submit it as part of Volume II? Yes with a detailed explanation of changes of personnel or labor categories under proposal to determine validity that vary from the minimum recommendation.

Response: See answers above

Question 29: Volume II, Page 47, Subfactor 1, b states “Offerors shall provide Key Personnel resumes, and commitment letters for each position.” Can the Government please confirm that Letters of Commitment are required for Key Personnel ONLY?

Response: Yes

Question 30: Can the Government please confirm that the Resumes and Letters of Commitment are included in the 30 page limitation for Volume II?

Response: Yes

Question 31: Volume III, page 48. The Government does not provide much guidance regarding the content of each “written, recent, and relevant past performance…” Does the Government want each Offeror to determine their own content of this volume?

Response: IAW Volume III page 48 – the content is described as: In these various past performance systems, the Government shall assess (but not limited to) the Offeror's quality of service, how well they performed on schedule and how well is their customer satisfaction ratings.

Question 32: Volume IV, page 48, states “Offeror shall provide a completed copy of TE-D-Bid Schedule and TE-M-Wage Determination Pricing Spreadsheet.”

h. Are these the only documents the Offeror must provide to meet the requirement Response: Provide accordingly as per solicitation Volume IV, page 48.

i. Does the Government want Offerors to include a narrative in addition to TE-D and TE- M?

Response: Provide accordingly as per solicitation Volume IV, page 48.

Question 33: Subfactor 1, page 50 item e states “The Contractor shall provide the name of the individual who is designated as the project Manager and provide a current legible photocopy of the individual’s Professional Engineering registration for the state of Texas. Failure to provide this shall result in this subfactor being unacceptable” PWS 2.1.11.1.1 states that this document must be provided 10 days prior to contract start. Can the Government please clarify if this document is to be provided with the proposal submission or after award, 10 days prior to contract start?

Response: We have revised the Solicitation via this amendment, which indicates Revised:

52.212-2: The Project Manager shall have a current Texas Class A MSW (Municipal Solid Waste) License with a minimum of three (3) years’ experience operating a landfill and managing personnel that perform work under solid waste requirement. The Project Manager shall comply with requirements of The State of Texas - Texas Engineering and Land Surveying Practice Acts and Rules Concerning Practice and Licensure when submitting professional documents. The Project Manager shall maintain a Texas Class A Municipal Solid Waste (MSW) License for duration of contract and provide current license to COR upon renewal. Resume shall have a minimum of three (3) years of experience in managing personnel that perform work of the type required by this contract. The Contractor shall provide the name of the individual who is designated as the Project Manager at time of proposal submission. “Offeror shall provide a written narrative to indicate they have the capability to possess the necessary license for this requirement not later than (NLT) the contract award date”. “The written narrative shall also acknowledge that a current legible photocopy of the individual’s license shall be provided NLT the contract award date”. Failure to provide this information shall result in this subfactor as unacceptable.

Additionaly PWS 2.1.11.1.1 has been revised to reflect this change.

Question 34: PWS 8.0 Deliverables A004 (page 55) states that Offerors must submit the name of the Program Manager “at time of proposal to include replacements.” Can the Government please explain what is meant by “replacements?”

Response: This is meant that if the Program Manager changes at any point prior to contract or throughout contract life.

Question 35: PWS 8.0 Deliverables A014 (page 56) states to provide the Transition Phase/In “NLT contract start date.” However a Phase-In plan is Subfactor 3 of Volume II. Can the Government please confirm that a Phase-In plan is to be provided with the proposal?

Response: Yes the phase in plan is part of proposal

Question 36: Has an Engineer already selected to perform landfill design for the cells? In TE-Q Landtec is referenced, please clarify.

Response: No. Landtec is the current contractor’s third party engineer firm

Question 37: Can the government confirm you want us to account for a 3:1 slope from bottom of cell to top of slope limits shown on TE-Q

Response: Yes, from the permit; “The permanent side slopes of the excavation are designed on a 3 to 1 slope to ensure stability and constructability.”

Question 38: Can the government identify where the existing contour sources are located in the work area?

Response: Drawing C2 of the permit contains the existing contours.

Question 39: Can the government identify if applicable where the leachate system will tie-in for disposal by Others?

Response: Disposal of leachate has to be pumped and then taken to the sanitary Sewer for disposal which is located by the shop BLDG 56135.

Question 40: Can the government clarify of we are to place spoils to the NE of the permit area?

Response: If by spoils offeror means excavated material stockpiled for final cover, the permit states “All stockpiles of soil material will be located along ridges or high points within the site, to avoid conflicts with existing drainage paths. The stockpile for final cover will be kept separate from the remainder of excavations.”

Question 41: Since no geotech info is available, please confirm if we should assume all clay liner material will originate from within the landfill cell(s) footprint?

Response: According to the permit, both daily and final cover material will be obtained from the excavations made at the proposed site. The materials will be stockpiled for use as final cover. An estimated 444,214 CY of material are required for the final cover and the on-site available soil that meets final cover requirements is estimated to be 384,000 CY. This will require approximately 60,214 CY to be provided from an off-site source.

Question 42: Can the government identify where the construction water source is located

Response: There is a water line located on the landfill that can be accessed with permission from the government and American Water. It has to be monitored and backflow preventer installed prior to use.

Question 43: Can the government clarify if a groundwater underdrain system will be required for all cells?

Response: Yes. The government currently has all monitoring wells around landfill and from the permit: “Protection of the groundwater is an integral part of the design with monitoring systems installed to indicate problems.”

Question 44: Can the government clarify if the landfill gas extraction system/wells will be by Others?

Response: This landfill does not have a gas extraction system. It doesn’t produce enough gas.

Question 45: What type of Final Cover System will be required for the site? A traditional liner with soil cover or an evapotranspiration cap?

Response: Look at the permit. It is spelled out in the permit what is required. There are actually reports that specifically discuss it. They are in binders. IAW TE-A, the permit indicates the type of cover system. Please refer to the permit provided in TE-A

Question 46: Will the government consider a Project Manager that meets the minimum solid waste requirements and a registered Professional Engineer in another state acceptable at the time of submission? When an individual is registered in another state as Professional Engineer, they are qualified to become a registered engineer in Texas.

Response: Please revised PWS 2.1.11.1 Project Manager Requirements.
