SUMMARY OF CHANGES
SECTION SF 30 - BLOCK 14 CONTINUATION PAGE
The following have been added by full text:
QUESTIONS AND ANSWERS
Question Answers
On Page 433, paragraph (ii) of Factor 2 - Past Performance, the Government states "Performance is defined as at least 24 months of performance within the last three years." Will the Government please clarify whether they are looking for references to have 24 months of performance within the last three years or for the work to have been active within the last three years and have had at least 24 months of total performance? In consideration of this question, please note that requiring 24 months of performance in the most recent 3 year period would mean that any contract ending in FY20 or even as recent as the beginning of FY21 would be deemed not relevant.
While we understand the 3-year recency time period and the importance of reviewing a 24-month period to determine performance success level, the combination of the two, pending interpretation, can greatly impede the ability of capable businesses to pursue this opportunity. We kindly request that the Government allow references where the contracts have ended within the past three years but have had at least a 24 month total period of performance across the contract.
Refer to: Reference RFP Page 433, Paragraph (ii); "Performance is defined as at least 24 months of performance within the last three years."
Will there be small business subcontracting requirements for this solicitation?
Refer to: SF 1449, Page 1 - #10 - This Acqusition is "Unrestricted". There are no small business subcontracting requirements for this solicitation. NOTE: See paragraph
3.24. of the Performance Work Statement.
Reference: PWS 2.1.39 states “BACO-90 is an effective tool to get contractors in theatre to support the US Forces on a temporary basis” and “Period of Performance cannot exceed 90 days over a 12-month period…”. Question: Under ADCMS IV, is BACO-90 considered travel/temporary duty (TDY)?
If yes, are the associated travel and TDY-covered expenses (as specified in the Joint Travel Regulation) billable under the ‘TDY Travel and Per
DIEM CLIN’?
Response: For "BACO-90" part time providers, associated travel and TDY covered expenses are not billable under TDY Travel and Per Diem CLINs. Hourly pricing proposed for Part Time BACO-90 healthcare workers are inclusive of all costs and should be considered in the firm fixed price billable rate. See Updates and Revisions to Amendment 1 of Solicitation.
Reference: RFP Page 430 (52.212-1 Addendum) Technical Capability (Factor 1) states: “If the joint venture does not demonstrate the technical capability for award, submit technical capability of each party to the joint venture but the total submitted by the joint venture shall not exceed the maximum page count under Factor I”. Question: Will the Government please confirm that the technical capability of the members of a Joint Venture can be consolidated and proposed as a single approach for the Joint Venture? Rationale: The page limitation would need to be increased if the Government’s intent is for “each” party to the joint venture to submit their own approach to each of the stated evaluation criteria.
Refer to: 52.212-1 Addendum “If the joint venture does not demonstrate the technical capability for award, submit technical capability of each party to the joint venture but the total submitted by the joint venture shall not exceed the maximum page count under Factor I”. The maximum page count stands as written.
Reference: RFP Page 434 (52.212-1 Addendum) Performance Risk Questionnaire states: “The offeror shall e-mail to the Contracting Office a list of all the POCs who were sent a questionnaire.” Question:
Will the Government please confirm that this list is excluded from page count and provided separately from an offeror’s proposal?
Refer to: 52.212-1 Addendum Section (3) The "POC List" is excluded from any page count and provided separately from an offeror's proposal.
Reference: RFP Page 433 (52.212-1 Addendum) Performance Risk Questionnaire states: “This volume shall not exceed 25 pages excluding Past Performance Questionnaire Forms, Attachment 5 Performance Risk Questionnaire and Contractor Performance Assessment Reporting System (CPARS).” Question: Does this statement indicate/imply that the Government is requesting offerors provide CPARS reports in their proposals?
Refer to: 52.212-1 Addendum Section (ii) “This volume shall not exceed 25 pages excluding Past Performance Questionnaire Forms, Attachment 5 Performance Risk Questionnaire and Contractor Performance Assessment Reporting System (CPARS).
Reference: RFP Page 433 (52.212-1 Addendum) Past Performance (Factor 2) states: “Offeror shall submit three but not more than five references for commercial customers, Federal or DoD Agencies, or other military organizations contracts performed or awarded during the past three years from the issue date of this RFP, which are relevant to the efforts required by this solicitation.” Question: If the Government determines that less than 3 of an offeror’s past performance references are considered “relevant” does that immediately disqualify that offeror’s proposal?
Refer to: 52.212-1 Addendum, Section 3, "Volume II Factor 2 – Performance Risk (Present and Past Performance) "Absent any recent and relevant past performance history or when the performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned, the offeror will be assigned an “unknown confidence rating” and its proposal will not be evaluated either favorably or unfavorably on past performance."
Reference: RFP Page 433 (52.212-1 Addendum) Past Performance (Factor 2) states: “Offeror shall submit three but not more than five references for commercial customers, Federal or DoD Agencies, or other military organizations contracts performed or awarded during the past three years from the issue date of this RFP, which are relevant to the efforts required by this solicitation.” Question: If an offeror submits 5 Past Performance references and the Government’s proposal evaluation team determines that 2 of the 5 references are “very relevant” and the other 3 references are “not relevant”, is that offeror immediately disqualified from further evaluation/award consideration because they did not “submit three” references “which are relevant to the efforts required by this solicitation”?
Refer to 52.212-1 Addendum, Section 3, "Volume II Factor 2 – Performance Risk (Present and Past Performance) "Absent any recent and relevant past performance history or when the performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned, the offeror will be assigned an “unknown confidence rating” and its proposal will not be evaluated either favorably or unfavorably on past performance."
Question: Will the Government please specify the expected locations associated with the positions on ADCMS IV (in more detail than what Attachment 3 currently provides)? This information was provided under the ADCMS III RFP and was helpful for numerous reasons in preparing pricing and evaluating risk.
Refer to: Exhibit 4 PWS, The Prospective (although not inclusive) Location List. In addition to the SubCLINS in which geographical locations are identified.
Reference: RFP Page 453 (52.212-2 Addendum) Cost and Price Factor states: “Business Systems: The Government will verify the adequacy of the Offeror’s business systems.” Question: Will the Government please elaborate on this requirement? Is this just the Government ensuring that an offeror has an accounting system deemed adequate by DCMA/DCAA? Does this ‘verification’ include cybersecurity considerations (e.g., CMMC)?
Revised to read. 52.212-2 Addendum, Cost and Price Factor 4. Volume III, Factor 3 - Cost and Price Factor paragraph v.“Business Systems: "The Government will verify the adequacy of the Offeror’s business systems.” is deleted.
Reference: Exhibit 1, Page 6. Question: Will the Government please identify if the following positions are considered Personal or Non-Personal Services: Registered Nurse-Medical Service Specialist, Registered Nurse-Telehealth and Registered Nurse-Referral Management?
Revised to read. Exhibit 1, Page 6 is hereby revised to include deliniations between Personal or Non-Personal Services. Refer to the specific CLIN/SUBCLINs as each position is identified whether it is Personal or Non-Personal.
Reference: Exhibit 8. Question: Will the Government please provide the minimum requirements and core duties for a Registered Nurse- Medical Service Specialist and a Registered Nurse- Lactation Consultant?
Refer to: Exhibit 8 PWS - HCW Minimum Requirements. The minimum requirements and core duties for the RN Medical Service Specialist and RN Lactation Consultant are identified under the title of Registered Nurse.
Reference: CLIN 0001BV - Part Time Physician Assistant. Question: Will the Government please provide a paragraph to explain the use of Part Time (PT) Physician Assistants (PA) (e.g., when, where, how often, etc.) in support of the contract? How many simultaneous PT PAs could be expected? Is there any expectation that a PT PA assignment would be followed by another PT PA assignment at the same location?
Response: A part time Physician Assistant would be considered as a "BACO-90" position for a 90 day maximum term in the host Nation given existing work visa regulations. The part time Physician Assistant requirements varies year to year and may be performed during different times of each year for any total period of time as required and as noted in any resultant Task Order.
Reference: Solicitation, Page 369, PWS para
1.5.7.1.2. Question: Will the Government please
revise paragraph 1.5.7.1.2? Rationale: The last sentence of this paragraph is missing letters, making the sentence illegible.
Revised to read: PWS para 1.5.7.1.2. The Government may order more than 480 hours per position, however, under BACO-90, work cannot exceed 90 days within a 12-month period.
Reference: Solicitation, Page 454, Para 4.b.
Question: Will Part Time Physician Assistants receive housing, in-country transportation, and per diem as reimbursable travel costs or should these costs be included in the FFP billable rate under CLINs X001BV?
Revised to read -52.212-2 Addendum (iii)
(1) Volume III Cost/Price Para 4.b. The final billable hourly rate should be based on 1,912 hours (exclusive of relocation, travel, and DoDDs Tuition) per year for full time and 480 hours (inclusive of all costs) per 90 days for part time under BACO 90." Hourly pricing for Part Time Physician Assistants are inclusive of all costs and should be considered in the firm fixed price billable rate.
Reference: Solicitation, Page 451, Para 3.b. states:
“The word “contract,” as defined herein, for the purpose of present and past performance submissions under this solicitation, does not include individual delivery orders, task orders, or blanket purchase agreements or basic ordering agreements” Question: Will the Government please consider revising this definition to allow offerors to submit task orders as past performance references?
Rationale: For some of the largest IDIQ contracts (e.g., DHA’s MQS), Government program and contracting offices will not evaluate a contractor’s performance at the IDIQ level (i.e., they will not respond to Past Performance Questionnaires, and they will not complete a CPARS report at the IDIQ level). Many of these programs are structured to capture a contractor’s performance/quality ratings at the task order level.
Refer to: 52.212-2 Addendum, Section 3, Paragraph b, "The word “contract,” as defined herein, for the purpose of present and past performance submissions under this solicitation, does not include individual delivery orders, task orders, or blanket purchase agreements or basic ordering agreements.
Reference: Solicitation, Page 451, Para 3.b. states:
“The word “contract,” as defined herein, for the purpose of present and past performance submissions under this solicitation, does not include individual delivery orders, task orders, or blanket purchase agreements or basic ordering agreements.”
Question: Can an offeror provide a collection of task orders, under a single IDIQ contract, as a single past performance reference? Rationale: For some of the largest and most relevant IDIQ contracts (e.g., DHA’s MQS), Government program and contracting offices will not evaluate a contractor’s performance at the IDIQ level (i.e., they will not respond to Past Performance Questionnaires, and they will not complete a CPARS report at the IDIQ level).
Question: Will the Government be performing cost realism analysis on the compensation plans? If yes, will the Government eliminate offerors from the competition if their prices are unrealistic?
Refer to: 52.212-2 Addendum, Basis for Award, Subfactor 1E, Compensation Plan - A compensation plan, (see Attachment 4- Example Comp_Plan_Composite Rates) will be submitted for each labor category/CLIN established under Schedule B. Each labor category and all elements of the compensation plan will be evaluated against the Government Independent Estimate and current market prices to ensure that the proposed compensation is sufficient to attract and retain quality staffing.
Can United Kingdom Licensed Healthcare Workers be used for ADCMS IV positions?
Refer to Exhibit 8, PWS - HCW Minimum Requirements for Degrees, Education, Certification/Licenses and Experience.
Can the format for Attachment 4 be altered, or is it required to be submitted as provided in the Solicitation?
Refer to: Attachment 4- "Use a format similar to the one below for the compensation plan for the Health Care Workers to break out the base labor rate and fringe benefits on an hourly basis for all positions listed in the CLINS. Also provide the additional information required by the instructions for the Compensation Plan in VOLUME IV – PRICE PROPOSAL in the form narratives in addition to the format below. See FAR Provision 52.222-46.
In Attachment 4, would the Government like to see the LQA and Cost of Living Allowances called out on their own line(s), part of the Fringe rate, or part of the Annual Salary?
See answer to Question 20.
For the Part Time positions, how/where does the Government want the Offeror to include the relocation costs in Attachment 3.
Response: For part time providers, associated travel and TDY (relocation costs) covered expenses are not billable under TDY Travel and Per Diem CLINs. Hourly pricing proposed for Part Time healthcare workers are inclusive of all costs and should be considered in the firm fixed price billable rate. See Updates and Revisions to Amendment 1 of Solicitation.
If the Offeror does not currently have a requirement for DCMA approved Business Systems, how will the Government verify the adequacy of the Offeror's Business Systems?
Revised to read. RFP Page 453 (52.212-2 Addendum) Cost and Price Factor 4.
Volume III, Factor 3 - Cost and Price Factor paragraph v.“Business Systems: "The Government will verify the adequacy of the Offeror’s business systems.” is deleted.
Would the Government be willing to provide an unprotected copy of the pricing workbook, so long as the protected copy is submitted?
Response: No, Attachment 3, will remain protected.
Can the Government provide a projected FTE count by labor category for each location?
Response: Estimated FTE by labor category and geographic location are noted in the respective CLINs/SubCLINs.
Will the Government consider accepting an Exhibit as the pricing schedule for the 1449 instead of needing to fill in 283 pages of Section B? This way the base IDIQ can reference an Attachment for the pricing instead of having all CLINs filled in.
Response: The requirement remains.
Reference (iii) Volume III Cost/Price Factor 3 (1) "The Offeror shall provide a completed Schedule B Supplies or Services and Prices/Costs of the solicitation." NOTE: in order of Precedence: SF1449, Section B pricing, supersedes Attachment 3
Will Key Personnel be required at the IDIQ or Taks Order level? Can the Government please provide an estimate of the number of Key Personnel and the labor categories required?
Refer to: PWS Section 2.1.26; "KEY PERSONNEL: Personnel designated by the contractor who is knowledgeable of the terms and conditions of the contract and authorized to make decision on behalf of the contractor. Key Personnel List to be provided NLT ten (10) business days after contract award. Requirements in the contract flow down to the Task Order Level.
How will the Government be handling the pricing of Labor Categories listed in Exhibit 1 that are not priced as part of the proposal submission?
Response: Labor Categories in Exhibit 1 that are not priced as part of the proposal submission will be negotiated at the task order level.
With CMMC not yet fully codified, and version 2.0 still in rule making phase, will government remove the DFARS 252.204-7021 from the solicitation at this time?
Response: DFARS 252.204-7021 is included and shall serve as the guiding requirement(s).
How will the Government handle HCWs that are accompanied with dependents? Because the LQA and COLA are affected by dependents, should the Offeror assume pricing does not include dependents for the IDIQ pricing?
Response: LQA and COLA, with or without family, are not separately priced in this contract. See answer to question 15.
Would the government consider revising the requirement for past performance references from a minimum of 3 to a minimum of 2? Projects of this size and scope are extremely rare in the federal government – there are very few companies who can provide more than one or two. If the government decides to keep the minimum at 3, will you then allow subcontractors to provide past performance to supplement that of the prime?
Reference RFP Page 451, Section 3, "Volume II Factor 2 – Performance Risk (Present and Past Performance) "Absent any recent and relevant past performance history or when the performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned, the offeror will be assigned an “unknown confidence rating” and its proposal will not be evaluated either favorably or unfavorably on past performance."
Would the government consider revising the requirement to have both the contracting activity and the technical representative sign each past performance questionnaire? In our experience on similar contracts, the contracting activity and the technical representative have the same performance information available to them. An alternative would be to accept CPARS in lieu of PPQs
Refer to: 52.212-1 Addendum, (3) Performance Risk Assessment Questionnaire, "The offeror shall complete Part I of the Past Performance Questionnaire and e-mail the questionnaire to both the Government contracting activity and technical representative responsible for the past/current contract The POCs shall be instructed to electronically complete Part II of the questionnaire and e-mail the entire questionnaire to the Contracting Office no later than the proposal due date..."
Many clinical services contracts of similar size and scope are awarded under IDIQs with multiple customers at different locations. Would the government consider allowing contractors to bundle several task orders under an IDIQ to show size and scope and then submit the bundle as a single past performance reference?
Refer to 52.212-2 Addendum, Section 3, Volume II Factor 2.Paragraph b, "The word “contract,” as defined herein, for the purpose of present and past performance submissions under this solicitation, does not include individual delivery orders, task orders, or blanket purchase agreements or basic ordering agreements.
Are there currently staffing challenges at any of he required locations? If so, can the Government provide information on which positions and locations?
Response: Potential Offerors may submit a request via the Freedom of Information Act (FOIA) to request access to Federal records.
Does the Government have a preference for where the Contractor Representative (Program Manager) or Alternate Contractor Representative is located?
Refer to: PWS paragraph 1.6.4.1 - The POC shall be an individual who is knowledgeable of the terms and conditions of the contract, authorized to make decisions regarding the contract, and respond within one hour of being contacted by the Government.
