Industry Question/FeedbackGovernment Response
SOW
Our Question is: Recommend the “Final Guidance for Federal Departments and Agencies on Consideration of Greenhouse Gas Emissions and the Effects of Climate Change in National Environmental Policy Act Reviews be added to this References List.No. The CEG guidiance is neither rule nor regulations. Additionally, Department of Army (DA) is in the process of providing direction on how the CEG guidiance should be handled. That direction is not final yet. Also, this list is primarily rules, laws, regulations, and directives.
SECTION L
This sections states, “B. Section 2 – Corporate Experience: (30 Page Limit). Our Question is: Recommend that the 30-page limit be deleted now that the whole volume is limited to 50 pages. The Final Solicatation will be changed to reflect this correction
This sections states, “C. Section 3 - Management Approach: (20 Page Limit) Our Question is: Recommend that the 20-page limit be deleted now that the whole volume is limited to 50 pages. The Final Solicatation will be changed to reflect this correction
The revised DRFP contains an Attachment 10 for completing the Corporate “Experience in Relevant Project Form”. Our Question is: Please provide a fill-in form for the requirement of the Past Performance Questionnaire and the Detailed Performance History ExamplesA fill-in form is only being provided for Corporate Experience examples. The Contractor is to use their own format for the Detailed Performance History Examples, but ensure all the required information in Section L for the examples is provided.
Section L; General Instructions 2(a); Item 5; page 2 of 24– Major Subcontractors and related Section L, Volume II-Technical Management, Sub-Section 2, Page 6 of 24: The prior draft defined major subcontractor as those who would perform 10% or more of the contractual work. It appears in this revised draft that the definition has been revised to any subcontractor who’s fully burdened rates will be included in Attachment 7. Attachment 7 does not include a breakout of rates by prime or subcontractor. Does the Government expect to see separate burdened rates in this table by prime contract and subcontractor? Or does the Government expect to be provided one overall composite rate encompassing rates by the Prime and all major subcontractors? Additionally, this paragraph also indicates the Government defines a “team member” as part of an formal or informal JV. If the major subcontractor is not part of a JV but there is a teaming agreement, can the Government confirm in this situation, the subcontractor is also part of the team? In this case, does the Government also require teaming agreements of major subcontractors required as part of this solicitation response? The Government expects overall composite rate encompassing rates by the Prime and all major subcontractors. More defined definitions for Prime Offeror, JV Member, Major Subcontractor, Minor Subcontractor, and Team Member will be provided in the final solicitation.
Section L, Volume IV-Cost; Sub-Section A (xii), – The prior draft included a table of 10 Government labor categories. This table also included proposed hours. This revised draft does not include this table in the text but does provide Excel table Attachment 7 that has 32 labor categories and 4 tabs. Two tabs are noted as Contractor Site and two tabs are noted Government Site. However, other than in Sub-Section B (xi) there is no explanation of Government or Contractor Site. Can the government provide an explanation of Contractor vs Government Site? The following definitions will be added to the soliciation in section L: Government site is work performed at locations where the offeror do not pay any facilities cost related to the solicitation labor categories. This includes facilities provided by: (i) Government at no cost to contractors and/or lower-tier subcontractors, and (ii) higher-tier contractor at no cost to lower-tier subcontractors. Contractor site is work performed at locations where the offeror pays facilites cost related to the solicitation labor categories.
Also, throughout the cost narrative there are requirements for presenting direct, indirect, and fee rates separately in this excel table. Are we correct to assume that this excel table can be expanded to include additional sub-tabs to identify the required content in greater detail? Or, is this attachment 7, as noted in sub-Section B (xiii) only for the fully burdened prime and major subcontractor team members with separate excel sheets detailing the build up from direct and indirect costs?Attachment 7 is only for the composite rates which use fully burdened prime and major subcontractor rates. The prime and major Subcontractors will provide separate excel sheets detailing the build up of their fully burdened rates showing direct and indirect costs.
Section L, Volume IV-Cost, Sub-Section B (ix) – Related to Question above, the Government provides the expected Travel and ODC costs by contract year. However, it is unclear how the government expects to see the results of the buildup related to travel and ODCs. Should the contractor present these costs in an indirect excel table separate from Attachment 7 or as noted above, can we include additional sub-tabs and/or content beyond what is currently provided? The contractor present these costs in an indirect excel table separate from Attachment 7
As this is a CPFF type solicitation, are Offerors reimbursed based on their actual costs incurred? The Government anticipates the majority of task orders awarded on the resulting IDIQ contract will be CPFF but some task orders may be FFP. Under a CPFF task order, the Contractor will reimbursed for allowable incured costs, to the extent prescribed in the task order.
Attachment 7 Composite IDIQ Rate Form – The Sample show for both Tab A and Tab C lists Prime, Major Subcontractor and Minor Subcontractors. A “major subcontractor” is defined as any teammate/subcontractor whose rates are included in the fully burdened composite labor rates proposed by the Prime Offeror in Attachment 7 “Composite IDIQ Rate Development Form”. If a Major Subcontractor is one that is listed on this form, please provide intentions of what is to be included / illustrated for a “Minor Subcontractor” that would be listed on this form? The listing of a minor subcontractor on Tab A and C on Attachment 7 was a typo and will be corrected in the final solicitation. Only Prime contractor and major subcontractor rates will be used to form the Composite Rates in Attachment 7. The following definition of a minor subcontractor will be added in the final soliciation: All subcontractors that do not fall under the major subcontractor definition shall be considered a “minor subcontractor.” Minor subcontractor should be identified as part of the prime offeror’s team but the minor subcontractor cost will be evaluated at the task order level. Minor subcontractor should only be subcontractors that perform labor not included in the EPCARTS Government Labor Categories in Attachment #1, such as labor that would fall under the Department of Labor Construction Wage Rates.
Section L, (4) Volume IV – Cost (A) (viii) – requires that the prime offeror and each proposed major subcontractor/team member shall provide a copy of their cost proposal to their cognizant DCAA office. Should this only be required for Major Subcontractors?Yes, this language will be corrected in the final soliciation.
Section L, (4) Volume IV – Cost (B) (ix) Section 9 – Travel and ODCs – This section indicates that the offeror is advised that profit/fee will not be authorized for either travel or ODCs under the resultant contract. If a resultant Task Order of this contract is to be self-performed by the offeror, how will non-labor subs, materials and/or equipment costs be categorized, and will they be subject this same restriction on profit/fee?Non-labor subs, materials and/or equipment costs will be subject to the same no profit/fee restriction. In the final solication, material will be broken out into its own category but non-labor subs and equipment cost will be categorized as ODCs.
Section L-5, 52.215-20 Requirements for Certified Cost or Pricing Data and Data Other Than Certified Cost or Pricing Data – As the Government anticipated adequate competition and certified cost or pricing data is not required, as stated in Section L, (4) Volume IV – Cost (iii), is this reference required?Even though adequate competition is expected, the Government reserves the right to require other that Certified Cost or Pricing Data at its discretion. Therefore the reference will not be removed.
SECTION M
Section M (4) Factor 3 – Cost, (b). “…will be utilized in the cost realism analysis of the prime offeror and major subcontractor/team member estimated base labor cost rates and indirect cost rates…” Should the reference to “major subcontractor/team member” be revised to “major subcontractor”?Yes, this will be corrected in the final soliciation.
Section M (4) Factor 3 – Cost, (f) – This section references ““Government Worksheet-IDIQ Cost Model” provided below”. This was not included in the updated Draft RFP information provided – please provide. This worksheet is being removed in the final solicitation.
OTHER QUESTIONS
In consideration of the magnitude of the proposed contract, would the Government consider awarding multiple contracts from this solicitation?Government has considered a Multiple Award Indefinite Delivery Indefinite Quantity (MAIDIQ) but has found a MAIDIQ not appropriate for this effort.
Is this contract a recompete or a new contract? This contract is a recompete. The requirements in this acquisition are a partial carryover of the requirements in the Scope of Work of MAIDIQ Engineering, Technical, and Operations Support Services (ETOSS) contracts W9113M-11-D-0003 and W9113M-11-D-0004.
