About this file
This document contains industry questions and government responses regarding the ARCENT Training & Range Operations Maintenance Services (ATROMS) solicitation. The solicitation is for contracted range operations and maintenance services at various training locations in Kuwait and potentially Jordan. Key details include clarification that work hours shall not exceed 54 hours per week according to Kuwaiti labor laws. The number and locations of Call For Fire Trainers and Engagement Skills Trainers are also confirmed. Housing support is clarified such that the first 30 contractor employees will be provided government housing, and any additional required housing solutions will be funded by the government. Various discrepancies between pricing workbook attachments and solicitation language were addressed and corrected by the government.

| RFP DOCUMENT REFERENCED | LOCATION OF VERBIAGE REFERENCED | INDUSTRY QUESTION(S)/COMMENTS | INSUSTRY CONCERN(S) | INDUSTRY | ||
| RECOMMENDATION(S) | Government Response | |||||
| Clearly list the name of the RFP specific document: e.g. ARCENT TSS PWS | List the page and paragraph: e.g. pg 59, paragraph 3.3.1.8 | Briefly describe Offeror's question or comment. | What is Offeror's concern? | Which statements or clarifications would Offeror prefer the Government provide, if any? | ||
| Solicitation Document | Page 116, paragraph L.5.1.3 | Section L states: PWS Reference: 2.5.7.1; 2.5.7.1.2; 2.5.11. | These PWS paragraphs no longer exist in the PWS. | Does the Government mean 2.5.6.1; 2.5.6.1.2; 2.5.10 instead? | Does the Government mean (Yes) |
2.5.6.1; (Validated) 2.5.6.1.2; (Validated)
2.5.10 (Validated) Solicitation Document Page 122, paragraph L.5.4.9 Section L.5.4.9 states: "The Offeror shall submit a breakdown of the fully burdened price for each material and ODC identified in SOLICITATION section L.5.2.4.2." This directs the reader to section L.5.2.4.2. There is no Solicitation section L.5.2.4.2. Will the Government provide the correct section reference? Section L numbering has been updated in order to correct error in references. Section L 5.4.9 is now L.5.3.9.
Now reads:L.5.3.9 The Offeror shall submit a breakdown of the fully burdened price for each material and ODC identified in SOLICITATION section L.5.1.4. The materials and ODCs, and associated quantities, proposed in this Factor, must match the materials and ODCs, and associated quantities, proposed in the Offeror’s Program Management Factor (L.5.1.4 Materials and ODCs).
Solicitation Document Page 122, paragraph L.5.4.11 and Page 123, paragraph L.5.5.3 A Professional Employee Compensation Plan is now required in both Volumes 3 (Cost/Price) and 4 (Administrative / General Information).
Evaluation of the Professional Employee Compensation Plan has been moved in Section M from Volume 3 (Cost/Price) in the Draft RFP to Responsibility determination (M.1.3). Based on the changes in Section L and M regarding requirement for and evaluation of the compensation plan, we are uncertain as to
1) its inclusion in both Volumes (Cost/Price and Admin/General), and
| 2) if and how the plan will be evaluated against an offerors cost/price information and Program Management volume (in particular the Staffing Plan). | We agree with the importance and the necessity of the Professional Employee Compensation Plan for realistic and reasonable staffing prices. |
| We recommend the Government clarify the Professional Employee Compensation Plan will be evaluated as part of Section M within both Volume's 1 (Program Management) and 3 (Cost/Price). | Section L numbering has been updated in order to correct error in references. |
L.5.4.11 has been removed and the Professional Employee Compensation Plan is now only in L.5.4.3 and M.1.3 Responsbility sections.
Solicitation Document Page 117, paragraph L.5.3.2 and
Page 119, paragraph L.5.3.10 L.5.3.2 states: "The Offeror's proposed Past Performance shall be submitted using Solicitation Attachment 7 “ Past Performance Rating Form” and shall address the following ATROMS Core areas (a-f)..."
| L.5.3.10 states: "If an interim or final CPARS report is not available, and an Award Fee Determination is not available or not applicable, the Offeror must submit a Past Performance Rating Form in accordance with Section L.5.3.2. The Rating Form will be used as the basis for the past performance evaluation for that project." | L.5.3.2 requires usage of Attachment 7 Past Performance Rating Form, while L.5.3.10 appears to require use of the Past Performance Rating Form only if the contract being utilized for Past Performance does not have an interim or final CPAR or Award Fee Determination available. | Recommend the Government confirm usage of the RFP Attachment 7 Past Performance Rating form is only necessary for use in this proposal if a CPAR or Award Fee determination is not available for the contract being cited for past performance, or revise Section L.5.3 to clearly stipulate how and when the form should be used by offerors. | Attachment 7 removed. | |||
| Solicitation Document | Pages: 5, 10, 16, 21, 27. | |||||
| Section B, CLIN Series X007 (FFP Material and ODC) | CLIN Series X007 for FFP Material and ODC states in the CLIN descriptions: "Provide all materials and Other Direct Costs (ODCs) required to execute the requirements listed in ARCENT PWS. Subcontractor cost and vehicle leases required to execute the services listed in the PWS. Material and ODC shall be approved prior to cost incurrence IAW the PWS." | The underlined portion of the CLIN description requires USG approval prior to purchase. This seems applicable for the Cost Material and ODC CLIN series, but not for the FFP Material and ODC CLIN series. | Recommend the Government remove this sentence from the CLIN descriptions of the X007 CLIN series. | Government removed “Material and ODC shall be approved prior to cost incurrence IAW the PWS. | ||
| Solicitation Document, and | ||||||
| Attachment_6_ATROMS_Price_Workbook | Attachment 6 includes CLIN series X007 for "Reserved", which is not shown in Solicitation Section B, which has changed the CLIN numbering in Attachment 6 for subsequent CLINs. | See Recommendation. | Recommend the Government update Section B CLIN structure or the Attachment 6 Price Workbook to correspond to each other. | Attachment 6 (Price Workbook) Deleted CLIN 0007 | ||
| ATROMS_Final_Solictation_W900KK23R0029.docx | pg. 112, para. L. 4 | 1. Is the attached Attachment 7 Past Performance Rating Form the correct form to use to address requirements a-f? | Past performance paragraph L.5.3.2 states: “Attachment 7 "Past Performance Rating Form” and shall address the following ATROMS Core areas (a-f):”. However, the form provided in the final RFP is designed to be sent to an offeror’s government contract representatives for an assessment on the offeror’s performance on the submitted past performance. It does not provide an area to address the requirements listed in paragraph L.5.3.2 and areas a-f. | Delete the language requiring the use of the current attachment 7 to address the L5.3.2. a-f items. Allow offerors to address those items in the current 50 page limit for Volume 2 found in RFP paragraph L.4. | Attachment 7 was removed. | |
| pg. 117, para. L.5.3.2 | 2. RFP paragraph L.5.3.10 indicates that Attachment 7 should be used to provide a performance evaluation on past performance citations if CPARs are not available. Should Attachment 7 be used only for performance evaluation, and not for addressing a-f requirements? | Section L numbering has been updated in order to correct error in references. |
L.5.3.2 is now L.3.2.2
L.5.2.2 has been updated to state the following:
"For each Past Performance project/reference submitted, Offerors shall provide the most recent and relevant CPARS evaluations and/or Award Fee Determination. Offerors CPARS Evaluations and/or Determinations will NOT be included as part of the Past Performance Volume page limitation.
Past Performance Volume shall address the following ATROMS Core areas (a-f):
| 3. If we are to use the current Attachment 7s for addressing a.-f. requirements, should offerors delete the Quality, Schedule, Cost Control, Business Relations, Management and Utilization of Small Business evaluation areas and put in places to provide information on a.-f. requirements? | Attachment 7 was removed. Offerors shall utilize CPARS evaluations. If CPARS evaluations are not available, Offerors shall address ATROMS Core areas a-f as part of its Past Performance Volume. | ||||
| ATROMS_Final_Solictation_W900KK23R0029.docx | pg. 112, para. L. 4 | Past Performance paragraph L.4 provides a table indicating the “II-Factor 2- Past Performance” has a page limit of 50 pages. Past Performance paragraph L5.3.2 states: “Attachment 7 “ Past Performance Rating Form” shall be utilized to address the following ATROMS Core areas (a-f). Past Performance paragraph L5.3.2 states: “Attachment 7 “ Past Performance Rating Form” and shall address the following ATROMS Core areas a-f." | Is each Attachment 7 Past Performance Rating Form used included in the page count? If so, as currently formatted (not currently in a format that addressed L.5.3.2 requirements a-f), it is 6-7 pages each. Provision of five PP contracts would result in use of 30-35 pages. If Attachment 7s are reformatted to address L.5.3.2 a-f requirements each could be extensively longer than 7 pages. | Delete the language requiring the use of the current attachment 7 to address the L5.3.2. a-f items. Allow offerors to address those items in the current 50 page limit for Volume II found in RFP paragraph L.4. | Attachment 7 has been removed. Offerors CPARS Evaluations and/or Award Fee Determinations will NOT be included as part of the Past Performance Volume page limitation. |
| pg. 117, para. L.5.3.1 | Paragraph L.5.3.4 states "The Offeror shall include all applicable verification documents identified in the worksheet and any other documentation required to unambiguously and sufficiently validate the individual Past Performance projects submitted." | Offerors CPARS Evaluations and/or Award Fee Determinations will NOT be included as part of the Past Performance Volume page limitation. | |||
| pg. 118, para. L.5.3.4 | 1. What constitutes the material that is counted in the 50 page count? Are "verification Documents" excluded from the 50 page count? | Exempt from inclusion in the Volume II 50 page limit the provision of supporting documents demonstrating qualifications: Past Performance Contract Documents, PWS/SOWs, CPARs, etc. | Offerors CPARS Evaluations and/or Award Fee Determinations will NOT be included as part of the Past Performance Volume page limitation. | ||
| 2. Should the use of Attachment 7 to addresses areas a-f be disregarded? And offerors format a word written response to present their past performance citations that fits into 50 pages? | Attachment 7 removed. Offerors CPARS Evaluations and/or Award Fee Determinations will NOT be included as part of the Past Performance Volume page limitation. | ||||
| Section B – RFP and Attachment_6_ATROMS_Price_Workbook | Section B pg. 2 - pg. 29 and TEP worksheet within Attachment 6 Price Workbook | The CLIN number and descriptions identified in Section B do not reconcile to the CLIN number and descriptions identified in Att. 6. Starting with CLIN x007; on Section B, this item is Material and ODC, but within Att. 6, the item is Reserved, so then the Item No.'s after x007 are out of sync and end at x013, whereas Att. 6 ends with x014 The discrepancy begins where the Government included an FFP Reserved CLIN each year within Att. 6, but not in Section B. | The CLIN structure does not align and may result in an inaccurate proposal. | Reconcile the CLIN structures. | Attachment 6 (Price Workbook) Deleted CLIN 0007 |
| Will the Government edit the documents to reconcile the CLIN structure? | |||||
| Section F – Deliveries or Performance | Pg 34 and 35 | CLIN number 0001 has a one-day overlap on 30 Nov 2023 with CLINs 0002 - 0013. | The one-day overlap may inflate pricing or cause inaccurate reporting. | Reconcile the dates for either Phase-In or all other dates in Base Year | CLIN 0001 PoP changed to 31 Aug - 29 Nov 2023. |
| Will the Government provide the correct dates for the Base Year in Section F? | |||||
| ARCENT TSS RFP file "ATROMS_Final_Solicitation_W900KK23R0029.pdf" | Section L.5.4.10, 1st sentence. | If an offeror uses a more current version of Excel than MS Excel 2013 and because Microsoft does not provide an option to "Save As" MS Excel 2013, an offeror has no "Microsoft Authorized" way to save an Excel file as MS Excel 2013, only MS Excel 2007's "xls". Also, Microsoft 365's subscriptions are backwards compatible with versions 2013, 2010 and 2007 (possibly others). | Compatibility and Compliance | Yes, offerors can use Microsoft 365's Excel as long as the offeror's excel version is properly licensed and compatible with MS Excel 2013. No other Microsoft Excel versions, (newer than stand-alone 2013 or older than stand-alone 2007) are allowable. It is up the offeror to ensure proper compatibility. | Section L numbering has been updated in order to correct error in references. |
L.5.4.10 is now L.5.3.10. Solicitation language updated to allow Microsoft 365 Excel.
| Can offers submit Excel Files using current, properly authorized, Microsoft 365 subscriptions? | |||||

The margin size requirement does not apply to the Excel documents. |
| Can the government clarify that the Cost/Price volume should be same margins as the other volumes and that the margin size does not apply to the Excel documents? | |||||

| Attachment_1_ATROMS_PWS | Section 2.2.2, Page 10 of 89 | Discussion: Normal work week is 8 hours a day over 6 days per week. Unscheduled events may require additional work hours but are limited to 54 hours per week IAW Kuwait Labor Law. | There are US DOD contracts in Kuwait that currently perform up to 12 hours per day, for 6 days per week and up to 72 hours per week. | Please confirm the limitiation of hours is 54 hours and if left prescribed, evaluate all offerors in the technical and price file. |
Question: Can the government confirm whether the DOD Memorandum for Record between the Kuwait Government, US ARCENT, and the 408th Contracting Support Brigade permits the Contractor to staff positions in excess of the 48/54 hour limit referenced in PWS 2.2.2? PWS labor hours are based on Kuwaiti Labor Laws, which shall not exceed a 54 hour work week.
The DOD Memorandum for Record between the Kuwait Government, US ARCENT, and the 408th Contracting Support Brigade does not apply to ATROMS contract scope of work.
Attachment_1_ATROMS_PWS 3.3.25, Page 42 of 83, Table 3.0 Discussion: Table 4.4 CFFT and EST values are wrong across the table. Number of TADSS impacts staffing assessment. Please provide the correct number of TADSS CFFT, total number is 4 with 3 at Camp Buehring, and 1 tentatively scheduled for Jordan.
3.2.2.6 The contractor shall provide TDY and return I/O support to the Jordan Training Center for the Call For Fire Trainer. Training is NTE 10 students per session, unlimited sessions per 8-hour work day, limited to 40 hours per week, limited to 2 weeks per quarter.
EST, total number is 9 with 7 in Kuwait, 1 tentatively scheduled for Jordan, and 1 in storage configuration. 3.2.2.5 The contractor shall provide TDY and return operator support to the Jordan Training Center for the Engagement Skills Trainer II. Training is NTE 5 students per session, unlimited sessions per 8-hour work day, limited to 48 hours per week, limited to 2 weeks per quarter.
| Question: Will the government please confirm the number of CFFTs and ESTs by location? | |||||
| Attachment_1_ATROMS_PWS | Page 8, Section 2.b | Discussion: The Government will provide living quarters for (30) Contractor employees at Camp Buehring, and (0) living quarters at Camp Arifjan.
