| AREA | COMMENT TYPE | PAGE NUMBER | SECTION NUMBER | COMMENT | EVALUATION (Completed by the Government) | Column1 | Column2 |
| Solicitation | Substantive | 66 | L.6.1.2 | The Government is requesting DUNS number which has been superseded by Unique Entity ID (UEID). Our JV was registered with UEID only and no DUNS. Request the Government change DUNS to UEID | Corrected+F12:F29 | ||
| Attachment | Substantive | Attachment16 | Camp Ripley CBA expired 4/30/2019 in preamble; expired 12/30/2017. Which is correct? Does the government have a current CBA? | Corrected and uploaded to Sam.gov notice | |||
| Attachment | Substantive | Attachment 10 | Att_10_MIOSS_Wage_Determinations_and_CBA_Locations.xlsx is incorrect. For example, Ft. Wainwright, AK and Ft. Dix, NJ are listed as Wage Determinations however, they are CBA according to Attachments 26 and 27 respectively. | Corrected and uploaded to Sam.gov notice | |||
| Attachment | Substantive | Attachment 7 | Att_7_MIOSS_Price-Cst_Workbook.xlsx. Worksheet titled “TOTAL EVALUATED PRICE” does not include the government’s surrogate amounts from the worksheet titled “MSTC Price Cost Matrix”. Request the government include the surrogate amounts on the TOTAL EVALUATED PRICE to provide clarity and accurate prices to both government evaluators and offerors. |
Many of the CBAs listed wages and health & welfare that go to 2024 and 2025. Should offerors use these amounts and then straightline (no escalation) in the out years. For example, contract award is anticipated as 3rd quarter of FY 2023 (1 June 2023). Should offerors price for CBA locations using the wage/H&W for periods of performance that are listed for August 2022, then use the August 2023 rates for Base Years 6 months and Option Year 1 then switch to August 2024 rates for the remaining portion of OY1? It appears the Option periods will cross over CBA effective dates. Added Surrogate amounts to Total Evaluated Price;
The Offeror shall identify on the Cost-Pricing Workbook (Attachment 7 for Unrestricted Offerors and Attachment X for Restricted Offerors) if each labor category is subject to the Service Contract Labor Standards. The labor rates proposed for each year can be adjusted except for instances where the labor categories are subject to the Service Contract Labor Standards and a revision is permitted under the provisions of FAR Clause 52.222-43. Therefore, offerors are cautioned not to escalate Service Contract Act (SCA) rates.

| Attachment | Critical | All | All | What is the appropriate WD, or CBA, to use for Camp Williams? | Solicitation | Substantive | 87 | M.4.5.2 | Relevancy in this section mentions "with a contract portfolio of $7M or more annually". This clause is not included elsewhere in the instructions in Section L or other sections in the evaluation criteria. Is the word "portfolio" meant to encompass our entire collective set of contracts (min 2, max 5) we include to demonstrate past performance? | The portfolio includes only the instant contract. | ||
| Solicitation | Substantive | 24 | |||||
| 33 | Section C | ||||||
| PWS Section 4.2 Facilities Management | Section C summary in the main solicitation states "The Offeror shall furnish the necessary supplies/services, facilities and materials required to perform the work described in this Solicitation Performance Work Statements (PWS) and all associated attachments/exhibits referenced in Section J of this solicitation." Other portions of the PWS corroborate this statement. However, other portions of the PWS imply that the work addressed by this solicitation (i.e., training) is to be performed on government owned facilities at each army location (i.e., the MSTC sites). Is the government furnishing the facilities or is the contractor is expected to furnish facilities? Please clarify so that we know what to include in our FFP pricing. | There are no contractor provided facilities required. This work will take place in the MSTC's. PWS Paragraph 2.16 Government Furnished Materials states The Government will make available the office space, communications capability, and information standard equipment and supplies, e.g. Desks, computers, phone, at each training location. | Solicitation | Substantive | Page 60 | Section L.3.1 | L.3.1 states "In accordance with FAR 15.306(c)(2), if the Contracting Officer determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may make a competitive range determination for purposes of efficiency, consisting of only those proposals that have a reasonable chance of award without a major rewrite." However, this appears to be incongruent with the LPTA Evaluation Approach that will be used to evaluate the Offerors described in Section M.3 (page 83). |
Question: Under which subparagraph of Section M.3 does the competitive range in Section L.3.1 apply to the Government evaluation of this RFP? Is it paragraph M.3.2.3.2, which only applies if ALL proposals have been evaluated and rated unacceptable?
| Question: It is very unusual to use a competitive range for an LPTA evaluation approach, so could the Government please explain why they included this language in the MIOSS RFP? | Corrected the Language in Solicitation L.3.1 to properly state: In accordance with FAR 15.306(c)(2), After evaluating all proposals in accordance with 15.305(a) and paragraph (c)(1) of this section, the contracting officer may determine that the number of most highly rated proposals that might otherwise be included in the competitive range exceeds the number at which an efficient competition can be conducted. Provided the solicitation notifies offerors that the competitive range can be limited for purposes of efficiency (see 52.215-1(f)(4)), the contracting officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals ( 10 U.S.C. 3303 and 41 U.S.C.3703). | ||

Page 69 Section L.4 Proposal Delivery, Paragraph L.4.2, Section L.6.2. Volume II Factor 1: Cost/Price The Request for Proposal specifies that "any MS Excel spreadsheets included as exhibits supporting the Cost and Price Volume should be in MS Excel 2013 format. This format must be editable and executable by the Government evaluator(s), clearly showing the calculations and formulas used in each cell".
IAW Microsoft's Lifecycle Policy, as of April 11, 2023, Microsoft Excel 2013 (or any other MS Office 2013 products) will no longer receive security updates or support.
This could potentially increase an organization's exposure to security risks or affect compliance obligations. To mitigate this risk and achieve initial CMMC Level 1 certification, we have migrated from MS Office 2013 products to MS Office 365.

As the MS Office 2013 software is set to expire soon, it is no longer available for download on the Microsoft website, and is challenging to obtain through third party providers. This could pose difficulties for both the government and the offeror.
This issue affects not only MS Excel but also MS Word which are both required in the development of proposals..
