ADDENDUM TO FAR 52.212-1
INSTRUCTIONS TO OFFERORS – PROPOSAL SUBMISSION. In the following paragraphs, pursuant to FAR Subpart 12.302(a), FAR Provision 52.212-1, and Instructions to Offerors – Commercial Items, is tailored. The basic provision paragraphs (a), (f), and (h) – (l) of FAR Addendum 52.212-1 are not replaced. The basic provision paragraph (d) and (e) are deleted for this solicitation.
Paragraphs 52.212-1(b), (c), and (g) are hereby replaced with the following:
1. General Instructions.
a. The Offerors may submit a proposal for one, two, or all three regions. If submitting a proposal for more than one region, the offeror must submit a separate proposal for each region. The regions are defined as: West (CLINs 0001-0028), Central (CLINs 0029-0063), and East (CLINs 0064-0111). The Offerors shall submit their proposal to the address identified in block 9 of the Standard Form (SF) 1449, Solicitation/Contract Award for Commercial Items and through beta.SAM. The proposal must be received no later than the date and time (Central Standard Time) specified in Block 8, SF 1449. Telegraphic, electronic mail, and facsimile proposals will not be accepted. Any offeror that submits an offer that is incomplete, does not comply with requirements stated in the PWS, or otherwise does not conform to the requirements specified herein may result in the offeror being removed from consideration for award. Failure to submit all the required documentation in exactly the manner stated with regards to timeliness and format specified in the solicitation will constitute a basis for the Government to reject a proposal as non-compliant and, therefore, unacceptable at the sole discretion of the Procuring Contracting Officer.
b. These instructions are designed to ensure the submission of information essential to the understanding and comprehensive evaluation of proposals. The instructions permit the inclusion of any additional data or information an offeror deems pertinent within the stated page limitations. Offerors are cautioned to follow the detailed instructions fully and carefully, as the Government reserves the right to make an award based on initial proposals received, without discussion of such proposals.
c. The proposal shall be clear, concise, and shall include sufficient detail for effective evaluation and for substantiating the validity of stated claims. The proposal shall not simply rephrase or restate the Government's requirements, but rather shall provide convincing rationale methods, processes and procedures to address how the offeror intends to meet these requirements. Offerors shall assume the Government has no prior knowledge of their facilities and experience, and will base its evaluation on the information presented in the offeror’s proposal. The Government will not infer meanings from vague or ambiguous language (e.g., “The Offeror understands/can comply/will comply with the PWS;” “Standard procedures will be employed;” “Well known techniques will be used.”). Any proposal that modifies or fails to conform to the essential requirements or specifications of the RFP may cause the proposal to be unacceptable resulting in the offer being removed from consideration for award. Any aspect of the proposal judged to be unacceptable may render the entire proposal unacceptable. If the proposal is determined to be unacceptable, upon completion of proposal evaluations the offeror will be notified promptly of the basis of the determination.
d. In accordance with FAR Subpart 4.8, Government Contract Files, the Government will retain one copy of all unsuccessful proposals. Unless the offeror requests otherwise, the Government will destroy extra copies of such unsuccessful proposals.
e. Period for acceptance of offers. The offeror shall provide a statement that the offeror’s proposal and prices will remain in effect for 180 calendar days after solicitation closing date.
f. Questions, Clarifications, or Discrepancies. Address all questions, clarifications, or concerns regarding this solicitation in writing to the attention of Clifton M. Wells, Contracting Officer (KO), via e-mail at clifton.m.wells.civ@mail.mil and the Contract Specialist, Anthony Hill at anthony.j.hill16.civ@mail.mil referencing solicitation number W81K04-20-R-0020. Contractors must submit questions in a Government provided format (see contractor question template, Attachment 1) via email no later than 3:00PM CST, 7 October 2020. In the event of solicitation discrepancies (e.g., errors, omissions, or points otherwise unclear or unsound), offerors shall immediately notify the KO in writing with supporting rationale. Be advised that all correspondence sent via e-mail shall contain a subject line that reads “W81K04-20-R-0020, RMW Services.”
Note: If an Offeror perceives that a question may reveal proprietary information, they must clearly mark the subject sentence or paragraphs and notify the Government that they consider the information proprietary. In such a case, the Government reserves the right to either:
1. Concur that the information is proprietary and respond only to the requesting Offeror; or,
2. Non-concur that the information is proprietary and decline to answer the question.
g. Electronic Offers. The offeror shall submit Volumes I through V in electronic format on read-only CD-R CDs clearly labeled with the Offeror’s name, CAGE Code, volume number and volume title. Each CD shall contain 1 Table of Contents for the volume and one file containing all elements of the volume. If files are compressed, the necessary decompression program must be included. The offeror’s CDs shall be virus free. The electronic versions of the proposal shall be submitted in a format readable by, at a minimum, Microsoft (MS) Office Word 2007, MS Office Excel 2007, MS Office Project 2007, and MS Office Power Point 2007, as applicable. The Government will accept .pdf files for the electronic version with the exception of the price proposal (MS Office Excel 2007 or latest compatible version) which requires the formulas to be reviewed by the Government. The Government will also accept Excel 2003 version as long as it is compatible with the Excel 2007 version. It will be the offeror's responsibility to ensure the Excel 2003 version is compatible with the Excel 2007 version.
h. If Offeror is Teaming with other Contractors, including teaming with Small Businesses, they shall describe any teaming arrangements (i.e., teaming agreements, joint venture, partnership, etc.) proposed for performance of the Contract. Offerors shall indicate the portion of work to be performed by each team member and shall state the business size of each member. In addition, Offerors shall include copies of all teaming agreements, and where applicable, the Small Business Administration approval of the teaming arrangement in Volume I, Administrative.
Note: Offeror shall identify its proposed team (prime and all subcontractors/team members) and discuss the role that each member will have in accomplishing the specific functional area requirements of the PWS.
i. Organization/Number of Copies/Page Limits. The offeror shall prepare the proposal as set forth in the Proposal Organization Table (Table 7 below). The titles and contents of the volumes shall be as defined in this table, shall be within the required page limits and with the number of copies as specified.
