OFFEROR QUESTIONS – 5
A. A revised Price Schedule, revised Project Facilities & Approximate SM and revised Priority Schedule of Facilities attachments are incorporated into this solicitation.
B. Questions and Answers
V. The following are Offeror questions and the Government’s response to each question:
Q24: Could you please clarify if there is page limitation for this RFP?
A24: There is no page limitation on the Phase 1 Proposal.
Q25: In response to your answer for #A21 for the performance bond and payment bond, both bonds will be total 30% of the contract, which is still a lot and Afghan companies are not able to provide such enormous bond. I am kindly requesting you to reduce the max bond to $3,000,000 for both bonds, or 15% for both bonds, which will be fair. I am sure you don’t know the bank policies in Afghanistan. In overseas, the situation is totally different.
Kindly requesting you to once again re-consider this issue and share your final decision.
A25: We do understand the banking and bonding situation in Afghanistan. We have already reduced the bonding requirement from 50% for each type bond (which would have been 100% total) to 15% for each type bond (equalling 30% of the contract value). Offerors are reminded that, per FAR Part 28 regulation, the Government must have financial protections in place to protect it against financial losses and to ensure fulfillment of the contractor’s obligations under the contract. However, after consultation with our attorney, we will reduce the bonding requirement for the Payment Bond to 5%, but the Performance Bond will remain at 15%; this equates to a total bonding requirement of 20% of the contract value. This is the final decision of the Contracting Officer for this solicitation and its resultant contract.
Q26: Upon reading the answers to the Qs #21 and #23, we believe your answers to these questions are contradictory. Please let us know if the bonding requirements are 15% of the total value of the awarded contract for Performance and Payment combined or 15% for each bonding type. For example, assuming the project awarded price is $10M, Scenario 1 – If 15% for a combined of Performance and Payment Bonds is correct, as it stated in the answer to the question #23, then the total amount for the 2 bonds will be $1.5 million. Will this be equally divided between the 2 bonds with an amount of $750,000 for Performance Bond and $750,000 for the Payment Bond? Or, Scenario 2 – Using your answer to Q #21, the requirements are $1.5M for Performance Bond and an additional $1.5M for Payment Bond, then the total value of these bonds for this project will be $3M or 30% of the total. Is this correct?
A26: The bonding requirements for this project are as follows: 15% of the contract value for the Performance Bond and 5% of the contract value for the Payment Bond. This equates to 20% of the contract value for the total bonding requirement for this project.
Q27: We have signed PPQs (NAVFAC/USACE PPQ-0 forms) which were obtained from USACE officers for our previous Afghanistan projects, and considering that we will use them for our Phase 1 Proposal. But your form is different from this previous form of ours. Can we use our previous official USACE PPQ-0 forms instead of the new one that was included in this solicitation?
A27: Yes.

3. PROCUREMENT METHODOLOGY
(a) This is a full and open, 2-phase, design-build, tradeoff source selection procurement using FAR Parts 15 and 36 proposal evaluation procedures. The following are the evaluation factors for Phases 1 and 2 of this solicitation:
Phase 1
Factor 1 – Specialized Experience Factor 2 – Construction Management Capability
Factor 3 – Past Performance
Phase 2
Factor 4 – Design Capability Factor 5 – Project Management Approach Factor 6 – Scheduling Capability Factor 7 – Key Personnel Factor 8 - Price
(b) Proposal submittal requirements are found in Section L herein.
(c) The basis of award is in Section M herein.
(d) Pursuant to FAR 36.303-1, the Government intends to advance between 5 and 8 Phase 1 offerors to Phase 2 of the solicitation.
4. ENTRY-GATE CRITERIA – As authorized in the Army Source Selection Supplement (SSS) of 28 Nov 2017, the Government will utilize entry-gate criteria and a pass/fail rating methodology to evaluate objective requirements prior to the start of evaluating the Phase 1 proposals.
The objective requirements for this solicitation are as follows:
(a) REQUIRED REGISTRATIONS AND LICENSE
Failure of an offeror to have the following at the time of Phase 1 proposal due date, will result in the offeror’s
Phase 1 proposal not being evaluated, and, thus, removed from competition:
(1) have an active, updated and completed registration in the System for Award Management (SAM) database;
(2) be determined base access eligible in the Joint Contingency Contracting System (JCCS)**; and,
(3) possess an Afghan Investment Support Agency (AISA) License or a Ministry of Commerce and Industries (MOCI) Entrepreneurial License, **Phase 1 proposals from offerors who are being vetted at the time of Phase 1 proposal submission deadline, will be evaluated. However, if there is still no decision as to whether the offeror is base access eligible at the conclusion of Phase 1 proposal evaluation, the offeror will not be considered for advnacement to Phase 2.
An offeror who would otherwise be awarded the contract, but due to an incomplete or expired registration(s) at any time up to contract award, will be deemed ineligible for the contract. Should this occur, the Government will then consider for award the next highest rated proposal with a reasonable price, who is determined responsible pursuant to the definition of ‘responsibility’ in FAR Part 9, and who possesses updated and valid registrations and is base access eligible according to JCCS.
The responsibility of maintaining current information in the following databases and organizations rests solely on the offeror:
a. System for Award Management (SAM): http://www.sam.gov/
b. Joint Contingency Contracting System (JCCS): https://www.jccs.gov/
c. Afghan Investment Support Agency (AISA) License: http://www.aisa.org.af/ or
Ministry of Commerce and Industries (MOCI) Entrepreneurial License:
http://moci.gov.af/ http://www.sam.gov/ http://www.jccs.gov/ http://www.aisa.org.af/ http://moci.gov.af/
If an offeror is a joint venture (JV), the JV entity must have a valid registration representing the JV as one (1) business, firm or entity. This is also applicable to SAM, JCCS, AISA or MOCI License. The Government will not accept separate registrations and licenses for each separate entity representing the JV.
(b) REQUIRED BONDS
For this design-build project, the Government requires the winning contractor to provide a performance bond and a payment bond, with each bond equal to 15% of the contract price. Thus, in addition to database registrations described in Paragraph 3(a) above and the offeror’s Phase 1 proposal receiving favorable ratings, another condition in order to advance to Phase 2 is the offeror’s ability to obtain the 2 required bonds as determined by the offeror’s response to the bonding question in the ‘Questionnaire for Phase 1 Offerors’ attachment. In that Questionnaire, the offeror must respond that he would be able to obtain the required bonds within 21 days after receiving contract award; otherwise, the offeror’s proposal will not advance to Phase 2.
For Phase 2, offerors must include in their Phase 2 proposal, an Irrevocable Letter of Credit (ILC) or a similar official, written commitment from an established financial institution, that attests to the offeror’s ability to obtain the required performance and payment bonds within 21 days of receiving contract award. Without an ILC or similar document in the offeror’s Phase 2 Proposal, the offeror will not be considered for contract award. FAR clause 52.228-14 explains the ILC in detail, and it is included in this solicitation in full text.
If the contractor is unable to obtain the 2 bonds 21 days after contract award, the Notice to Proceed (NTP) will not be issued, and the contract will be terminated.
5. INSTALLATION ACCESS REQUIREMENT
In accordance with CENTCOM Clause 5152.225-5916, Mandatory Eligibility for Installation Access, the Government will remove an offeror from consideration and not evaluate or complete the evaluation of his proposal if the offeror is found to be base access ineligible in the Joint Contingency Contracting System (JCCS/JCXS). The
Government reserves the right to make this determination at any time prior to contract award, including at the time of receipt of proposals and prior to the start of evaluations. The Government also reserves the right to determine an offeror ineligible for award at any time after receipt of proposals if an offeror becomes ineligible for installation access. No debriefing will be provided for those offerors removed from consideration as a result of the ir base access ineligibility, since the determination may be made in advance of the offeror’s proposal being reviewed or in advance of the Government completing its evaluation. Offeror queries or requests for reconsideration related to installation or base access eligibility must be directed to the authority responsible for base access decisions, and NOT the Contracting Officer.
6. QUESTIONS FROM OFFERORS
All offeror questions must be emailed to nikisha.w.cook@usace.army.mil and mary.j.harding@usace.army.mil.
Responses to questions will be provided via an amendment to the solicitation.
7. PHASE 1 PROPOSAL DUE DATE
(a) The Past Performance Questionnaire attachment must be completed by each of the offeror’s customer/client POCs, and each POC must email the completed form to nikisha.w.cook@usace.army.mil and mary.j.harding@usace.army.mil no later than 1500 HRS, Local Kabul Time, on 20 March 2018.
(b) Phase 1 Proposals, excluding completed Past Performance Questionnaires, must be emailed to mailto:nikisha.w.cook2@usace.army.mil mailto:mary.j.harding@usace.army.mil mailto:nikisha.w.cook@usace.army.mil mailto:mary.j.harding@usace.army.mil the following persons no later than 1500 HRS, Local Kabul Time, on 24 March 2018:
Nikisha Cook at nikisha.w.cook@usace.army.mil
Mary Harding at mary.j.harding@usace.army.mil
OFFEROR QUESTIONS - 3
A. Submittal Requirements for Factor 3 – Past Performance is changed as follows:
From Paragraph 1: The offeror shall provide a list of three (3) customer or project owner Points of Contacts (POCs) who will provide present and/or past performance information on the offeror for design/build projects undertaken for the POCs the last ten (10) years from the issuance date of this solicitation.
From Paragraph 3: The offeror may provide completed Past Performance Questionnaires for other U.S. Government contracting offices as long as the projects undertaken for the customer/client/project owner, and which the client/customer POC was providing performance information on the offeror, were for design/build projects completed in the last ten (10) years from the issuance date of this solicitation.
B. Questions and Answers
III. The following are Offeror questions and the Government’s response to each question:
Q15: May we submit a copy of our CPARS completion ratings in lieu of a new PPQ? If yes, do we need to send this separately prior to 15 March?
A15: Yes, you can submit a CPARS completion ratings in lieu of a new PPQ, by the due date and time of the Phase 1 proposal (24 March 2018).
Q16: If the PPQ only is acceptable, may we submit a PPQ completed previously for the USACE? Or, are you requiring a new PPQ, sent directly from the original contract POC?
A16: We would prefer a new PPQ, but you can submit a previous PPQ from USACE if it was completed within the last 10 years from the issuance date of this solicitation, and submit that with the Phase 1 proposal.
Q17: Please extend the deadline for PPQ and proposal submission by at least two weeks.
A17: The deadline for PPQ submittal is now changed to 1500 HRS, Local Kabul Time, on 20 March
2018.
The Phase 1 proposal deadline remains at 1500 HRS, Local Kabul Time, on 24 March 2018. The Government cannot change the deadline date for the Phase 1 proposal because the procurement schedule is aggressive and must be adhered to in order to meet customer requirements.
Q18: In Factors 1 and 2, can we use subcontractor’s experience / past performance to satisfy requirements of this proposal?
A18: Yes, you can use your experience and past performance as a subcontractor for Factors 1 and 2. For Factor 1 / Specialized Experience, make sure to state on your list of projects that you were a subcontractor for the applicable project(s). In the Factor 1 Submittal Requirement, it states that the following information (under #4) must be included on your list: “Whether the Offeror was the Prime, Subcontractor or Part of a Joint
Venture and Percentage of Work Performed by the Offeror”.
mailto:nikisha.w.cook@usace.army.mil mailto:mary.j.harding@usace.army.mil
If you meant the question for Factor 3 / Past Performance, the answer is yes, you can use your experience and past performance as a subcontractor to address this factor.
Q19: JCCS authority notified us that our documents have been submitted for base vetting / approval. We may get final decision during proposal evaluation. Would you let our proposal be in competition until we get base access decision?
A19: Yes, we will allow the evaluation of Phase 1 proposals from offerors who are being vetted at the time that Phase 1 evaluation is taking place. However, we will not advance to Phase 2 any offeror who is not actually determined base access eligible at the conclusion of Phase 1 proposal evaluation. That is the fairest process since there will be offerors who are already base access eligible prior and during Phase 1 evaluation.
OFFEROR QUESTIONS - 4
IV. The following are Offeror questions and the Government’s response to each question:
Q20: Is there an advance payment involved? Can we at least have 5-10% advance payment after we provide performance and payment bonds to the client? We are negotiating with sureties / banks and they want to know so they can evaluate / calculate their risks.
A20: Notwithstanding the fact that it is not customary to provide advance payment on USACE construction contracts and would be difficult to obtain approval for such a financial arrangement, the Government also cannot, and will not, provide advance payment because the FAR clause at 52.232-5 Payments Under Fixed- Price Construction Contracts is included in this solicitation and will be included in the resultant contract. This clause states that “the Government shall make progress payments monthly as the work proceeds, or at more frequent intervals as determined by the Contracting Officer, on estimates of work accomplished which meets the standards of quality established under the contract, as approved by the Contracting Officer.” An advance payment would mean payment when work commensurate to the amount you are requesting will not have been accomplished yet.
Additionally, one of the conditions for an offeror to receive contract award is that the offeror must be determined “responsible”, as specified in FAR 9.104-1(a), which states “to be determined responsible, a prospective contractor must have adequate financial resources to perform the contract, or the ability to obtain them.” The Government understands that, in Afghanistan, it may be difficult to obtain performance and payment bonds, but there are substantial risks to the Government, as well, should contracted work not be completed or completed inadequately. In light of the situation, the Government is permitting the use of alternative types of security, such as those listed in FAR 28.204-1 United States Bonds or Notes; FAR 28.204-2 Certified or Cashier’s Checks, Bank Drafts, Money Orders or Currency; and, FAR 28.204-3 Irrevocable Letter of Credit (ILC). **However, please note that, for this solicitation and resultant contract, the Government cannot accept currency / cash.
Q21: Answer to Question 14 allows bidders to provide 15% bonds. It is a fair deal, and we thank you for this.
Is this 15% only for performance bond, or is it for both performance and payment bonds? Do we need to provide only one bond with a value of 15% contract value, or 2 bonds of 15% each?
A21: The winning contractor must provide a Performance Bond at 15% of contract value and a Payment Bond at 15% of contract value, or any of the types of securities mentioned in Government Response #A20 above.
Q22: Is the entry to Camp Pratt from the main / current gate? It takes a couple of hours to enter this camp based on our experience in the same camp, and life support was not allowed inside the base. Is it a different situation now, or will a separate and easier access be provided to the contractor?
A22: The contractor will use the existing main ECP gate until the required contractor-constructed perimeter fence and contractor-constructed ANA external ECP have been completed. Once the perimeter fence and new ECP are constructed, the contractor shall use this ECP for site access.
Q23: The percentage of performance and payment bond is 15%. It is two different guarantees – performance guarantee and payment guarantee. Please let us know how much is performance and how much is payment guarantee in 15%. The highest performance guarantees and other guarantees in Afghanistan and other world, do not exceed from 5%.
A23: The dollar mount of the performance and payment bond is 15% of whatever the contract award amount is if you receive contract award. For Phase 2 of your proposal, you need to submit an official, written instrument (like an ILC, letter with official stamp, etc.) from an established banking or financial institution that attests to your firm being able to obtain a performance bond and a payment bond, or something similar as stated in Government’s Response #A20 above, at the amount equal to 15% of the contract award amount.
