52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)
A. BASIS FOR AWARD (52.212-2)
The Government may award up to three contract awards from this solicitation. The award will be made to the lowest priced technically acceptable proposal. Proposals will be evaluated for technical acceptability (including past performance), but will not be ranked using the non-price Factors (and Subfactors). In order for an Offeror to be considered for award, the proposal must receive an “Acceptable” rating in every non-price Factor. A proposal receiving a rating of “Unacceptable” in any non-price Factor will not be eligible for award.
B. FACTORS TO BE EVALUATED
The following evaluation factors will be used to evaluate each proposal: Award will be made to the offeror whose proposal is the lowest priced technically acceptable proposal.
Factor 1: TECHNICAL APPROACH: Evaluation of the offeror’s proposal as it applies to the Performance Work Statement (PWS). A detailed explanation of the criteria for the evaluation is set forth in the “Evaluation Approach”.
Factor 2: PRICE The resulting award will be a Firm-Fixed Price contract. The Government will evaluate for unbalanced pricing and price reasonableness for this Firm-Fixed Price effort. The evaluation of price will be based on a proposed price submitted by the offeror(s).
Factor 3: PAST PERFORMANCE: Each offeror’s past performance will be evaluated for recency, relevancy, and quality. The results will be used to determine an overall performance confidence assessment for each offeror.
C. EVALUATION APPROACH
All proposals shall be evaluated by the Source Selection Team (SST).
1. FACTOR [1]: TECHNICAL APPROACH
Proposal Submission Requirements: The offeror should provide a detailed narrative that identifies the Offeror’s understanding of the overall scope of the requirement and communicates a company specific approach to completing the work. The narrative should specifically address the following elements:
Staffing: State the anticipated number of workers to be employed at each work location. Provide within the narrative the basis for the intended staffing approach.
Qualifications: State skills, certifications, and other qualifications the proposed staff at each location will hold or a plan that proposed employees will hold the minimum skills, certification, and qualification required by the performance work statement by the end of contract phase-in. (Please see the Performance Work Statement for minimum qualifications.)
Evaluation Procedures: The evaluation approach for the technical factor is as follows:
a. Adequacy of Response. The proposal will be evaluated to determine whether the offeror’s methods and approach have adequately and completely considered, defined, and satisfied the requirements specified in the request for proposals (RFP). The proposal will be evaluated to determine the extent to which each requirement has been addressed in the proposal in accordance with the proposal submission section of the RFP.
Failure to satisfy the requirements specified in the RFP may cause the entire proposal to be found to be unacceptable.
b. Feasibility of Approach. The proposal will be evaluated to determine the extent to which the proposed approach is workable and the end results achievable based upon a finding of acceptable or unacceptable on the following elements;
Technical Narrative: A proposal that does not provide a narrative addressing overall scope of the requirement and a company specific approach to completing the work will be found unacceptable, a proposal that does provide a narrative addressing overall scope of the requirement and a company specific approach to completing the work will be found acceptable. The Technical Narrative shall contain the following:
a. Staffing: The Government will evaluate the extent to which an Offeror’s approach provides for an adequate number of staff. Inadequate staffing may be rated as unacceptable. Failure to provide a staffing plan with the proposal will be found unacceptable, a proposal that provides a staffing plan that shows adequate staffing will be found to be acceptable.
b. Qualifications: Evaluate the contractors approach to staff the requirement with employees with the necessary skills, certifications, and qualifications. A proposal that communicates unskilled/uncertified/unqualified staff at phase-in end may be rated as unacceptable. Failure to provide skills, certifications, qualifications will be found unacceptable, a proposal that provides skills, certifications, qualifications and staff at phase-in end will be found to be acceptable.
Evaluation Standard:
Technical Approach is evaluated in terms of Acceptable or Unacceptable, based on the proposal information provided against the evaluation procedures above.
Adjectival Rating Description
Acceptable A rating of ‘Acceptable’ will be given if an Offeror’s technical narrative description demonstrates adequate staffing and qualification to meet the requirement of the solicitation.
Unacceptable Proposals shall be considered unacceptable if the Offorer’s technical narrative description does not meet the requirement of the solicitation.
2. FACTOR [2]: PRICE FACTOR
All offeror’s pricing shall be evaluated by the Source Selection Team (SST) to determine the price being provided and that the pricing received is a fair and reasonable price. The price will be evaluated after determination of the technical acceptability of the offerors non-price factors.
Proposal Submission Requirements:
The Government may award up to three contract awards from this solicitation. Firms are encouraged to propose to any location or locations they intend to work. The offeror shall provide pricing and complete all line items, that the offeror intends to perform, that are being proposed on Standard Form 1449 (SF 1449). The SF1449 shall be signed by an official that is authorized to bind the company. The offeror shall also acknowledge all amendments to the solicitation in accordance with the instructions on the Standard Form 30 if issued. For any CLIN that the offeror does not intend to propose on, the offeror can enter a value of zero (0) or “no offer”.
Evaluation Procedures:
The Offeror’s Price proposal will be evaluated as follows;
1) Compliance: The Price proposal submitted by the Offeror will be evaluated for compliance based upon the submission requirements contained in 52.212-1 and the above Proposal Submission Requirement instructions.
2) Errors: The Offeror’s Price proposal will be reviewed for errors. The Offeror may be given an opportunity to clarify certain aspects of their proposal at the sole discretion of the Contracting Officer.
3) Location Total Evaluated Price: The Government may award up to three contract awards from this solicitation. Firms are encouraged to propose to any location or locations they intend to work. The Government will evaluate each location’s price independently of the other locations. The low for each location will be considered the low for that location for purposes of award. Firms are encouraged to propose to any location or locations they intend to work. Firms are reminded to submit variations in price proposals for any combination of locations as described in the CLIN Section of the solicitation, e.g.: One (1) Location, Two (2) Locations, or all Three (3) Locations. The Government will evaluate each location by taking the base price and adding all optional CLINs associated with that location to come to a location total price. The evaluation of all option CLINs will not obligate the Government to exercise any option.
(a) 52.217-8 To evaluate the option to extend services (FAR 52.217-8) CLINs, one-half of the proposed price for the last year of the performance period under CLIN 3001- CLIN 3003 shall be added to the Total Evaluated Price.
(b) Unbalanced Pricing: The Offeror’s overall Price proposal will be evaluated for unbalanced pricing as defined in FAR 15.404-1(g). An offer may be rejected if the contracting officer determines that the lack of balance poses an unacceptable risk to the Government (see FAR 15.404-1(g)(1) through FAR 15.404-1(g)(3)).
(c) Phase-in: Please price base year with the understanding that performance expectation for the phase-in is a minimum of 60% of the technical requirements within thirty (30) days. Within sixty (60) days of the beginning of the performance period of the contract, the contractor shall be performing 80% of the technical requirements. Full performance of all technical requirements will be required after the first ninety (90) days.

b. RELEVANCY: The second aspect is to determine how relevant a recent (5 years) effort accomplished by the offeror is to the effort to be acquired through the source selection. Relevant determination shall include similarity of service/support, complexity, dollar value, contract type, and degree of subcontract/teaming.
Relevancy is not separately rated.
c. QUALITY ASSESSMENT: The third aspect assesses the overall quality of the offeror’s past performance. Documented results from Past Performance Questionnaires, interviews, CPARS, and other sources form the support and basis for this assessment. Evaluation of past performance shall be in accordance with this plan utilizing the forms and questionnaires provided.
The Government will focus its inquiries on the offeror’s record of performance as it relates to all solicitation requirements, including cost, schedule, performance, and the same for proposed subcontractors. For the purposes of this requirement, major subcontractors are defined as members of an offeror’s overall team who are expected to perform 10 percent or more of the proposed effort. A significant achievement, problem, or lack of relevant data in any element of the work can become an important consideration in the evaluation process.
The Government may use data provided by the offeror in its proposal and data obtained from other sources, including data in Government files or data obtained through interviews with personnel familiar with the contractor and their current and past performance under Federal, State or Local government or commercial contracts for same or similar services as compared to the NAICS 811412. The Government may consider a wide array of information from a variety of sources, but is not compelled to rely on all of the information available.
d. PERFORMANCE CONFIDENCE ASSESSMENT: Source Selection Team will utilize the
Performance Confidence Assessment to select the most appropriate confidence level for each Offeror. Ensure the rationale for the conclusions reached are included. Absent any recent and relevant past performance history or when the performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned, the offeror will be assigned a “neutral confidence rating” and its proposal will not be evaluated either favorably or unfavorably on past performance.
Evaluation Standard:
Past Performance is evaluated in terms of performance confidence based upon the relevancy of contracts submitted and information on how well the contractor performed.
RELEVANCY RATINGS AND DEFINITIONS: PAST PERFORMANCE

No Confidence Based on the offeror’s recent/relevant performance record, the Government has no expectation that the offeror will be able to successfully perform the required effort.

An Offeror’s proposal will be rated “UNACCEPTABLE” for this factor if, based on the Offeror’s performance record, the Government has a low or no expectation that the Offeror will be able to successfully perform the required effort.
* Note: In the case of an Offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the Offeror may not be evaluated favorably or unfavorably on past performance (FAR 15.305(a)(2)(iv)).
