A firm fixed-price contract shall be used when the risk involved is minimal or can be predicted with an acceptable degree of certainty.

Commercial Acquisition– Requires use of fixed price contracts for the acquisition of commercial items.

A firm-fixed-price contract provides for a price that is not subject to any adjustment on the basis of the contractor’s cost experience in performing the contract. This contract type places upon the contractor maximum risk and full responsibility for all costs and resulting profit or loss. It provides maximum incentive for the contractor to control costs and perform effectively and imposes a minimum administrative burden upon the contracting parties.

Firm Fixed Price Contract

The award will be made based on the lowest priced technically acceptable proposal with appropriate consideration given to the three (3) evaluation factors: Technical, Price, and Past Performance. To receive consideration for award, a rating of no less than “Acceptable” must be achieved for the non-price factors. The Government is anticipating the award of up to three contracts.

PRICE FACTOR: All offeror’s pricing shall be evaluated by the Source Selection Team (SST) to determine the price being provided and that the pricing received is a fair and reasonable price. The price will be evaluated after determination of the technical acceptability of the offerors non-price factors.

The Government’s intent is to issue a FFP contract, meaning, that an offeror that proposes a Total Evaluated Price of $10 for performance in Italy, and receives award, the offeror would receive $10 over the 12 month performance paid in monthly increments of performance regardless of increases or decreases in repairs or service. Offeror shall be cognizant of potential increases or decreases throughout the life of the contract and consider those in their pricing.
