5152.233-4002 AMC-LEVEL PROTEST PROGRAM (June 2016)

If you have complaints about this procurement, it is preferable that you first attempt to resolve those concerns with the responsible contracting officer. However, you can also protest to Headquarters, AMC. The HQ, AMC-Level Protest Program is intended to encourage interested parties to seek resolution of their concerns within AMC as an Alternative Dispute Resolution forum, rather than filing a protest with the Government Accountability Office or other external forum. Contract award or performance is suspended during the protest to the same extent, and within the same time periods, as if filed at the GAO. The AMC protest decision goal is to resolve protests within 45 working days from filing. To be timely, protests must be filed within the periods specified in FAR 33.103. Send protests (other than protests to the contracting officer) to:

Protest to HQAMC shall be filed at:

Headquarters U.S. Army Materiel Command Office of Command Counsel-Deputy Command Counsel 4400 Martin Road Rm: A6SE040.001 Redstone Arsenal, AL 35898-5000 Fax: (256) 450-8840 or e-mail: usarmy.redstone.usamc.mbx.protests@mail.mil

(a) This provision implements section 523 of Division B of the Consolidated and Further Continuing Appropriations Act, 2015 (Pub. L. 113-235), and similar provisions, if contained in subsequent appropriations acts.

(b) If the Offeror is proposing a total contract price that will exceed $5,000,000 (including options), the Offeror shall certify that, to the best of its knowledge and belief, it--

(1) Has [ ] filed all Federal tax returns required during the three years preceding the certification;

(2) Has not [ ] been convicted of a criminal offense under the Internal Revenue Code of 1986; and

(3) Has not [ ], more than 90 days prior to certification, been notified of any unpaid Federal tax assessment for which the liability remains unsatisfied, unless the assessment is the subject of an installment agreement or offer in compromise that has been approved by the Internal Revenue Service and is not in default, or the assessment is the subject of a non-frivolous administrative or judicial proceeding.

52.212-1 INSTRUCTIONS TO OFFERORS--COMMERCIAL ITEMS (DEVIATION 2018-O0018) (MAR 2020)

(a) North American Industry Classification System (NAICS) code and small business size standard. The NAICS code(s) and small business size standard(s) for this acquisition appear elsewhere in the solicitation. However, the small business size standard for a concern which submits an offer in its own name, but which proposes to furnish an item which it did not itself manufacture, is 500 employees.

(b) Submission of offers. Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. Offers may be submitted on the SF 1449, letterhead stationery, or as otherwise specified in the solicitation. As a minimum, offers must show--

(1) The solicitation number;

(2) The time specified in the solicitation for receipt of offers;

(3) The name, address, and telephone number of the offeror;

(4) A technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary;

(5) Terms of any express warranty;

(6) Price and any discount terms;

(7) "Remit to" address, if different than mailing address;

(8) A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212-3(b) for those representations and certifications that the offeror shall complete electronically);

(9) Acknowledgment of Solicitation Amendments;

(10) Past performance information, when included as an evaluation factor, to include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information); and

(11) If the offer is not submitted on the SF 1449, include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.

(c) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 30 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.

(d) Product samples. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of offers. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender's request and expense, unless they are destroyed during preaward testing.

(e) Multiple offers. Offerors are encouraged to submit multiple offers presenting alternative terms and conditions, including alternative line items (provided that the alternative line items are consistent with subpart 4.10 of the Federal Acquisition Regulation), or alternative commercial items for satisfying the requirements of this solicitation.

Each offer submitted will be evaluated separately.

(f) Late submissions, modifications, revisions, and withdrawals of offers:

(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.

(2)(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and--

(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or

(B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government's control prior to the time set for receipt of offers; or

(C) If this solicitation is a request for proposals, it was the only proposal received.

(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.

(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.

(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.

(5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers.

Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer.

(g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror's initial offer should contain the offeror's best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.

(h) Multiple awards. The Government may accept any item or group of items of an offer, unless the offeror qualifies the offer by specific limitations. Unless otherwise provided in the Schedule, offers may not be submitted for quantities less than those specified. The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit prices offered, unless the offeror specifies otherwise in the offer.

(i) Availability of requirements documents cited in the solicitation. The Offeror also shall enter its Electronic Funds Transfer (EFT) indicator, if applicable. The EFT indicator is a four-character suffix to the unique entity identifier. The suffix is assigned at the discretion of the Offeror to establish additional SAM records for identifying alternative EFT accounts (see subpart 32.11) for the same entity. If the Offeror does not have a unique entity identifier, it should contact the entity designated at www.sam.gov for unique entity identifier establishment directly to obtain one. 52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)

The award will be made based on the lowest priced technically acceptable proposal with appropriate consideration given to the three (3) evaluation factors: Technical, Price, and Past Performance. To receive consideration for award, a rating of no less than “Acceptable” must be achieved for the non-price factors.

C. FACTORS TO BE EVALUATED

The following evaluation factors will be used to evaluate each proposal: Award will be made to the offeror whose proposal is the lowest priced technically acceptable proposal.

Factor 1: TECHNICAL APPROACH: Evaluation of the offeror’s proposal as it applies to the Performance Work Statement (PWS). A detailed explanation of the criteria for the evaluation is set forth in the “Evaluation Approach”.

Factor 2: PRICE The resulting award will be a Firm-Fixed Price contract. The Government will evaluate for unbalanced pricing and price reasonableness for this Firm-Fixed Price effort. The evaluation of price will be based on a proposed price submitted by the offeror(s).

Factor 3: Past Performance: Each offeror’s past performance will be evaluated for recency, relevancy, and quality.

The results will be used to determine an overall performance confidence assessment for each offeror.

D. EVALUATION APPROACH

All proposals shall be evaluated by the Source Selection Team (SST).

1. FACTOR [1]: TECHNICAL APPROACH

Proposal Submission Requirements: The offeror should provide a detailed narrative that identifies the Offeror’s understanding of the overall scope of the requirement and communicates a company specific approach to completing the work. The narrative should specifically address the following elements:

Staffing: State the anticipated number of workers to be employed at each work location. Provide within the narrative the basis for the intended staffing approach.

Qualifications: State skills, certifications, and other qualifications the proposed staff at each location will hold or a plan that proposed employees will hold the minimum skills, certification, and qualification required by the performance work statement by the end of contract phase-in. (Please see the Performance Work Statement for minimum qualifications.)

Evaluation Procedures: The evaluation approach for the technical factor is as follows:

a. Adequacy of Response. The proposal will be evaluated to determine whether the offeror’s methods and approach have adequately and completely considered, defined, and satisfied the requirements specified in the request for proposals (RFP). The proposal will be evaluated to determine the extent to which each requirement has been addressed in the proposal in accordance with the proposal submission section of the RFP.

Failure to satisfy the requirements specified in the RFP may cause the entire proposal to be found to be unacceptable.

b. Feasibility of Approach. The proposal will be evaluated to determine the extent to which the proposed approach is workable and the end results achievable based upon a finding of acceptable or unacceptable on the following elements;

Technical Narrative: A proposal that does not provide a narrative addressing overall scope of the requirement and a company specific approach to completing the work will be found unacceptable, a proposal that does provide a narrative addressing overall scope of the requirement and a company specific approach to completing the work will be found acceptable.

Staffing: The Government will evaluate the extent to which an Offeror’s approach provides for an adequate number of staff. Inadequate staffing may be rated as unacceptable. Failure to provide a staffing plan with the proposal will be found unacceptable, a proposal that provides a staffing plan that shows adequate staffing will be found to be acceptable.

Qualifications: Evaluate the contractors approach to staff the requirement with employees with the necessary skills, certifications, and qualifications. A proposal that communicates unskilled/uncertified/unqualified staff at phase-in end may be rated as unacceptable. Failure to provide skills, certifications, qualifications will be found unacceptable, a proposal that provides skills, certifications, qualifications and staff at phase-in end will be found to be acceptable.

Evaluation Standard:

Technical Approach is evaluated in terms of Acceptable or Unacceptable, based on the proposal information provided against the evaluation procedures above.

Adjectival Rating Description

Acceptable Proposal meets the requirements of the solicitation.

Unacceptable Proposal does not meet the requirements of the solicitation.

2. FACTOR [2]: PRICE FACTOR

All offeror’s pricing shall be evaluated by the Source Selection Team (SST) to determine the price being provided and that the pricing received is a fair and reasonable price. The price will be evaluated after determination of the technical acceptability of the offerors non-price factors.

Proposal Submission Requirements:

The offeror shall provide pricing and complete all line items, that the offeror intends to perform, that are being proposed on Standard Form 1449 (SF 1449). The SF1449 shall be signed by an official that is authorized to bind the company. The offeror shall also acknowledge all amendments to the solicitation in accordance with the instructions on the Standard Form 30 if issued. Offerors are required to propose on the Service Contract Reporting CLIN for each location that is being proposed. They can enter a value or NSP and if they do not enter a figure, then €0 will be assumed.

Evaluation Procedures:

The Offeror’s Price proposal will be evaluated as follows;

1) Compliance: The Price proposal submitted by the Offeror will be evaluated for compliance based upon the submission requirements contained in 52.212-1 and the above Proposal Submission Requirement instructions.

2) Errors: The Offeror’s Price proposal will be reviewed for errors. The Offeror may be given an opportunity to clarify certain aspects of their proposal at the sole discretion of the Contracting Officer.

3) Location Total Evaluated Price: The Government will evaluate each locations price independently of the other locations. The low for each location will be considered the low for that location for purposes of award. The Government will evaluate each location by taking the base price and adding all optional CLINs associated with that location to come to a location total price. The evaluation of all option CLINs will not obligate the Government to exercise any option. The Offeror’s proposed fixed-price CLINs and pricing within the Price Proposal Work Breakdown Pricing Sheet may be evaluated, using one or more of the techniques described in FAR 15.404-1 in order to determine if they are fair and reasonable.

For a price to be fair and reasonable, it must represent a price to the Government that a prudent person would pay in the conduct of competitive business.

(a) 52.217-8 To evaluate the option to extend services (FAR 52.217-8) CLINs, one-half of the proposed price for the last year of the performance period under CLIN 3001- CLIN 3003 shall be added to the Total Evaluated Price.

(b) Unbalanced Pricing: The Offeror’s overall Price proposal will be evaluated for unbalanced pricing as defined in FAR 15.404-1(g). An offer may be rejected if the contracting officer determines that the lack of balance poses an unacceptable risk to the Government (see FAR 15.404-1(g)(1) through FAR 15.404-1(g)(3)).

(c) Phase-in: Please price base year with the understanding that performance expectation for the phase-in/first month of the base year is at least 60% of…
