SECTION F - DELIVERIES OR PERFORMANCE
REQUIRED DELIVERY SCHEDULE__________________________
Prior to issuance of a production award, the Government and contractor will negotiate a contract delivery schedule for the quantity to be awarded, in six month increments known as delivery periods. Any previously established contract delivery schedule for quantity already on contract will remain unchanged unless approved by the PCO. This negotiated contract delivery schedule will be at the DODIC level, with the Government determining production priority at the MILSTRIP level. Upon execution of a production order, the contractor is obligated to deliver the DODICs and associated quantities outlined in the contract during the established six month delivery periods.
Six month delivery periods will coincide with the Government Fiscal Year (GFY) as follows: October 1st - March 31st and April 1st -
September 30th. Delivery dates negotiated for issuance of a production award shall not exceed September 30th of the subsequent GFY, unless approved by the PCO.
Examples:________
(a) Quantities ordered from: Date of Contract Award - September 30, 2022.
Delivery Schedule Not-to-Exceed (NTE): September 30, 2023 regardless of when the order is placed during the fiscal year.
(b) Quantities ordered from: October 1, 2022 - September 30, 2023.
Delivery Schedule NTE: September 30, 2024 regardless of when the order is placed during the fiscal year.
The contractor shall provide a monthly forecast for ammunition deliveries on the contract delivery schedule on a per DODIC basis. The monthly forecast shall be provided for the entire delivery period at time of award for new orders, and shall clearly articulate the contractor's monthly forecast for ammunition deliveries. While not contractually binding, a timely and accurate monthly forecast is necessary in order for the Government to communicate expected ammunition deliveries to stakeholders and ensure readiness for all customers.
If the actual delivery quantity varies from the six month contract delivery schedule, the contractor shall propose a rebaselined schedule, to include a monthly forecast, no later than the 5th working day after the delivery period. The rebaselined schedule shall include all undelivered quantity on contract as of the last day of the previous six month delivery period, and shall represent a contract delivery schedule that is realistically achievable. No variances from the previous six months will be continued into the rebaseline, and the contract delivery schedule will start over with each six month period. The previous contract delivery schedule will no longer be valid once the rebaseline is incorporated into the contract. The Government reserves the right to unilaterally incorporate a contract delivery schedule if the parties cannot reach an agreement.
At the end of the six month delivery period, consideration may be assessed for all delinquent DODICs in accordance with the formula and table below. The Government may also pursue further remedies to offset any harm caused as a result of the late delivery.
Consideration will be based on actual performance for the prior six month delivery period and will not take into account when the delinquency is scheduled to be made up. Consideration will be calculated for each DODIC and summed to determine the total consideration owed. The value of delinquent quantity will be calculated utilizing the unit price of the product* multiplied by the number of units delinquent.
* Unit price of product to be used in calculation:
For the consideration calculation in the first, second and third six month periods of the contract (April 2022 - September 2022, October
2022 - March 2023, and April 2023 - September 2023) use the lowest unit price for each DODIC awarded during the first Delivery Order
(Ordering Period 1).
For the consideration calculation in the fourth and fifth six month periods of the contract (October 2023 - March 2024 and April 2024 -
September 2024) use the lowest unit price for each DODIC awarded during the second Delivery Order (Ordering Period 2).
This pattern will continue for each Ordering Period of the contract.
Percent Delivered Consideration Charge_________________ ____________________
93% or greater No Penalty
75% - 92.9% Value of delinquent quantity x 25% of prompt payment rate
50% - 74.9% Value of delinquent quantity x 50% of prompt payment rate
49.9% or below Value of delinquent quantity x 100% of prompt payment rate
The Prompt Payment rate is be defined as the current rate published by the U.S. Department of the Treasury. Current rates can be found at: https://www.fiscal.treasury.gov/fsservices/gov/pmt/promptPayment/rates.htm
The Government reserves the right to change priorities at the MILSTRIP level at no additional cost to the Government as long as the

total contract quantity per DODIC does not change within the six month delivery periods.
In the event of a national emergency, including engagement in conflict or declaration of war, the Government reserves the right to establish monthly contractual delivery schedules at no cost to the Government, and shall not be held liable for any effects resulting from this change. In addition, the Government can establish monthly contract delivery schedules if there is a readiness issue on a specific DODIC(s).
Upon acceptance through WAWF, the contractor is required to ship lots within thirty days unless an extension to this timeframe is granted in advance by the PCO.
Any delinquencies or delays in delivery caused by the contractor's failure to submit an adequate First Article Test waiver request will be deemed contractor fault. This failure does not constitute an excusable delay. Government denial of the contractor's waiver request is also not excusable for any delinquencies or delays in delivery.
Disputes and controversies of any nature whatsoever between the Government and contractor regarding this narrative will be settled via determination by the PCO. The PCO's determination shall be final and binding on the Government and contractor.
