SECTION 00 70 00 - CONDITIONS OF THE CONTRACT
The following were previously included by reference and are now included by full text:
52.204-24 REPRESENTATION REGARDING CERTAIN TELECOMMUNICATIONS AND VIDEO
SURVEILLANCE SERVICES OR EQUIPMENT (AUG 2020)
The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it "does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument" in the provision at 52.204-26, Covered Telecommunications Equipment or Services--Representation, or in paragraph (v) of the provision at 52.212-3, Offeror Representations and Certifications-Commercial Items.
(a) Definitions. As used in this provision-
Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
(b) Prohibition.
(1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.
115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to--
(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.
115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract. Nothing in the prohibition shall be construed to--
(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(c) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for "covered telecommunications equipment or services."
(d) Representations. The Offeror represents that--
(1) It [ ] will, [ ] will not provide covered telecommunications equipment or services to the Government in the performance of any contract, subcontract or other contractual instrument resulting from this solicitation. The Offeror shall provide the additional disclosure information required at paragraph (e)(1) of this section if the Offeror responds "will" in paragraph (d)(1) of this section; and
(2) After conducting a reasonable inquiry, for purposes of this representation, the Offeror represents that--
It [ ] does, [ ] does not use covered telecommunications equipment or services, or use any equipment, system, or service that uses covered telecommunications equipment or services. The Offeror shall provide the additional disclosure information required at paragraph (e)(2) of this section if the Offeror responds "does" in paragraph (d)(2) of this section.
(e) Disclosures.
(1) Disclosure for the representation in paragraph (d)(1) of this provision. If the Offeror has responded "will" in the representation in paragraph (d)(1) of this provision, the Offeror shall provide the following information as part of the offer:
(i) For covered equipment--
(A) The entity that produced the covered telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the original equipment manufacturer (OEM) or a distributor, if known);
(B) A description of all covered telecommunications equipment offered (include brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); and
(C) Explanation of the proposed use of covered telecommunications equipment and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.
(ii) For covered services--
(A) If the service is related to item maintenance: A description of all covered telecommunications services offered (include on the item being maintained: Brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); or
(B) If not associated with maintenance, the Product Service Code (PSC) of the service being provided; and explanation of the proposed use of covered telecommunications services and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.
(2) Disclosure for the representation in paragraph (d)(2) of this provision. If the Offeror has responded "does" in the representation in paragraph (d)(2) of this provision, the Offeror shall provide the following information as part of the offer:

1 GENERAL REQUIREMENTS
1.1 DESCRIPTION
This project will consist of renovations to accommodate simulator installation (government provided, not under this contract). The existing facility will not be occupied by government personnel during construction. Work includes installation of interior and exterior roll up doors, design and construction of a welded steel staircase, design and construction of a very early warning smoke detection system to integrate with existing fire alarm/suppression systems, design and electrical modifications to existing installation including connection to government provided equipment, new doorway/wall to separate existing hallways, plumbing to include new eyewash station, communications (tele/data) modifications, and limited infrastructure for security systems installed under separate contract. Work will include prioritizing repairs to the sim bay, computer room, and coordination with other contractors and US government to facilitate installation of simulator.
All work is intended to match the existing facility including but not limited to: level of finishes, conduit color coding, aesthetics and color selections. Reticulated Form Absorber in classroom shall be black, minimum 0.5” thickness, UL94-HF1 Flammability rating.
1.2 PHASING, GOVERNMENT FURNISHED EQUIPMENT, AND SIMULTANEOUS CONTRACT
OUTSIDE THIS SCOPE OF WORK
Work within the WST high bay, room 116 and computer room 113 shall be complete first.
Simulator delivery will take place once the following are complete: roll up doors are installed, metal stair is installed, floor in high bay is resurfaced, and the opening into MIOS 210 is created in the high bay wall.
Simulator contractor will be responsible for simulator delivery and installation (not in this scope). However, fire alarm interface, electrical connections, condensate drain, and GPS antenna installation will be in this scope of work as shown in the drawings and specifications.
GPS antenna and cable will be provided for installation under this contract.
1.3 DESIGN DOCUMENTS
A The following require stamped drawings or designs from contractor beyond the bridging documents:
1 Verification of lintel, bond beam, or reinforcement requirements for opening to be cut from WST High Bay 116 into second floor MIOS 210. Additionally, verification that floor construction is adequate for additional load of SNS equipment. SNS console is 72”W x 68.5”D x 76.5”H and 1600 LBS. SNS IOS is 46.25”W x 60”D x 26.25”H and 240 LBS.

1.4 MANDATORY JOB SITE VISIT
Interested bidders must attend a mandatory site visit prior to the bid due date. The site visit will be scheduled and advertised by the Contracting Officer (KO).
1.5 BIDDING
Submit cost proposals to the KO. All bids must be in writing, using the bid form specified in the solicitation. All bids must be received by the date and time specified in the solicitation.
1.6 CODES AND REGULATIONS
All work shall be accomplished in accordance with the following:

1.7 WORKMANSHIP
All work shall be accomplished in a professional manner by experienced tradespersons to the complete satisfaction of the COR.
1.8 APPROVALS AND CHANGES
A Submit all proposed change order documents to the KO for approval prior to procurement of equipment and commencement of the change.
B No deviation from approved plans, specifications and general notes will be permitted without written approval from the COR. Requests for deviations or substitutions must be submitted on a substitution request form available from the COR.

A HAZARDOUS MATERIALS
1 Submit two copies of the manufacturer’s Safety Data Sheets (SDS) for all hazardous materials used during the course of the project along with the following additional information:
a Number of components in material if it is a kit b Container type c Unit of packaging: (oz, gal, lb, qt, ea, etc.)
d Package: (can, drum, bottle, cylinder, etc.)
1.11 OPERATION AND MAINTENANCE MANUALS
See individual specification sections
1.12 COORDINATION
A The contractor shall coordinate all work with the COR.
B Contact the COR five (5) working days in advance of mobilization on site and provide proper documentation to allow for processing of base access paperwork. This requirement includes deliveries of any kind.
C Same day request and access is not always possible.
1.13 TEMPORARY FACILITIES
The contractor shall be provided reasonable access to existing electricity, water, and sewer utilities required to perform the work. If additional new temporary utility connections are required, the contractor shall pay for connections and service.
1.14 CONTRACTOR MATERIAL STORAGE
The contractor shall submit a request in writing for material storage or laydown areas not immediately inside the area of work. Exterior laydown requests must include a site plan schematic showing area in reference to existing buildings.
1.15 DAMAGE
The Contractor shall be responsible for any damages cause to any existing work areas during the entire performance of this project. The Contractor shall be responsible to rectified or replaced any equipment damaged without additional expense to the Government.
1.16 QUALITY CONTROL
A A pre-construction conference will be held by the KO at a time prior to the commencement of work and shall be attended by the COR, the end user, and the Contractor.
B The purpose of this conference is to completely review the job and the specifications to confirm mutual understanding of the job content and performance.
C The Contractor is responsible for quality control. Inspections by the COR do not alleviate the contractor from his responsibility. The Contractor shall be responsible for all applicable material testing and special inspection activities necessary to ensure the project is constructed according to code.
1.17 SCHEDULES
A The Contractor shall begin work within 10 calendar days after the issuance of the Notice to Proceed.
B No on-site work shall start until the Contractor has an Approved Project Schedule.
C The period of performance shall be 180 days for this contract.
D The work within WST High Bay 116 shall be scheduled for completion prior to 9 Dec.
E The COR will coordinate Contractor work schedules upon award.
F The COR will notify the Contractor if a job site is located in a secure area. This facility will not be a secure area until completion of this project and certification. Warranty work may require work within a secure area.
1 The Contractor shall provide written notice to the COR at least three working days prior to working in secure areas.
2 The Contractor shall provide personnel that meet the requirements to work within the secure areas without escorts.
3 The COR will provide a letter to the Contractor granting permission for work within secure areas.
a The notice shall include working hours, location of work, and number of workers.
b The Contractor shall keep this letter on the jobsite at all times.
1.18 ACCESS AND GENERAL PROTECTION/SECURITY POLICY AND PROCEDURES:
A. Access and General Protection/Security Policy and Procedures. This standard language is for contractor employees with an area of performance within Government controlled installation, facility, or area. The contractor shall comply with all applicable installation/facility access and local security policies and procedures, which may be obtained from the Contracting Officer’s Representative (COR). The contractor shall also provide all information required for background checks to meet installation access requirements to be accomplished by the local installation’s Security Forces, Director of Emergency Services or local Security Office. The contractor shall ensure compliance with all personal identity verification requirements as directed by DoD, HAF and/or local policy.
Should the Force Protection Condition (FPCON) change, the Government may require changes in contractor security matters or processes.
B. For Contractors that do not require CAC, but require access to a DoD Facility and/or
Installation. Contractor and all associated sub-contractors employees shall comply with adjudication standards and procedures using the National Crime Information Center Interstate Identification Index (NCIC-III) and Terrorist Screening Database (TSDB) (AFI 31-101 and AFI 10-245), applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative), or, at OCONUS locations, in accordance with status of forces agreements and other theater regulations.
C. All commercial, contractor, and sub-contractors vehicles are subject to random inspections each time they enter the base.
D. If badges will be issued, they will be issued by the 153d Security Forces Squadron (SFS) to the contractor through the 153 CES COR. Badges shall be issued, tracked, and collected in accordance with instructions from Security Forces.
1. The following are the requirements and procedures for the contractor:
a. Contractors working in Controlled or Restricted areas or any area on the flight line must be issued a specific contractor identification badge or be escorted. (This project is located on the airfield).
1.19 CUTTING AND PATCHING
A Cutting and patching includes cutting into existing structures to provide for the performance of the work and subsequent fitting and patching as required to restore surfaces disturbed, damaged or otherwise altered to their original or specified condition.
B Visual Requirements: Do not cut and patch work in a manner that would result in substantial visual evidence of cut and patch work. Remove and replace work judged by the COR to be cut and patched in a visually unsatisfactory manner.
C If possible, retain the original installer or fabricator, or another recognized experienced and specialized firm to cut and patch.
D Use materials for cutting and patching that are identical to existing materials. If identical materials are not available, or cannot be used, use materials that match existing adjacent surfaces to the fullest extent possible with regard to visual effect. Use materials for cutting and patching that will result in equal-or-better performance characteristics.
E Restore surfaces of patched areas to match adjacent finishes. Where necessary, extend finish restoration into retained adjoining work in a manner, which will eliminate of patching and refinishing.
1.20 CLEAN-UP
A See specification section 024100. Note: include additional 40 yards for disposal of simulator packaging.
B Protect existing building and contents from damage, dirt and dust during construction related activities.
1.21 ENVIRONMENTAL COMPLIANCE
A Spill Notification: The contractor shall notify the COR upon spilling any quantity of hazardous materials/waste. Spill Containment Control and Countermeasures shall be provided by the contractor in accordance with 20 CFR 112.
B Hazardous Materials Storage: Ensure all hazardous materials stored outdoors are placed in secondary containment in accordance with 40 CFR.
C Hazardous Waste: All hazardous waste generated from the use of hazardous materials shall be disposed offsite. The contractor shall make the COR aware of all hazardous waste through the Hazmat disclosure process and provide all required documentation.
D. Adequate soil erosion control measures shall be implemented to minimize sediment migration from the work site. This may include but is not limited to silt fencing, straw bales, and fiber rolls. Extra caution should be exercised to prevent exposing excess soil along the hillside of the work site and allowing soil erosion to the creek at the base of the slope. All storm water pollution prevention measures must be done in accordance with the WYDEQ Small Construction General Permit WYR10-A000 located on the DEQ Water Quality Division website.
1.22 FACILITY SERVICE OUTAGES
If the project requires any facility utility outages, the contractor shall provide a written request at least 72 hours before planned outage period and receive approval from 153 CES customer service before disconnection.
Contractor to post when fire suppression system is out of service. Contractor to coordinate with 153 CES Fire and Emergency Services Flight (base fire department) for any required outage for fire alarm system.
1.23 PARKING
Adequate on-site parking for contractor vehicles will be designated by the Government.
1.24 OWNER TRAINING

2 COSTS LINE ITEMS
2.1 CLIN 0001 BASE BID SIM BAY CONSTRUCTION
This scope includes all work required in the sim bay. This includes but is not limited to coiling overhead doors and associated wiring, floor resurfacing, metal stair, opening for SNS device, relocation of electrical equipment and associated wiring.
2.2 CLIN 0002 BASE BID CONSTRUCTION – REST OF FACILITY
This scope includes all work required in the rest of the facility except bid option 1.
2.3 CLIN 0003 BID OPTION 1 CONSTRUCTION – NEW JANITOR’S CLOSET
This scope includes all work required to construct new janitor’s closet in galley/vending.

A. Contractor Manpower Reporting: The contractor shall report ALL contractor labor hours (including subcontractor labor hours) required for performance of services provided under this contract for the Air Force collection site. The contractor is required to completely fill in all required data fields using the following web address: http://www.ecmra.mil/. Reporting inputs will be for the labor executed during the period of performance during each Government fiscal year (FY), which runs October 1 through September 30. While inputs may be reported any time during the FY, all data shall be reported no later than October 31 of each calendar year. 4 DESCRIPTION OF WORK
4.1 CONSTRUCTION
The simulator facility is located at the Cheyenne RAP Air Guard installation. This project will consist of renovations to accommodate simulator installation (government provided, not under this contract). Work includes installation of interior and exterior roll up doors, design and construction of a welded steel staircase, design and construction of a very early warning smoke detection system to integrate with existing fire alarm/suppression systems, design and electrical modifications to existing installation including connection to government provided equipment, new doorway/wall to separate existing hallways, plumbing to include new eyewash station, communications (tele/data) modifications, and limited infrastructure for security systems installed under separate contract. Work will include prioritizing repairs to the sim bay and computer room and coordination with other contractors and US government to facilitate installation of simulator.
Work within WST High Bay Room 116 and computer room 113 shall be critical path and will be prepped for simulator delivery first. Work can occur in the rest of the facility simultaneously and after completion of high bay work.
Fire suppression system modifications intent:
Trainer (Simulator): The simulator contractor will provide and install a complete VESDA system covering the motion sim and computer equipment (racks) themselves. The facility contractor will be responsible for providing and installing from building fire alarm to trainer systems:
1) Output from cabinet P1 where trainer VESDA system reports to. This will indicate fire in the trainer to the building fire alarm panel.
2) Building fire alarm input to cabinet P1.
3) Shunt trip to shunt trip breaker MSEMM (being relocated in this scope).
4) EPO to Trainer UPS (being replacing by sim contractor) and EPO to vacuum pump UPS (being installed by sim contractor) based on building fire alarm.
5) Building horn/strobe within the cockpit in coordination with sim contractor.
6) Building fire alarm pull station at operator’s station (on trainer) in coordination with sim contractor.
WST High Bay 116 and Computer Room 113: VESDA system shall be provided by facility contractor (and associated power). Sampling tubing layout by contractor’s fire protection engineer to coordinate with existing systems and cover high bay ceiling, computer room ceiling, and below raised access floor in computer room. Existing pre-action fire suppression system to remain.
The intent is to design and install and or upgrade the fire alarm systems without change to the existing fire suppression system or devices associated with the pre-action system. The design shall be designed and stamped by a licensed Fire Protection Engineer. All components and new installation shall be compatible and or exceed existing components and materials. The system shall provide protection, i.e. shunting power, prior to or upon water release. Furthermore, we want to ensure that all outputs from, but not limited to the WST High Bay and computer room VESDA, heat detectors, water flow, and each stage of alarm are transmitted via MAAP + to the Fire Department (Base Central Station). The design and installation shall also verify, modify, and provide the appropriate water discharge locations, volumes, and directions, which meet all requirements as defined in the specification and per Air Force guidance. Provide programming for new components and reprogramming as required of existing components to ensure shunt trip, notification of building occupants and reporting to fire department performs as intended. Intent is to shunt systems provided with shunt trip capability with 135 degree F thermal heat detectors and a minimally delayed water flow switch; Intent is to shunt systems provided upon building fire alarm. However, the engineer of record shall may propose a system, for approval demonstrating shunting capability. Field verification is required with approval from the Base Civil Engineer.
All components must be compatible, controlled and monitored by the existing Monaco panel, or a new like Monaco panel shall be installed by the contractor. The panel shall also monitor all facility VESDA outputs:
These at a minimum when activated will provide four levels of alarm. These are:
1. Supervisory: Alarm Level 1 (Alert)
2. Supervisory: Alarm Level 2 (Action)
3. Alarm Level 3 (Fire 1)
4. Alarm Level 4 (Fire 2)
The system shall have 135 F degree F heat detectors, located in the Room 113 Computer Room both above and below the floor. The system also required 135 F degree F heat detectors in Room 116 WST High Bay. Heat detectors when activated shall shunt power in the computer and the simulator room. The Monaco panel shall also monitor the water flow devices which shall have outputs to shunt the power.

Government furnished contractor installed equipment: Two VESDA panels will be provided with mounting brackets to be installed by contractor in this scope. These panels will be connected to air sampling within the simulator and the government furnished/ government installed computer racks.
Contractor to connect to sampling tubes in equipment and provide sampling at computer room ceiling and below access floor. As described above, simulator contractor will install simulator VESDA equipment. Facility contractor will provide and install facility VESDA system.
Endstate: Repair the current Fire Detection and Suppression system to protect life, safety, and organizational equipment. The system provides very early warning and appropriate responses including, but not limited to, occupant notification, NMS, suppression, and shunt control to mitigate fire damage, accidental discharges and detrimental effects from accidental discharges.
