SECTION 00 10 00 NOTES

1. All information relating to this Request For Quote (RFQ), including pertinent changes/amendments and information will be posted to the Contract Opportunities module of the System for Award Management (SAM) website (www.sam.gov).

2. For security reasons, all potential quoters, plan rooms, printing companies, etc. are required to be registered with the SAM website to access secured files. Interested quoters are also required to submit their annual representations and certifications at the same site.

3. Electronic transmission of quotes is authorized and accepted.

4. A complete quote package must contain the following:

4.1. Standard Form (SF)1442, and back. Pursuant to Federal Acquisition Regulation 4.102, Solicitation, Offer, and Award, front , blocks 20A, 20B, and 20C must be signed by an official having the authority to contractually bind the Contractor's Signature company. One copy of the SF1442 is required to have an original signature.

5. Joint Venture Requirements.

5.1. Quoters wishing to submit a quote as a Joint Venture (JV) must also submit (with the pro Forma documents) a copy of the JV agreement that is executed in accordance with FAR4.102(d). Additionally, each JV partner shall submit evidence that its board of directors has approved its participation in the JV. For an unincorporated entity, submit an instrument of similarly binding character.

5.2. JV quoters are reminded that the JV entity must be registered in the Entity Information module of the SAM website. For solicitations that are set-aside, the JV must also meet the applicable size standard. If the JV entity has received a size determination from the Small Business Administration (SBA), submit a copy of that determination with the bid.

5.3. Pursuant to FAR19.302(b), the Contracting Officer may protest the small business representation or representation of a JV entity where one (1) or more of the party/parties appears to not meet the set-aside standard. All questions regarding JVs must be directed to SBA.

2.6. BASIS OF AWARD- EVALUATION

I. Basis for Contract Award - Evaluation of Quotations-Simplified Acquisition Procedures

(a) The Government will award a contract resulting from this solicitation to the responsible quoter whose quote conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors, under FAR 13.106-2, shall be used to evaluate quotes comparatively without priced tradeoffs:

(i) Technical - Risk; and

(ii) Price

Quote Evaluation: The evaluation process will be accomplished as follows (Organized by Volume):

A. General: We will award a contract to the responsible quoter who represents the best value to the Government on the basis of comparison of its (1) quote, and (2) technical - risk.

B. Volume I, Quote

1. General: We will determine the merits of your quote on the basis of (a) its acceptability and (b) its quoted price.

(a) Acceptability: We will determine the acceptability of your quote on an acceptable or unacceptable basis. We will consider your quote acceptable if it (i) conforms to the material solicitation requirements; (ii) manifests your unconditional assent to the terms of this Request for Quote (RFQ), and

(iii) you are a responsible prospective contractor pursuant to FAR 9.104-1. (NOTE: By submission of a quote, the quoter represents that it

)unconditionally assents to the terms of this Request for Quote, except for any written express exceptions.

(i) Conformance. Material solicitation requirements include those terms affecting quality, quantity, price, or delivery.

(ii) Assent. If you (1) take exception to any term of this RFQ, (2) propose any additional terms, or (3) omit material information required by this RFQ then we will consider your quote to be unacceptable and ineligible for contract award.

The bidder shall furnish a bid guarantee in the form of a firm commitment, bid bond supported by good and sufficient surety or sureties (b) e.g., acceptable to the Government, postal money order, certified check, cashier's check, irrevocable letter of credit, or, under Treasury Department regulations, certain bonds or notes of the United States. (a) Definitions. As used in this provision, Covered article, FASCSA order, Intelligence community, National security system, Reasonable inquiry, Sensitive compartmented information, Sensitive compartmented information system, and Source have the meaning provided in the clause 52.204-30, Federal Acquisition Supply Chain Security Act Orders-Prohibition.

(b) Prohibition. Contractors are prohibited from providing or using as part of the performance of the contract any covered article, or any products or services produced or provided by a source, if the prohibition is set out in an applicable Federal Acquisition Supply Chain Security Act (FASCSA) order, as described in paragraph (b)(1) of FAR 52.204-30, Federal Acquisition Supply Chain Security Act Orders-Prohibition.

(c) Procedures.

(1) The Offeror shall search for the phrase "FASCSA order" in the System for Award Management (SAM)( https://www.sam.gov) for any covered article, or any products or services produced or provided by a source, if there is an applicable FASCSA order described in paragraph (b)(1) of FAR 52.204-30, Federal Acquisition Supply Chain Security Act Orders-Prohibition.

(2) The Offeror shall review the solicitation for any FASCSA orders that are not in SAM, but are effective and do apply to the solicitation and resultant contract (see FAR 4.2303(c)(2)).

(3) FASCSA orders issued after the date of solicitation do not apply unless added by an amendment to the solicitation.

(d) Representation. (7) Reason why the applicable covered article or the product or service is being provided or used;

(f) Executive agency review of disclosures. The contracting officer will review disclosures provided in paragraph (e) to determine if any waiver may be sought. A contracting officer may choose not to pursue a waiver for covered articles or sources otherwise subject to a FASCSA order and may instead make an award to an offeror that does not require a waiver.

(a) Definitions. As used in this clause-

Covered article, as defined in 41 U.S.C. 4713(k), means-

(1) Information technology, as defined in 40 U.S.C. 11101, including cloud computing services of all types;

(2) Telecommunications equipment or telecommunications service, as those terms are defined in section 3 of the Communications Act of 1934 (47 U.

S.C. 153);

(3) The processing of information on a Federal or non-Federal information system, subject to the requirements of the Controlled Unclassified Information program (see 32 CFR part 2002); or

(4) Hardware, systems, devices, software, or services that include embedded or incidental information technology.

FASCSA order means any of the following orders issued under the Federal Acquisition Supply Chain Security Act (FASCSA) requiring the removal of covered articles from executive agency information systems or the exclusion of one or more named sources or named covered articles from executive agency procurement actions, as described in 41 CFR 201-1.303(d) and (e):

(1) The Secretary of Homeland Security may issue FASCSA orders applicable to civilian agencies, to the extent not covered by paragraph (2) or (3) of this definition. This type of FASCSA order may be referred to as a Department of Homeland Security (DHS) FASCSA order.

(2) The Secretary of Defense may issue FASCSA orders applicable to the Department of Defense (DoD) and national security systems other than sensitive compartmented information systems. This type of FASCSA order may be referred to as a DoD FASCSA order.

Intelligence community, as defined by 50 U.S.C. 3003(4), means the following-

(1) The Office of the Director of National Intelligence;

(4) The Defense Intelligence Agency;

(5) The National Geospatial-Intelligence Agency;

(6) The National Reconnaissance Office;

(7) Other offices within the Department of Defense for the collection of specialized national intelligence through reconnaissance programs;

(8) The intelligence elements of the Army, the Navy, the Air Force, the Marine Corps, the Coast Guard, the Federal Bureau of Investigation, the Drug Enforcement Administration, and the Department of Energy;
