About this file

This document is a TSA Form 2815, a Non-Disclosure Agreement (NDA) template for individuals and entities granted access to Sensitive Security Information (SSI) by the Transportation Security Administration. The form may be used in lieu of or to supplement DHS Form 11000-6 when additional restrictions on SSI access are deemed appropriate.

The NDA establishes binding terms requiring signatories to safeguard SSI as defined in 49 CFR Part 1520, handle materials in accordance with established policies and procedures, and immediately notify TSA of any suspected breaches involving loss of control, compromise, or unauthorized disclosure. Access is granted conditionally for a sole specified purpose and terminates upon conclusion of the need-to-know for that purpose. Signatories must return or certify destruction of all SSI records within 30 days of termination. Unauthorized disclosure may result in cancellation of conditional access, civil penalties under 49 U.S.C. § 46301, court orders prohibiting disclosure, and other enforcement actions. The agreement incorporates by reference obligations created by Executive Orders 12356 and 12968, whistleblower protection statutes, and laws protecting classified information and national security. The document includes provisions acknowledging that the agreement does not supersede protections for disclosures to Congress, Inspector Generals, or regarding illegality, waste, fraud, abuse, or public health and safety threats. The form requires signature by the individual or entity receiving SSI access and acceptance by a TSA representative, with the program office or Contracting Officer responsible for maintaining the executed agreement per agency record disposition schedules.

The recipient’s name, authorized entity, and purpose of disclosure must be completed in advance by the issuing program office. The program office, Contracting Officer Representative (COR), or Contracting Officer, as appropriate, is responsible for maintaining the executed NDA in accordance with agency record disposition schedules.

10. Each provision of this Agreement is severable. If any administrative or judicial tribunal should find any provision of this Agreement to be unenforceable, all other provisions shall remain in full force and effect.

11. By granting the undersigned conditional access to information in this context, the United States Government does not waive any statutory or common law evidentiary privileges or protections that it may assert in any administrative or judicial proceeding to protect SSI to which the undersigned has been or may be given conditional access under the terms of this Agreement.
