About this file

This document is a Request for Information (RFI) Questions and Answers spreadsheet for the Thurgood Marshall Federal Judiciary Building (TMFJB) Energy Savings Performance Contract (ESPC) Notice of Opportunity (NOO), issued on May 22, 2026.

The RFI addresses 20 questions from contractors regarding submission requirements, facility specifications, and project scope. Key clarifications include: the Management Approach section page limit has been expanded from 5 to 10 pages; Section 5.1 (ESCO Experience) remains at 10 pages and Section 5.2 (ESCO Management Approach) is confirmed at 10 pages; 10-point font is acceptable for tables, graphics, and headers/footers with 12-point minimum for body text; Cover/Title Page, Table of Contents, and Glossary are outside page limitations; Past Performance Questionnaires are external to page counts. The AOC clarified that the AHU/VAV design package will be released during the Interagency Agreement (IGA) phase at 100% completion pending GAO Risk Assessment, with the ESCO having opportunity to review and adjust design to meet ESPC project requirements. The AHU replacement scope, currently under design by AOC, will be funded within the ESPC project scope. Monthly water and sewer consumption data has been provided; natural gas infrastructure exists but is not currently in service. Primary electrical service consists of three 13.2kV PEPCO feeders. The facility's existing steam and hot water infrastructure is sufficient for planned AHU systems but inadequate for future multi-zone VAV conversions requiring internal heating water infrastructure upgrades.

RFI Number Question Answers

The Management Approach is a critical section of this response and has a lot of information that needs to fit into the five-page limit. Will the government expand the page limit for the Management Approach from five pages to ten pages? Agreed; the AOC would accept a max of 10 pages.

Can the government provide information regarding both the water and natural gas usage and spend?

The annual information is included in the NOO, monthly water and sewer consumption and cost for the past year has been provided by the Energy and Sustainability branch and is provided as an attachment to this RFI document.

There is an existing natural gas line to the building; however, it is not utilized/not in service at this time.

3 Does this opportunity have a solicitation number?

This is the Notice of Opportunity Stage; a solicitation number will be provided when a Request for Proposal (RFP) is issued.

4 Does this response have a requirement for the page size and/or page margins?

Standard 1" margins, 8 1/2" x 11" page size, and fold out style format is acceptable if required by specific content.

Page 4 of the NOO state "The design of the AHU system is underway and near completion." Please clarify if the agency will allow for ESCO review and adjustment of this design if it provides a betterment to the AHU replacement approach, overall system efficiency, overall system's ability to provide desired thermal comfort improvements, and/or overall system resilience?

Yes, ESCO will have opportunity to review and adjust design to meet ESPC project requirements.

Designer of Record is aware of the ESCO and amenable.

Section 5.2 of the Required Submittals request a significant amount of information be included in a 5-page limit. Will the agency consider extending the page limit of this section to 8 pages? See responses to RFI No. 1 and 4.

Page 4 states "The existing heating water infrastructure does not have sufficient capacity to support the addition of terminal unit reheat throughout the building and will need to be upsized to support future reheat capacity." Is this indicating that there is not enough capacity from the Capital Complex Power Plant (CPP) or simply that the existing Thurgood Marshall Federal Judiciary Building's internal steam/hot water distribution infrastructure is not adequate for the revised AHU system planned?

The existing steam and hot water is sufficient for the revised AHU systems that are planned for this ESPC. For future conversions to multi-zone variable air volume (VAV) systems, the existing steam capacity from the CPP is adequate, however, the internal infrastructure at TMFJB is inadequate to convert the steam to heating water for future VAV multi-zone renovations.

Section 5.1 of the Required Submittals request a significant amount of information be included, particularly if information is provided for up to the 5 project limit, in a 10-page limit. Will the agency consider extending the page limit of this section to 12 pages? See responses to RFI No. 1 and 4.

Section 5.2 ESCO Management Approach: Can that section be increased from 5 pages to 10 pages? See responses to RFI No. 1 and 4.

Section 5.3 References for ESCO Past Performance: Is it AOC’s expectation for the ESCO to fill out sections 1-4 of a standard Past Performance Questionnaire (PPQ) and include that as part of our Expression of Interest (EOI)? If yes does the PPQ’s fall outside of the page count?

A PPQ will be sent to provided POC's if determined necessary and will be outside of page count. The PPQ will be provided as an attachment to this RFI document and contractors should populate sections 1-4 as appropriate for each project.

Section 5.3 References for ESCO Past Performance: Is there a page limit for this section?

Section 5.3 is requesting contact information for up to five previous customers who can provide information related to projects described under 5.1 ESCO Experience. See response to RFI No. 10.

There is a lot of information that is requested to be addressed in section 5.2 "ESCO Management Approach" with only 5 pages. Is the government willing to grant an additional 3 pages to this section to address all requested information? See responses to RFI No. 1 and 4.

AOC makes note in section 3.1 that the design of the AHU replacement will be made available to the selected ESCO. At this stage, can you clarify the intentions of including the AHU scope of work currently being designed by the AOC? Is the expectation that the construction and implementation of the AHU scope will be funded from the ESPC? Intent is to include in the ESPC project scope.

5.3 References for ESCO Past Performance

Please confirm that this section is outside any stated page limitations See response to RFI No. 10 and 11.

Section 5.1 and 5.2 Background: Recent NOOs with similar requirements have allowed for 10-point font in tables, graphics, and header/footer content.

Question: Will the Government allow for 10-point font in tables, graphics, and header/footer content?

10-point font is acceptable for tables, graphics, and header/footer content;

however, 12-point font size is the minimum for all other content. Please also see response for RFI No. 1 and 4.

Section 5.2 Background: The Government is requesting a significant amount of information to be covered in 5 pages. Recent NOOs with similar requirements have increased this page allocation to 8 pages.

Question: Will the Government allow 8 pages to complete Section 5.2 ESCO Management Approach? See responses to RFI No. 1 and 4.

Will the Government allow for a Cover/Title Page, Table of Contents, and Glossary to be provided outside of the stated page limitations? Yes

2.2 Facility Descriptions – Overview of Utilities

Under electricity, the first sentence states there are four electric feeds from PEPCO and the second sentence references three feeds. Please clarify.

Clarification for the information contained in 2.2 Facility Description under Overview of Utilities, first bullet point, Electricity:

"Primary electrical service is supplied by Potomac Electric and Power Company (PEPCO) from three (3) 13.2kV medium voltage (MV) feeders. Each MV feeder serves a single 1500kVA, 13.2kV-480/277VAC, delta-wye transformer. The PEPCO transformers are located in one underground vault on the east side of the building. The low voltage (LV) secondary of each 1500kVA transformers is connected to a LV power circuit breaker (PCB) configured with a spot network protector."

2.3 Summary Information on Facility Energy and Water Usage

Please provide any available data on water and sewer consumption. See response to RFI No. 2.

At what approximate completion stage will the AHU/VAV design package be released to the selected ESCO? At substantial completion, or will the selected ESCO be able to assist with final design development during the IGA?

During the IGA.

Design Documents are 100% and currently completing GAO Risk Assessment.
