1.0 INTRODUCTION

Tennessee National Wildlife Refuge (TNWR) proposes to perform roadway and culvert improvement along portions of Big Sandy Road within the boundaries of the Big Sandy Unit Wildlife Refuge. This portion of Big Sandy Road is 6.87 miles long and is gravel (Figure 1). The Project workspace will remain along Big Sandy Road for road repair and ditch reconditioning. Portions of the road that require ditch reconditioning total approximately 3.62 miles, which includes 22 culverts, 17 streams, and 9 wetlands (Figure 5). No streams within the Project Study Area are on the 303(d) list of impaired streams.

Bennett’s Creek, Farmer Pond, Robbins Creek, Roberson Lake, Ross Branch, and Big Sandy River are listed as an Exceptional Tennessee Water (ETW) because of their location on the TNWR. Out of those listed as ETW, only Farmer Pond and Roberson Lake will be affected by the road repair and ditch reconditioning.

On behalf of Tennessee National Wildlife Refuge, AECOM conducted a wetland and other “waters of the United States” (WOTUS) delineation within the Project’s Study Area as described in Section 1.1.

The delineation involved a desktop review of existing information and a field delineation of wetlands and watercourses. Information collected during the desktop review was used in conjunction with the field delineation to identify regulated areas pursuant to the United States Environmental Protection Agency (USEPA) Clean Water Act (Section 404) regulations, as administered by the United States Army Corps of Engineers (USACE). This report will be used to assist TNWR’s efforts to identify potential WOTUS present within the Project Study Area and determine permitting requirements for development of the Project.

Field surveys were conducted on April 14 and 15, 2021 by two AECOM biologists in accordance with applicable federal, state, and local regulations. Weather conditions for the delineation were cloudy, with temperatures between 50 and 70 degrees Fahrenheit.

2.0 METHODS

This section describes the sources used in the desktop data review and the methods used during the field delineation process.

2.1 DESKTOP DATA REVIEW

A desktop data review of existing information was conducted to assess the potential presence of watercourses, wetlands, and/or wetland indicators within the Study Area prior to conducting the field delineation. Information reviewed included:

U.S. Fish and Wildlife Service (USFWS) National Wetland Inventory (NWI) data (USFWS, 2021), U.S. Department of Agriculture (USDA) Natural Resources Conservation Service (NRCS) Soil Survey for Henry County, Tennessee (USDA, 2020), U.S. Geological Survey (USGS) 7.5-minute topographic quadrangle for Paris Landing and Poplar

Creek, TN (USGS 2019 and 2016) Federal Emergency Management Agency (FEMA) floodplain mapping (FEMA, 2007), and USGS National Hydrography Dataset (USGS, 2019).

2.2 FIELD DELINEATION METHODS

On April 14 and 15, 2021, AECOM biologists conducted a delineation of the Study Area for jurisdictional WOTUS, including wetlands. AECOM identified habitat types, wetlands, waterbodies, and other regulated special aquatic sites encountered.

2.2.1 Wetlands

The Project Study Area was evaluated for wetlands using the routine method defined by the USACE Wetlands Delineation Manual (Environmental Laboratory, 1987) and the Regional Supplement to the Corps of Engineers Wetland Delineation Manual: Eastern Mountains and Piedmont Region, Version 2.0

(USACE, 2012).

Vegetation Vegetation evaluation included identification of trees, saplings and shrubs, herbaceous plants, and woody vine species. As per the USACE guidance, trees and woody vines were evaluated in an approximate 30-foot radius plot; saplings and shrubs were evaluated in a 15-foot radius plot; and herbs were evaluated in a 5-foot radius plot. For each stratum, plants were identified to the lowest taxon possible, and the dominant species were determined based on the absolute percent cover of each species. The wetland indicator status of each species was determined using the National Wetland Plant List (USACE, 2018).

Soils Soils were classified using Munsell Soil Color Charts to identify any hydric soil indicators. Samples taken had depths to 12 inches or refusal due to bedrock.

Hydrology Hydrology was evaluated by observing surface water or saturated soils and looking for evidence of recent inundation, evidence of current or recent soil saturation, and evidence from other site conditions.

2.2.2 Watercourses

Watercourses were identified by a defined streambed; hydrologically sorted substrate material;

observable dimension, pattern, and profile; and the presence of an ordinary high-water mark (OHWM;

USACE, 2005). Watercourse limits were delineated based on the OHWM or the top of bank (TOB), which was determined by the first substantial break in slope between the edge of the stream bed and the surrounding terrain. Streams were classified based on the USACE definition of flow regime as ephemeral, intermittent, or perennial, and AECOM’s professional judgment. Each identified stream was assessed using Tennessee Department of Environment and Conservation’s Hydrological Determination Field Data Sheet (Version 1.5), as prepared by a Qualified Hydrologic Professional – Mr.

Jim Orr, 1018-TN11. Additionally, AECOM collected specific information about width, depth, and bank characteristics for all identified stream features. Streams were photographed showing upstream, downstream, and substrate images (Appendix A).

2.2.3 Mapping

AECOM mapped the boundary location of each field-delineated resource using Global Positioning System (GPS) EOS Arrow units with sub-meter accuracy in conjunction with the ESRI ArcCollector application on iPad tablets. The GPS data was imported into ESRI ArcMap Geographic Information System (GIS) software, where the data was reviewed, edited for quality and accuracy, and compiled in a format suitable for transfer and use. These points were then projected onto georeferenced aerial images to create maps used to illustrate the location and size of the delineated wetlands and watercourses for incorporation into the delineation report and future use in agency consultations, permit applications, and plans.

3.0 RESULTS AND DISCUSSIONS

The following is a summary of findings from the desktop data review and the results of the field delineation efforts.

3.1 DESKTOP DATA

The following provides the results of the desktop data review conducted for the soils, watercourses, and NWI wetlands within the Study Area.

3.1.1 Study Area Setting

The Study Area is geographically situated within the Western Highland Rim of the Interior Plateau ecoregion of Tennessee. The Study Area is located on both the Paris Landing and Poplar Creek, TN USGS quadrangle maps. Mostly deciduous forests, cropland, and palustrine forested wetlands are the dominant land covers in the area. Streams are low to moderate gradient, with productive, nutrient-rich waters, resulting in algae, rooted vegetation, and occasionally amphibians and fish.

3.1.2 USDA Soils

Soils mapped within the Study Area were identified from the USDA-NRCS soils database (USDA-NRCS, 2021). The review indicated that 16 soil mapping units are present in the Project Study Area (Figure 3).

There are 14 soil mapping units listed as not having hydric soil inclusions when located in floodplains.

One soil mapping unit is listed as having hydric soil, CVA. One soil mapping unit has minor components that could have hydric soil when located in a floodplain, Lo (7%). The soils mapped in the Study Area are listed in Table 2.

3.1.3 NWI Wetlands

USFWS NWI mapping illustrates wetland habitats and vegetation communities using interpretation of aerial photography. The data provide general boundaries of potential wetlands and require ground surveys to accurately define the boundaries of wetlands present, if any, and determine their proper classification. The habitats and communities identified are classified according to the scheme provided in Classification of Wetlands and Deepwater Habitats of the United States (Cowardin et al., 1979).

A review of the USFWS NWI Wetlands Mapper website identified five NWI features within the Project Study Area (Figure 2). There are three unnamed stream features within the Study Area, one R4BC and two R5UBHs. The R4SBC is at Culvert #16 (S-014-C-016-BS-041521 and W-008-C-016-BS-041521).

One R5UBH is located at Culvert #1 (S-002-C-001-BS-041421). The other R5UBH is located at Culvert

#19 and #20 (S-017-C-019&20). There are two ponds within the Study Area, Robertson Lake and Farmer Pond, both listed as PUBHh.

3.1.4 Water Resources

The National Hydrology Dataset (NHD) represents the water drainage network of the United States, as maintained by USGS via topographic maps, as well as data provided by stewardship partnerships with states and other participating collaborative bodies. The NHD was reviewed to identify two 12-digit Hydrologic Unit Code (HUC12) watersheds, and mapped NHD streams in the Study Area vicinity as shown on Figure 4. The Project Study Area is located within both the Kentucky Lake Subwatershed (HUC12: 060400050905) and the Outlet Big Sandy River Subwatershed (HUC12: 060400050704).

The two NHD-mapped water features are located within the Study Area, Robertson Lake and Farmer Pond. S-007-C-007&008-BS-041421 flows into Robertson Lake. S-008-C-010-BS-041421 flows out of Farmer Pond.

3.1.5 FEMA National Flood Hazard Layer Review

The National Flood Hazard Layer (NFHL) is a geospatial database that contains effective flood hazard data, as maintained by FEMA. The NFHL can be referenced with associated NHD, NWI, and NRCS hydric soils data to determine potential wetlands of an area. The NFHL for Henry County (FEMA, 2007) was reviewed to identify 100-year floodplains present within the Study Area and vicinity (Figure 4).

The NFHL indicates that some of the Study Area is located within a mapped 100-year floodplain (Flood Zone AE). Streams at Culverts #10, 12, 13, 14, 16, 17, 18, 19, and 20 are within the 100-year floodplain, along with wetlands at Culverts #12 and 16.

3.2 FIELD DELINEATION

The field delineation on April 14 and 15th, 2021, identified 26 water features within the Study Area, which included 17 streams and 9 wetlands. The location of the delineated water features and sample points are illustrated on Figure 5. A photographic log of identified land cover types and delineated resources is provided in Appendix A.

3.2.1 Site Description

The Project Study Area includes three land cover classifications – Cropland, Palustrine Forested Wetland, and Mixed Deciduous Forest (Table 3). Future land use is anticipated to remain the same. A brief description of these land cover types is provided below.

Table 3. Land Cover Classifications and Description in and adjacent to the Study Area Land Cover Description Cropland The cropland vegetation community consisted primarily of fields typically planted with soybeans and corn.

Palustrine Forested Wetland (PFO)

The PFO communities primarily consisted of American Elm (Ulmus americana), Red Maple (Acer rubrum), Pignut Hickory (Carya glabra), Sweet-Gum (Liquidambar styraciflua), Annual Fimbry (Fimbristylis annua), Lamp Rush (Juncus effusus), Round leaf Greenbrier (Smilax rotundifolia), and Japanese Honeysuckle (Lonicera japonica).

Mixed Deciduous Forest

Mixed deciduous forest community consisted primary of Northern White Oak (Quercus alba), Sweet-Gum (Liquidambar styraciflua), Winged-Elm (Ulmus alata), White Ash (Fraxinus americana), Round leaf Greenbrier (Smilax rotundifolia), Virginia Creeper (Parthenocissus quinquefolia), and Japanese Honeysuckle (Lonicera japonica).

3.2.2 Wetlands

Nine wetlands were identified within the Study Area. All wetlands were Palustrine Forested Wetlands.

Field data forms are provided in Appendix B. Photographs of the watercourses are provided in Appendix A. Wetlands are described in Table 4.

3.2.3 Watercourses

Seventeen streams were identified within the Study Area and consisted of upland wet weather conveyances (WWC), ephemeral WWCs, intermittent, and perennial streams. Field data forms are provided in Appendix B. Photographs of the watercourse are provided in Appendix A. A description of each watercourse is provided below, and details are provided in Table 4.

4.0 SUMMARY AND CONCLUSIONS

A field delineation of the Study Area was conducted on April 14 and 15, 2021. Within the Study Area, 17 streams and 9 wetlands were identified and delineated.

Impacts to WOTUS which cannot be avoided may require permitting from both the USACE under the USEPA’s Section 404 of the Clean Water Act and Tennessee Department of Environment and Conservation (TDEC) under Section 401 of the Clean Water Act. The USACE permits minor impacts to water features with Nationwide Permit 14 – Linear Transportation Projects. For linear transportation projects, the impact cannot cause the loss of greater than ½ acre of waters of the United States without an individual 404 permit. Pre-construction notification is required if the loss of waters is greater than 1/10 of an acre for each stream and no notification is required if the impact is less than 1/10 acre per stream. Tennessee approves minor road repairs under General Aquatic Resource Alteration Permit (ARAP) for Construction or Removal of Minor Road Crossings. Impacts to any individual stream greater than 200 feet, or wetland of greater than 1/10 acre, would require an individual permit. USFWS, Tennessee Wildlife Resources Agency (TWRA), and the State Historic Preservation Office (SHPO) coordination will be required for compliance with the Clean Water Act and the TDEC 401 Certification.

The General ARAP would be required for any impacts to streams or wetlands resulting from minor road impacts. Application of a General ARAP for the proposed project is required for each water body impacted. Negotiations with TDEC may allow for all impacts to be lumped under one General or Individual Permit Application. Confirmation of HD determinations and wetland delineations is required prior to permit approval.

The reported results of the ecological survey conducted by AECOM on this Project are limited to the areas within the Study Area provided in Figure 5. Areas that fall outside of the Study Area were not evaluated in the field and are not included in the reporting of this survey.

The field delineation results presented herein apply to the existing and reasonably foreseeable site conditions at the time of AECOM’s assessment. They cannot apply to site changes of which AECOM is unaware and has not had the opportunity to review. Changes in the condition of a property may occur with time due to natural processes or human impacts at the project site or on adjacent properties. Changes in applicable standards may also occur as a result of legislation or the expansion of knowledge over time. Accordingly, the findings of this report may be invalidated, wholly or in part, by changes beyond the control of AECOM. Final jurisdictional determination of WOTUS can only be made by the USACE. As such, the findings reflect the professional opinion of AECOM.
