About this file
This is a Transaction Confirmation for natural gas supply services between Constellation NewEnergy-Gas Division, LLC (seller) and the Wisconsin Department of Administration (buyer). The transaction is governed by an existing Gas Supply Agreement effective June 8, 2016, and specifically covers gas delivery to the State of Wisconsin Correctional Institution in Stanley, Wisconsin. The document is executed under Deal No. 1432733 and Contract No. CNEG19718, with signatures from Nancy H. Fischer (Vice President-Retail Ops for Constellation) and Dave Bender (Enterprise Contract Officer for Wisconsin DOA).
The contract covers natural gas supply for the 2022 calendar year (January 1 - December 31, 2022) with monthly fixed quantities ranging from 2,058.0 MMBtu in August to 7,274.0 MMBtu in January, totaling 52,608 MMBtu annually. The pricing is set at a fixed rate of $0.00460 per MMBtu for all months, representing basis pricing only and excluding commodity costs, which will be determined by NYMEX last day settle prices. Gas will be delivered via the VIKING pipeline to the CADOTT delivery point, with Wisconsin Gas (WG) serving as the local distribution company. The service level is classified as "Secondary Firm," allowing for interruptions under specific circumstances including force majeure, utility curtailments, and transportation capacity constraints. Billing will be based on actual consumption, and the agreement includes provisions for incremental pricing, balancing services, and automatic month-to-month extensions beyond the contract term if neither party terminates with 30 days' notice.
