About this file

This document is a Non-Tax Program Quick FactSheet detailing debt collection procedures for multiple New Jersey state agencies, including the Department of Agriculture, Department of Banking and Insurance, and Department of Revenue. The factsheet outlines specific protocols for collecting various types of non-tax debts, including nursery and plant dealer invoices, banking and insurance fines, enforcement penalties, and human resources-related overpayments. The document provides comprehensive guidelines for debt submission, transmission schedules, dispute handling, payment arrangements, settlements, and special circumstances like bankruptcy and death.

The factsheet emphasizes that under P.L. 2008, c. 24, all Executive Branch State agencies must submit delinquent debt to the Department of Revenue when it becomes 91 days old or more. There is no statute of limitations on collecting state debt, though there is a 10-year limit on taking legal collection actions. Payment arrangements typically allow monthly payments with no more than 36 months for resolution, and the collection agency is instructed to attempt full debt collection before considering settlement options. The document also details specific procedures for different types of debts, including banking fines, enforcement penalties, and human resources overpayments, with each category having unique handling requirements and contact information.

Description of Debt:The Bureau of Plant, Pest and Disease regulates all Nurseries and Plant Dealers in the State of NJ. All inspections are done on an annual basis and when the client's invoice is paid, they receive either a Nursery Certificate or a Nursery Stock Dealers Certificate. Clients who have not paid their bill within 30 days are sent a second bill with a $5.00 late fee attached to it. If that is not paid within 30 days, they are sent a third notice letter and given two weeks to satisfy their debt. If we receive no response from the letter, we then forward the client to DORES for collection.DOBI investigates a person or business entity who is suspected of violating banking, insurance, and real estate department regulations, codes and/or State statutes. Upon investigation, fines, costs, and /or restitution may be assessed by the department. Such receivables include: Type 1--Banking Fines, Type 2--Enforcement Fines, Type 3--Real Estate Fines, and Type 4--Guaranty Fund assessments. The age of the Banking debt may date back to the early 1990's; Real Estate and Enforcement debt may date back to the late 1990's. Type 6--Special Assessment - DOBI collects special assessment on an annual basis for expenses incurred by the Division of Insurance; the apportionment for each carrier is based on the companies net written premiums for the preceeding calendar year. Type 7-- Fraud Assessment - DOBI collects a Fraud assessment on an annual basis for expenses incurred by the Division of Criminal Justice and the Insurance Fraud Prevention Unit; the apportionment for each carrier is based on the companies net written premiums for the preceeding calendar year.Human Resources is responsible for recouping the overpayment of money from State employees who have left employment of any division/unit under the Department of Agriculture. Such receivables include 1) salary overpayment (overdrawn benefit time - sick, vacation, and/or administrative leave; 2) tuition reimbursement; and 3) other (e.g., discipline, dishonored check for COBRA payments, etc.). The AEC code indicates the State Agency where the employee worked (see AEC Codes listed above). Employees are given their yearly benefit time at the start of each year; if they leave State employment before the end of the year, they have not earned the full year's worth of time and must pay back that portion that was not earned. Most cases are for salary overpayments; the record layout will include the number of hours that have been overdrawn and the comment section will provide additional details.Human Resources is responsible for recouping the overpayment of money from State employees who have left employment of any division/unit under the Department of Banking and Insurance. A2ENFORCEMENT - AIR POLLUTIONThis program performs the following activities to ensure compliance with the Air Pollution Control Act and compliance with issued permits: investigate complaints, conduct inspections, issues enforcement documents, both formal and informal which may include assessed penalties, negotiate compliance schedule and penalty settlements.
A3ENFORCEMENT - RIGHT TO KNOWThe Community Right to Know (CRTK) program collects, processes, and disseminates the chemical inventory, environmental release and materials accounting data required to be reported under the New Jersey Worker and Community Right to Know Act, N.J.S.A.34:5A (New Jersey Legislature Home Page) and the federal Emergency Planning and Community Right to Know Act of 1986 (EPCRA). This information is used by the public, emergency planners, and first responders to determine the chemical hazards in the community. Enforcement conducts site visits to verify the accuracy of the CRTK surveys. Enforcement documents are issued for failing to submit the surveys.
A4ENFORCEMENT - TCPAThe TCPA program provides assistance to covered facilities, and verifies compliance with N.J.A.C. 7:31. The Program reviews and approves risk management plans (RMPs) developed under the regulation as part of compliance with State and Federal accidental release prevention (ARP) requirements.
A5ENFORCEMENT - RADIATIONThe Radiation Protection Program and Release Prevention mission is to protect the citizens of New Jersey from unnecessary exposure to radiation. The program conducts inspections and issues enforcement documents at sites ranging from X-ray facilities, nuclear powerplant sources, radon gas exposure in homes and other buildings, facilites that use certain radioactive materials in medicine, industry and research.
A6ENFORCEMENT - LAB CERTIFICATION FINESThe Office of Quality Assurance (OQA) offers certification for environmental testing laboratories to ensure that regulatory decisions made by federal, state, and municipal government agencies are based upon accurate and dependable analytical data. Enforcement will audit and inspect certified labs and issue enforcement documents, if needed.
A7ENFORCEMENT - NOISEDEP Compliance & Enforcement does not have an active noise program. All noise complaints are referred to the counties.
A8ENFORCEMENT - PESTICIDESThe Pesticide Control Program (PCP) is primarily responsible for ensuring compliance with federal and state laws and regulations regarding the use, sale, transport, disposal, manufacture, and storage of pesticides in the state of New Jersey. It also promotes pollution prevention and pesticide use reduction through training and outreach activities involving Integrated Pest Management (IPM).
C0ENFORCEMENT - COASTAL MONITORING
C1ENFORCEMENT - STREAM ENCROACHMENTThe state regulates work in flood hazard areas and riparian zones to protect the loss of life and property during flood events, preserve riverine habitat, and to insure the quality and integrity of the State's surface waters. The program also minimizes flood damage by ensuring that buildings are placed in safe areas, and are constructed to withstand high water.
C2ENFORCEMENT - WATERFRONT DEVELOPMENTThe Waterfront Development Law is a very old law, passed in 1914, that seeks to limit problems that new development could cause for existing navigation channels, marinas, moorings, other existing uses, and the environment.
C3ENFORCEMENT - CAFRACAFRA applies to projects near coastal waters in the southern part of the State. The CAFRA area begins where the Cheesequake Creek enters Raritan Bay in Old Bridge, Middlesex County. It extends south along the coast around Cape May, and then north along the Delaware Bay ending at the Kilcohook National Wildlife Refuge in Salem County. The inland limit of the CAFRA area follows an irregular line drawn along public roads, railroad tracks, and other features.
C4ENFORCEMENT - FRESHWATER LANDSNew Jersey protects wetlands under the New Jersey Freshwater Wetlands Protection Act, N.J.S.A. 13:9B. This law also protects transition areas or "buffers" around freshwater wetlands. Wetlands are commonly referred to as swamps, marshes, or bogs. However, many wetlands in New Jersey are forested and do not fit the classic picture of a swamp or marsh. Previously misunderstood as wastelands, wetlands are now being recognized for their vital ecological and socioeconomic contributions.
C5ENFORCEMENT - DAM SAFETYNew Jersey's Dam Safety program is administered by DEP's Division of Engineering & Construction, Dam Safety Section, under the rules and regulations promulgated in May 1985 known as the Dam Safety Standards.
