Bid Amendment #3 Summary

This is Bid Amendment #3 issued by the State of New Jersey Department of the Treasury, Division of Purchase and Property, for Bid Solicitation #26DPP01215 (T1841) – Geographic Information Systems Services. The amendment extends the quote submission deadline from February 4, 2026, to February 19, 2026, at 2:00 PM Eastern Time and provides responses to bidder questions submitted during the Electronic Question and Answer period. The solicitation seeks Geographic Information Systems services in two categories: Spatial Data Development and GIS Application Development and Implementation Services. The state intends to award contracts to a maximum of 20 bidders across both categories. Bidders must demonstrate a minimum of five years of experience in GIS services and provide at least three references for completed state government projects in each category for which they are bidding. An optional pre-quote conference was held on December 4, 2025, and the attendee list is included in the amendment. The base contract term is three years with potential extensions up to two additional years through mutual written consent.

Bidders must submit all-inclusive blended hourly rates for both contract years and three years of pricing on the state-supplied price sheet. The state will evaluate quotes using a weighted consumption/market basket model. Upon award, contractors will receive all work through a mini-bid process where individual project requests are distributed to all approved contractors in the relevant GIS service category. Professional liability insurance of at least $1,000,000 per occurrence is required, and contractors must comply with extensive data security requirements, including submission of a security plan within 30 days of award. The amendment clarifies numerous submission requirements, including that business registration documentation and New Jersey Certificate of Employee Information Report are not required at quote submission but will be required prior to contract award. Current awardees are not automatically included in future awards, and bidders awarded contracts may add subcontractors after initial award in compliance with Section 3.13.8 requirements.

1
Quote Submission
Q: Please confirm a Bidder may deliver a hardcopy quote instead of submitting a response electronically.

A: Please be advised that all Quotes shall be submitted electronically through NJSTART.

2
Quote Submission
Q: Should I check that I have properly completed and attached all of the required documents with my submitted Quote?

A: Yes. Prior to the Quote Opening Deadline, a Bidder should review the documents comprising the submitted Quote to ensure that all of the required documents have been completed and attached. Oftentimes a Quote is deemed non-responsive because a Bidder fails to attach a required form or attaches a blank form. To review a submitted Quote, a Bidder should log into NJSTART and review each document attached to the Quote submission. Instructions on how to review a submitted Quote can be found in the Quick Reference Guide entitled How to Review a Submitted Quote, which is available on the NJSTART Vendor Support Page under Vendor Reference Guides.

Bidders should include the level of detail it determines necessary to assist the Evaluation Committee in its review of the Bidder’s Quote.

18
Section 3.15 – Bidder Quote Overview Form
Q: The Bidder Quote Overview Form appears to request the same information as Section 3.16 Management Overview and Section 3.17 Contract Management. Should the content in the Bidder Quote Overview Form be a summary of those sections, or should it replicate the full content of Sections 3.16 and 3.17?

A: The Bidder Quote Overview Form should not replicate the full content of Sections 3.16 Management Overview and 3.17 Contract Management. Instead, it should provide a concise summary of the key points from those sections. The form should highlight the bidder's capability to fulfill the Scope of Work by summarizing the technical approach, understanding of the contract's objectives, and management strategy, including communication plans. While Sections 3.16 and 3.17 offer detailed narratives and comprehensive plans, the Overview Form should distill this information into an accessible format that clearly demonstrates the bidder's preparedness and alignment with the solicitation's requirements.

19

Q: Reference Contact Information Requirements

A: This is not a question and cannot be answered as posed.

24
Section 3.22 – Experience with Contracts of Similar Size and Scope
Q: 1. In section 3.22 of the bid solicitation, bidders are instructed to provide two names and telephone numbers of individuals from the contracting party for each contract listed. The solicitation goes on to say that the bidder shall provide a minimum of three references for completed state government projects in each category in which we are bidding. If we only have one contact name/number for some projects, is that acceptable?

A: As provided in Bid Solicitation Section 9.2, Definitions, the term “should” denotes that which is permissible or recommended, not mandatory. Paragraph 1 of Bid Solicitation Section 3.22 states that for each such contract listed, the Bidder should provide two (2) names and telephone numbers of individuals for contracting party. If a Bidder only has one (1) contact name/number for some projects, that is acceptable. However, Bidders should be aware that Quotes will be evaluated based on the content provided therein, and failure to provide all recommended information may result in a lower evaluation score.

Further, Bid Solicitation Section 3.22 states in paragraph 2 that the Bidder shall also provide a minimum of three (3) references for completed state government projects in each category in which they are bidding. As provided in Bid Solicitation Section 9.2, Definitions, the term “shall” denotes that which is a mandatory requirement. Therefore, a minimum of three (3) references for completed state government projects in each category is required.

25

If we only have one reference for some projects, is that acceptable?

A: Please see response to Question #24.

A: Bidders will be awarded based on capacities for either Bid Solicitation Section 4.1 Spatial Data Development or Bid Solicitation Section 4.2 Application Development and Implementation Services.

36
Section 4.3 – Contractor Mini-Bid Requirements Post Award
Q: Will all work contracted through this contract come only through the award of Mini-bids?

A: Yes, Bidders awarded a Contract for Bid Solicitation Section 4.1 Spatial Data Development and/or Bid Solicitation Section 4.2 Application Development and Implementation Services will receive all work via the Mini-Bid process.

A: Varies by both Using Agency and project as specified in each Mini-Bid Request for Quotations (RFQ).

38
Section 4.3 – Contractor Mini-Bid Requirements Post Award
Q: Does the State anticipate a higher volume of mini-bids in spatial data development or application development and implementation services over the base contract term?

A: Historically, there have been many more awarded Mini-Bids for Spatial Data Development than Application Development and Implementation Services. Though the size and scope and value vary widely.

39
Section 4.3 – Contractor Mini-Bid Requirements Post Award
Q: Can the State provide any historical insight into how many awarded vendors typically receive mini-bid opportunities versus those that are rarely engaged?

A: The State cannot answer this question, as it does not track or maintain a database of this information.

40
Section 4.3 – Contractor Mini-Bid Requirements Post Award
Q: Are awarded contractors permitted to propose fixed-price mini-bids that effectively blend labor categories, provided the total price aligns with the awarded hourly rate ceilings?

A: Yes, that is the requirement.

41
Section 4.3 – Contractor Mini-Bid Requirements Post Award
Q: Are mini-bid requests automatically distributed to all approved contractors within the relevant GIS service category?

A: Yes, the Mini-Bid Firm Fixed Price should be based on the all-inclusive hourly rates provided by the Contractor’s original Quote.

43
Section 4.3 – Contractor Mini-Bid Requirements Post Award

A: The State is unable to provide this information to Bidders at this time.

44
Section 5.4 – Ownership of Material
Q: H. The State agrees that any reuse of the Contractor’s work product not related to the original project shall be at the State’s own risk. Justification: We respectfully request that its liability be expressly limited in the event that the work product is used in a manner not specifically contemplated under this Contract. When work product is transferred, we are unable to control its use and application. If a party elects to use the work product outside of the specific scope for which it was created, equity dictates that we are not liable.

A: The State does not accept the proposed modification. The State declines to waive any potential legal rights or to limit its potential risks beyond those outlined in the Bid Solicitation.

45
Section 5.4 – Ownership of Material
Q: I. Notwithstanding the foregoing, the Contractor shall retain all common law, statutory and other reserved rights including copyright in its pre-existing intellectual property, standard design elements, architectural/engineering details that are neither unique to the State nor related to the business of the State and the State shall be granted a non-exclusive license to reproduce such design elements and details in conjunction with its use on the projects. Justification: We request preserving certain GFT original content and pre-existing/background intellectual property.

A: This is not a question and cannot be answered as posed. However, the State does not accept any proposed modification to the identified section.

46
Section 7.1 – Insurance
Q: We will accept the contract “as-is” if awarded, but we assume it is in the best interest of all parties to have a fully insurable contract, and are hopeful that you will consider making minor edits. We note that the following section (4.1 Indemnification) presents insurability issues. Our insurance does not allow us to “defend” professional liability claims, but it can defend general liability claims. Additionally, the indemnification also creates insurability issues because it requires us to indemnify regardless of negligence or fault. As a professional services firm, the indemnity should be modified to provide a negligence-based indemnity for claims arising out of professional services. [Bidder] could agree to a non-negligence based indemnity for claims arising under general or automotive liability. Item 4.1.A.1. Delete the word “defend”. Item 4.1.A.1.a. Delete the phrase “which shall arise from or result directly or indirectly from the work and/or products supplied” and insert “to the extent caused by the negligent acts, errors or omissions in the performance of services “ under this Contract or the order; and…”

A: The State does not accept the proposed modification. Terms and conditions on publicly bid procurements must be consistent for all potential Bidders, and cannot be based on a single vendor’s terms.

47
Section 8.9.2 – Price Evaluation
Q: Could you provide clarification on the statement in 8.9.2 Price Evaluation?

A: The question does not specifically identify what statement needs to be clarified. Therefore, this question cannot be answered.

48
Attachment 1 – Combined State of New Jersey Standard Terms and Conditions
Q: Do we need to sign the State Standard Terms And Conditions document and return with our submission?

A: No, Bidders are not required to sign and return the State Standard Terms and Conditions document (Attachment 1) with their Quote submission.

49
Attachment 2 – Standard Forms Packet
Q: Can the State please confirm if the State of New Jersey Security Due Diligence Third-Party Information Security Questionnaire is required with this solicitation?

A: The State of New Jersey Security Due Diligence Third-Party Security Questionnaire is not required to be submitted with a Bidder’s Quote.

50
Attachment 2 – Standard Forms Packet
Q: Can the State please confirm if the Public Work Registration Certificate is required with this solicitation?

A: A Public Work Registration is not required to be submitted with a Bidder’s Quote.

51
Attachment 2 – Standard Forms Packet
Q: Can the State please confirm if the Affidavit of Apparel Form is required with this solicitation?

A: The Affidavit of Apparel Form is not required to be submitted with a Bidder’s Quote.

52
Attachment 2 – Standard Forms Packet
Q: Please confirm that the Business Registration documentation and New Jersey Certificate of Employee Information Report are not required to be submitted with our proposal but will be required after award notification.

A: Bidders are not required to submit their Business Registration Documentation and/or New Jersey Certificate of Employee Information Report with their Quote, but these items will be required prior to the award of a Contract.

53
Attachment 3 – State-Supplied Price Sheet
Q: Can you clarify what you are looking for in the price sheet? Do we enter just be one blended rate for each category?

A: Bidders may bid on one or both GIS categories. Bidders shall enter their All-Inclusive Hourly Rate for the category they intend to bid on in the corresponding Price Line on the State-Supplied Price Sheet. Bidders must include pricing for all three (3) years. The All-Inclusive Hourly Rate is intended to be a blended rate, as All-Inclusive Hourly Rate is defined in Section 9.2 to include all direct and indirect costs.

54
Attachment 3 – State-Supplied Price Sheet
Q: Do all expenses that may be incurred in performing the work specified in an awarded Mini-bid (e.g. travel) need to be accounted for in the hourly rates provided?

A: The Hourly Rate for Price Line 1 shall include all yearly costs associated with achieving the requirements of Bid Solicitation Section 4.1, Spatial Data Development. The Hourly Rate for Price Line 2 should include all yearly costs associated with achieving the requirements of Bid Solicitation Section 4.2, Application Development and Implementation Services.

Once a Mini-Bid RFQ is released, each awarded Contractor will have the opportunity to submit a final Quote based on the scope of work for the RFQ. This Mini-Bid Quote should then include all expenses associated with the RFQ scope of work.

55
Attachment 3 – State-Supplied Price Sheet
Q: Section 4.3 indicates that firm fixed prices must be included in mini-bid RFQ responses. Could you clarify how these prices relate to the STATE-SUPPLIED PRICE SHEET rates submitted in the original RFP response? Specifically, are we permitted to propose different rates, include additional expenses, and/or travel costs as necessary, or are we required to calculate prices by multiplying the originally submitted rates by estimated hours?

A: Rates provided on the State-Supplied Price Sheet shall be construed as the maximum or ceiling hourly price awarded Contractors are allowed to Quote Using Agencies. However, Contractors are encouraged to offer discounts or lowered pricing during the Mini-Bid Process. Additionally, the Mini-Bid Quotes shall be calculated by taking the original All-Inclusive hourly price listed on the Contractor’s State-Supplied Price Sheet and multiplying it by the estimated number of hours for the particular project.

56
General
Q: Could you please clarify why this solicitation is being issued outside of the state’s MSA contract vehicle? We want to ensure we understand the procurement pathway and any implications for eligibility.

A: The State does not recognize the “MSA contract vehicle” reference and therefore cannot answer this question.
