2
Forms
Q: EEO 271 Certification is not marked on the Checklist but is stated in RFP. Is this mandatory? Same for the NJ Security Due Diligence Form?
A: On August 15, 2022, Governor Murphy signed Executive Order 302 to lift the routine COVID-19 testing requirements for School Districts, Child Care Settings, and State Contractors.
https://nj.gov/infobank/eo/056murphy/pdf/EO-302.pdf

Forms
Q: Is the Vendor able to alter the Bidder Data Form in order to provide more information?
A: The Bidder Data Sheet is provided for the Bidder’s convenience to provide the State information for contracts of similar size and scope. As long as the Bidder provides the requested information, the form can be altered and/or additional sheets can be attached to provide more information.
4
Forms
Q: With the exception of the price sheet can the Vendor post other forms? Will the forms posted be kept confidential?
A: Bidders may submit the documents necessary to support its Quote. However, as noted in Bid Solicitation Section 3.11 bidders should not submit anything that would conflict with the Bid Solicitation terms, conditions, or Scope of Work.
As noted in Section 3.13.7 – Contents of Bid Proposal of the Bid Solicitation, Quotes are public documents subject to release to the public pursuant to N.J.A.C. 17:12-1.2(b) and (c), or under the New Jersey Open Public Records Act (OPRA), N.J.S.A. 47:1A-1 et seq., or the common law right to know. The State reserves the right to make the final determination on what is subject to disclosure and will advise the bidder accordingly.
5
General Question
Q: We understand that the State wants to make an award as quickly as possible. NJ Start shows a contract begin date of 12/17/2022. Please provide an estimated award date that bidders should use as a start date in their transition plans, understanding that the date(s) will likely change upon contract award.
A: The State seeks to make the award as soon as reasonably possible following the evaluation process outlined in Bid Solicitation Section 8.9, Evaluation Criteria. Once the evaluation of the submitted Quotes is complete, the Procurement Bureau will recommend to the Director for award, the responsible Bidder(s) whose Quote, conforming to this Bid Solicitation, is most advantageous to the State, price and other factors considered. The Director may accept, reject or modify the recommendation of the Procurement Bureau. If accepted, an award letter will be issued to the parties.
Bidders may assume the date of award is “Day 1”, and established time frame references after contract award for required plans will be acceptable (example only: 1st phase complete ten days after award; 2nd phase complete four weeks after contract award, etc.).

A: NJSTART does not have a file size restriction.

10

A: No, a physical facility is not required in the State of New Jersey.

However, the State strives to complete the Electronic Q&A process in a timely manner. Bid Amendments are still viewable on the “Summary” page of the Bid Solicitation in NJSTART for bidders not on the bid holder list, The Quote opening date will be extended by Bid Amendment in the event that responses to the Q&A cannot be provided with sufficient time to prepare a Quote prior to the advertised Quote opening date.

Please see “T1414- Revised Price Sheet- 12.21.2022” in the Attachments Tab for 22DPP00696 in NJSTART.
18
Price Sheet
Q: Will the State please provide estimated volumes by line item of the Price Sheet? Alternatively, will the State please provide actual volumes by line item for the last 12 months?
A: The numbers change based on the amount of births and paternities established, but the program currently averages about 27,000 COPs/AODs per year, 88,000 birth records per year, and 27,000 hospital COPs for incentive payments per year.
19
SSTC Section 5.7
Q: Will the State please consider providing Vendor with a 30 day cure period, or such other time of greater or lesser length as the parties may agree to in writing, prior to any termination for cause? Vendor respectfully requests that in accordance with industry standards, common business practice, and the principles of equity and fairness, Vendor be granted the opportunity to correct any alleged default prior to termination with a reasonable time to do so.
A: State Standard Term and Condition Section 5.7 has been revised to change the ten (10) day cure period to a thirty (30) day cure period.
Refer to Bid Solicitation Section 5.12, Modifications and Changes to the State of NJ Standard Terms And Conditions (SSTC), in “T1414 – Revised RFP – 12.21.2022” in the Attachments Tab for 22DPP00696 in NJSTART.
20
SSTC Section 5.7
Q: In the event that the State terminates the contract in part or materially de-scopes the project, will the State please consider negotiating an equitable adjustment of pricing? Because Vendor’s pricing is offered on the assumption that Vendor will be providing the full range of services requested in this RFP, Vendor respectfully requests that, in the event of any termination in part, the State be willing to negotiate equitable pricing appropriate to the restructured deal.
A: The State declines to accept the proposed modification. Pursuant to SSTC Section 5.4, State’s Option to Reduce Scope of Work, the parties have the ability to negotiate an adjusted contract price when the section has been invoked to reduce the scope of work under a contract.
21
SSTC Section 6.1
Q: Would the State please consider clarifying that the price reduction in the referenced section only applies to similarly situated customers during the contract period and that when determining whether a customer is similarly situated, the parties will consider: (i) the geographic location of the accounts; (ii) industry differences affecting information technology costs; (iii) workload and complexity factors (including operating environment); (iv) the service level requirements offered; (v) the duration and nature of the contractual commitment; (vi) the volume of services being provided; (vii) contractual terms, conditions and allocation of risk; (viii) the amount of investment made by the Vendor in equipment and personnel to support the provision of the services; (ix) the appropriate overhead; and (x) other unique factors of each deal?
A: Price reductions should be analyzed relative to the State’s contract. If the Vendor’s applicable price for goods or services to the State would be reduced, then the State must be informed of the change.
22
SSTC Section 6.5
Q: Are contracts considered which require payment within 30 days (instead of the 60 days mentioned in the SSTC document)?
A: The State does not accept the proposed modification. Pursuant to SSTC Section 6.5, the New Jersey Prompt Payment Act, N.J.S.A. 52:32-32 et seq., requires state agencies to pay for goods and services within 60 days of the agency's receipt of a properly executed State Payment Voucher or within 60 days of receipt and acceptance of goods and services, whichever is later. | 25 |
Section 1.2
Q: Are there any elements of the current service that require improvement in the new contract?
A: The contract requirements for the existing contract should not be considered when reviewing this Bid Solicitation. Each contract may have unique requirements, and incorporating requirements not included in this Bid Solicitation may render a bidder’s Quote non-responsive and ineligible for award. Please refer to Section 4.0 of this Bid Solicitation for the project requirements.
26
Section 1.3
Q: Will the State consider providing an estimated contract amount for this contract by year?
