A Federal Occupational Health (FOH) Contractor Representative Lisa Swain, MPH, CSP performed a limited walk-through Annual Asbestos Visual Surveillance Check as required by the General Services Administration (GSA) for their owned facilities. Bulk or air samples were not collected. In addition, compliance with GSA contract safety and health requirements, listed on the attached checklist, was determined for Operations and Maintenance (O&M) and Custodial contractors. Per GSA instructions only spaces listed on Table A were visually checked. During the surveillance check, observations of any potential damage to the asbestos-containing materials (ACM) was noted and recorded. Had any imminently dangerous conditions been observed they would have been immediately reported to the FOH Representative, GSA Customer Service Center Manager, and GSA Safety and Environmental Management Branch Representative in accordance with GSA established procedure.
GSA Form 3614, GSA Notice of Unsafe/Unhealthful Workplace Conditions was completed for any potential deficiencies and provided to the GSA Building Manager.
One GSA Form 3614 may list multiple violations. An opportunity to correct violations, if any, would be given to the GSA employee or representative during the inspection.
Those violations corrected are noted in the text of the report.
The FOH Contractor Representative used the GSA ACM Checklist – FY 2018 approved by GSA for consistency purposes and to ensure the required information was obtained at this facility. The checklist and 3614 forms, if any, are attached to this report as supporting documentation.
This report is based on personal observations during the surveillance check and from conversations with onsite personnel. Not all possible hazards and conditions may have been identified during this brief inspection, because not all spaces were inspected (per GSA), conditions are hidden or inaccessible and changes in equipment, regulations, operations and personnel may not be known at the time of the inspection.
The report contains the following GSA required sections: Building Descriptions, General Findings, Comments and Concerns, Action Items, Checklist/Form 3614, Form 3559, Corrected Items and Other.
Note: The FOH Contractor Representative designated in this project is an employee of H,S&E Resources, Inc. which has performed the services indicated in this report.
Nothing in this report is intended nor should be interpreted as establishing any form of employment or contractor relationship between the FOH Contractor Representative and General Services Administration, Federal Occupational Health, U. S. Public Health Service, or any division, agency, or contractor thereof.
Reports and other publications issued by the Environmental Health Services program of the Federal Occupational Health (FOH) were prepared under procedures established by FOH, which were designed to assure the technical competency of the persons or organizations under contract to FOH. In addition, reports and other publications were reviewed internally by one or more FOH technical staff, and all comments were addressed to the satisfaction of the issuing office, prior to dissemination.
I. BUILDING DESCRIPTION
The Paul G. Rogers Federal Building and Courthouse, GSA Building Number FL0066AC, is located at 701 Clematis Street, West Palm Beach, Florida. The facility was constructed in 1972 and covers 104,499 square feet of area. There are four floors above ground. The building is constructed of steel beams and concrete flooring with a composition/built-up roof. The roof was replaced in 2001.
Cooling towers were replaced in 2016.
The building is heated and cooled by circulating heating and chilled water systems.
These systems are supplied heating water from two (2) boilers and chilled water from two (2) chiller units all located on the 1st floor. The cooling towers located on the roof were replaced in 2016. Air Handling Units (AHU’s) located throughout the building utilize the heating and chilled water to condition the air which is then distributed throughout the building via a ductwork system. Domestic hot water has a two pipe supply and return loop recirculation system. Domestic cold water is a one pipe system. A major asbestos renovation occurred in 1992 in which all ACM sprayed on ceiling material and ACM pipe insulation was purportedly removed. Sections of the 2nd, 3rd and 4th floors were renovated in 2005.
II. GENERAL FINDINGS
An annual visual surveillance check of the Paul Rodgers FB/CT was conducted by a FOH Contractor Representative, Lisa Swain, MPH, CSP, on September 25, 2018. Chris Singian the GSA Building Manager accompanied the inspector during this survey. Mr. Greg Chatham representing Tigua Enterprises, Inc. the O&M contractor, assisted in the survey. The custodial contractor is Goodwill Enterprises represented by Mr. German Serpas. This is a contractor-operated facility.
The overall building Risk Assessment Code (RAC) is 3. Significant deficient findings (RAC 1 or 2) were not identified during this surveillance. Nine (9) citations were issued during this visual surveillance of which five (5) are repeat deficiencies. Corrective measures were not taken during this surveillance.
Damaged ACM was observed in the following locations:
The PACM floor tile in Room 117 is in poor condition. Stucco and caulk on exterior panels and roof is damaged.
Otherwise, the remaining ACM observed during this building re-surveillance was in good condition.
Inaccessible spaces – The following spaces were not accessible during the visual surveillance: Rooms 436, 440 and tenant spaces as noted above.
New suspect ACM was not identified during this survey. Suspect materials must be treated as asbestos until sampled and analyzed. Suspect materials are noted in in blue font in the attached table.
The most recent Annual ACM Visual Surveillance Spreadsheet was used for visual inspection purposes. Any additional information obtained by the FOH Contractor Representative during this surveillance check was added to the table.
The FOH Contractor Representative did not conduct any asbestos sampling.
The FOH Contractor Representative noted if ACM was removed since the last surveillance.
Additional information obtained by the FOH Contractor Representative during this surveillance check was added to the table. The FOH Contractor Representative did not conduct any asbestos sampling or measure ACM quantities other than note if ACM was removed since the last surveillance. The FOH Contractor Representative may note suspect materials that were not previously identified or tested and list them in the spreadsheet (Table A) as suspect materials with recommendations for testing. Findings are located in the attached table.
Any changes to the quantity and condition of ACM in the facility should be incorporated into GSA’s Operations and Maintenance (O&M) Plan.
All subsequent sampling, inspection results and any new information must be incorporated into the attached table to render it as accurate and usable as possible for future surveillances.
Photographs were taken of the building where possible and are included in the table.
Three attachments are associated with this report: 1) An Annual ACM Visual Surveillance Table, 2) GSA Checklist/Form 3614, and 3) GSA Violations Form 3559.
III. COMMENTS AND CONCERNS
The PACM floor tile in Room 117 is in poor condition.
As noted in previous surveys, the asbestos-containing mortar on the exterior of the building is showing signs of damage. The asbestos-containing mortar with imbedded rocks is attached to fiberglass panels. Rocks have fallen from the asbestos-containing mortar and were observed lying on the ground and excess debris was observed on the 2nd floor walkway. The asbestos-containing mortar, where the rocks were previously imbedded, visually looked solid. In addition, damage was observed on the columns where the caulking pulling away from the fiberglass/asbestos-containing mortar panels. Moderate damage was seen at the base of most column panels.
Asbestos-containing caulking on inside of the roof-mounted asbestos-containing mortar fiberglass panels is coming loose in a few places. In addition the other side of the fiberglass panel containing the asbestos-containing mortar/rock had minor damage in a few places where the asbestos-containing mortar/rocks had delaminated.
Minor to moderate deterioration was observed on window glazing in selected areas. Note: all windows were not inspected during the survey.
GSA Building Manger had not distributed the annual asbestos letter stating the current status, condition and location of ACM in the building to the tenants, O&M and custodial contractors.
The custodial contractor is not utilizing a low speed buffer and non-abrasive pads on VAT.
The custodial staff had completed their initial 2-hour asbestos awareness training and the required annual refresher training. They stated that they do not strip any VAT floors.
The GSA Building Manager did not have current online asbestos refresher training as per GSA policy.
GSA’s contract has the following nine asbestos O&M requirements: 1) at least one O&M asbestos trained worker/supervisory person onsite; 2) annual fit tests;
3) annual medical exams; 4) the EPA asbestos O&M document; 5) NIBS O&M books (either available onsite or access to 6) Asbestos repair equipment onsite;
7) written respirator program; 8) written medical surveillance plan; 9) written protective equipment plan. The O&M met all of these requirements.
The GSA Building Manager, Mr. Chris Singian maintains building records for this facility. However, they are not maintained in the building and do not include abatement documentation.
The O&M contractor had current refresher asbestos training.
Not all the suspected TSI could be inspected because it is above ceilings, in wall cavities or underneath newer floor tile or carpeting.
A contractor notification and sign-in sheet regarding the presence of ACM within the building was available and implemented by the O&M contractor. However, the types and locations of the ACM is not specified.
Changes in the quantity of ACM made during renovation, demolition or general O&M work had not been recorded in the O&M plan and noted in the ACM records. All changes to the quantity, condition, friability, etc. must be recorded immediately in the O&M plan. Each building should have its own records, O&M plan on site and be continuously updated by site personnel. Each facility upon receiving this updated ACM Surveillance Table should check it for accuracy and use it to record all changes in ACM amount, location, condition, etc. This table will be requested during all future checks and audits.
IV. ACTION ITEMS
The PACM floor tile in Room 117 must be immediately sampled or treated as VAT and abated.
Repair damaged ACM (mortar and caulk) on the columns and roof mounted walls, including the asbestos-containing mortar and caulking. Properly remove loose material found around damaged areas. Investigate as to whether asbestos fibers were delaminating from the outside walls and columns. Test the soil around the fallen rocks for asbestos fibers.
Seal/abate window glazing. Inspect all windows to identified damaged glazing.
Custodial personnel must use HEPA vacuums and wet methods to clean potential debris.
Distribute annual notification letter to tenants and O&M/custodial contractors regarding status, condition, presence and location of ACM in the building.
Building Managers should participate in the GSA online university asbestos awareness training. Maintain a copy of the training records in building asbestos file.
Require Custodial contractor to annually provide asbestos awareness refresher training and document.
Require O&M contractor to meet asbestos contract requirements. These include providing: medical surveillance to determine ability to wear a respirator, written medical surveillance program, written respiratory protection program, written personal protective equipment program, respirator fit-testing annually, and respirator protection training.
Maintain current records on all abatement, O&M repairs or periodic surveillance activities involving ACM. Maintain documents within the facility.
Require ACM sampling PRIOR to renovation or demolition. Maintain records in the asbestos file to be used for future inspection and surveillances.
Require outside contractors sign and date a form regarding notification of the presence, type and location of ACM before allowing any contractor to commence work within the building. This document demonstrates communication between the contractor and GSA regarding ACM and procedures for working around ACM. GSA should ensure that agencies hiring contractors also provide notification.
Continue maintaining the remaining ACM in good condition.
Conduct annual asbestos visual surveillance inspections at this facility. When conducting the next annual visual surveillance survey, please provide the inspector a copy of this report and request they verify location and condition.
Request the inspector to note any additional suspect ACM. Note and rectify discrepancies between the reports. All changes to condition, location, etc., should be made on the associated standardized spreadsheet.
Upon receiving this updated ACM Surveillance Table A, the GSA Building Manager and Maintenance Inspector should check it for accuracy and use it to record all changes in ACM amount, location, and condition as the renovation continues. It is suggested that this attached spreadsheet, which incorporates older and newer data, be used along with building floor plans to maintain an up-to-date record of asbestos locations and conditions. This table will be requested during all future inspections and audited.
Previous analyses of floor tiles with negative results are suspect if analyzed by PLM. TEM is the current method of choice because it can see the coated asbestos fibers that PLM cannot. Also, new floor tile and mastic may contain asbestos depending on overseas manufacture location. Therefore, floor tiles that were negative for asbestos and newer floor tile should be re-sampled and analyzed by TEM before renovating any area containing floor tile.
New materials installed during renovation such as, mastic, ceiling tile, drywall mud, etc. are considered as PACM unless a letter is obtained from the construction contractor (PE) and/or architect stating, “No asbestos products were installed during this renovation”. If this documentation is not available new materials must be sampled and analyzed for asbestos prior to future renovation, remodeling, and demolition in those areas. Obtain similar documentation for all future renovations, remodeling or demolitions. The documentation should be made a permanent fixture in the building asbestos file.
Each facility upon receiving this updated ACM Surveillance Table should check it for accuracy and use it to record all changes in ACM amount, location, condition, etc. This table will be requested during all future inspections and audited.
All building materials affected by renovations and/or demolition, not previously sampled and analyzed in that specific space, must be sampled and analyzed prior to work commencing or assumed to contain asbestos.
V. 3614’s
1. REPEAT - Moderate damage to Stucco (asbestos-containing mortar) on the outside of the building on columns and on the roof panels. Repair/Maintain stucco following GSA O&M Plan and all Federal, State and Local Regulations.
2. REPEAT - Minor damage to asbestos-containing caulking on the outside of the building on the roof panels. Repair/Maintain caulking following GSA O&M Plan and all Federal, State and Local Regulations.
3. Minor to moderate deterioration was observed on window glazing in selected areas. Note: all windows were not inspected during the survey. Seal/abate window glazing. Inspect all windows to identified damaged glazing. Custodial personnel must use HEPA vacuums and wet methods to clean potential debris.
4. REPEAT - PACM floor tile is in poor condition in Room 117. Seal floor tile in Room 106 with wax coating. The floor tile in Room 117 must be immediately sampled or treated as VAT and abated.
5. Custodians are using high speed equipment to strip VAT flooring. Equipment used to strip VAT must be less than 300 rpm, use low abrasive pads and use wet stripping methods.
6. REPEAT - Tenants, O&M and custodial contractors were not notified annually of presence, location and condition of asbestos within their building. Notify tenants, O&M and custodial contractors, other contractors in writing annually of presence, location and condition of ACM.
7. ACM records were not maintained in the building as required by law. Update and maintain a copy of all ACM records. This enables the building mechanic to make other contractors aware of ACM locations before they commence work.
8. Asbestos documentation on site was missing and/or incomplete. Maintain all asbestos repairs, abatement, sampling and inspection documents on site for review.
9. REPEAT - GSA Building Managers did not participated in the GSA online Asbestos Awareness Training. Ensure Building Managers and Specialists participate in the asbestos refresher class annually.
VI. CORRECTED CITATIONS
The following items were corrected during the day of the surveillance check or shortly thereafter and confirmed by the GSA Building Manager: None
VII. OTHER
Each facility upon receiving this updated ACM Surveillance Table A should review it for accuracy and use it to record all changes in ACM amount, location, condition, etc. This table will be requested during all future surveillance checks and audited.
When conducting the next annual visual ACM surveillance, please give the GSA inspector a copy of this report and have them verify all locations. Request the GSA inspector to note any additional suspect ACM. When using the previous Contract Inspector, request them to use this report and to verify discrepancies between the reports. Require previous contractor to modify their surveillance report to include the attached table. All changes to condition, location, etc., should be made on this standardized spreadsheet.
The Surveillance Table is to be updated continuously. The table contains three color-highlighted areas that indicate changes in the amount, location or condition of ACM. Red indicates changes in the amount or condition of ACM. Blue denotes “suspect asbestos,” as noted by the inspector, that should be sampled and analyzed before any renovation or demolition occurs. Green indicates that suspect asbestos was determined not to be ACM or that ACM was removed.
Column 3 indicates the remaining ACM as of the last annual visual ACM surveillance check. In the “Condition” column, good implies no or very minor damage (i.e., less than 1 percent), fair implies between 1 and 10 percent overall damage and poor means damage greater than 10 percent overall or 25 percent localized.
Table A - Annual ACM Visual Surveillance Table
Note: This table is in color. Information will be lost if reproduced in black and white! This table is for O&M purposes only. A renovation requires additional evaluation and sampling prior to commencement of work.
