Memorandum for Record
Subject: Guidance for Generation and Disposal of Special Waste on Kirtland Air Force Base (Asbestos)
This memorandum is to provide guidance to all contractors and vendors performing work on Kirtland Air Force Base (KAFB) for the movement and disposal of Special Waste material generated by the work being performed. This includes Asbestos Containing Material (ACM), The Albuquerque Environmental Health Department (AEHD) regulation 20.11.20.22 New Mexico Administrative Code (NMAC) and the federal standards incorporated into
20.11.64 NMAC, Emission Standards for Hazardous Air Pollutants for Stationary Sources, require that AEHD be notified of any abatement operations prior to any work commencing. It is the responsibility of the contractor/vendor to notify the AEHD in accordance with their requirements. Failure to provide proper asbestos notification shall be a violation of the requirements of 20.11.64 NMAC. Knowingly violating provisions of 20.11.64 NMAC is a fourth-degree felony pursuant to the New Mexico Air Quality Control Act, 74-2-14.C.3 NMSA 1978. In addition, all NMED regulations and US Department of Transportation regulations will be adhered to during the abatement process, packaging, transport, and disposal of all waste.
Whenever special waste material is generated during execution of a contract on KAFB for abatement or remediation of asbestos containing material, the generator of the material is KAFB. No material can be transported off KAFB without a valid manifest signed by the designated/appropriate representative of KAFB Civil Engineering.
Currently this is the Environmental Specialist/Asbestos Operations Officer for the KAFB Base Maintenance Contract, (phone number 505.300-6582/505.846-2102) email address sumner.wells.ctr@us.af.mil). Once the manifest is signed and the material is approved for transport, in accordance with the State of New Mexico Solid Waste Regulation (20.9.8.19.E NMAC) the transporter will, after disposal is completed, return the original manifest to the generator (KAFB) within 30 days of the waste reaching the disposal site.
In addition, all abatement and disposal documentation will be provided to the Asbestos Operations Officer via email, sumner.wells.ctr@us.af.mil.
Under no circumstances should any asbestos waste be transported off of KAFB without prior approval and a signed manifest from the Asbestos Operations Officer.
Failure to comply with this requirement may result in a Notice of Violation (NOV) with financial penalties from the AEHD or NMED. If negligent, the NOV and financial penalties will be assessed to the abatement contractor.
