About this file
This document is a Service Contract Labor Standards (SCLS) Certification form. It provides instructions and certifications for offerors to indicate whether the services to be provided under a federal contract are exempt from the Service Contract Labor Standards (formerly known as the Service Contract Act).
The certification addresses specific requirements for establishing an exemption, such as the equipment being serviced being sold regularly to the general public, the services being provided at established catalog or market prices, and the compensation plan for service employees being the same as for commercial customers. Depending on the offeror's certification, different SCLS clauses may or may not apply in the resultant contract. The Laboratory Procurement Official will make the final determination on the applicability of the SCLS statute based on the offeror's certification.

SERVICE CONTRACT LABOR STANDARDS (FORMERLY
SERVICE CONTRACT ACT) CERTIFICATION
If O eror is seeking an exemption from Service Contract Labor Standards, check the box for the applicable exemption below and certify to it at the end of this form.
Exemption Under FAR 52.222-48: Exemption from Application of the Service Contract Labor Standards to Contracts for Maintenance, Calibration, or Repair of Certain Equipment- Certification
(a) The o eror shall check the following certification:
Certification

(i) An "established catalog price" is a price included in a catalog, price list, schedule, or other form that is regularly maintained by the manufacturer or the o eror, is either published or otherwise available for inspection by customers, and states prices at which sales currently, or were last, made to a significant number of buyers constituting the general public.
(ii) An "established market price" is a current price, established in the usual course of trade between buyers and sellers free to bargain, which can be substantiated from sources independent of the manufacturer or o eror; and

(1) Will not apply to this o eror, then the Service Contract Labor Standards clause in this solicitation will not apply in any resultant contract to this o eror; or
(2) Will apply to this o eror, then the clause at 52.222-51, Exemption from Application of the Service Contract Labor Standards to Contracts for Maintenance, Calibration, or Repair of Certain Equipment-Requirements, in this solicitation will not apply in any resultant contract awarded to this o eror, and the o eror may be provided an opportunity to submit a new o er on that basis.

and
(2) The o eror shall notify the Laboratory Procurement O icial as soon as possible, if the Laboratory Procurement O icial did not attach a Service Contract Labor Standards wage determination to the solicitation.
(d) The Laboratory Procurement O icial may not make an award to the o eror, if the o eror fails to execute the certification in paragraph (a) of this provision or to contact the Laboratory Procurement O icial as required in paragraph (c) of this provision.
